ALBANY, OHIO, 43054. GOOD EVENING. COUNCIL MEMBERS AND I TO MY YOUNGER BROTHER IS 30 YEAR POLICE VETERAN AND SO, UH I'VE BEEN A LOT OF TROUBLE WITH HIM IF I DIDN'T THINK THEM AND IT'S GOOD TO SEE THAT IT'S A TOUGH JOB THAT FOLKS ARE CONTINUING TO SIGN UP THE SURVEY. I KNOW WE'RE GRATEFUL SO UM, THANK YOU FOR HAVING ME BACK. MAYOR AND I DID SPEAK AT THE LAST COUNCIL MEETING IN DECEMBER ABOUT A GROUP OF PARENTS THAT I'M INVOLVED IN WHO ARE TROUBLED BY SOME OF THE POLICIES ENACTED BY OPENING SCHOOLS THAT WE BELIEVE PUTS THE MOST VULNERABLE STUDENTS TRANS TEENAGERS AT A GREATER RISK WHEN THEY HAVE BEEN IN THE PAST. AND JUST TO GIVE YOU SOME STATISTICS. MOST OF THAT CONCERN IS BECAUSE OF THE FOLLOWING 42% OF LGBTQ. TEENS CONTEMPLATES SUICIDE ONLY ABOUT ONE IN THREE LGBTQ DREAMS HAVE A HOME THAT AFFIRMS THEM. BUT WE KNOW THAT LGBTQ YOUTH HAVE ACCESS TO A SAFE SPACE TO SCHOOL HOBBY SPORT CLUB. THEY WILL REPORT LOWER ATTEMPTS AT SUICIDE. THEREFORE ALL OF THESE PARENTS AND I THINK MANY YEARS COMMITTED TO CREATING MAINTAINING SAFE SPACES FOR ALL YOUTH BECAUSE WE WANT THEM TO GROW UP TO BE VALUED MEMBERS OF OUR COMMUNITY. I BECAME INVOLVED WITH THIS GROUP. OF PARENTS. BECAUSE MY SON ZACH, MY OLDEST SON, ZACH, IS TRANS ZACH IS A WHIP SMART 17 YEAR OLD WHO'S AT OHIO STATE UNIVERSITY FULL TIME AS A HIGH SCHOOL SENIOR THROUGH THE COLLEGE CREDIT PLUS PROGRAM. LIKE MANY 17 YEAR OLD BOYS, HE SPENDS A LOT OF TIME PLAYING COMPUTER GAMES, AND HE THINKS MOST OF HIS DAD'S JOKES ARE PRETTY DUMB. TO BE HONEST, HE THINKS OLIVER EXACTLY ALSO THE FIRST TRANS PERSON I EVER MET. COUNCILMAN FELLOWS. YOU CAN IMAGINE MY DISAPPOINTMENT WHEN I WAS NOTIFIED AND SAW THAT JUST A FEW HOURS BEFORE I LAST SPOKE TO THIS COUNCIL. YOU HAD POSTED SOMETHING ON FACEBOOK PAGE. THERE'S DEEPLY HURTFUL TO TRANS FAMILIES. I CAN ALSO TELL YOU THAT WHEN WE SEE SOMETHING LIKE THAT PUBLICLY POSTED OUR INITIAL RESPONSE IS NOT ONLY TO WORRY ABOUT OUR CHILDREN BUT ALSO WORRY ABOUT WHAT KIND OF THINGS ARE YOU SAYING WHEN NO ONE'S LISTENING. YOU OWE THE SINCEREST [00:20:02] OF APOLOGIES TO MANY PEOPLE, AND I HOPE THAT YOU'VE STARTED TO REFLECT ON YOUR INCREDIBLY POOR JUDGMENT. TO BE SURE, THERE MAY BE MANY CALLS FOR YOUR RESIGNATION. AND THERE MAY BE MANY WHO BELIEVE THAT YOU HAVE NO BUSINESS HOLDING YOURSELF OUT AS A REPRESENTATIVE OF OUR COMMUNITY. BUT I'M NOT HERE TO ASK FOR YOUR RESIGNATION. I IMAGINE YOU KNOW AS MANY TRANSGENDER PEOPLE AS I DID WHEN MY SON CAME OUT. I'VE LEARNED A LOT OVER THE LAST TWO YEARS SUPPORTING MY SON. AND WHEN I SAY I'VE LEARNED A LOT I MEAN, I'VE LEARNED A LOT ABOUT MYSELF. AND HOW I CAN BE A BETTER FATHER. BROTHER HUSBAND AND COMMUNITY MEMBERS. I TRULY BELIEVE YOU SHOULD NEVER LET A CRISIS GO WASTED. AND DESPITE THE FACT THAT WE LIVE IN A CULTURE THAT LOVES TO CANCEL PEOPLE, I DON'T WANT TO CAST YOU OUT. I WANT TO INVITE YOU IN I CHALLENGE YOU TO USE YOUR CRISIS IS AN OPPORTUNITY TO LEARN AND TO UNDERSTAND. TRANS PEOPLE AREN'T SOME UNANIMOUS GROUP OR NOT SORRY, ANONYMOUS GROUP TO BE MADE FUN OF THEY'RE YOUR NEIGHBORS. THEY ARE YOUR NEIGHBORS, CHILDREN. THEY ARE YOUR CONSTITUENTS. HE DID A DEEPLY REGRETTABLE THING. BUT THAT DOESN'T HAVE TO DEFINE YOU. THIS IS THE FIRST BOOK I READ. AFTER ZACK CAME OUT TO ME AND HELP ME UNDERSTAND WHAT HE HAD BEEN THROUGH AND CONTINUES TO GO THROUGH. I'M GIVING THIS BOOK TO YOU ALL OF MY CONTACT INFORMATION. I INVITE YOU TO READ IT AND TO REACH OUT TO ME TO TALK ABOUT IT. I BELIEVE WHAT YOU CAN ULTIMATELY MAKE SOME GOOD COME OUT OF YOUR MISTAKE, AND THAT WILL BE A BETTER RESULT FOR YOU AND FOR THIS COMMUNITY. THANK YOU. JUST GIVE THE BOOK. THANK YOU. SURE APPRECIATE YOUR COMMENTS. I WOULD ALSO LIKE YOU TO KNOW THAT I HAVE A DAUGHTER THAT CONSIDERS HERSELF A PRONOUN IS OF THAT. AND THEN CLOSE TO THE GAY COMMUNITY A LOT OF MY LIFE. I HAD MY ROOMMATE IN COLLEGE. WE'RE ROOMING TOGETHER. CAME OUT AS GAY. WHY WE WERE ROOMING TOGETHER. I'VE HAD FRIENDS GAVE FRIENDS WORKED FOR A GAY GAY DOCTOR. WHILE I WAS IN COLLEGE. I HAVE NO ANIMOSITY TOWARDS ANYONE GAY OR TOWARDS ANYONE. TRANS AND I WANT TO READ A STATEMENT AND FIRST OFF ON ALSO STATE THAT I HAVE REGRETS TO THE CITY STAFF AND COUNCIL FOR THE ATTENTION THIS HAS BROUGHT TO THEM. BUT FIRST AND FOREMOST, THIS IS