SO THIS IS THE MIDDLE HIGH REGIONAL PLANNING COMMISSION SIGNATURE ENVIRONMENTAL CONFERENCE. THEY HAVE LOTS OF DAY SESSION. THERE'S USUALLY KEYNOTE ON LUNCH SPEAKER AND SEVERAL SESSIONS IN BETWEEN FROM LOCAL GOVERNMENT FROM THE PRIVATE SECTOR. IT'S A GOOD EDUCATIONAL OPPORTUNITY. SO WE'D BE HAPPY TO COVER THAT REGISTRATION. IF YOU GUYS ARE INTERESTED IN GOING JUST MAYBE.

SO WE HAVE A COUPLE UPDATE ITEMS, THE FIRST ONE BEING SO LAST MONTH WE TALKED ABOUT THIS WEEK. OH GRANT AND A REACHED OUT AND TALK TO SWEET CO. ABOUT A COUPLE OF THE IDEAS THAT WE HAD COME UP WITH. THE TWO BEING THE WATER BOTTLE FILLING WITH QR CODE MODELED ON PREVIOUS GRANT THIS WEEK. OH UM , HAD FUNDED AND THEN WE ALSO TALK TO THEM ABOUT THIS KIND OF PERMANENT E WASTE DROP OFF IDEA THAT CATHERINE HAD UH, WE DIDN'T NOT GREAT SUCCESS ON BOTH OF THOSE TOPICS WITH WACO THIS YEAR . THEY'RE REALLY NOT LOOKING TO FUND UM. THEY WEREN'T TOO EXCITED ABOUT FUNDING ANOTHER WATER BOTTLE FILLING GRANT. UH THEY SAID THAT THAT IT'S HARD FOR THEM TO HAVE UM, EVEN THOUGH WITH THE Q R CODE, DO YOU THINK THAT'S A LITTLE MORE DATA DRIVEN THAN JUST PAIN TO PUT THE FILLING STATIONS IN, THEY SAID.

IT'S REALLY HARD TO QUANTIFY. IS SOMEONE REALLY DOING USING THAT INSTEAD OF USING A PLASTIC

SO INSTEAD OF. SUBMITTING A NEW GRANT APPLICATION, BUT WE'VE DECIDED IS WE'RE JUST GOING TO DOUBLE BACK AND FOCUS ON IMPLEMENTATION OF THE GRANT THAT THE SERVICE DEPARTMENT GOT LAST YEAR, WHICH WAS TO INCREASE RECYCLING OPPORTUNITIES WITHIN CITY FACILITIES. AND WORK WITH THE SERVICE DEPARTMENT TO JUST CLOSE THAT OUT AND IMPLEMENT IT , AND THEN MAYBE WE COULD REGROUP AND HAVE MORE TIME TO THINK ABOUT NEXT YEAR'S OPPORTUNITIES. SO WE'LL KEEP YOU UPDATED ON HOW THAT'S GOING. I FORGET IT'S THE DOES THE SCOPE OF THAT INCLUDE ADDING PUBLIC RECEPTACLES OR THAT IS JUST IN THIS ALL THIS. YEAH, REALLY. SO THAT HAS BEEN SIGNED BY THE GOVERNOR, AND IT GOES INTO EFFECT ON SEPTEMBER 13TH OF THIS YEAR. SO WE HAD THE CITY ATTORNEY REVIEW THE LEGISLATION. I DON'T KNOW IF ANY OF YOU HAVE LOOKED AT IT, BUT IT'S UM WE WANTED HIS FOR HIM TO LOOK AT IT WITH AN EYE ON THE IMPACT OF THE CITY INTO THIS BOARD. SO YOU KNOW, ESSENTIALLY, THE BILL CONTAINS SOME DEFINED TERMS. IT DEFINES A SOLAR ENERGY COLLECTION TO DEVICE IS A SOLAR PANEL ESSENTIALLY. AND ALSO IT'S DEFINITIONS FOR CONDOMINIUM PROPERTIES. UM YOU KNOW A, WHICH IS A UNIT OWNERS ASSOCIATION. SO THAT'S ESSENTIALLY ASSOCIATION FOR A CONDOMINIUM DEVELOPMENT.

