[4. ACTION ON MINUTES]

COUNCIL MEETING. ACTION ON THE MINUTES PRIOR TO TONIGHT'S MEETING, COPIES OF SEVERAL MINUTES WERE DISTRIBUTED TO COUNCIL MEMBERS WILL START WITH THE DECEMBER 13TH REGULAR COUNCIL MEETING. ARE THERE ANY ADDITIONS OR CORRECTIONS TO THE PROPOSED MINUTES FROM THE DECEMBER 13TH MEETING? I GOT A FEW MOSTLY TYPO TYPE CORRECTIONS FROM COUNCIL MEMBER CHARLES DECEMBER 13 MINUTES. HE DID WANT TO MAKE ONE SENTENCE CLEAR ABOUT HE WOULD KEEP THE COUNCIL APPRISED OF THE PROGRESS AS IT PROGRESSES REGARDING DIFFICULT BALL COURTS. SO WE DID CHANGE THAT ONE PARAGRAPH A LITTLE BIT BETTER THAN THAT SUBSTANTIVE CHANGES. ALRIGHT IF THERE'S ANY QUESTIONS ON THE MINUTES AND I DID MAKE THOSE CHANGES TO THE ORIGINAL SO YOU CAN ADAPT, THEN I WOULD MOVE FOR THE ADOPTION OF THE REGULAR COUNCIL MEETING MINUTES. FROM DECEMBER 13TH AS SUBMITTED BY CONSENSUS. THE NEXT SET OF MEETINGS ARE FROM OUR ORGANIZATIONAL MEETING ON JANUARY 3RD ANY ADDITIONS OR CORRECTIONS TO THE PROPOSED ORGANIZATIONAL MEETING MINUTES, COUNCIL MEMBER SHAWL FOUND TWO INSTANCES WHERE I THINK IT WAS A DISCUSSION IF IT WAS A MOTION, BUT HIS NAME WAS LEFT OFF. IT JUST SAID COUNCIL MEMBER AND THERE WAS NO SHOT AFTER SO WE PLUGGED HIM BACK IN WHEN WE WERE TALKING ABOUT COUNSELORS INTENTIONAL GERMAN DOCTOR GIVE HIM CREDIT. UM, BUT WE CORRECTED THAT ERROR, AND THAT CORRECTION WAS MADE TO THE ORIGINAL.

ALRIGHT THEN I WOULD MOVE FOR THE ADOPTION OF THE ORGANIZATIONAL MEETING MINUTES BY CONSENSUS. AND THEN THAT LEAVES US WITH THE JANUARY 3RD REGULAR COUNCIL MEETING MINUTES , CORRECTIONS TO THOSE COUNCIL MEMBERS HAD NO CORRECTIONS. ANYONE ELSE? OH, YEAH. FEEL FREE. ALRIGHT THEN I WOULD ALSO MOVE FOR THE ADOPTION OF THE REGULAR COUNCIL MEETING MINISTER IN JANUARY 3RD BY CONSENSUS. ADDITIONS OR CORRECTIONS TO THE AGENDA. ANY ADDITIONS OR CORRECTIONS PROPOSED BY STAFF COUNSEL TO THE AGENDA NOT RECEIVED ANY ALRIGHT HEARING

[6. HEARING OF VISITORS]

VERY MUCH APPRECIATE THE SUPPORT OF RESIDENTS IN THE DISTRICT, WHICH IS NOW DISTRICT FOR IT INCLUDES ALL OF NEW ALBANY, ALL THE PLAIN TOWNSHIP ALL THE KAHANE, JEFFERSON TOWNSHIP, BLACK LICK AND THE CITY OF WESTERVILLE, BUT NOT THE CITY SCHOOL DISTRICT IN WESTERVILLE, SOUTH OF 2 70, NOR A LARGE PORTION OF COLUMBUS.

NORTH OF MORE SOUTH 1 61 GOING EAST TOWARDS THE NEW HAMILTON'S ROAD AREA. UM, BUT IT'S AN HONOR TO SERVE THE DISTRICT. AND I'M FULLY COGNIZANT THAT ALTHOUGH MANY PEOPLE IN THE DISTRICT VOTED FOR ME, NOT EVERYONE DID. AND AS YOUR STATE REPRESENTATIVE , I WANT YOU TO REASSURE YOU THAT I WORK FOR ALL OF THE RESIDENTS OF THE DISTRICT AND ALL OF OHIOANS TRYING VERY MUCH TO ADDRESS SOME OF THE ISSUES AND PROBLEMS THAT ARE INDIVIDUAL FAMILIES FACE THAT OUR BUSINESSES FACE IN ORDER TO MAKE OHIO VIBRANT AND GROWING CITY AND SORRY STATE. EXCUSE ME. IT'S STILL UNDER HEARING YOUR VISITORS THERE. ANYONE FROM THE PUBLIC THAT WOULD LIKE TO ADDRESS COUNCIL REGARDING MATTER THAT IS NOT ON TONIGHT'S AGENDA. ALRIGHT

[7. BOARD/COMMISSION REPORTS]

BOARDING COMMISSIONER REPORTS AND THE UPDATE FROM THE PLANNING COMMISSION. NO MEETING. PARKS AND TRAILS ADVISORY BOARD MEETING ARCHITECTURAL REVIEW BOARD. WE HAD A MEETING. OKAY WE DISCUSSED THE ROSE ONE TO PROJECT. SO, UM, SOME WONDERFUL PLANS FOR THE PUBLIC PARKING GARAGE THAT WILL BE HOPEFULLY RIGHT BEHIND HERE. I MEANT TO BRING THE DRYING SURROUNDINGS. I KNOW THAT CROSS MEMBER DIRK USED TO HAVE A LONG STANDING TRADITION OF THAT WHICH I WILL START DOING NEXT TIME. BUT THEY VOTED TO DEMOLISH THE MILL BUILDING AND THE CURRENT, UM, GARAGE FOR THE N A. P D AND ISSUED A CERTIFICATE OF APPROPRIATENESS FOR THE PUBLIC PARKING GARAGE. UM WITH SOME CONDITIONS OF FURTHER REVIEW FOR LIGHTING AND LANDSCAPES. BUT IT WAS A BEAUTIFUL BUILDING. UM VERY, UH, WITHIN EUROPE PARKING GARAGE THAT REALLY FELT LIKE NEW ALBANY. ALRIGHT I KNOW. I JUST WANT TO TAKE A MOMENT TO THANK THE NORBERT COMPANY IN RAMSAR FOR THEIR ASSISTANCE IN DESIGNING THE GARAGE, GIVING US SOME THINGS TO THINK ABOUT.

CERTAINLY NO SURPRISE, BUT THE END OF THE PROCESS. I THINK EVERYONE REALIZED WHAT A WHAT YOU COULD DO WITH A PARKING GARAGE AND IT REALLY IT. YOU KNOW, I FOR ONE WAS ALWAYS A LITTLE, UH, HESITANT ABOUT STRUCTURED PARKING, BUT WAS CONVINCED OVER TIME THERE IS THE RIGHT THING TO DO. AND THEN YOU HAD TO MAKE IT SOMETHING THAT WAS ACCEPTABLE IN NEW ALBANY.

AND I REALLY THINK THIS WENT A LONG WAYS TO MEETING THAT REQUIREMENT. IT LOOKS LIKE IT'S GOING TO SERVE THE FUNCTION OF A PARKING GARAGE. BUT IT DOESN'T SCREAM. I'M A PARKING GARAGE, WHICH. MAYBE WE'LL HAVE TO PUT SOME SIGNS UP THERE TO SAY HERE BUILDING SO WELL DONE. IS THERE ANY WAY TO GET THAT PACKET SENT OUT TO COUNSEL JUST TO SEE THEM REVENUES AND JENNIFER. I FIGURE JOHN I 10 WAS OKAY WITH IT. WE'RE GOOD. ALRIGHT BOARD OF ZONING APPEALS AND IN THE REPORT , NO MEETING AS SUSTAINABILITY ADVISORY BOARD SO IT WASN'T MEETING GOING FORWARD. UM. I DON'T AND PART OF THE CITIZENS POLICE ACADEMY WITH AS YOU KNOW , MR MAYOR. SO THE NEXT FEW, UH

[00:10:02]

, WEDNESDAYS I WILL BE NOT IS SUSTAINABILITY ADVISORY BOARD, BUT COUNCIL MEMBER FELLOWS WAS KIND ENOUGH TO PINCH IT FOR ME, SO I'M GOING TO KICK IT OVER AND I DON'T THINK WE DID HAVE A MEETING. IT WAS A VERY GOOD MEETING. I WILL SAY THIS, THE MEMBERS OF THE SUSTAINABILITY BOARD ARE VERY ENGAGED FOLKS AND THE ENJOYED BEING A PART OF THAT. DURING THE MEETING. WE COVERED THE SOLAR BEST PRACTICES. BIRTHDAY TO ARBOR DAY PLANNING AND SCHOOL GRANT PROGRAMS PLANNING AND BOTH STEVEN AND ADRIAN DID A REALLY GOOD JOB PRESENTING THE SOLAR BEST PRACTICES REPORT AND I THOUGHT WOULD BE IMPORTANT FOR AT LEAST ADRIAN OR STEPHEN TO GIVE US JUST A BRIEF SYNOPSIS OF WHAT THAT MEANS TO COUNSEL AND WHEN WE CAN EXPECT THAT THAT.

LEGISLATION THAT COME TO US? YES. SO I CAN GIVE YOU SOME BACKGROUND AND STEVE, IF YOU WANT TO TALK ABOUT SCHEDULE FEEL FREE. UM SO IN FOR A COUPLE OF REASONS, ONE BEING JUST CONTINUED INTEREST IN THE COMMUNITY AND SUSTAINABILITY AND SOLAR PANELS, ANOTHER BEING CHANGES, UM, IN LEGISLATION AT THE STATE LEVEL RECENTLY. WE UNDERTOOK THIS EFFORT TO TRY TO UNDERSTAND WHAT SHOULD WE DO FROM A ZONING CODE STANDPOINT, RELATED TO THE PLACEMENT OF SOLAR PANELS. IN DIFFERENT ZONING DISTRICTS WITH THE NEW ALBANY SO THE FIRST STEP IN THAT PROCESS, BUT WE WORKED WITH THEM CASCADE TO CREATE ESSENTIALLY AS A REPORT ON BEST PRACTICES AND LOCALLY REGIONALLY AND, UM. USES OF TECHNOLOGY BECAUSE THIS IS AN AREA WHERE TECHNOLOGY AND BUILDING MATERIALS IS CHANGING REALLY FAST. SO THE RESULT OF THAT EFFORT WAS THIS REPORT.