MY POST. IT'S NOT COUNCILS POST WHERE THE CITY'S POST IT'S MY POST. TODAY IN OUR SOCIETY IS DIVIDED ON MANY SOCIAL ISSUES, IMPORTANT ISSUES THAT DESERVE SPIRITED AND RESPECTFUL DEBATE. I RECOGNIZE FOR SOME THAT MY SHARING OF SATIRICAL MEME MAY NOT HAVE BEEN THE BEST WAY TO PARTICIPATE IN THIS DEBATE. BUT IT'S ALSO IMPORTANT TO RECOGNIZE THAT I DO NOT CHECK MY FIRST AMENDMENT RIGHTS AT THE DOOR. JUST BECAUSE I'M AN ELECTED OFFICIAL. AS ALWAYS, I WILL CONTINUE FROM TIME TO TIME. TO SHARE MY VIEWS OR VIEWS OF OTHERS ON ISSUES THAT IMPACT OUR SOCIETY AND COMMUNITY TO CONTRIBUTE TO A FREE AND OPEN PUBLIC. DEBATE. AS AN EXAMPLE. JUST PRIOR. TO MY SHARING OF THE MEME IN QUESTION. I SHARED A STORY ABOUT KATHERINE'S CATHERINE SWEITZER. MS SWEITZER WAS THE FIRST WOMAN TO RUN THE BOSTON MARATHON. WAS AN INSPIRATION FOR MANY AROUND THE WORLD AND HELP THE CHANGE WOMEN'S ATHLETICS FOREVER. JUST PRIOR TO THAT. I SHARED A STORY ABOUT MARY EDWARDS WALKER. AN AMERICAN FEMINIST SUFFRAGIST SUSPECTED SPY PRISONER OF WAR INSURGENTS AT THE TIME OF THE AMERICAN CIVIL WAR AND SOMETHING NOTABLE ABOUT MRS WALKER AT THE TIME. IN THIS POSTING THAT I SHARE. THE QUESTION WAS ASKED OF HER. WHY DO YOU WEAR MEN'S CLOTHES? AND HER QUESTION HER RESPONSE TO THAT? WAS THERE NOT MEN'S CLOTHES. THEY'RE MY CLOTHES. THE POINT IS THESE. TWO THESE ARE TWO GREAT STORIES ABOUT TWO COURAGEOUS AMERICANS THAT MADE A REMARKABLE AND LASTING IMPACT ON OUR SOCIETY. ON MANY ISSUES, WE MAY OFTEN AGREE AND SOMETIMES DISAGREE, AND THAT'S OKAY. THERE IS NO QUESTION IN MY MIND. THAT OUR DIVERSITY AS A SOCIETY MAKES US STRONGER, BUT. THAT'S THE OPEN ACCEPTANCE OF DIVERSITY OF THOUGHTS AND IDEAS THAT ALLOWS US TO GROW AND BECOME MORE UNDERSTANDING OF ONE ANOTHER. WITH THAT SAID, AND I WELCOME YOUR INVITATION VERY MUCH. FOR ANYONE WHO WOULD LIKE TO MEET WITH ME TO DISCUSS THIS ISSUE OR ANY RANGE OF ISSUES. I WILL BE MORE THAN HAPPY TO DO SO. WE WILL LIKELY FIND THAT WE HAVE MORE IN COMMON THAN NOT. AND COME AWAY MORE ACCEPTING FOR TAKING THE TIME TO LISTEN AND TO LEARN FROM ONE ANOTHER, AND [00:25:04] THAT'S MY STATEMENT. THANK YOU, MR FELLAS. ANY OTHER. MEMBER OF THE PUBLIC THAT WOULD LIKE TO SPEAK TO COUNSEL REGARDING MATTER THAT IS NOT ON TONIGHT'S AGENDA. ALL RIGHT, WE'LL END THE [7. BOARD/COMMISSION REPORTS] HEARING OF VISITORS THAT TAKES US THE BOARDING COMMISSION REPORTS. THE PLANNING COMMISSION. MR SHAW ON THE UPDATE, NO MEETING. PARKS AND TRAILS ADVISORY BOARD. NO MEANING AND MISTER DARK'S NOT HERE. I'M SURE WE DID NOT HAVE A MEETING AT ARCHITECTS REVIEW BOARD. BOARD OF ZONING APPEALS, NO MEANING SUSTAINABILITY ADVISORY BOARD. WE DID HAVE A MEETING. FEELS LIKE IT'S BEEN A MONTH AGO, BUT, UH WE HAD A VISIT FROM MR TOBY THUNBERG WITH ACTUALLY IN PACKAGING HE SHARED THAT THE PROGRESS AND THE VISION OF THE VERTEX. THE VERTEX RECYCLING FACILITY THAT IS NEARING COMPLETION AND COULD BE ONLINE AND IT'S EXTREMELY EXCITING TO HAVE THAT TYPE OF FACILITY LOCATED HERE IN THE CITY. THAT'S GONNA YOU KNOW, DRIVER RECYCLING AND, UH THERE AREN'T MANY AROUND AND WE'RE GOING TO ACTUALLY NEED TO TRYING TO SOURCE THEM. SOME RECYCLED MATERIAL BECAUSE I DON'T THINK WE CAN GET IT ALL LOCALLY. THAT'S WHAT THEIR DEMANDS GOING TO BE. UH BUT I THINK, UH, DOWN THE ROAD AND MAYBE MARCH OR SO IT'S GOING TO BE ACTUALLY, YOU KNOW, UP AND RUNNING AND PRETTY COOL. I'LL THAT COUNCIL NOW. I THINK THE SUSTAINABILITY BY THE REWARD'S GONNA DO A FIELD TRIP OUT THERE AND I'LL SHARE WITH COUNSELORS ACTUALLY BEING THE WAY THEY BUILT. A FACILITY IS TO BE INTERACTIVE AND TO OUR FRIENDLY THEY'VE GOT A CATWALK UP HIGH, SO YOU CAN KIND OF GO THROUGH THE FACILITY AND ACTUALLY SEE IT AS IT'S WORKING. SO UM, I THINK THE REALLY COOL EXPERIENCE TO SEE THAT RIGHT HERE IN OUR CITY SO UM AND I DON'T KNOW. I'VE MET TOBY IN THE PAST WHILE AGO BUT HE'S ABOUT HIS ENERGETIC AND PASSIONATE ABOUT WHAT? HE, UH ABOUT THIS PROJECT AND EVERYTHING THAT ACTUALLY, UM AND VERDICTS ARE GOING TOGETHER. SO UM, HE'S HIS DOOR IS ALWAYS OPEN. IF WE COUNSEL WOULD LIKE HIM TO COME IN AND THROW A LITTLE 10 MINUTE THING TOGETHER. AS IT COMES ALONG, HE'S MORE THAN WILLING TO SHARE THEIR STORY. AND IT'S A STORY THAT IT'S A REALLY GOOD STORY TO SHARE FOR THE CITY SO UM UNTIL WE KIND OF YOU