IT DEFINES A PLANNED COMMUNITY DEFINES A HOMEOWNERS ASSOCIATION OR A AND THEN THIS ONE IS TO FIND THE DECLARATION AND THAT IS THE INSTRUMENT THAT SUBJECTS ARE CERTAIN PROPERTY TO CONDOM ENDING IN LAW CONDOMINIUM LAW PLANNED COMMUNITY LAW. SO ESSENTIALLY, SOMETIMES YOU HEAR THOSE AS REFERRED TO AS LIKE CC AND RS OR RESTRICTIONS. BUT IN THE IN THE BILL, IT'S CALLED A DECLARATION. SO THIS APPLIES TO ALL OWNERS OF CONDOS AND THOSE WHO OWN HOMES WITHIN A PLANNED COMMUNITY. IT ALSO APPLIES TO THE OAS IN THE, UH SO IT DOESN'T NECESSARILY HAVE DIRECT APPLICATION TO LOCAL GOVERNMENTS. AH! GENERALLY H O S CAN STILL PROHIBIT SOLAR ENERGY COLLECTION DEVICES OR SOLAR PANELS. UM, BUT IF THE DECLARATION PERMITS SUCH INSTANT INSTALLATION, THEN THE BILL OFFERS SOME ADDITIONAL RIGHTS TO HOMEOWNERS. IN ORDER TO, UM, INSTALLED THOSE SOLAR PANELS. THE CITY OF ATTORNEY DID NOTE THAT THE BILL IS UNCLEAR IF THE DECLARATION IS SILENT ON SOLAR PANELS. SO I THINK THAT KIND OF WITH WHEN THINGS ARE UNCLEAR AND LEGISLATION THEY USUALLY SEND WORK THEIR WAY OUT THROUGH THE COURT PROCESS EVENTUALLY, AND THAT WILL PROBABLY BE DEFINED MORE DECIDED MORE. IN THAT DIRECTION. SO WHAT DO THESE CHANGES MADE TO NEW ALBANY RESIDENTS? UM IN TERMS OF IF YOU ARE IN A PLANNED COMMUNITY WITH THE DECLARATION. OWNERS MAY INSTALL SOLAR PANELS AS LONG AS FEW THINGS APPLY. SO IF THERE IS

NO EXPRESS PROHIBITION IN THE DECLARATION, SO THEY'RE NOT SPECIFICALLY PROHIBITED. AND IF THE INSTALLATION IS TO INCUR ON THE INDIVIDUAL OWNERS UNIT FOR IN THEIR SPECIFIC LOT. UM SO IN CONCLUSION, IT DOESN'T SEEM THAT THE NEW LAWS GIVE OWNERS UNFETTERED RIGHTS TENDS TO ALL SOLAR PANELS, BUT IT MERELY PROVIDES SOME REGULATIONS AND PROCEDURES FOR OWNERS TO KNOW WHEN THEY HAVE THE RIGHT TO INSTALL. SO I THINK WHAT THAT MEANS FOR THIS BOARD AND FOR THE CITY IS YOU KNOW HOW H O A S? IMPLEMENT OR WHAT THEY DO WITH THEIR DECLARATIONS. NOW THAT THIS LAW WILL BE IN EFFECT NEXT MONTH. UM IS ONE THING, BUT I THINK AS THE CITY WE NEED TO BE PREPARED TO REALLY UNDERSTAND AND HONE IN ON OUR PROCESS AND OUR REGULATIONS TO ALLOW SOLAR PANELS. UM, SO WHEN AND IF YOU KNOW, THERE ARE ADDITIONAL HOMEOWNERS THAT ARE ALLOWED TO BECAUSE OF THE WAY THAT WE'RE IN A POSITION THAT WE'RE READY TO HAVE A CLEAR EXPECTATION AND PROCESS FOR THOSE HOMEOWNERS. SO WE HAVE. WE ARE WORKING WITH OUR STANDING CONSULTANTS MK SK ON THIS BEST PRACTICES REPORT. THEY'RE LOOKING AT DIFFERENT LOCAL REGISTER REGULATIONS ON ABOUT SOLAR PANELS AROUND THE COUNTRY, AND WE PLAN TO BRING THAT REPORT TO YOU AND KIND OF WHAT THE BEST PRACTICES