THAT IS THE BEST PRACTICES DOCUMENTED TALKS ABOUT CAN THE CHANGING NATURE OF TECHNOLOGY FOR ME? THE MOST USEFUL PART IS IT HAS MAYBE HALF A DOZEN CASE STUDIES OF DIFFERENT LOCAL EXAMPLES OF HOW THEY DO OR DON'T REGULATE SOLAR PANELS WITHIN THEIR COMMUNITIES. THE IDEA IS TO TAKE THIS REPORT AND WE STARTED THE SUSTAINABILITY ADVISORY BOARD. TO OUR DIFFERENT BOARDS AND COMMISSIONS. SO SUSTAINABILITY, THE ARCHITECTURE REVIEW BOARD BOARD AND PLANNING COMMISSION AS YOU MIGHT EXPECT THAT WHAT WE WOULD PROBABLY WILL GET A RANGE OF OPINIONS ON THE BEST WAYS TO REGULATE THOSE, UM UM SOLAR PANELS AND THE COMMUNITY GOING TO GATHER ALL THAT FEEDBACK FROM THE DIFFERENT BOARDS AND COMMISSIONS, AND THE RESULT OF THAT FEEDBACK WILL BE SOME SORT OF CO CHANGE. THAT WOULD ALSO THEN GO THROUGH THE ENTIRE PUBLIC PROCESS THROUGH DIFFERENT BOARDS AND COMMISSIONS AND ULTIMATELY, TWO CITY COUNCIL , SO THAT HAS NOT BEEN DRAFTED YET. WE'RE JUST IN THE FEEDBACK PORTION, AND WE'RE GETTING FEEDBACK FROM THE DIFFERENT BOARDS AND COMMISSIONS BASED ON WHAT'S IN THE BEST PRACTICES REPORT. THANK YOU. THAT WAS A VERY GOOD EXCHANGE DURING THE SUSTAINABILITY COMMITTEE, ANYTHING WAS THE LONGEST MEETING TO DATE. IT WAS 20. THANKS JEFF. MY WIFE CAME AND SAID THIS WILL BE ABOUT AN HOUR. SHE'S LIKE ABOUT AN HOUR, DON'T YOU? THAT WAS A GOOD MEETING. THANK YOU FOR DOING THE UPDATE. ALRIGHT ANY UPDATE FROM THE IDEA COMMITTEE, NO MEETING CEMETERY RESTORATION ADVISORY BOARD MEETING AND THERE WAS NO MEETING AT THE PUBLIC RECORDS, COMMISSION. CORRESPONDENCE OR COMMUNICATION. HAS ANYONE RECEIVED ANY CORRESPONDENCE OR COMMUNICATION SINCE OUR LAST MEETING THAT LIKE TO PROVIDE AN UPDATE ON SECOND READING OF ORIGINS AND PUBLIC HEARING

[9. SECOND READING OF ORDINANCES AND PUBLIC HEARING]

ORDINANCE, 001 2023 IN ORDER TO ACCEPT THE EXPEDITE TAIPAN ANNEXATION OF 61.26 PLUS OR MINUS ACRES FROM JERSEY TOWNSHIP , LICKING COUNTY TO THE CITY OF NEW ORLEANS. JOE THANK YOU, MAYOR. WE SHOULD HAVE A MAP IN THIS PACKET THAT WE GO SHOWING ALL OF THE PARCELS THAT ARE GOING TO BE INCLUDED IN ORDINANCES. ONE THROUGH FIVE, UM ORDINANCES, 134 AND FIVE ARE ALL ALL OF EM. YEAH, WE WERE INCORPORATED IN THE ANNEXATION AGREEMENT THAT WAS PASSED BY COUNCIL BACK IN JANUARY OF 2022. UH THAT WAS RESOLUTION ARE 04 2022, THE PARCELS THAT ARE WITHIN THE WHAT WE WOULD DESCRIBE AS THE AREA THAT'S UNDER THE INFLUENCE OF INTEL. SO WE HAVE THE INTEL PARCEL ITSELF. AS WELL AS THE ADJACENT PROPERTIES AROUND IT TO THE WEST AND TO THE SOUTH. IN CONJUNCTION WITH THE ANNEXATION AGREEMENT. WE WERE ALSO REQUIRED TO DO ROAD MAINTENANCE AGREEMENTS. THOSE WERE ALSO APPROVED. IN THE EARLY MONTHS OF LAST YEAR. ORDINANCE TWO IS THE EXCEPTION AND THAT'S ACTUALLY TO THE LOWER ONE AT THE BOTTOM OF THE SCREEN THERE, JASON TO THE WEST SIDE OF MINK STREET. AGAIN ALL OF THESE WERE EXPEDITED. TYPE ONE ANNEXATIONS

[00:15:02]

, WHICH BASICALLY HAVE EXPEDITED TYPE ONE AS WE HAVE IT WRITTEN UP HAVE THE CHARACTERISTICS OF A TRADITIONAL ANNEXATION DIFFERENCES. THE TIMING IS COMPRESSED. SO INSTEAD OF TAKING 9 TO 10 MONTHS FOR THE ANNEXATION PROCESS TO BE COMPLETED IN TYPICAL TYPICALLY TAKES ABOUT THREE MONTHS OR SO. UH SO THE LOOKING COUNTY COMMISSIONERS HEARD THE ANNEXATION PETITIONED BY THE APPLICANT. AND THEY APPROVED EACH OF THESE AGAIN. 1234 AND.

FIVE UM, AND THE NEXT STEP NOW THAT THE 60 DAY WAITING PERIOD HAS LAPSED. IS TO FOR COUNCIL TO TAKE ACTION AGAIN AS PART OF THE ANNEXATION AGREEMENT. WE HAVE LANGUAGE THAT PROTECTS THE FIRE DEPARTMENT. IT BASICALLY SPELLS OUT THE COMPENSATION PROCESS FOR FIRING AN M S IN THE EVENT THAT , UH, TAX ABATEMENTS ARE PROVIDED TO PARTICULARLY DEVELOPMENT PROJECT IF IT MEETS THOSE STANDARDS. IT'S ALL HIM. RIGHT ANY QUESTIONS FROM COUNCIL ON THE ORDINANCE? HMM WELL, WE'LL OPEN THE PUBLIC HEARING. WOULD ANYONE ONE FROM THE PUBLIC LIKE TO SPEAK REGARDING ORDINANCE? 1 2023. YES COUNCIL MEMBER THERE? YES FELLOWS. YES YES. COUNCIL MEMBER SHUTTLE? YES SEVEN. YES ORDINANCE 1 2023. ORDINANCE 002 2023 ORDINANCE TO ACCEPT THE EXPEDITED TYPE ONE ANNEXATION OF 6.15 PLUS OR MINUS ACRES FROM JERSEY TOWNSHIP, LICKING COUNTY TO THE CITY OF NEW ORLEANS. EVERYTHING I JUST GOT DONE SAYING APPLIES TO THIS , WITH THE EXCEPTION THAT THIS 6.15 ACRES IS PART OF AN AREA THAT WAS ACTUALLY, UM AN ANNEXATION AGREEMENT THAT OCCURRED ON JUNE 16TH 2015. BUT WE AND THE COUNCIL LEGISLATION THAT AUTHORIZED ME TO EXECUTE THE ANNEXATION AGREEMENT WAS R 29 2015. UH AGAIN. WE HAVE A ROAD MAINTENANCE AGREEMENT, WHICH WAS ENTERED INTO THE COUNTY COMMISSIONERS APPROVED THE ANNEXATION PETITION.

RESOLUTION 1 16-61. AND THE 60 DAY WAITING PERIOD HAS LAPSED, SO COUNCIL CAN TAKE ACTION THIS EVENING. GREAT ANY QUESTIONS ON ORDINANCE SO TOO? OPEN THE PUBLIC HEARING. WOULD ANYONE FROM THE PUBLIC LIKE TO SPEAK REGARDING ORDINATES OUT TO 2023? NO PUBLIC COMMENT WILL CLOSE THE PUBLIC HEARING. IS THERE A MOTION ON THE ORGANS? REMOVING THE OPTION OF ORDINANCE TO 2023.

SECOND. COUNCIL MEMBER FELLOWS YES, MEMBER DARK COUNCIL MEMBER BRISK. YES MAYOR SPOTTING? YES YES. COUNCIL MEMBER SHOP? YES YES. SEVEN. YES VOTES PERFORMANCE. OH, 2 2023.

ORDINANCE 03 2023 NORTHERN'S TO ACCEPT THE EXPEDITED TYPE ONE ANNEXATION OF 13.87 PLUS OR MINUS TAKERS FROM JERSEY TOWNSHIP. LICKING COUNTY DID THE CITY OF NORTON. YEAH SO THE COUNTY APPROVED THIS TO RESOLUTION. 1 16. THEY'RE 60. AND THIS IS THIS IS LOCATED ON THE ROAD WEST OF CLOVER VALLEY ROAD IN EAST OF BERMUDA, BERMUDA DRIVE. SO IT WOULD BE JUST THAT THAT SMALL BOX THERE TO THE RIGHT OF BERMUDA. COUNCIL 60 DAYS HAS ELAPSED SO COUNCIL CAN TAKE ACTION. ANY QUESTIONS ON THE ORDINANCE. OPEN THE PUBLIC HEARING. WHAT ANYONE FROM THE PUBLIC LIKE TO SPEAK REGARDING ORDINANCE 03 2023. NO COMMENT WILL CLOSE THE PUBLIC HEARING.

THERE'S A MOTION ON THE ORGANS. BEFORE THE ADOPTION OF ORDNANCE OH, 3 2023 2ND. PROTEST YES, COUNCIL MEMBER WILL TRAVEL COUNCIL MEMBER SHOP? YES, SPOTTING. YES COUNCIL MEMBER BRISK. YES THAT'S NUMBER. DEREK. YES, FELLOWS. UMBRELLAS. YES YOU HAVE. SEVEN. YES. VOTES ORDINANCE. 3 2023 OH 4 2023 AN ORDINANCE TO ACCEPT THE EXPEDITED TYPE POINT ANNEXATION OF 312.86 PLUS OR MINUS ACRES FROM JERSEY TOWNSHIP, LICKING COUNTY TO THE CITY OF THEM ALL.