KNOW, WAS THE MAJORITY OF THE MEETING. THEN, UH, SCOTT RAN THROUGH THE RESIDENT SURVEY WITH THE BOARD AND THEN WE JUST KIND OF DID AN UPDATE OF OUR CURRENT PLANS FOR ALL OF OUR PROGRAMS THAT WE GOT GOING THIS YEAR. SO GREAT. ANY QUESTIONS ON THAT NOTHING. IDEA IMPLEMENTATION PANEL MEETING WE DIDN'T HAVE A MEETING SINCE I LAST CEMETERY RESTORATION ADVISORY BOARD MEETING MEETING OF THE PUBLIC RECORDS COMMISSION AND CORRESPONDENCE OR COMMUNICATION RECEIVED FROM COUNCILS SINCE OUR LAST MEETING THAT ANYONE WOULD LIKE TO PROVIDE AN UPDATE ON. SECOND READING OF ORDINANCES IN PUBLIC [10. INTRODUCTION AND FIRST READING OF ORDINANCES] HEARING. WE HAVE NO NONSENSE TONIGHT'S AGENDA INTRODUCTION AND FIRST READING OF ORVIS IS ORDINANCE 01 2023 IN ORDER TO ACCEPT THE EXPEDITED TAPE, TYPE ONE ANNEXATION OF 61.26. PLUS OR MINUS ACRES FROM JERSEY TOWNSHIP , LICKING COUNTY TO THE CITY OF NORMAL. THANK YOU, MAYOR. SO THIS IS ONE OF A SERIES OF ANNEXATIONS THAT WE'VE FIRST BEGAN TO PREPARE FOR. ACTUALLY. AS EARLY AS THIS TIME LAST YEAR. THIS PARTICULAR. NO PROPERTY IS LOCATED ON THE WEST SIDE OF MINK. SOUTH OF JUG STREET. AH THE IT WAS FILED UNDER AN EXPEDITED TYPE ONE. THIS IS PART OF THE NX STATION AGREEMENT THAT WAS ORIGINALLY ENTERED INTO BY THE TOWNSHIP AND THE CITY BACK IN 2015. THE AREA ENCOMPASSES THE ACTUALLY EVERYTHING ITSELF AND JOG. WEST OF MAKE EAST OF HARRISON. SO IT'S PART OF A LARGER ANNEXATION AREA WHERE WE'VE WE'VE HAD MULTIPLE ANNEXATIONS IN THE PAST. WE ALSO HAVE ENTERED INTO THE ROAD MAINTENANCE AGREEMENTS THAT ARE REQUIRED BY LICKING COUNTY. THE COUNCIL ADOPTED THE. RESOLUTION AUTHORIZING ME TO ENTER INTO THAT ROAD MAINTENANCE AGREEMENT . UH, THAT WAS THE FIRST PIECE OF LEGISLATION IN JANUARY OF LAST YEAR. UH THE LANDOWNER HAS FILED THE ANNEXATION PETITION. THE 60 DAY WAITING PERIOD HAS BEEN MET. AND COUNCIL IS ABLE TO TAKE ACTION ON THIS, UM THIS LEGISLATION ON JANUARY 17TH. [00:30:03] RIGHT QUESTIONS REGARDING THE ORDINANCE. WE'LL SET THAT FOR A SECOND READING IN PUBLIC HEARING IN OUR MEETING ON JANUARY 17TH ORDINANCE 002 2023, NORTHERN'S TO ACCEPT THE EXPEDITING TYPE ONE ANNEXATION OF 6.15, PLUS OR MINUS ACRES FROM CHURCHES, TOWNSHIP LICKING COUNTY TO THE CITY OF NORTHERN JOB. THANK YOU AGAIN. THERE THIS WAS WE ENTERED INTO AN ANNEXATION AGREEMENT WITH I WAS AUTHORIZED TO DO THAT , UH, THE BEGINNING OF 2022. AGAIN THE LANDOWNER HAS FILED A PETITION WITH LICKING COUNTY COMMISSIONERS. THE 60 DAY REQUIREMENT HAS BEEN MET AND COUNCIL CAN TAKE ACTION ON THIS AGAIN IN JANUARY OF JANUARY 17TH OF THIS YEAR. THE QUESTIONS ON THE ORDINANCE. WE'LL SET THAT FOR A SECOND READING IN PUBLIC HEARING AT OUR MEETING ON JANUARY 17TH. ORDINANCE OO 3 2023 AN ORDINANCE TO ACCEPT THE EXPEDITED TYPE ONE ANNEXATION OF 13.87 PLUS OR MINUS ACRES FROM JERSEY TOWNSHIP LOOKING COUNTY TO THE CITY OF NORTH AGAIN EXPEDITED TYPE ONE AND. WE'VE MET ALL THE REQUIREMENTS FOR THE ANNEXATION AGREEMENT AND THE ROAD MAINTENANCE AGREEMENT AND THIS CAN LIKEWISE BE CONSIDERED BY COUNSEL ON JANUARY 17TH OF THIS YEAR. ANY QUESTIONS ON ORDINANCE 03. ALSO SAID THAT FOR A SECOND READING IN PUBLIC HEARING AT OUR MEETING ON JANUARY, 17TH COORDINATES OO 4 2023 ORDINANCE TO ACCEPT THE TYPE ONE ANNEXATION OF 312.86 PLUS OR MINUS FIGURES FROM JERSEY TOWNSHIP, LICKING COUNTY TO THE SIGNAL. UM. JOIN TO THINK OF ANYTHING NEW. I CAN ADD HERE MUCH SCRIPT, JOE. SO AWESOME AGAIN. THE 60 DAY WAITING PERIOD HAS BEEN MET. AGAIN THIS WAS AUTHORIZED. THE ANNEXATION AGREEMENT WAS AUTHORIZED BEGINNING OF LAST YEAR, AS WELL AS THE ROAD MAINTENANCE AGREEMENT, AND THIS COULD BE CONSIDERED FOR APPROVAL AND GENEROUS 17 20. ALL RIGHT. ANY QUESTIONS ON THE ORDER AND SO FORTH, AND WE'LL SET THAT FOR A SECOND READING OF PUBLIC HEARING OR MEETING ON JANUARY 17 ORDINANCE. 