ARE IN THE REGION IN THE COUNTRY. AND THEN FROM THERE, WE'D LIKE TO GET YOUR THOUGHTS AND DISCUSSION ON WHAT THE CITY SHOULD DO. IN TERMS OF THAT THERE ARE CO CHANGES NEEDED OR, YOU KNOW. SHOULD WE ALLOW? SHOULD THEY BE UNFETTERED? SHOULD THEY? YOU KNOW WHAT ARE THE REASONABLE REGULATIONS THAT WE SHOULD PUT IN PLACE TO ALLOW THEM? UM, SO I AM HAPPY TO SHARE THIS MEMO WITH YOU. A AS FAR AS I UNDERSTAND IT, THE CITY OF NEW ALBANY RIGHT NOW. IS KIND OF UNFETTERED AS FAR AS SOLAR GOES. CORRECT YEAH. I MEAN, WE'RE KIND OF SILENT. WE PERMITTED THEM AS LIKE ACCESSORY STRUCTURES. DEPENDING ON THE LOCATION, SO IF YOU'RE IN THE VILLAGE CENTER, AND WE'VE HAD A COUPLE EXAMPLES OF HOMES IN THE VILLAGE CENTER THAT PUT SOLAR PANELS UP , SO THEY'VE BEEN REQUIRED TO GO THROUGH THE ARCHITECTURAL REVIEW BOARD, OF COURSE CERTIFICATE OF APPROPRIATENESS, SO IT KIND OF DEPENDS ON WHERE IN THE COMMUNITY OR LOCATED. SO IF MY DEED RESTRICTION SAYS I CAN'T PUT SOLAR PANELS ON MY ROOF UNLESS IT'S SOUTH, FACING NOT VISIBLE FROM THE STREET. SENATE BILL 61 REALLY DOESN'T IT DOESN'T DO ANYTHING SEEMS TO ME THAT IT. IT DOESN'T ALLOW DOESN'T MAKE THE ALLOW YOU TO PUT THEM WHEREVER YOU WANT. THE IT'S INTERESTING TO READ. AND WHAT AS A STAFF WE WOULD LIKE TO DO IS TO HAVE A BUDGET PROPOSAL FROM THIS BOARD THAT YOU ADORE IN TERMS OF WHAT YOU WOULD LIKE TO ACCOMPLISH IN 2023 BE ABLE TO PRESENT THAT CITY COUNCIL AND GET YOU KNOW WHATEVER PROJECTS OR PROGRAMS ARE INTERESTED IN FUNDED FOR NEXT YEAR, AND THEN THAT WILL HELP US KIND OF PUT TOGETHER AT WORK PROGRAM FOR THESE MEETINGS IN TERMS OF KNOWING THEY WERE. YOU KNOW, THIS IS WHAT WE'RE DOING IN THE FIRST QUARTER OF 2023 PLAN THAT OUT MAP THAT OUT FOR THE REST OF THE YEAR. SO AS A STAFF. WE JUST KIND OF, UM, SKETCHED OUT OR OUTLINED A FEW THINGS THAT WE THOUGHT YOU MIGHT WANT TO CONTINUE ON TO NEXT YEAR, AND THAT SHOULD BE PART OF THE BUDGET DISCUSSION. UM OBVIOUSLY THE COMPOSTING PROGRAM WE WOULD WANT TO CONTINUE THAT ABOUT $19,000 ANNUAL COST TO THE CITY. UM TO CONTINUE THAT IF WE WANTED TO EXPAND THAT GET NEW BENDS ARE ADDITIONAL BINS. UM YOU KNOW, WE COULD WE COULD INCREASE THAT BUDGET A LITTLE BIT. UM PARKING STRUCTURE BEHIND OUR THIS BUILDING HERE AND THE POLICE DEPARTMENT. UM WILL BE CREATING A VETERAN'S MEMORIAL AREA. AND, UM AT THE END OF THE DAY. WE'RE ALSO GOING TO BE SETTING UP AN AREA FOR REDEVELOPMENT PROPERTIES, THE OLD DUKE AND DUCHESS STATION AND THE OLD USED TO BE THAT THE POLICE THE POLICE STATION MANY YEARS AGO. UM SO THIS WHOLE BLOCK BASICALLY KIND OF GET GET IMPROVED, BUT I THINK ONE OF THE I