THIS IS THE WHAT WAS THE LARGE CROSSHATCHED AREA TO THE FAR RIGHT OF THE SCREEN THAT YOU JUST SAW. A MINUTE AGO. IT'S THAT ONE THERE. AGAIN APPROVED BY THE COUNTY COMMISSIONERS

[00:20:04]

THROUGH RESOLUTION 1 16 59. AND THE 60 DAY BREAKING PERIOD HAS LAPSED SO WE CAN TAKE ACTION THIS EVENING. ANY QUESTIONS ON ORDER AND SO FORTH. WELL WHEN THE PUBLIC HEARING ANYONE FROM THE PUBLIC LIKE TO SPEAK REGARDING ORDINANCE OF 4 2023. HEARING NO PUBLIC COMMENT WILL CLOSE THE PUBLIC HEARING AND I WOULDN'T MOVE FOR THE ADOPTION OF ORDINANCE 04 2023 2ND. THE SHOP. COUNCIL MEMBER SHELL YES. COUNCIL MEMBER BRISK. YES NUMBER DEREK? YES COUNCIL MEMBER FELLOWS? YES YES. COUNCIL MEMBER WILL TRY. YES SEVEN. YES VOTES FOR THAT ORDINANCE OF 4 2023 ORDINANCE, SO 5 2023. NORTON'S TO ACCEPT THE EXPEDITED TYPE ONE ANNEXATION OF 15.3 PLUS OR MINUS ACRES FROM JERSEY TOWNSHIP LOOKING COUNTY TO THE CITY OF NEW ORLEANS. JOE. AGAIN THIS WAS APPROVED BY THE COMMISSIONERS THROUGH RESOLUTION. 1 16 58. AH THE ANNEXATION AGREEMENT WAS APPROVED BY COUNCIL BACK IN JANUARY OF 2022, THE 60 DAY WAITING PERIOD HAS LAPSED. IN THIS PARCEL IS LOCATED. JUST NORTH OF JUNK STREET THERE IN THAT BOX, UH AND ROUGHLY THE CENTER OF THE SCREEN. ALL RIGHT. ANY QUESTIONS ON THE ORDINANCE? OPEN THE PUBLIC HEARING ANYONE FROM THE PUBLIC LIKE TO SPEAK REGARDING ORDINANCE 05 2023. NO PUBLIC COMMENT WILL CLOSE THE PUBLIC HEARING. THERE'S A MOTION ON THE ORGANS MOVE ADOPTION ORDINANCE 5 2023. SECOND. THAT'S A MEMBER SHOW. YES, YES. COUNCIL MEMBER? YES COUNCIL MEMBER FELLOWS? YES MEMBER OF RISK? YES, SPOTTING? YES CHILD. YES YES, FOLKS TO ADOPT WORD. LET'S GO. 5 2023 STAND AT THE JOE SHOW RIGHT ORDINANCE 006 2023 ORDINANCE TO AMEND THE ZONING ORDINANCE OF THIS EVENING TO ALBANY BY AMENDING THE ZONING MAP TO REZONE 403 PLUS OR MINUS ACRES OF LAND, GENERALLY LOCATED SOUTH OF GREEN CHAPEL ROAD. WEST OF MINK STREET, EAST OF BEACH ROAD AND NORTH OF DRUG STREET, FROM AGRICULTURAL AGGIE TO TECHNOLOGY MANUFACTURING DISTRICT TMD, AS REQUESTED BY N . B. J HOLDINGS LLC CARE ERIN UNDERHILL AS FIRE, MR MAYOR. THANK YOU. SO THIS IS A REZONING TO THE TMD ZONING DISTRICT FOR FOUR OF THE FIVE AREAS THAT WE'RE JUST ANNEXED INTO THE CITY EVENING, ALBANY. SO THESE ARE THE AREAS THIS IS JUDGE STREET DOWN HERE. SO THAT'S NORTH OF JUG WEST OF MINK BEACH ROAD IS OVER HERE SO EAST OF BEACH AND THEN SOUTH OF GREEN CHAPEL. SO AS REQUIRED BY CODE. ALL OF THESE PROPERTIES BEING REZONED ARE CONTIGUOUS TO THE EXISTING TMD ZONING TO THE EAST, SHOWN IN THE BRIGHT BLUE HERE IN ORDER TO MEET THE MINIMUM ZONING SIZE STANDARDS, SO THE TMD ALLOWS FOR A VARIETY OF USES FROM THE CITY'S LIMITED INDUSTRIAL DISTRICT AND ALSO ADDS ADDITIONAL USES, SUCH AS SOLAR PANELS, GAS STORAGE AND WATER TREATMENT FACILITIES. THE TMD ALSO ESTABLISHES THE MOST RESTRICTIVE SETBACK, MOUNDING AND LANDSCAPING REQUIREMENTS IN THE CITY AND ALSO AS COMPARED TO THE NEARBY LG ZONING DISTRICTS TO THE WEST AND TO THE SOUTH. SO BACK WHEN THE ORIGINAL TMD WAS BEING REZONED, THE CITY PARTNERED WITH MORE BSI AND HIRED A TRAFFIC ENGINEER. UM AND THIS IS JUST SHOWING THE CURRENT IMPROVEMENTS THAT ARE BEING DONE IN AND AROUND THE AREA. SO ALL THE IMPROVEMENTS, UM, PLANNED.

INCORPORATE THIS REZONING THAT IS BEING HEARD TONIGHT. AND THE TMD ALSO INCLUDES A LANDSCAPE STANDARDS DESIGN PLAN. SO THIS IS THE ONLY DISTRICT THAT INCLUDES IT, AND THIS IS JUST A COUPLE OF EXCERPTS THAT SHOWS THE TYPE OF DESIGN STANDARDS THAT INCLUDED IN THAT, AND THIS INCLUDES THINGS SUCH AS STREET TREES, MOUNDING STORMWATER BASINS AND PARKING LOT.

SCREENING IS CONSISTENT THROUGHOUT THE ENTIRE ZONING DISTRICT BETWEEN SITE TO SITE.

SO THIS IS THE AREA OUTLINED ON THE NEW ALBANY FUTURE LAND USE PLAN. SO THE ZONING TONIGHT IS THE EXACT SAME TMD ZONING AS IT EXISTS IN THE PARK TODAY, AND IT TAKES THE BEST STANDARDS FROM OTHER ZONING AND ENHANCES THEM. SO THE PROPOSAL MATCHES THE LAND USE RECOMMENDATIONS FOUND IN THE ENGAGED IN ALBANY STRATEGIC PLAN SHOWN HERE FOR THE EMPLOYMENT CENTER AND THE NEW ALBANY PLANNING COMMISSION REVIEWED AND RECOMMENDED APPROVAL AT THEIR MEETING DURING DECEMBER. STAFF IS HAPPY TO ANSWER ANY QUESTIONS FROM COUNCIL. ANY QUESTIONS FROM COUNCIL IN THE ORDINANCE, STEPHEN, YOU KNOW YOU'RE SHOWING THE ELEVATIONS. WE DO THE ROADS OUT THERE THERE. THAT'S PROBABLY

[00:25:04]

NOT COMPLETELY RELATED TO THE ORDINANCE. BUT WHEN WE DO THE ROADS OUT THERE DRUG STREET DRUG STREETS. B HAS BEEN REDONE AND THEY DID NOT BURY THE UTILITIES. OR THE UTILITY IS GOING TO BE BURIED ON THE OTHER. ROADS THERE. SO. I THOUGHT SO IMMEDIATELY THERE NOT JUST BECAUSE THE COST IS, UM IT'S COST PROHIBITIVE AT THIS TIME, BUT WE ARE CONSIDERING IT FOR THE FUTURE, AND, UH, NEVER, BUT RIGHT NOW, IT'S SMART. IT'S JUST DRIVING DOWN DRUG STREET OF THE KNIGHTS OF THOSE UTILITIES WERE UNDERGROUND WHEN THEY SO IT'S SOMETHING WE ARE DOING, UM ALONG MINK AND GREEN CHAPEL, AND WE DID TO SOME EXTENT ON DRUG AS WELL AT JOE'S DIRECTION. WE ARE HAVING THE LATERALS THE SERVICE LINES GOING ACROSS THE ROAD BURIED, UM, WHICH SHOULD HELP QUITE A BIT WITH THE AESTHETIC. IT'S GOING TO BE A WORLD CLASS BUSINESS PARK AND IT WOULD YOU KNOW, I THINK IN THE FUTURE WE DEFINITELY NEED TO PLAN WIDELY TELLING IT WAS SOMETHING THAT WE WERE HOPING TO ACCOMPLISH, BUT WITH THE COST PER MILE TO BURY THOSE AND THEN ALSO WITH THE HIGH VOLTAGE LINES ALSO BEING IN THE VICINITY. HMM WE THOUGHT THAT IF THERE MIGHT BE A BETTER OPPORTUNITY TO COME BACK AT A LATER TIME, BUT IT'S DEFINITELY SOMETHING THAT WE WOULD LIKE TO DO IF WE HAVE THE MONEY, THANKS. RIGHT. ANY OTHER QUESTIONS ON THE ORDINANCE. OPEN THE PUBLIC HEARING ANYONE FROM THE PUBLIC LIKE TO SPEAK REGARDING ORDINANCE 6 2023. THERE IS NO PUBLIC COMMENT WILL CLOSE THE HEARING. IS THERE A MOTION ON THE ORGANS? I MEAN FOR THE ADOPTION OF ACCORDANCE OF 6 2023 2ND. COUNCIL MEMBER KISSED YES. COUNCIL MEMBER FELLOWS COUNCIL MEMBER SHOP? YES COUNCIL MEMBER WILL TRUMP YES. MAYOR SPAULDING . YES COUNCIL MEMBER OF RISK? YES COUNCIL MEMBER. DEREK? YES YES. FIRST ORDINANCE 6 2023. ORDINANCE OO 7 2023 NEW ORDERS TO A MAN CHAPTER 159 RULES OF PROCEDURE FOR BOARDS AND COMMISSIONS OF THE CITY OF NEW ALBANY, OHIO, IS QUALIFIED ORDINANCES AS REQUESTED BY THE CITY OF NORMAN. YEAH THIS REQUEST CAME FROM A COUNCIL MEMBER DEREK AND THE BOARDS TO TAKE A LOOK AT WHEN THE ORGANIZATIONAL MEETINGS FOR BEING HELD BECAUSE IN SOME CASES , MEMBER BOARDS WERE HOLDING ORGANIZATIONAL MEETINGS AND THEN SENDING EVERYONE BACK HOME. THERE WEREN'T ANY MATTERS. SO WE WANTED TO GO AHEAD AND OPEN THAT UP TO BE MORE FLEXIBLE SO THAT THEY COULD HAVE MATTERS TO ATTEND TO BE MORE EFFICIENT WITH THEIR TIME. THE 2020 NEW ALBANY CHARTER REFERENCES THE STANDARD RULES THAT WE'VE JUST WORKED ON HERE AND THEIR ARTICLE 10 UNDER BOARDS AND COMMISSIONS, AND IT STATES THAT IF NO UNIQUE RULES ARE ESTABLISHED, THE BORDER COMMISSION SHALL OPERATE ACCORDING TO THE STANDARD RULES , AND THE RULES WERE LAST UPDATED IN 2007, SO THERE ARE CERTAINLY OVERDUE FOR AN UPDATE . UM WE MET FIRST WITH DEVELOPMENT STAFF WHO ARE SUPPORTING MOST OF THE CITY BOARDS. IN ADDITION TO LAW DIRECTOR ALBRECHT AND COUNCIL MEMBER KISSED, WHO WENT THROUGH THESE WITH US AND MADE THE RECOMMENDATIONS. I WENT THROUGH THE RECOMMENDATIONS INDIVIDUALLY IN THE FIRST READING AND HELP YOU TO DO THAT AGAIN BEFORE YOU ARE HAVING WE CAN ANSWER QUESTIONS. RIGHT? ANY QUESTIONS ON ORDER AND SO SEVEN.PEN THE PUBLIC HEARING ANYONE FROM THE PUBLIC LIKE SPEAK REGARDING ORDINANCE OF 7 2023. THERE IS NO PUBLIC COMMENT WILL CLOSE THE HEARING AND I WOULD MOVE TO THE ADOPTION OF ORDINANCE. OH 7 2023 2ND. MM. HERE'S BALDING. YES YES . COUNCIL MEMBERSHIP? YES COUNCIL MEMBER KISSED? YES FELLOWS. YES COUNCIL MEMBER. DEREK? YES. RISK? YES. SEVEN. YES FESTERED COORDINATES 7 2023.