05 2023 AN ORDINANCE TO ACCEPT THE EXPERT CHAPLAIN. ANNEXATION OF 15.3 CLOSE TREMENDOUS TAKERS FROM GEORGIE TOWNSHIP, LICKING COUNTY TO THE SEAT ONCE AGAIN, 60 DAY WAITING PERIOD HAS BEEN MET. ALL OF THE NECESSARY AGREEMENTS HAVE BEEN ENTERED INTO BY THE TOWNSHIP IN THE COUNTY. RELATIVE TO THE ANNEXATION AGREEMENT IN THE ROAD MAINTENANCE AGREEMENT. AND THIS COULD BE CONSIDERED ON THE 17. ALRIGHT AND IF FOLKS FROM THE PUBLIC OR WATCHING AT HOME OR READ ABOUT THIS AFTERWARDS, I MEAN ALL OF THIS LAND THAT IS BEING ANNEXED OR PROPOSED FOR ANNEXATION UNDER THESE VARIOUS ORDINANCES ARE ALL WITHIN THE BOUNDARIES THAT WERE DISCLOSED BY THE CITY. UM, DURING THE INTEL ANNOUNCEMENT, SO IT'S NOT NEW GROUND. IT'S JUST GOING THROUGH THE PROCESS OF FINALLY HAVING THAT EXEMPTION COMPLETED. UM BUT WE'LL GO AHEAD AND SET THAT FOR A SECOND READING IN PUBLIC HEARING OR MEETING ON JANUARY 17TH. ORDINANCE 006 2023 NORDEN IS TO AMEND THE ZONING ORDINANCE THAT THIS EVENING WALK BY AMENDING THE ZONING MAPS OF REZONE 403 PLUS OR MINUS ACRES OF LAND, GENERALLY LOCATED SOUTH OF GREEN CHAPEL ROAD WEST OF MINK ROAD, EAST OF BEACH ROAD AND NORTH OF JUG STREET FROM AGRICULTURAL, A G TWO TECHNOLOGY MANUFACTURING DISTRICT, TMD. AS REQUESTED BY MB J. HOLDING, ELSIE CARE. KAREN UNDERHILL, ESQUIRE. MR MAYOR. THANK YOU, MA'AM. SO THIS IS A REZONING FOR FOUR OF THE FIVE ANNEXATIONS THAT COUNCIL JUST HEARD ON THE NORTH SIDE OF JUG STREETS WITH GREEN CHAPEL BEACHES OVER HERE. THIS IS MILLER AND CLOVER VALLEY AND, OF COURSE, MINK. UH SO AS REQUIRED BY CODE, ALL PROPERTIES BEING REZONED TO THE TMD OR CONTIGUOUS TO EXISTING TMD ZONE PROPERTIES SHOWN IN THE BLUE HERE. SO THIS TEAM D DISTRICT ALLOWS FOR A VARIETY OF USES FROM THE CITY'S LIMITED INDUSTRIAL DISTRICT AND ADDS USES, SUCH AS SOLAR PANELS, GAS STORAGE AND WATER TREATMENT FACILITIES. THE TMD ALSO ESTABLISHES MORE RESTRICTIVE SETBACKS, MOUNDING AND LANDSCAPING AND LANDSCAPING REQUIREMENTS BEEN NEARBY LG ZONING DISTRICTS. SO AS YOU MIGHT RECALL WHEN THE CITY DID, UM, THE STRATEGIC PLAN UPDATES IN THE FIRST TMD, UM, REZONING WAS IN PLACE. THE CITY DID TRAFFIC MODELING WITH OH, DOT SO ALL OF THE TRAFFIC MODELING RECOMMENDATIONS ARE ALREADY IN IRISH CITIES CAPITAL IMPROVEMENT PROJECTS SHOWN ON THIS MAP HERE THAT'S ON THE WEBSITE. SO ALL THE PRIMARY OR PHASE ONE AND PHASE TWO. IMPROVEMENTS ARE CURRENTLY EITHER PLANNED OR UNDERWAY. WHERE THIS REZONING IS [00:35:01] ADJACENT. SO THE TMD ALSO INCLUDES A LANDSCAPE DESIGN STANDARDS PLAN. THIS DESIGN STANDARDS PLAN INCLUDES THINGS SUCH AS STREET TREES, MOUNDING STORMWATER BASINS AND PARKING LOT SCREENING, AND THIS HELPED ENSURES THE CREATION OF A CONSISTENT STREETSCAPE THROUGHOUT THE BUSINESS PARK. SO JUST TO RECAP. THIS IS THE EXACT SAME TMD ZONING AS AS EXISTS IN THE BUSINESS PARK TODAY, AND THE TMD TAKES THE BEST STANDARDS FROM OTHER ZONING DISTRICTS AND ENHANCES THEM. THIS PROPOSAL MATCHES THE LAND USE RECOMMENDATIONS FOUND IN THE CITIES ENGAGED IN ALBANY STRATEGIC PLAN AND THE PLANET CITY PLANNING COMMISSION REVIEWED AND RECOMMENDED APPROVAL AT THEIR MEETING LAST MONTH. STAFF IS HAPPY TO ANSWER ANY QUESTIONS. AND I'LL JUST SAY JUST FOR THE RECORD JUST TO REITERATE WHAT YOU JUST SAID. I KNOW THE PLANNING COMMISSION THEY HAD TALKED ABOUT THE 403 ACRES THAT TECHNICALLY MEETING THAT 500 NEEDED, BUT AS STEVEN POINTED OUT, BECAUSE THE INDIVIDUAL PARCELS ARE ADJACENT TO PROPERTY, ALREADY ZONED TMD AT THEIR THEN QUALIFIES FOR IT. SO THAT WAS REALLY THE ONLY DISCUSSION PIECES THEY HAD ON THAT. REMEMBER CORRECTLY. YEP. ALRIGHT I KNOW WE'RE VERY METICULOUS WITH THOSE OWNING STANDARDS AND ACTUALLY A LOT. THERE ARE MANY FEATURES OF THAT TMD ZONING TEXTS THAT ARE MORE RESTRICTIVE FOR THE DEVELOPER THAN JUST OUR TRADITIONAL ZONING FOR THAT AREA. ABSOLUTELY. ANY QUESTIONS OR COMMENTS REGARDING ORDINANCE 06 SET THAT FOR A SECOND READING IN A PUBLIC HEARING OR MEETING ON JANUARY 17TH. ORDINANCE 08. THERE WE GO. SEVEN. ORDINANCE 7 2023 IN ORDINANCE TO AMEND CHAPTER 159 RULES OF PROCEDURE FOR BOARDS AND COMMISSIONS OF THE CITY OF NEW ALBANY OR HOUSE QUALIFIED LAWRENCE'S AS REQUESTED BY THE CITY OF NEW ORLEANS COUNCIL COUNCIL MEMBER DEREK HAD ASKED US TO DO A REVIEW, AND WE COULD STARTEDNE BAC OIN 201K 9 AND KIND OF ABANDONED IT. I GOT A LITTLE BUSY WITH COVID THERE, BUT CAME BACK AROUND AND I MET WITH BOTH DEVELOPMENT STAFF HAD BEEN SUPPORTING THE BOARDS AND COMMISSIONS AND THE MAJORITY OF THE CITY'S BOARDS, COMMISSIONS AS WELL AS LAW DIRECTOR AUBRAC, UM AND ALSO THE NEW DEPUTY CLERK. CHRISTINA DID A KIND OF A FRESH EYES AT THE RULES, AND WE HAVE SOME RECOMMENDATIONS IN ORDER TO UPDATE THEM TO MEET CURRENT PRACTICES. FOR STARTERS, NO THAT THE CHARTER REFERS TO THE GENERAL RULES OF