THINK THE GREATEST PART OF THE PROJECT IS THAT WE'RE REALLY TAKING CUES FROM ROSE RUN ONE I THINK THAT WAS AN AMAZING PROJECT FOR US. BUT I THINK NOW THAT WE'RE KIND OF OWNING AND MAINTAINING IT WE'RE SEEING, LIKE, OKAY. WE PROBABLY COULD HAVE DONE THINGS A LITTLE DIFFERENTLY. SO WHAT WE'VE DONE THIS TIME IS WE HAVE A COMPANY THERE AND APPLIED ECOLOGICAL SERVICES GROUP AND BASICALLY THERE EVALUATING AT A VERY DATA DRIVEN, QUANTITATIVE, QUALITATIVE LEVEL, THE ACTUAL CONDITION OF THE STREAM AS IT IS TODAY. AND WE INTEND. TO IMPLEMENT VERY SPECIFIC, VERY TARGETED IMPROVEMENTS TO THE STREAM. THE STREAM IN ITS CURRENT CONDITION IS PRETTY UNHEALTHY. UM IT'S JUST NOT AN AGREED IT'S NOT IN A GREAT CONDITION, SO THE PROJECT IS ACTUALLY GOING TO REALIGN THE STREAM. IT'S GOING TO BE TO REESTABLISH SOME OF ITS FLOODPLAIN AREA THAT JUST OVER TIME HAS BEEN COMPLETELY AWAY FROM IT. UM AND THEN YOU KNOW, AS PART OF THE DESIGN THAT WILL BE INTRODUCING RIPPLES, AND, UH JUST JUST OTHER ELEMENTS WITHIN THE STREAM THAT HELPED INTRODUCE OXYGEN AND OTHER THINGS. UM SO WHAT? WE'RE DOING THAT FROM THE BEGINNING, SO THE GREAT THING IS THAT THE END OF THE DAY. I KNOW THAT I CAN SPEAK CONFIDENTLY THAT IT ROSE RUN TO ROSE AROUND ONE. WE HAVE A VERY, VERY HIGH QUALITY SCREAMED IN THAT AREA, AND IT'S FANTASTIC. BUT I REALLY CAN'T SAY MUCH MORE THAN THAT. SO WHAT'S GOING TO BE GREAT NOW AS ROSEN ONTO WE'RE GOING TO BE ABLE TO HAVE A REALLY QUALIFIED DATA TO COMPARE BEFORE AND AFTER AND CAN REALLY IN THOSE SHOW. THIS IS WHAT WE'VE DONE. THAT AREA, SO OBVIOUSLY ANYTHING THAT WE DO HERE IS GOING TO BE TO THE DIRECT BENEFIT OF EVERYTHING DOWNSTREAM WITH THAT, SO THAT'S A THAT'S A GREAT PROJECT. UM WE WILL BE HAVING MEMBERS OF THAT PROJECT TEAM. WE HAVE A VARIETY OF CONSULTANTS ON THAT TEAM. UH BUT THEY WILL BE COMING IN AND GIVING A PRESENTATION TO THIS BOARD SOMETIME BEFORE THE END OF THIS YEAR. BUT THAT PROJECT AGAIN IS, UM WE'RE NEARING A 30% PLAN. 30% PLAN IS BASICALLY WE TAKE IT. WE DEVELOP IT TO A PLACE WHERE WE HAVE AN UNDERSTANDING OF ALL OF THE CONSTRAINTS AND WE HAVE AN UNDERSTANDING OF WHAT THE COSTS ARE, AND THEN GENERALLY, THAT'S WHERE WE TAKE THINGS TO COUNSEL. SOMETHING WE SEEK THEIR INPUT, BUT THAT'S SOMETHING ONE WOULD FORWARD IN THE BUDGET FOR NEXT YEAR OR MONTH. SO AND THAT'S SOMETHING THAT WILL BE PRESENTED THIS PROJECT IN ITS ENTIRETY PRESENTED TO COUNCIL AT OUR CAPITAL RETREAT. THIS THIS, UM, SEPTEMBER. SO THAT THAT'S A GREAT PROJECT, YOU KNOW, AND

THEN WE KNOW WE'VE WE'VE ALL BEEN TO TAYLOR FARM. AND UH, SO THAT CONSTRUCTION IS ONGOING.