COORDINATES OH 8 2023 IN NORTHERN'S TO RENEW THEIR APPROVAL OF THE FINAL PLAN FOR 60 SINGLE FAMILY LOTS ON 38.9, PLUS OR MINUS ACRES AND ACCEPT RESERVES A, B, C AND D FOR THE WOODHAVEN SUBDIVISION, LOCATED AT 7555, BEVEL, HEIMER ROAD AND 73 TO 5 WALNUT STREET. AS REQUESTED BY BOB WEB GROUP. AND BRANDON. HELP ME OUT HERE, BELLY . SHALL I SEE? I KNEW IT WAS THE RIGHT ONE CHANCE TO GET THEM READY. SO THIS IS THE GENERAL AREA SHOWN ON THE SCREEN HERE.

SO THIS IS LOCATED WEST OF PEOPLE HEIMER ROAD SOUTH OF WALNUTS AND EAST OF THE UPPER CLARITIN'S SUBDIVISION, SO THE CITY SUBDIVISION REGULATIONS STATE THAT IF A PLAN IS NOT RECORDED WITHIN ONE YEAR, IT SHALL BECOME VOID, AND THIS PLANT WAS APPROVED IN NOVEMBER OF 2021. SO IT'S ABOUT 13 OR 14. MONTHS ON AND WAS NOT RECORDED SO IT MUST COME BACK BEFORE COUNCIL FOR RENEWAL. SO THIS IS THE PLATS THAT WAS PREVIOUSLY APPROVED AND THAT IS UP FOR

[00:30:05]

RENEWAL TONIGHT. SO THIS IS THE SAME ONE THAT WAS AS PREVIOUSLY APPROVED. THIS IS THE SAME NUMBER OF LOTS, DENSITY PARKLAND , OPEN SPACE AND STREET GRID AND CONNECTIONS. THE ONLY UPDATE IS SOME MINOR CHANGES TO THE UTILITY EASEMENTS GIVEN THE UPDATED ENGINEERING PLANS, BUT THERE HAVE BEEN NO OTHER SUBSTANTIVE CHANGES. UM SINCE THEN, SO THIS PLAN IS STILL IN COMPLIANCE WITH THE FINAL DEVELOPMENT PLAN THAT WAS APPROVED BY THE PLANNING COMMISSION AND THEN LASTLY, TO AT THE FIRST READING COUNCIL MENTIONED STREET NAMES. I WILL ADD THAT SINCE THE FIRST READING THE CITY ENGINEERING STAFF AND THE APPLICANTS ENGINEERING STAFF HAS BEEN IN CLOSE COMMUNICATION. WHAT WE FOUND AFTER DIGGING INTO THIS IS THAT THE CLOSE STREET NAMES, SO THERE'S WOODHAVEN LOOP. AND THEN THERE'S WOODHAVEN DRIVE. WHAT WE FOUND OUT THAT THERE WILL BE NO ADDRESS NG DONE OFF OF WOODHAVEN DRIVE, SO WE SEE THAT AS A BENEFIT, AND THEN MOST IMPORTANTLY, WE'VE ALSO BEEN COORDINATING AND AGREE THAT THERE CAN BE NO IDENTICAL OR DUPLICATIVE DUPLICATIVE HOUSE NUMBERS THROUGHOUT THE ENTIRE SUBDIVISION BECAUSE WE FIND IN THE PAST THAT'S WHERE WE'VE DEFINITELY HAD CONFUSION IN THE SAME HOUSE NUMBERS. AND SO STAFFS HAPPY TO ANSWER ANY QUESTIONS FROM COUNCIL. THE ONLY QUESTION I WOULD HAVE IS THAT WE DISCUSSED THIS LAST TIME. TALKING ABOUT WOODHAVEN. BEVEL HEIMER ROAD SET TO BE REDONE.

WERE IMPROVED OR. ENHANCED, HOWEVER, YOU WANT TO PUT IT IN THE SPRING. HOW SOON CAN WE GET TO WORK ON THAT ROAD ONLY BECAUSE OF THERE'S SO MUCH TRAFFIC GOING. BORN UP AND BACK TO DOUBLE HAMMER PARK. IN THE SPRINGTIME WHEN THE WRECK BUILDS. INDIRECT TEAMS ARE PLAYING. IT MAY BE A BECAUSE OF CONGESTION THERE OR. YES, THE COMPANY. I'M SORRY. YOU CAN JUST GIVE THE NAME OF THE COMPANY WEB WEB GROUP. THANK YOU. SO WE HAVE SABCO CONTRACT IS DONE ALL THE OTHER WORK OUT THERE AND THAT IS ONE OF THE LAST BIG ITEMS WE HAVE TO DO. A LOT OF IT HAS TO DO WITH ASPHALT PLANTS OPENING. WE'RE STILL WAITING ON SOME FINAL APPROVALS THROUGH THE COUNTY ON THE SIDE. WE'RE REPLACING CULVERTS UNDERNEATH THE DOUBLE HEIMER. WE STILL DON'T HAVE THAT APPROVAL YET, UM SO AS SOON AS WE HAVE THAT, TRUST ME, WE WANTED TO BE DONE AND LOOK GREAT SO WE CAN MOVE ON AND SO I HAVE A BETTER CHANCE OF SELLING IN THERE. UM I WOULD SAY , YOU KNOW, UNFORTUNATELY, IT'S BEST CASE IS GOING TO BE LATER MARCH OR APRIL, WHICH I KNOW IS RIGHT WHEN OBVIOUSLY THE PARK IS GOING TO START BECOMING ACTIVE AS IT'S A PRIORITY TO REALIZE THAT THAT'S A THAT TIME OF YEAR, ESPECIALLY THAT'S A HEAVILY TRAFFICKED ROAD. SURE, I CAN TELL YOU SAFRICA WHEN THEY GET IN, AND THEY STARTED JOB AND THEY GET IN AND GET OUT AND WE WILL PUSH THEM TO, YOU KNOW, DO THAT IMPROVEMENTS ARE JUST PUTTING TURNING LANES IN. IS THAT WHAT YOU'RE DYING? I BELIEVE IT'S A TWO FT. WIDENING. WHERE WERE WE? TO TEAR UP PART OF IT AND REPLACE THE CULVERT. UM THAT IS COMING FROM THE EAST INTO OUR PROJECT, AND THEN I BELIEVE IT'S TWO FT. WIDENING ALONG OUR ENTIRE SECTION IN FRONT OF OUR PROPERTY. THESE ARE TRAIL GOING IN WITH THEM OR NOT. THAT WILL GO INTO THE EXACT SAME TIME ALONG WALNUT IS RIGHT THAT BUBBLE HEIMER AND WALNUT. THANK YOU. THESE LOTS CURRENTLY. FOR SALE. WE OPENED IT UP FOR SALE TWO WEEKS AGO. YES THEY ARE FOR SALE AND STARTING TO GET PEOPLE OUT THERE. IS IT GOING GOOD, GOOD, GOOD ACTIVITY, AND WE'VE GOT 22 MODELS INTO THE PERMITTING DEPARTMENT WAITING ON APPROVALS TO GET THOSE GOING. GREAT. STUFF. ANY OTHER QUESTIONS ON THE ORDINANCE. ALL RIGHT, LET ME GO AHEAD AND OPEN THE PUBLIC HEARING WHEN ANYONE FROM THE PUBLIC LIKE TO SPEAK REGARDING ORDINANCE OH 8 2023. THERE IS NO PUBLIC COMMENT WILL CLOSE. THE PUBLIC HEARING IS VERY EMOTIONAL ON THE ORDER. I MOVE ADOPTION OF ORDINANCE 8 2023. SECOND. COUNCIL MEMBER WILL TROUT. YES, THIS COUNCIL MEMBER DEREK YES. SHELVES YES. YES COUNCIL MEMBER, FELLAS. YES COUNCIL MEMBER BRISK. YES YES, YES. PHONES TO ADOPT COORDINATES. OH, 8 2023. THANKS, BRENT. ORDINANCE 09 2023 NORTHERN'S TO DETERMINE THE ANNUAL COMPENSATION OF THE AMERICAN COUNCIL MEMBERS AND ADDITIONAL SALARY FOR THE MAYOR, PRESIDENT PRO TEM OR DESIGNATED COUNCIL MEMBER PRESIDING OVER MAYOR'S COURT COURT MAZE. APOLOGIES I APPARENTLY FORGOT TO BRING THAT SLIDE ACROSS. YES, BUT CAN I TALK TO YOU ABOUT IT? THIS IS THE ANNUAL ORDINANCE BY