BOARDING COMMISSION IN THE CHARTER. THAT'S ARTICLE 10 SECTION 10.1 B. AND IN PARAGRAPH SIX. IT SAYS THAT ANY BOARD THAT DOESN'T HAVE ITS OWN ESTABLISHED ROLES WILL FALL BACK ON THIS. THIS WILL BE THEIR RULES AS WELL. IT'S STANDARD IN OUR CITY CODE SECTION 1 59. AND TO ANSWER YOUR QUESTION. COUNCIL MEMBERS SHALL 1 59 IS JUST 1 59 IS THE RULES. THERE'S NOTHING IN ADDITION TO THAT. SO WE HAD SOME RECOMMENDATIONS, SOME OF WHICH JUST UPDATING THE LANGUAGE FROM VILLAGE TO CITY VILLAGE MINT ADMINISTRATOR TO CITY MANAGER THOSE SORTS OF THINGS WE'VE BEEN CALLING IT THE PUBLIC SERVICE COMPLEX, SO WE WENT AHEAD AND DID THAT. UM, THE PURPOSE WAS TO BROADEN ORGANIZATIONAL MEETINGS TO THE GROUP'S WEREN'T JUST HOLDING MEETINGS COMING IN ORGANIZING AND LEAVING. YOU KNOW, HAVE HALF A YEAR TO DO THAT, AND SO THAT YOU CAN HAVE SOME MATTERS ON THE AGENDA AS WELL. UM THERE WILL BE AN ANNUAL REVIEW OF THE ATTENDANCE POLICY AT THE ORGANIZATIONAL MEETING. UM HAVE SOME RECOMMENDATIONS ON THAT. BUT WE DID WANT TO AT LEAST COVER IT IN THE CODE. UM WE UPDATED A COUPLE THINGS TO MATCH COUNCIL RULES SPECIFICALLY WHERE THE MEETING SCHEDULES WERE BEING POSTED. AND ALSO WHEN COUNTING ABSENCES WERE COUNTING A MINUTE, 12 MONTH PERIOD. AND IF YOU WANTED TO REFRESHER ON THAT THE STANDARD RULES HAD THREE CONSECUTIVE ABSENCES ARE FOR A YEAR. AND SO WE'RE JUST SAYING THAT AMOUNT IN A 12 MONTH ROLLING PERIOD AGAIN JUST TO MATCH COUNCIL RULES. SO THAT'S THE BOARDING COMMISSIONS. THERE'S SOME AGENDA, FLEXIBILITY AND HOW AGENDAS ARE DISTRIBUTED BECAUSE SOME PEOPLE GET PAPER. SOME GET ELECTRONIC. WE'RE JUST SAYING THAT THEY WILL BE DISTRIBUTED. UM THERE WAS A REMOVAL OF A REFERENCE TO THE STRICT RULES OF PROCEDURE, WHICH IS IN AN OLD SET AND DIRECTOR ALBRECHT CAN EXPLAIN THAT FURTHER, MAYBE AND SOME FLEXIBILITY ON THE AGENDA FORMAT , SO THERE'S A SUGGESTED AGENDA. BUT IF YOU'RE NOT USING THE EXACT ONE, UM YOU'RE ALLOWED TO DEVIATE IS NEEDED. AND FINALLY, THERE WAS A REQUIREMENT THAT AN APPLICANT FOLLOW UP WITH A REQUEST TO TABLE SEVEN DAYS IN WRITING AFTER IT HAD BEEN GRANTED AND WE FORGET THAT WAS ALREADY IN THE RECORDS SO THEY DIDN'T NEED TO SEND A LETTER AND THAT'S WHAT WE FOUND. OKAY? ANY QUESTIONS OR COMMENTS REGARDING THE ORDINANCE. I JUST JUST HAD THE ONE WOULD. COULD YOU GO OVER JUST THAT LAST PIECE 1 59 05 REMOVING STRICT RULES OF EVIDENCE. UM, I THINK I HAVE A GOOD GRASP OF THAT. BUT I'D BE [00:40:01] INTERESTED JUST TO HEAR YOUR THOUGHTS ON THAT. YES SO RIGHT NOW, THE RULES SAY STRICT RULES OF EVIDENCE SHALL NOT APPLY, AND I'M YET TO SEE ANY RULES OF EVIDENCE APPLIES, SO WE THOUGHT THAT WE WOULD TAKE OUT REFERENCE TO THE RULES OF EVIDENCE ALTOGETHER AND JUST SAY THE PROCEDURES WILL BE ESTABLISHED. TO PROVIDE FOR A FAIR HEARING. SO THAT WAY EACH BOARD OR COMMISSION WOULD HAVE OPPORTUNITIES THAT THEIR OWN PROCEDURES AND NOT NECESSARILY EVER WORRY ABOUT THE RULES OF EVIDENCE. BUT MAKE SURE YOU GOT A FAIR SHAKE WHEN THEY'RE REPRESENTING THERE. THEIR CASE. OKAY ALRIGHT. WE KNOW IF WE HAVE THAT IN RIGHT, LIKE THEY'RE GOING TO BE REVIEW OF THE SEPARATE BOARDS AND COMMISSIONS ROLLS TO MAKE SURE THAT THAT WAS OUR WE'LL SPEAK TO THOSE ISSUES. I'M NOT SURE I DON'T THINK WE WERE PLANNING ON REVIEWING THE OTHER BOARDS AND COMMISSION RULES OF THERE ANY BUT I ASKED PLANNING MANAGER MAYOR WE CAN THINK OF WHO HAS SEPARATE ROLES THAT HAS THEIR OWN BYLAWS AND THE ROCKY FORD BLACK LOOK ACCORD. OF COURSE, SINCE IT'S A JOINT BOARD HAS THEIR OWN, BUT EVERYONE ELSE AT LEAST AS FAR AS THE DEVELOPMENT BOARDS AND THE BOARDS THAT I SIT ON, OR WALL WOULD FALL BACK ON THE STANDARD RULES. OKAY? SO LIKE, JUST THE ONLY THING I COULD THINK OF, AND I'M SURE YOU'VE THOUGHT ABOUT THIS, WE'LL SEE. IT'S JUST WHEN THERE'S RECORD, THERE'S EVIDENCE THAT'S PRESENTED AT THE HEARING . HOW DOES THAT BECOME PART OF THE RECORDS? AT LEAST A PLANNING COMMISSION, WHICH I CAN. I THINK ALL THE OTHER BOARDS ARE THE SAME. THERE'S A FORMAL MOTION TO ACCEPT ALL THE DOCUMENTS AND RECORDS SUBMITTED TO US, SO THERE IS A RECORD OF WHAT SUBMITTED TO IT IN WRITING. SO THERE IS A PROCEDURE IN PLACE TO MAKE SURE THAT WHATEVER IS PRESENTED FOR THEIR CONSIDERATION IS IN THE RECORD, SO THAT WITNESSES OBVIOUSLY EVERYONE GETS MORNING AT THE START. YEP AT THE START