FOR THE INITIAL PHASE OF BOARDWALK IMPROVEMENTS AND LEADER TRAIL IMPROVEMENTS. WE JUST GOT KICKED OFF ON THESE TAYLOR FARMS. PHASE TWO I HAVE NO IDEA HOW MANY HOW MANY TAYLOR FARMS PHASES THEIR OWN SPEEDING BECAUSE I THINK IT'S ONE OF THOSE THINGS THAT WE CAN CONTINUE TO THIS KIND OF LATER ON AND LATER ON LATER ON. BUT WHAT WE WHAT WE KNOW IS THAT THE SCOPE OF THIS PROJECT IS GOING TO INFORM AND PUT US IN A PLACE WHERE WE WHERE WE HAVE. WE'VE MADE A DECISION ON WHAT IS THE WHAT IS THE MASTER PLAN FOR THE HOMESTEAD AREA? RIGHT NOW? WE'VE WE HAVEN'T REALLY CAME TO A FINAL CONCLUSION ON THAT YET AS FAR AS THE RESTORATION OF THE HOME SITE ITSELF, THE RESTORATION OF THE BARN YOU KNOW THE CHICKEN CUBE ALL THAT THAT WE SAW THERE. UM THE OTHER PART IS WE WILL INCLUDE THE RELOCATION OF THE COMMUNITY GARDEN. SO AS A PART OF THE IMPROVEMENTS FOR ROSE AROUND TO THAT WILL BE RELOCATED AND DESIGNED, UH, REALLY TAILOR MADE TO BE RIGHT OUT THERE AT TAYLOR FARM. THERE'S ALSO SOME TRAIL EXTENSIONS, SOME ADDITIONAL TRAIL EXTENSIONS THAT WE'RE GOING TO DO IT AS A PART OF PHASE TWO, BUT WE'RE ALSO GONNA BE EXPANDING ON A LOT OF WHAT PHASE ONE. HAS DONE BY IMPLEMENTING A LOT OF HABITAT. IMPROVEMENTS, AND THIS IS KIND OF THE BIRDING AND OTHER OTHER ELEMENTS TO REALLY PROVIDE THAT HABITAT TO, YOU KNOW, HAVE HAVE THAT HEAVY. SO, UM AGAIN. JUST KICK THAT OFF THAT AT THE SAME TIME, WE'RE ANTICIPATING HAVING THAT IN SOME PERFORM AGAIN TO PRESENT A COUNCIL AT THE COUNCIL RETREAT THIS YEAR FOR CONSIDERATION IN THE BUDGET NEXT YEAR, SO BUT AGAIN, OTHER GREAT GREAT PROJECTS, ALL OF WHICH I THINK HAS HAD VERY, VERY PRINCIPAL SUSTAINABILITY. PRIORITIES SO WE'RE DOING A LOT OF REALLY GOOD THINGS. WHAT ONE LAST THING, TOO, IS, UH, NOT TO BE OUTWEIGHED HERE BY TAYLOR FARMS PAGE TWO, BUT WE ARE GOING TO BE BUILDING SOMETHING. FOOTBALL COURTS BACK BEHIND THE WHAT IS THE MIRACLE FIELD AND THE ON THE SCHOOL CAMPUS K ONE BUILDINGS WHICH ARE BLOODS AREA HERE, THE SAME TOWNSHIP AQUATIC CENTER. UM AND IN CONJUNCTION WITH THAT, YOU KNOW, KIND OF AS I THINK, ENCOURAGED BY THIS GROUP WE'RE GOING TO BE, UH ADDING A VEGETATED BIOS. WELL, WE'RE GOING TO HAVE SOME TYPE OF SOME TYPE OF RAIN GARDEN ELEMENT THAT WE'RE GOING TO BUILD AND EXPAND, AND WE'RE GOING TO JUST KIND OF TAKE A SWING AT IT. AND I THINK, TRY TO INTRODUCED MAYBE SOME SUSTAINABLE PLANTINGS AND OTHER THINGS, BUT, YOU KNOW TO JUST SEE THE ORDER THE POSSIBILITY AND IT'S AT AN AREA.

I THINK THAT, UH PEOPLE WILL GET HAPPY HAVING ABILITY TO HAVE SOME INTERFACE WITH SO SMALL LITTLE PROJECT. WE'RE EXCITED. SEE HOW IT GOES. SO KIND OF FEEDBACK AGAIN. THAT'S ALL I HAVE. AND THEY WORK WITH LOCAL GOVERNMENTS AND ASK A LOT OF REALLY GOOD QUESTIONS ABOUT US. BUT THE CITY WANTS TO DO WITH OUR FUTURE WITH SOLAR AND UM THEY MAINTAIN A LOT OF ASSETS IN THE ENTIRE MIDWEST. SO THE FIRST STEP WE TOOK WAS THEY'RE GOING TO KIND OF AUDIT ALL OF THE CITY'S BUILDINGS. LOOK AT OUR ELECTRIC BILLS AND WHAT OPPORTUNITIES THEY HAVE. SO THAT PROCESS WE'RE GOING TO ONCE WE GET THE RESULTS. DON'T LET US KNOW THIS MAKES SENSE DOESN'T SEE WHAT OPPORTUNITIES CITY HAS SO THAT COULD BE AN OFFSHOOT.