[00:35:04]

WHICH COUNCIL CONSIDERS ITS PAY SECTION 404. THE CITY'S CHARTER AUTHORIZES COUNCIL BY ORDINANCE TO ANNUALLY DETERMINE ITS COMPENSATION. THE CODIFIED ORDINANCE IS NO LONGER REFLECT THE EXACT AMOUNT, BUT THEY DO SAY THAT YOU CONSIDER IT BY ORDINANCE. NO EMERGENCY. THIS FIRST READING WAS ON JANUARY 3RD. THIS IS THE SECOND READING AND THE ORDINATES WILL BECOME EFFECTIVE AFTER THE USUAL 30 DAY REFERENDUM PERIOD. THIS ORDINANCE WOULD INCREASE COUNCIL SALARY ABOUT 5% COMMENSURATE WITH THE ADJUSTMENT THAT CITY STAFF RECEIVED FOR 2023. THE AMOUNTS WERE APPROPRIATED IN THE 2023 BUDGET. ANY QUESTIONS ON THE ORDINANCE. OPEN THE PUBLIC HEARING ANYONE FROM THE PUBLIC LIKE SPEAK REGARDING ORDINANCE 09 2023. THERE IS NO PUBLIC COMMENT WILL CLOSE. THE PUBLIC HEARING IS VERY EMOTION ON THE ORGANS. I MOVED TO ADOPT ORDINANCE 09 2023. SECOND. COUNCIL MEMBER, FELLAS. YES YES, COUNCIL MEMBER. SHALL YES.

COUNCIL MEMBER WILL TRAP YES. MAYOR SPAULDING COUNCIL MEMBER OF RISK? YES YES. SEVEN. YES VOTES TO APPROVE 09 2023. INTRODUCTION AND FIRST READING OF ORDINANCES. I THINK THAT THIS

ACRE CONSERVATION EASEMENT AS REQUESTED BY THE NEW ALBANY COMPANY. THANK YOU, MAYOR. THIS ORDINANCE AUTHORIZES THE ACCEPTANCE OF THE CONSERVATION EASEMENT FROM THE NEW ALBANY COMPANY THAT'S GENERALLY LOCATED EAST OF AVIS AND WEST OF BABBITT. AND NOTE THAT THIS IS JUST OUTSIDE OF THE CITY LIMITS. THIS PROPERTY HAS WATERCOURSES AND WETLANDS UNDER THE REGULATORY JURISDICTION OF THE U. S. ARMY CORPS OF ENGINEERS, AND THIS LEGISLATION IS THE NEXT STEP IN THE PERMITTING PROCESS WITH THE OHIO EPA ANNUAL SUMMIT. U S ARMY CORPS OF ENGINEERS THAT'S REQUIRED BY THE NATIONWIDE PERMIT. THE PERMIT REQUIRES THAT CERTAIN WETLANDS AND BUFFER AREAS PROTECTED AND PERPETUITY BY RECORDING A CONSERVATION EASEMENT. AND THE PUBLIC ENTITY MUST BE THE GRANTEE OF SUCH EASEMENT TO ENSURE THE PURPOSES OF THE EASEMENT IS FULFILLED. THE SEASONING CONTAINS RESTRICTIONS AND TEND INTENDED TO PRESERVE AND PROTECT THE NATURAL INTEGRITY OF THIS AREA AND WITH IT WITHOUT WE'RE HAPPY TO ANSWER ANY QUESTIONS, JUST A FRIENDLY REMINDER WITH A CONSERVATION EASEMENT ARE WE STILL WILL USE ANY SORT OF LIKE PASSIVE PARK FEATURES WITHIN THAT, YOU KNOW, DOWN THE ROAD FROM 70 ACRES, WANTED TO MAKE IT INTO SOME SORT OF TAYLOR FARM TWO POINT OH, UM, BUSINESS PARTNER? YEAH. YES SO GENERALLY AND TOM, YOU CAN CHIME IN HERE. BUT GENERALLY, UM LIKE MAN MADE FEATURES ARE RESTRICTED . UM AND AS FAR AS THE LEISURE TRAIL GOES, THAT MIGHT BE WE'LL HAVE TO HONESTLY DIG INTO THE CONSERVATION PATIENT EASEMENT ITSELF. OKAY LEGISLATION LATER ON ON THE AGENDA WITH ONE WHERE THERE IS A LEISURE TRAIL WITHIN IT THAT WAS TAKEN CARE OF BEFORE. AH THE PLAN WAS GENERATED AND IMPROVED BY THE ARMY CORPS OF ENGINEERS FOR THIS PARCEL, SOMETHING AS ELABORATE AND EXTENSIVE AND TAYLOR FARM. I CAN'T IMAGINE WHATEVER HAPPENED HERE. EXTENDING A ASPHALT LOSER TRAIL ALONG THAT ROAD. I COULD IMAGINE AH, GETTING APPROVAL TO ALLOW SOME TYPE OF MULTIPLE PATHS. MAYBE ACHIEVABLE, BUT CERTAINLY NOT SOMETHING WITH BOARDWALKS AND PLAY STRUCTURES.

BE NICE TO HAVE LIKE A BECAUSE THE BUSINESS PARKS THERE IS THAT THAT WHAT SIDE TO THAT IS THAT GOOGLE PEOPLE INTO THE NORTH IS THE GOLF CLUB. ALSO IMPORTANT TO NOTE THAT THIS IS WITHIN THE NEW ALBANY SCHOOL DISTRICT BOUNDARIES. PERHAPS NOT A PASSIVE PULL OVER WHERE YOU HAVE BENCHES THERE SO FOLKS CAN TAKE A BREAK. AND LOOK, ALAN. ONTO THE UM, YEAH, ALL OF THOSE THINGS WOULD YOU WOULD HAVE TO HAVE REVIEWED AND IMPORTANT BY THE HARMONY KORINE, ETHIOPIA AND THEY ARE VERY YOUNG. RELUCTANT TO ALLOW OR ENCOURAGE ACTIVITY AND ACTIVITY. OKAY? WE HAVE SEVERAL OF THESE NOW. I THINK THIS MAY BE THE THIRD OR THE FOURTH AND THERE IS NO LIABILITY TO THE CITY. SO IT'S THE PROPERTY OWNER WERE TO COME IN AND DO SOMETHING THAT WOULD VIOLATE THE TERMS OF THE EASEMENT AGREEMENT. THE CITY WOULD HAVE HAVE NO OBLIGATION TO TAKE ANY TYPE OF ENFORCEMENT ACTION OR BE RESPONSIBLE FOR ANY REMEDIATION AND WE TAKE CONTROL OF THESE PROPERTIES. IS THAT WHAT I UNDERSTOOD OR NOT? WE HAVE OVERSIGHT OF THE OF THE OF THE PRESERVATIONIST, BUT THAT'S IT. I'VE GOT ANOTHER QUESTION IF I CAN NOT TO DELAY MATTERS ANY

[00:40:06]

FURTHER. UH WHEN WE SAY, FOR EXAMPLE, BECAUSE WE'RE TALKING ABOUT CONSERVATION. DEVELOPER COMES IN. DO A PROJECT AND THEY HAVE TO REMOVE TREES IN ORDER TO COMPLETE THAT PROJECT. WE HAVE ANYTHING WITH THE DEVELOPER WOULD THEN HAVE TO REPLACE TREES OR MY TREES SO THAT THEY CAN. GO SOMEWHERE SO THE CITY CAN PUT THEM SOMEWHERE ELSE. ADDITIONAL NO. OKAY? THANK YOU. ALRIGHT ANY OTHER QUESTIONS ON THE ORDINANCE? GO AHEAD AND SET THAT FOR SECOND READING AT OUR MEETING ON FEBRUARY 7TH. ORDINANCE 0 11 2023 ORDINANCE TO ACCEPT A 0.666 ACRE CONSERVATION EASEMENTS REQUESTS ABOUT THE NEW ALBANY COMPANY. THANK YOU, MAYOR. THIS ORDINANCE AUTHORIZES THE ACCEPTANCE OF CONSERVATION EASEMENT FROM THE NEW ALBANY COMPANY THAT'S GENERALLY LOCATED SOUTH OF GETTING PARKWAY. AND WEST OF BEACH ROAD AND FRANKLIN COUNTY. THIS CONSERVATION NEEDS MET IS CONTINUOUS TO ANOTHER CONSERVATION EASEMENT AREA. THAT'S UP NEXT, SO IT'S A IT'S A PART OF A LARGER ONE. THIS ONE BEING IN FRANKLIN COUNTY, THE ONE YOU'LL HEAR NEXT IS IN LOOKING COUNTY. AND JUST LIKE THE ONE THAT I HAD JUST READ. THIS PROPERTY HAS WATERCOURSES AND WETLANDS UNDER THE REGULATORY JURISDICTION OF THE OHIO EPA. A THIS LEGISLATION IS THE NEXT STEP AND THE PERMITTING PROCESS WITH THAT AGENCY REQUIRED BY THE LEVEL THREE ISOLATED WETLANDS PERMIT. AND, UM. THIS USE MINT CONTAINS RESTRICTIONS INTENDED TO PRESERVE THE NATURAL INTEGRITY OF THIS AREA. BE HAPPY TO ANSWER ANY QUESTIONS. ALL RIGHT. ANY QUESTIONS ON THE ORDER, AND SO 11? THEY WILL SET THAT FOR A SECOND READING OR MEETING ON FEBRUARY 7TH ORDINANCE. 12 2023 NORTHERNERS TO ACCEPT A 42.374 ACRE CONSERVATION EASEMENT AS REQUESTED BY THE NORTHERN COMPANY. THANK YOU, MAYOR. AND SO THIS IS, UM KIND OF THE SECOND PART OF THIS CONSERVATION EASEMENT. THIS IS THE BIGGER PORTION UM, CONTINUOUS TO THE ONE THAT I HAD JUST READ, UM, SO VERY SIMILAR TO THE OTHER ONES. THIS ONE IS ALSO, UM, UNDER THE REGULATORY JURISDICTION OF THE OHIO EPA, AND IT'S A PART OF THAT SAME LEVEL THREE ISOLATED WETLANDS. PERMIT UM, SO THE EASEMENT CONTAINS THE SAME RESTRICTIONS THAT ARE MEANT TO PRESERVE THE NATURAL INTEGRITY OF THIS AREA. AND WITH THAT, I'M HAPPY TO ANSWER ANY QUESTIONS.