OF EVERY MEETING ANYBODY WHO IS GOING TO TESTIFY EVERYBODY'S STATEMENTS ASKED US WHERE TO TELL THE TRUTH. I JUST THINK IT'D BE FUN TO JUST GO THROUGH THE CIVIL RULES OF EVIDENCE. EVERY TIME THAT WE HAVE A HEARING. WE HAD A QUIZ. I'M SORRY. I THINK THAT'S HEARSAY. I WOULD PREFER SECTIONS . SEE? I TOLD YOU YEAH, I THINK OUR NEW PLANNING CONDITION LEASE LIKE COULD HANDLE THAT PRETTY WELL EXCITED ABOUT IT. YES YOU HAVE THAT NOW, MARLON. THANKS. THANKS FOR THAT. ALRIGHT ANY OTHER QUESTIONS REGARDING THE ORDINANCE? GO AHEAD AND SET THAT FOR A SECOND READING IN PUBLIC HEARING OF A MEETING ON JANUARY 17TH. ORDINANCE 08. AN ORDINANCE TO RENEW THE APPROVAL OF THE FINAL PLATFORM. 60 FAMILY LOTS ON 38 POINT. OH, NINE PLUS OR MINUS ACRES AND ACCEPT RESERVES A, B, C AND D FOR THE WOODHAVEN SUBDIVISION LOCATED AT 755, FELTHEIMER ROAD AND 73 TO 5 WALNUT STREET, AS REQUESTED BY BOB WEB GROUP CARE OF BRANDON. BELLY. SORRY FOR MAKING THAT RUN. WELL, I THANK YOU. ALLY IF YOU STUCK IT OUT THIS LONG. WE SHOULD AT LEAST GET YOUR NAME RIGHT? MR MAYOR. THANK YOU. SO THIS IS A RESIDENTIAL SUBDIVISION THAT IS LOCATED ON THE SOUTH SIDE OF WALNUT STREET TO THE NORTH AND WEST OF PEOPLE . HEIMER ROAD, SO THE CITY SUBDIVISION REGULATIONS STATES THAT THE PLANT IS NOT RECORDED WITHIN ONE YEAR OF ITS APPROVAL BY CITY COUNCIL. IT SHALL BECOME VOID PLATZ FOR THIS SUBDIVISION WAS IMPROVED, WAS APPROVED IN NOVEMBER OF 2021. AND IT WAS NOT RECORDED. AND SO THE PLAT APPROVAL HAS BECOME VOID. AND SO THAT'S WHY IT'S BACK BEFORE COUNCIL TONIGHT FOR RENEWAL THAT'S IN THE TITLE. SO THIS IS THE EXACT SAME WELL, PRETTY MUCH THE EXACT SAME PLATT THAT CITY COUNCIL PREVIOUSLY APPROVED. THE ONLY CHANGE IS UTILITY EASEMENTS THAT HAVE BEEN TWEAKED A LITTLE BIT THROUGH THE ENGINEERING PROCESS. BUT THIS IS THE SAME NUMBER OF LOTS DENSITY PARKLAND STREET GRID AS PREVIOUSLY IMPROVED BY CITY COUNCIL. AH AND IT IS STILL IN COMPLIANCE WITH THE FINAL DEVELOPMENT PLAN AND PLANNING COMMISSIONS. PREVIOUS APPROVAL. UM LAST YEAR, SO STAFF IS HAPPY TO ANSWER ANY QUESTIONS ABOUT THIS RENEWAL. YOU GOT ONE QUESTION FOR BRAND. THE HOUSE IN THE NORTHWEST CORNER. THERE THAT WAS NOT PART OF THE DEVELOPMENT IS NOT FOR SALE TO YOU GUYS HAVE PLANS ON ACQUIRING THAT PIECE OR RIGHT? FOR ANYONE TO STEP UP. AND BRENNAN, IF YOU'LL GIVE YOUR NAME AGAIN AND YOUR ADDRESS, THANK YOU. BRANDON BELL. I MHM. YES, PLEASE SURE. 79 VINEYARD HAVEN DRIVE. DUBLIN OHIO 3016. WE'VE TRIED THE FOLKS THAT WE BOUGHT THE PROPERTY OFF OF STORIES THAT WE HAVE NOT BEEN ABLE TO COME TO TERMS ON PRICE, SO THEY HAVE IT FOR SALE. WHETHER OR NOT SOMEONE HAD PEOPLE TALK TO US ABOUT TEARING IT DOWN AND BUILDING HOME THERE. I DON'T HAVE SOME FIRE. THANKS I JUST NOTICED RECENTLY THAT WAS FOR SALE. APPRECIATE IT. I HAVE [00:45:11] A SUGGESTION WHILE YOU'RE UP THERE TRYING TO TRYING TO GET AHEAD OF THIS BEFORE IT HAPPENS. UM IN NAMING OF YOUR STREETS. YOU HAVE WOODHAVEN LOOP AND WOODHAVEN. DR WE'VE HAD ISSUES IN THE PAST WITH VERY SIMILAR NAMES. UM IS THERE AN OPPORTUNITY HERE? MAYBE THE CHANGED ONE OF THOSE NAMES, OKAY? I. I MEAN, WE'RE OKAY WITH IT. I DON'T KNOW IF YOU'VE GOT A THEME HERE ON THE WOOD THING. SO UM, YOU KNOW, WOULD SOMETHING WOULD BE FINE, BUT, YEAH. OKAY I CAN SPEAK TO THAT. I LIVE ON MAYNARD PLACE AND ON THE SAME LOOP IS MANNER IN PLACE EAST. AND I CAN TELL YOU I GET A LOT OF CHRISTMAS PRESENTS DELIVERED TO MY HOUSE THAT ARE GENERALLY NOT MINE BECAUSE IT GOES TO THE ADDRESS OF THE SAME ON MANNER. PLACE WOULD JUST BE A SUGGESTION. WHAT'S THE TIMELINE LOOKING LIKE OUT THERE? BRAIN? LIKE GETTING OUT OF THE GROUND, BUT SOME OF THE SITES. SO WE HAVE A MEETING TOMORROW WITH THE FROM A DEPARTMENT TO GO. MAKE SURE WE HAVE EVERYTHING WE NEED TO GO IN FRONT MODELS OF ITEMS. WITH THE CITY'S APPROVAL. OBVIOUSLY TIME OF YEAR. WE'RE SUPPOSED TO BE WHITE MEN OF DOUBLE HEIGHT. REALLY CAN'T DO THAT UNTIL STRENGTH WE'RE WORKING THROUGH THAT. HOPE IS WELL, WE'LL HAVE A MODEL STARTED THERE IN THE NEXT 30 DAYS. HOW MANY MODELS ARE GOING TO HAVE TRUE. GENERATIONAL 55 OLDER SINGLE FAMILIES DO ONE GOOD. AND MIX THIS PROBABLY MORE STAFF PRESSURE THE WIDENING OF DOUBLE HEIMER. IS, DOES IT TERMINATE? AT THE SOUTHERN PORTION OF THIS PROJECT FOR NOW. AND THERE ARE PLANS TO CONTINUE THAT. AT SOME POINT AT SOME POINT IN THE FUTURE, SO IF WE HAVE WE HAVE TO THINK BACK AND RECALL IF THERE'S ANY UNINCORPORATED AREA LAST, BUT WE COULD DO WE COULD WORK SOMETHING OUT WITH THE PUT IT ON SHIP. IF WE NEED TO. OUR BIGGEST PROBLEM IS GOING TO BE THE AVAILABILITY OF RIGHT AWAY. SO WHENEVER WE DO A SUBDIVISION, WE REQUIRE ADDITIONAL RIGHT AWAY ON THE UNINCORPORATED AREAS THAT REMAIN. WE'RE LIMITED UNLESS WE CAN GET ADDITIONAL RIGHT AWAY FROM THE PROPERTY. I DON'T THINK IT'S POSSIBLE BUT I THINK WOULD BE A GOOD IDEA TO GET THAT COMPLETED BEFORE. REDLEGS GET STARTED UP IN BEVEL HEIMER BECAUSE THAT'S A HEAVILY TRAFFICKED ROAD DURING REX SEASON AND IT CAUSED A LOT OF DISRUPTION AND THAT'S STILL UNDER CONSTRUCTION. WELL, THAT PORTION HAVE LEISURE PATH. YEAH IT'S SUPPOSED TO HAVE HALF ON THE INSIDE OF THE OF THE GREEN SPACE THERE, FI REMEMBER CORRECTLY. DIRECT BEHIND MIRANDA. OKAY? DEFINITELY BE INCREASED TRAFFIC BIKING UP THAT WAY FOR PICKLEBALL, TOO. THAT'S RIGHT. OKAY THERE'S MY ONE TIME FOR THIS MEETING AND BINGO. MIGHT NOT, WE MIGHT NEED TO MAKE THAT A FOUR LANE EXPRESSWAY UP THERE. PICKLE BOTTLE EXPRESSWAY BRAND IS JUST TRYING TO GET HOME TO HIS FAMILY, ALWAYS AUCKLAND. ANY OTHER QUESTIONS REGARDING ORDINANCE A HEAD AND SET THAT FOR SECOND READING IN PUBLIC HEARING IN OUR MEETING ON JANUARY 17TH? I'M SURE WE'LL HAVE A BIGGER CAR THAT NIGHT, SO BE READY. THANKS, BRANDON BRANDON. ORDINANCE 09 2023. AN ORDINANCE TO DETERMINE THE ANNUAL COMPENSATION OF THE AMERICAN COUNCIL MEMBERS IN ADDITIONAL SALARY FOR THE MAYOR, PRESIDENT PRO TEM OR DESIGNATED COUNCIL MEMBER PRESIDING OVER HIS COURT. MASON? YES. THIS IS THE ANNUAL ORDINANCE WE PREPARED FOR MANY YEARS NOW I WORK FOR YOU TO SECTION 4.4, THE CITY'S CHARTER, WHICH AUTHORIZES COUNCIL BY ORDINANCE TO ANNUALLY DETERMINE ITS COMPENSATION. THIS USED TO BE LIKE THE ACTUAL NUMBERS USED TO BE IN OUR CITY CODE. BUT IF YOU REMEMBER LAST YEAR WE SEPARATED THAT OUT. SO NOW CITY CODE JUST FOR FIRST THE FACT THAT YOU WILL DETERMINE YOUR YEAH. PAY ANNUALLY BY ORDINANCE. UM. AND SALARY SHALL BE THE SAME FOR ALL COMPANY COUNCIL MEMBERS, EXCEPT FOR IN THE CASE OF SOMEONE SERVING ON MAYOR'S COURT, SO THAT'S JUST GENERAL LANGUAGE. THAT'S NOW IN THE CODE. AND NOW IF WE WANT TO CHANGE THE NUMBERS, IT'S JUST AN ORDINANCE THAT HAS TO BE PASSED WITH TWO READINGS IN A REFERENDUM PERIOD. SO THAT'S WHAT WE'RE DOING TONIGHT. THIS ORDINANCE WOULD INCREASE COUNCIL SALARY BY 5% WHICH IS COMMENSURATE WITH THE ANNUAL INCREASE CITY STAFF RECEIVED. [00:50:02] THE ADJUSTED SALARY WOULD BE EFFECTIVE JANUARY 1 2023. THESE AMOUNTS WERE APPROPRIATED IN THE 2023 BUDGET. ANY QUESTIONS ON ORDINANCE ON NINE. THE ONLY THING I MENTIONED MAYOR IS I KNOW WE HAVE MAYOR'S COURT UP THERE. AND, AS YOU KNOW, WE DON'T CURRENTLY HAVE MAYOR'S COURT RIGHT NOW. WE'RE STILL WITHIN THAT. I GUESS THAT TRIAL TIME WITH JOHANNA AND JUST JUST TO POINT OUT THAT, UM IN THE ORDINANCE, SECTION ONE. IT DOES SAY THAT UNLESS IT WILL NOT BE PAID OUT UNLESS WE HAVE SOMEONE OR COUNCIL MEMBERS REGULARLY SCHEDULED TO PRESIDE IN MAYOR'S COURT, AVERAGING TWO COURT SESSIONS PER MONTH, SO IF WE DON'T HAVE IT, THAT TAKES CARE OF THE FACT THAT WE WOULD NOT BE PAYING ANYONE FOR THAT. AND I JUST WANTED TO POINT THAT OUT. I WOULD AGREE. RIGHT ANY OTHER QUESTIONS REGARDING THE ORGANS? HAS SAID THAT FOR SECOND READING [11. RESOLUTIONS AND PUBLIC HEARING] AND PUBLIC HEARING IN OUR MEETING ON JANUARY, 17TH THAT TAKES US TO RESOLUTIONS RESOLUTION ARE 1 2023 RESOLUTION APPROVING AN APPLICATION TO PLACE FARMLAND LOCATED IN THE CITY OF NEW ALBANY, JERSEY TOWNSHIP AND LICKING COUNTY IN AN AGRICULTURAL DISTRICT FOR REAL ESTATE, TAXATION PURPOSES, PRESUMED TO OHIO ADVICE CODE 9 TO 9. MR THANK YOU, MAYOR. SO WE'VE DONE THIS A COUPLE OF TIMES PRIOR AT THE REQUEST OF THE PROPERTY OWNER BASICALLY WHAT HAPPENS IS PRIOR TO AN ANNEXATION. THE PROPERTY OWNER MAY HAVE THE PROPERTY IN A C A U B DESIGNATION OR AGRICULTURAL DESIGNATION. WHAT THAT DOES IS IT DIFFERS TAX LIABILITY, OR THE HIGHER TAX LIABILITY RATE ON PROPERTY THAT'S BEING USED FOR AGRICULTURAL PURPOSES. AT THE TIME THAT THE PROPERTY IS SOLD AND PUT INTO A HIGHER USE THAN THAT TAX BILL COMES DUE SO WHEN THE PROPERTY IS HAS BEEN ANNEX THAT WE'VE BEEN