THAT IS THAT IN THE NEW OPEN SCHOOL DISTRICT AS WELL, I THINK IT'S JUST OUTSIDE, RIGHT. YEAH, OKAY. THAT'S A NICE TREE STANDARD PRESERVED. ALL RIGHT. ANY AND AGAIN. PRIME PARK SEEMS SIMILAR QUESTIONS. I MEAN, THIS IS AN EPI, A THESE MEN ARE THE RESTRICTIONS QUITE AS RESTRICTIVE AS THE ARMY CORPS. THESE UM SO SOMETIMES THE ARMY CORPS ONES ARE ASSOCIATED WITH WETLANDS AND THINGS LIKE THAT WOULD BE A LITTLE BIT MORE RESTRICTIVE. BUT THIS ONE SIMILAR TO THE OTHER ONES ON THE AGENDA TONIGHT HAVE THOSE SAME RESTRICTIONS FOR MAN MADE STRUCTURES AND THAT, OKAY? ALRIGHT AGAIN, IT'S SEEMING 40 ACRES. NICE TREE STAND, YOU KNOW, SURROUNDED BY INDUSTRIAL USE MIGHT AGAIN. DOWN THE ROAD MIGHT LOOK AT THAT FOR SOME SOME RECREATIONAL OPPORTUNITIES WITHIN THE EASEMENT RESTRICTIONS. ORDINANCE 0 13 2023. NORTHERN'S TO EXCUSE ME, UH, ANY OTHER QUESTIONS ON THE ORDINANCE THAT FOR A SECOND READING OR MEETING ON SECRETARY FEBRUARY 7TH ORDINANCE 0 13 2023 ORDINANCE TO ACCEPT A 9.417 ACRE CONSERVATION EASEMENT, AS REQUESTED BY ROMANELLI IN HOUSTON BUILDING COMPANY. THANK YOU, MAYOR. THIS ORDINANCE AUTHORIZES THE ACCEPTANCE OF A CONSERVATION EASEMENT FROM ROMANELLI AND HUGHES COMPANY. UM AND IT IS GENERALLY LOCATED SOUTH OF EAST DUBLIN, GRANVILLE AND WEST OF HARLEM, RHONE THIS CONSERVATION EASEMENT IS CREATED. OR SORRY, IS REQUIRED BY THE CONDITIONAL APPROVAL OF THE STORM. WATER DRAINAGE MANUAL TYPE THREE VARIANTS REQUEST THAT WAS ISSUED TO ROMAN ELLEN HUGHES BY THE CITY OF COLUMBUS. AS A CONDITION OF THIS PERMIT AND RELATED APPLICATION MATERIALS. WATERCOURSE AND ADJACENT AREAS MUST BE PROTECTED BY THE CONSERVATION EASEMENT, AND THIS AGREEMENT IS INTENDED TO SATISFY THIS CONDITION. PUBLIC ENTITY MUST BE THE RECIPIENT OF SUCH EASEMENT TO ENSURE THAT THE PURPOSES OF THE EASEMENT ARE FULFILLED. AND VERY SIMILARLY, THE EASEMENT CONTAINS RESTRICTIONS. AND THAT WE'RE

[00:45:03]

HAPPY TO ANSWER ANY QUESTIONS. GO AHEAD EXAMPLE WHERE. THE ASPHALT SAMPLE ON THE SOUTH SIDE OF DUBLIN. GRANVILLE ROAD WAS INSTALLED AS PART OF THIS PERMIT APPLICATION YOU MAY HAVE NOTICED DRIVING BY THEIR RECENTLY THERE WAS A VERY SIGNIFICANT PLANTING THAT WAS INSTALLED WITHIN THE PADDOCK SPACE. ALONG DUBLIN GRANVILLE ROAD AS WELL. THAT WAS ALSO PART OF THE PERMIT APPLICATION DEPLOYMENT. TREE PAINTING OR WHAT KIND OF YEAH, IT'S PROBABLY LIKE 30 OR SOMETHING IN THERE LOT MORE MORE THAN IT WAS. IT WAS OPEN MEADOW WEST SIDE OF IT WILL NOW TURN INTO WHAT FORCED TO THE AREAS ARE THE PLANTING IS IDENTICAL TO WHAT HE DID IN THE TOGETHER FORMING PERSON. YEAH. IS THIS PROPERTY COLUMBUS? YEAH. SO. DOES IT MAKE SENSE THAT IT'S APPLIED TO BEAR CONSERVATION HERE? STAFF OF COLUMBUS. SO THE APPLICANT CAN CHOOSE ANY PUBLIC ENTITY. UM THAT'S BECAUSE. IT FEELS LIKE EVEN THOUGH THE COLUMBUS BOUNDARY KIND OF LEAVES IN AND OUT OF THIS AREA FEELS LIKE IT'S PART OF NEW OPENING. OKAY? WE COULD CERTAINLY ASK COLUMBUS THAT THEY WOULD BE INTERESTED. YEAH I THINK CHARLENE'S ANSWERED THE QUESTION . THE PROPERTY OWNER HAS THE RIGHT TO TAKE EASEMENT WHEREVER THEY WANT. AH WE THOUGHT IT MOST PERFECT TO BRING TO ALBANY IS GOING TO HAVE CLOSED OUR EYES AND EARS ON IT. IN THE CITY OF COLUMBUS. IF SOMETHING WERE TO HAPPEN OR SO WE HAVE JURISDICTION OVER BECAUSE WE ARE ALLOW CREATION IS CORRECT. SO WE HAVE THAT CIRCUMSTANCE ANYWHERE ELSE CORRECTLY. MAYBE ON MORSE ROAD. SO. ONE EARLIER TONIGHT. THIS WOULD BE YEAH, THE WHILE THOSE AREN'T IN THE CITY OF COLUMBUS. THEY'RE NOT IN THE CITY OF RIGHT ROAD. I DON'T THINK THOSE HAVE THE SAME EASTMAN RESTRICTION TO PRESERVE BUT IT IS WITH THE CITY. COLUMBUS. YOU'RE RIGHT. OKAY? SO THOSE OTHER ONES COULD POTENTIALLY GO TO PLAIN TOWNSHIP. THAT'S WHAT I GUESS THERE IS IN BETWEEN THE TOWNSHIP PROPERTY MAKES SENSE. DIDN'T KNOW. LIKE CITY COLUMBUS IS A LITTLE BIT DIFFERENT. TOWNSHIP. AND JUST TRYING JUST DESERVES A STRING THAT GOES THROUGH THAT.

YES. NAME BASICALLY RIGHT ALONG THE RIGHT LINE ON THE RIGHT SIDE. CORRECT THAT'S CORRECT.

JUST ALONG THERE WERE IN BRITISH EXTRA THREE. OKAY. GREAT LEISURE TRIAL BRIDGE THERE. ON THE OTHER SIDE OF THE ROAD ON THE SOUTH SIDE. AH THAT WAS THAT ORIGINALLY IS WERE THERE LEAVE YOUR TRAIL JUST KIND OF WENT DOWN INTO NOWHERE NORTH SOUTH SIDE TALKING ABOUT SOUTH SIDE THERE WITH THE LOSER TRUCK. THEY WERE GOING TO PUT A BRIDGE OVER THAT. YOU'RE TALKING ABOUT THE GREEN MILL? YEAH. ON THE NORTH SIDE OF THIS SOUTH OF THE ROOM. MHM YEP. SAME PLACE NOW, LIKE IT'S NOT ON THE SOUTH SIDE OF INVESTMENT. GOT IT. ALRIGHT ANY OTHER QUESTIONS ON ORDINANCE 13 . WE'LL SET THAT FOR SECOND READING OUR MEETING ON FEBRUARY 7TH. RESOLUTIONS AND PUBLIC

[11. RESOLUTIONS AND PUBLIC HEARING]

HEARING RESOLUTIONS ARE OH 6 2023 OF RESOLUTION APPROVING AUTHORIZING THE EXECUTION OF AN AMENDMENT TO DEVELOPMENTS PLAY AGREEMENT WITH NEW ALBANY DATA CENTER SPE L L C THANK YOU, MAYOR. SO LET'S CITING QUESTION IS AN AFFILIATE OF THE LINCOLN PROPERTY COMPANY THAT IS DEVELOPING THE SITE OUTLINED IN RED SHOWN ON THE MAP HERE, SO JUG STREET ON THE SOUTH SIDE AND THEN BEACH ROAD JUST TO THE WEST OF THE SITE. SO I'LL SKIP. ACTUALLY, THIS ONE GOES STREET HERE. SO THIS IS THE SITE SHOWN HERE IN THE DARK COLORED AREA, SO THE SITE IS CURRENTLY SERVED BY A SINGLE CALLED A SACK. THAT'S A PUBLIC STREET CALLED HORIZON COURT, AND, UH AS COUNSEL MIGHT RECALL WHEN THIS CAME TO COUNCIL, UH, THINK MAYBE A YEAR OR TWO AGO, THERE ACTUALLY WAS SOME DISCUSSION AND CONTEMPLATION. ON A EXTENSION GOING TO THE EAST. AND SO THAT'S SCHEMATIC STREET CONNECTION IS SHOWN IN RED HERE. BUT SINCE THE HORIZON COURT, PLATT WAS APPROVED BY CITY COUNCIL, A LOT HAS CHANGED IN THE BUSINESS PARK . SO WITH THE ANNOUNCEMENT OF

[00:50:01]

INTEL AND THE NEW HARRISON ROAD EXTENSION WE HAVE BEEN ABLE TO THE CITY'S BEEN ABLE TO PARTNER WITH LINCOLN PROPERTY COMPANIES IN ORDER TO DO THIS DSA AMENDMENTS. AND SO THE PRIMARY PURPOSE OF THIS DSA AMENDMENT IS TO PROVIDE THE CITY ADDITIONAL RIGHT OF WAY. UTILITY AND STREETSCAPE G. ZEMAN'S FOR A FUTURE PUBLIC STREETS THROUGH THEIR SITE SHOWN HERE IN ORDER TO CONNECT HORIZON. COURT OVER TO HARRIS AND ROAD EXTENSION. SO THE COMPANY OR COMPANIES AGREED TO CONVEY RIGHT OF WAY AND EASEMENTS AT NO COST TO THE CITY , AND IN EXCHANGE, THE CITY AGREES TO DESIGN CONSTRUCT AND PAY FOR WHAT WE'RE CALLING THE HORIZON COURT STREET EXTENSION TO THE EAST. AND SO THIS INFRASTRUCTURE IMPROVEMENT IS PART OF THE CITY'S OVERALL INFRASTRUCTURE IMPROVEMENT PACKAGE AS RELATED TO THE INTEL PROJECT. HAPPY TO ANSWER ANY QUESTIONS. WHEN THAT SITE WAS INITIALLY CAME TO DID YOU SAY THAT'S GOING TO BE A. PARDON WAREHOUSE WAREHOUSE. SO BECAUSE YOU SAID DATA CENTER, BUT IT IS A MIXTURE OF BOTH DATA CENTERS AND WAREHOUSES. OKAY? USED IN THIS WAY IT WAS GOING TO BE ALL THE WAREHOUSES. MAYBE NO. THEY DIDN'T KNOW IT COULD HAVE BEEN EITHER. DIDN'T THEY SEE THAT THEY HAVE A NATIONALLY? WE KNOW WHAT DATA CENTER WHO'S GOING TO MANAGE THE DATA CENTERS. THEY DON'T KNOW. THEY'RE JUST PROPERTY. THEY'RE JUST DEVELOPERS, SO THEY'RE NOT NECESSARILY BUILDING THE BUILDINGS. THEY'RE TRYING TO FIND COMPANIES THAT WOULD WANT TO EITHER LEASE BUILDINGS OR BUILD THEIR OWN. INTO I THINK THEY WANTED SOME FLEXIBILITY. THERE ARE NATIONAL FIRM. THIS IS THEIR FIRST TIME DOING WORK FOR SURE. IN CENTRAL OHIO AND I THINK IN THE STATE OF OHIO, AND THEY HAVE A PRETTY ROBUST DATA CENTER PORTFOLIO GROUP WITH COINS. THEY'VE WORKED WITH ALL OVER THE COUNTRY, AND THEN THEY ALSO HAVE SPECIALIZED IN MANUFACTURING AS WELL. SO I THINK THEY WANTED TO KEEP THEIR OPTIONS OPEN. AND WE, UM ZONING ALLOWS FOR THEM TO DO THAT, AND SEEMS TO MAKE A LOT OF SENSE. WE'RE REALLY HAPPY THAT THEY WERE WILLING TO WORK WITH US.

BECAUSE IF YOU IF YOU RECALL PLANNING COMMISSION NOBODY WAS REAL HAPPY ABOUT THIS SUPER LONG CALLED A SAG HEADING INTO THE SITE AND JUST TERMINATING THERE, AND SO THE FACT THAT THEY ARE WILLING TO DEDICATE RIGHT AWAY AND WORK WITH US TO MAKE THAT ROAD CONNECTION. ESPECIALLY AFTER THE FACT WE'RE PRETTY THANKFUL ABOUT THAT SECOND ALBUM, BECOMING A TRAFFIC CIRCLE. CHIEF YES, ESSENTIALLY. YEAH, IT WILL ACT AS REALLY LIKE AN INTERSECTION OF TWO WAY INTERSECTION HERE BUT WILL REMAIN SORT OF AROUND IT CALLED A SACK SHEEP IN ORDER TO ALLOW FOR ACCESS TO THESE OTHER BUILDINGS. I KNOW THE PLANNING COMMISSION. THEY TALKED ABOUT EMERGENCY VEHICLES BEING ABLE TO ACCESS THAT CIRCLE. I'M ASSUMING THAT THIS ACTUAL ROAD CONNECTIONS PROBABLY HELPED THAT SO THAT THAT'S A GOOD THING. ABSOLUTELY THAT WAS THE DOTTED LINE. IT'S NOT PART OF THIS DISCUSSION. BUT IS THAT TOO SHOWING POTENTIAL FUTURE EXTENSION? THEN, AS WELL, THAT'S RIGHT. THAT'S SHOWING A DESIRED FUTURE EXTENSION TO THE EAST IN ORDER TO CREATE ADDITIONAL CONNECTIVITY AND CONNECTIONS OVER TO CLOVER VALLEY ROAD FROM HARRISON ROAD EXTENSION. OKAY? ANY QUESTIONS ON THE RESOLUTION. WE'LL OPEN THE PUBLIC HEARING ANYONE FROM THE PUBLIC LIKES TO SPEAK REGARDING RESOLUTION R 06 2023. HEARING NO PUBLIC COMMENT WILL CLOSE THE PUBLIC HEARING. YOU'RE A MOTION ON THE RESOLUTION OF ADOPTION RESOLUTION R 06 2023. COUNCIL MEMBER CHARLOTTE COUNCIL MEMBER KISS. YES COUNCIL MEMBER FELLOWS ? YES YES, YES. YES YES. COUNCIL MEMBER WILL TRAP YES. SEVEN. YES VOTES TO THAT RESOLUTION. R 06 2023. RESOLUTION ARE 7 2023 I RESOLUTION TO APPROVE A FEE PAYMENT IN LIEU OF LEISURE TRAIL CONSTRUCTION AND ACCORDANCE WITH CODIFIED ORDINANCES SECTION 1165.6. AND 1187.18 AT 589 TO JOHNSTOWN ROAD AS REQUESTED BY MEMBER HOMES. MR MAYOR. THANK YOU VERY SWOLLEN. SO THE CITY CODE STATES THAT A PAYMENT IN LIEU OF TRAIL CONSTRUCTION MAY BE CONSIDERED WHETHER SPECIAL CIRCUMSTANCES AND IT GOES, GOES ON TO SAY THAT A PAYMENT IN LIEU OF CONSTRUCTION MAY BE PERMISSIBLE WHEN A TRAILS FOUND BY COUNSEL TO NOT BE APPROPRIATE DUE TO ONE OF THE FOLLOWING CONDITIONS. SO THE FIRST THING THAT THE LEISURE TRAIL IS IMPRACTICAL DUE TO TOPOGRAPHIC CONDITIONS OR SECOND STRAINS, OR THE SECOND IS THAT WE SHOULD TRAILS DO NOT EXIST IN THE AREA.

THERE IS NOT A LIKELIHOOD FOR TRAILS TO BE CONSTRUCTED IN THE NEAR FUTURE, AND THAT A FAMILY WOULD BETTER SERVE THE COMMUNITY RATHER THAN A TRAIL BEING INSTALLED AT THIS LOCATION. AND

[00:55:03]

SO THE SITE WE'RE LOOKING AT TONIGHT IS LOCATED IN WHAT WE CALL THE EAST OF ASHTON NEIGHBORHOOD, SO IT'S LOCATED OUTLINED HERE IN RED AND SO THE CITY STAFF HAS REVIEWED THEIR REQUESTS AND OFFERS THE FOLLOWING INFORMATION FOR COUNCIL'S CONSIDERATION. SO THERE DOES NOT APPEAR TO BE ANY TOPOGRAPHIC CONSTRAINTS, AND IT DOES APPEAR THAT THE TRAIL COULD BE INSTALLED USING CONVENTIONAL CONSTRUCTION MEANS AND METHOD. THE PROPERTY TO THE SOUTH AT 5886 HAD A LEISURE TRAIL PAYMENTS APPROVED BY COUNCIL BACK IN NOVEMBER OF 2020 FOR ITS FRONTAGE LOCATED RIGHT HERE. SO AND THE SUBJECT PROPERTY LOCATED AGAIN TO THE NORTH OUTLINED IN RED. THERE IS LUGER TRAIL ACROSS THE STREET TODAY SHOWN ARE INDICATED BY THE ORANGE LINE, AND THAT'S APPROXIMATELY 90 FT AWAY ACROSS THE STREETS OF THE NEXT LOCATION, WHERE THERE IS LEISURE TRAIL ON THE EAST SIDE OF US 62 HERE WOULD BE UP NEAR THE MARKET DOMAIN APARTMENTS JUST OFF TO THE NORTH. AND THEN TO THE SOUTH. I BELIEVE IT'S NOT UNTIL YOU HIT FENWAY OR THE GREENSWARD ROUNDABOUT TO THE SOUTH ALONG THE EAST SIDE THERE. SO THE APPLICANT IS REQUIRED TO SUBMIT THREE UM. CONSTRUCTION ESTIMATES FOR THE COST OF LEISURE LEISURE TRAIL CONSTRUCTION HERE. THE CITY ENGINEER HAS REVIEWED THAT AND BASED ON CURRENT BID TABULATIONS AND RECENTLY CONSTRUCTION PROJECTS, THE CITY ENGINEER ESTIMATES THE COST OF CONSTRUCTION TO BE A 53 FT PER LINEAR FOOT. AND SO THE PROPERTIES STREET FRONTAGE TOTALS, 174.5 FT AND THAT DOES NOT INCLUDE ITS DRIVEWAY. AND SO THE CITY ENGINEERS RECOMMENDS THAT AN APPROPRIATE FEE PAYMENT FOR LEISURE TRAIL HERE WOULD BE A TOTAL OF 9249. HAPPY TO ANSWER ANY QUESTIONS FROM COUNCIL. HOW MANY HOMES ARE THEY EXPECT TO PUT IN THAT SITE IS THAT ONE YES . SO THIS IS ONE HOMESITE RIGHT HERE. THERE'S A SECOND HOME SITE JUST TO THE SOUTH AND EAST OF ASHEN. AND THEN THERE'S ONE VACANT LOTS TO THE THIRD ONE DOWN, BUT I BELIEVE THAT ONE IS ALSO OH, OH, YOU'RE RIGHT. I'M SORRY. THANK YOU, TOM. YEAH. SO THE PROPERTY OWNER HERE? YEAH, HAS PURCHASED BOTH THESE PROPERTIES OF ALL THOSE PROPERTIES. THERE WOULDN'T BE.

WOULDN'T IT BE WISE TO HAVE LEISURE TRAIL? THE GIRLS FROM THE NORTHERN PROPERTY. DOWN. TO TWO. AND WORKED YET. WELL ON ON THE WEST SIDE, JUST SO PEOPLE COMING OUT OF THOSE NEIGHBORHOODS CAN GET DOWN AND CROSS OVER THERE. MAYBE MAYBE NOT. WE ONLY THREE HOUSES AND WHATNOT. YEAH, ABOUT FOUR. YEAH. AND. SO WE IF WE WANT TO COME BACK AT A LATER DATE, WE SAW HIM RIGHT AWAY. TOTALLY YOUR BATH ON THIS PROPERTY AND THE OTHER ONES TO THE SOUTH. THAT IS CORRECT.