INFORMED BY LOOKING COUNTY THAT THEY REQUIRE. LEGISLATION FROM THE MUNICIPALITY AUTHORIZING THE. THE DESIGNATION FOR YOU A UV STATUS BEFORE THEY WILL TAKE ACTION. SO UH, THIS GIVES THE PROPERTY OWNER OF THE ABILITY TO PUT THE PROPERTY INTO AGRICULTURAL USE DESIGNATED FOR UNDER THE CIA. YOU'VE PORTION OF THE TAX CODE AND THEN AT SOME POINT IN THE FUTURE AFTER THE THERE'S THE DEVELOPMENT OPPORTUNITY THAT WOULD OCCUR. THE DEFERRED TAXATION WOULD BE DUE BY THE PROPERTY. IT'S NOT CLEAR FROM THE LEGISLATION WHERE THIS IS LOCATED. SO, UM I'LL HAVE THIS. I CAN PASS THIS AROUND. SO IT IS LOCATED. THREE PARCELS ARE LOCATED ON THE WEST SIDE OF BEACH ROAD. AND ONE IS IMMEDIATELY THE NORTHWEST CORNER OF GETTING PARKWAY AND BEACH AND THE OTHER IS A LITTLE BIT FARTHER WEST AND THE SOUTH SIDE AGAIN PARKWAY. THAT I CAN THAT'S ROUGH. AND THAT'S THAT LAND IS CURRENTLY BEING FARMED IN IS THAT TASK TAX DESIGNATION. DOES IT HAVE ANY DURATION ON IT? IT'S JUST THAT THE COUNTERS DISCRETION. YES SO THE OWNER CAN SO MISS TAYLOR FOR YEARS WOULD BRING, UH, GIVE A COMPARABLE EXAMPLE. MISS TAYLOR WOULD BRING IN, UM CATTLE ON HER PROPERTY AND HAVE THEM GRAZED THERE FOR A SPECIFIC PERIOD OF TIME TO MEET THAT REQUIREMENT. I HAVE THE CORNER OF MIDDLE HARLEM AND DUBLIN, GRANVILLE ROAD IN AND OF COURSE, ACROSS DUBLIN GRAVEL ON THE NORTH SIDE. SHE WOULD FARM THAT THAT GROUND BUT AS LONG AS THE GROUND IS BEING USED FOR AGRICULTURAL PURPOSES, WHETHER IT'S CATTLE OR CROPS, THEY CAN CONTINUE TO MAINTAIN THAT TEXT, DOESN'T IT? TOM, ARE YOU DOING CATTLE? YEAH. TRUCK FULL BUFFALO YELLOWSTONE OUT THERE. ALL RIGHT. ANY QUESTIONS ON THE RESOLUTION? WE'LL OPEN THE PUBLIC HEARING. RL 5 2023 AROUND SOLUTION TO CLARIFY CERTAIN SECTIONS OF THE CITY OF NEW ALBANESE PERSONNEL POLICIES TO DEFINE HONORABLE AND NON BURNABLE SALARY AS REQUESTED ABOUT OHIO PUBLIC EMPLOYEES RETIREMENT IT'S NOT THANK YOU, MAYOR TO USE JOE'S TERMINOLOGY. THIS IS A HOUSEKEEPING ITEMS THAT WE ADOPT EVERY YEAR. UM THE DIFFERENCE IN THIS IS THAT WE DID AT THE VACATION PAY OUT LAST YEAR DURING, UM, AN UPDATE TO THE CODE IN ORDINANCE. OH, 15 2022. SO JUST TO REMIND EVERYBODY THAT OHIO PUBLIC EMPLOYEES RETIREMENT SYSTEM OPENS REQUIRES MUNICIPALITIES TO PASS AN ANNUAL RESOLUTION TO CONFIRM THE EXISTENCE OF SICK LEAVE AND VACATION. WE HAVE CONVERSION PLANS FOR THE PURPOSE OF THIS RESOLUTION CONVERSION OCCURS WHEN AN EMPLOYEE CONVERTS ACCRUED TIME TO CASH FOLLOWING THE CITY'S PASSAGE AGAIN OF THIS RESOLUTION OPENS, WILL REVIEW THE CHAPTERS THAT WE HAVE IN THE CODIFIED ORDINANCES RELATED TO THIS PERSONNEL POLICIES AND DETERMINE WHETHER OR NOT THE CONVERTED TIME IS PENSIONABLE. THE CITY HAS TRADITIONALLY AGAIN PERMITTED THE CONVERSION OF LIMITED AMOUNT OF SICKLY BASED UPON THE AMOUNT OF SICK LEAVE USED BY AN EMPLOYEE DURING THE CALENDAR YEAR. THE CODE STATES THAT EACH PERMANENT FULL TIME NONUNION EMPLOYEE MAY RECEIVE PAYMENT IN CASH FOR A PORTION OF UNUSED, ACCRUED SICK LEAVE HOURS AT THE END OF THE PRECEDING FISCAL YEAR AND PROVIDED SUCH EMPLOYEE WAS ENTITLED TO SICK LEAVE BENEFITS DURING ALL OF THE 26 PAY PERIODS. OF THAT PREVIOUS YEAR. THE ADOPTION OF OVER 15 2022 ALLOWED FOR THE AMENDMENT TO 1 55 09, WHICH NOW ALLOWS FULL TIME EMPLOYEES AND OFFICIALS TO RECEIVE A PAYOUT FOR UP TO 80 HOURS OF VACATION LEAVE, PROVIDED THEY CARRY OVER A BALANCE OF AT LEAST 4400 AND 88 480 HOURS AS A DECEMBER 1ST AND REMINDER LEAVE US CONVERTED ON A LIFE OH, BASIS, SO BURNABLE SALARY REGARDLESS. UM IS CAPPED AT LEAVE ACCRUED IN THE CURRENT YEAR LESS ANY LEAVE USED TODAY IN THE SAME CALENDAR YEAR. THEREFORE, ANY EXCESS PAYOUT ABOVE THAT AMOUNT WITHIN OUR POLICY WOULD NOT BE PENSIONABLE , REGARDLESS SO THAT, UM IF THEY WERE ALLOWED TO PAY OUT 80 HOURS, BUT THEY USE 60. AND DIDN'T EARN THAT IN THE CURRENT YEAR, 20 WOULD ONLY BE HONORABLE IF THEY USED IT SO THAT'S IT. IF YOU HAVE ANY QUESTIONS, LET ME KNOW IT'S A LITTLE BIT DIFFERENT THIS YEAR. THAT'S WHY I WANT TO EXPLAIN IT. SO IN THE PAST THAT WILL NOT DO THE VACATION CASH OUT AS AN HERBAL. WE DIDN'T DO A VACATION CASH OUT AT ALL. OH, OKAY. VACATION WAS NEW. SO NOW WE HAVE A VACATION COUNCIL CASH OUT POLICY AND IT BECOMES ER NOBLE SALARY. YES FISCAL YEAR. YES. ANY QUESTIONS ON THE RESOLUTION. OPEN THE PUBLIC AREA.