AND I THINK WE TALKED ABOUT THAT WHEN WE WERE LOOKING AT THOSE FURTHER NORTH. WE DIDN'T WHEN WE GET CLOSER TO MARKET CENTER. WE DO NOT HAVE RIGHT AWAY TO PUT LASER PATH THEY'RE CURRENTLY DOING THAT IS ALSO CORRECT. YEAH I UPON IT'S A LITTLE HARD TO SEE HERE. BUT THE THERE IS, THIS LINE HERE IS SHOWING THE RIGHT OF WAY DEDICATION, SO IT IS DEDICATED HERE AND THEN YOU CAN KIND OF SEE THE LINE GOES TO THE CENTER LINE OF THE ROAD, SO IT'S RIGHT ABOUT. I THINK AT THIS POINT JUST NORTH OF THIS PROPERTY WE HAVE WE'RE PROPERTY STARTS GOING TO THE CENTER LINE OF THE ROAD. SO THE CITY WOULD NEED ADDITIONAL RIGHT OF WAY COMMITMENTS REALLY? PRETTY MUCH FROM THE NORTH OF THIS SITE ALL THE WAY TO THE BEGINNINGS OF RICHMOND SQUARE, THE VILLAGE CENTER IN ORDER TO LOCATE ALICIA TRAIL ON THE EAST SIDE OF 62. AS MUCH AS I'D LIKE TO HAVE ONE THERE. AT LEAST WE'VE GOT THE BELIEVE EIGHT FT. ONE ON THE OTHER SIDE, SO I CAN IMAGINE SOME FUTURE DATE WE WOULD HAVE WON THEIR THOUGH. THIS INTO TOWN. MY OWN CONCERN, DRAGGING IT NORTH AND NOW YOU'VE CREATED A MID BLOCK CROSSING TO YEAH. WHICH I'D RATHER FOLKS HAVE TO GO SOUTH AND THE TUNNELS RIGHT DOWN THE STREET. UM. CORRECT ANY OTHER QUESTIONS ON THE RESOLUTION. OPEN THE PUBLIC HEARING. WOULD ANYONE FROM THE PUBLIC LIKE TO SPEAK REGARDING RESOLUTION ARE SEVEN. NO PUBLIC COMMENT WILL CLOSE THE PUBLIC HEARING EMOTION ON THE RESOLUTION. I MEAN, FOR THE ADOPTION OF RESOLUTION ARE 7 2023 2ND. COUNCILOR PRECAST YES.

BREAST? YES, MEMBERSHIP. YES TRAP? YES MAYOR SPOTTING? YES COUNCIL MEMBER, DEREK? YES

[01:00:02]

REMEMBER, FELLAS? YES SEVEN. YES VOTES TO THAT RESOLUTION ARE 7 2023. RIGHT ANYONE CARE TO MAKE THE STANDING COMMITTEE REPORT. REPORTS OF REPRESENTATIVES JOE ANY UPDATES FROM ORBISON, NO

[13. REPORTS OF REPRESENTATIVES]

MEANING IT'S A ANY UPDATE FROM THE JOINT PARKS. AH THEY HAD A MEETING, BUT REALLY NOTHING PERTAINS TO THE CITY. ALRIGHT ANY UPDATE FROM NEW ALBANY PLAYING LOCAL SCHOOLS? YES THERE WAS A SCHOOL BOARD MEETING ON JANUARY 9TH. THEY HAD THEIR ORGANIZATIONAL MEETING. DEBBIE KALINOWSKI WAS RE ELECTED PRESIDENT IN PALM HIM OFF WAS RE ELECTED AS VICE PRESIDENT FOR THE UPCOMING YEAR. THE REGULAR MEETING. THERE WAS QUITE A BIT OF PUBLIC PARTICIPATION REGARDING THE PRONOUN PARTY AGAIN. AH THE ONLY CHANGE IN THAT PARENTS CANAL GIVE PERMISSION TO CHANGE THEIR STUDENTS PRONOUNS IN POWER SCHOOL, SO IT DOESN'T HAVE TO NECESSARILY BE A WRITTEN EMAIL OR ANYTHING TO THE SCHOOL. THEY CAN DO IT ONLINE. BUT IT STILL HAS TO BE DONE BY THE PARENT. SO THAT'S THE ONLY UPDATE. REGARDING THE POLICY. THE REST OF THE MEETING WAS PRETTY, UH, LOW KEY UM, THERE WASN'T BETTER NEWS THAT JUST CAME OUT. YOU GUYS MIGHT HAVE SEEN THE LAST COUPLE OF DAYS. MIKE BUSH HAS STEPPED DOWN AS SCHOOL BOARD MEMBER. EFFECTIVE JANUARY 15TH SO SCHOOL BOARD WILL BE. BEGINNING THE PROCESS OF APPOINTING ANOTHER MEMBER IN THE NEXT MONTH OR SO. AND THAT'S IT FROM SCHOOLS. ALL RIGHT, MR. DARKENING UPDATE FROM THE TOWNSHIP TOWNSHIP DIDN'T MEET ON FOURTH GENERAL BUSINESS, TOO.

THINGS HAVE NOTE THEY PROVED THEIR PAYMENTS TO THE SUPPORT OF THE MCCOY CENTER OR REPAIRED AND MAINTENANCE. APPROXIMATELY $25,000 A SHAMELESS $50,000 TO THE EMPATHY CONSTRUCTION COMMITMENTS. 2023. RIGHT, THAT WAS IT. REPORT OF CITY OFFICIALS . MAYORS UPDATE WILL BE

[14. REPORTS OF CITY OFFICIALS]

ATTENDING THE U. S CONFERENCE OF MAYORS AND WASHINGTON. SEE TOMORROW THURSDAY AND FRIDAY.

ONE OF THE AGENDA ITEMS IS THE EXPLOSION PICKLEBALL SOME EXTRA AND BRING THOSE MATERIALS BACK FOR COUNCIL MEMBER SHORT. MAKE SURE WE'RE GETTING THE LATEST GREATEST UPDATE ON PICKLEBALL.

UH ALL JOKING ASIDE ANY ANYTHING ELSE FROM THE CONFERENCE? THAT LOOKS INTERESTING. I'LL MAKE SURE AND DISTRIBUTE THE COUNCIL MEMBERS SO EVERYONE CAN PARTAKE IN THE INFORMATION THAT GETS EXCHANGED. UH WE DID HAVE A COMMON MEETING LAST WHAT LAST WEEK. IT WAS HOSTED BY MORE BUSY JUST SOME UPDATES FROM SOME OF THE ACTIVITY OF THE GENERAL ASSEMBLY. UM SOME CONCERN ABOUT SOME CHANGES TO TAXING STRUCTURES IN OHIO, INCLUDING MUNICIPAL INCOME TAX. CERTAINLY SOMETHING WORTH WATCHING. AN UPDATE ON GOVERNOR DEWINE'S VETO OF THE LIMITATION ON MUNICIPALITIES ABILITY TO LIMIT THE SALE. OF CERTAIN VAPING PRODUCTS. PARTICULARLY FLAVORED VAPING PRODUCTS. CITIES STILL HAVE THAT RIGHT? UNLISTED GENERAL SIMPLY MOVES TO OVERTURN THE GOVERNOR'S VETO OR PASSES ADDITIONAL LEGISLATION. UM UPDATE ON AN TRACK AND ITS INTEREST IN IN OHIO AND THE POSSIBILITIES OF RAIL CONNECTIONS BETWEEN. PITTSBURGH, CINCINNATI, COLUMBUS TO CHICAGO. SOUNDS LIKE THERE'S ACTUALLY SOME TRACTION. INTEREST AT THE GOVERNOR'S OFFICE IN THAT, PERHAPS MOVING FORWARD, SO THAT'S ENCOURAGING NEWS. UM AND IT'S NOT JUST YOU KNOW, THE OLD THREE C CONNECTION, WHERE WOULD BE A 30 MILE AN HOUR AVERAGE SPEED. THESE ARE GOING TO BE HIGH SPEED TRAINS WILL NOT BE A LOT OF INFRASTRUCTURE IMPROVEMENTS FOR THAT TO HAPPEN. EXISTING TRICK OR NEUTRAL. A LITTLE BIT ABOVE. IT DEPENDS. I THINK THE HOPE IS THAT IF THEY DO THAT THREE C CONNECTION, IT WILL BE ALL NEW, HIGH SPEED RAIL WITH THE SPEEDS OVER 100 MILES AN HOUR, SO YOU KNOW IT DOESN'T TAKE YOU THREE HOURS TO GET TO CLEVELAND AND YOU CAN DRIVE YOUR CAR AND 45. SO I WANNA MAKE IT COMPETITIVE WITH WITH AUTOMOTIVE TRAFFIC AS WELL. SO WE'LL SEE. AND WE'LL KEEP YOU UPDATED ON THOSE THINGS AS THEY COME ABOUT.

IT'S ABOUT ALL I HAVE ANY UPDATE FROM THE CLERK JUST THAT I HAD WITH YOUR ELECTRONIC PACKETS SENT OUT THE COUNCIL RULES WITH THE UPDATES THAT YOU GUYS MADE ON THE FLOOR AND IF YOU DON'T HAVE ANY OBJECTION, I WILL GIVE THIS TO THE MARRIAGE DECIDE TONIGHT. HMM. GREAT. THAT'S IT FOR ME FROM THE FINANCE DIRECTOR. YES UM, I HAVE HANDED YOU OUT THE SHORTENED DECEMBER MONTHLY REPORT. AND IT HAS A COUPLE MORE PAGES THAN USUAL. I'LL GO OVER WITH YOU AND I PUT

[01:05:07]

PAGE NUMBERS ON THE BOTTOM. SO I'M HOPING THAT I'VE MADE SOME IMPROVEMENTS THAT WILL THAT WILL HELP IN THIS REVIEW. SO THE FIRST PAGE IS THE NORMAL GENERAL FUND REVIEW. WE FINISHED THE YEAR. ABOUT 103% ABOVE OUR PROJECTIONS FOR REVENUE, WHICH INCLUDE OUR PROJECTIONS FOR INCOME TAX. THE AMENDED BUDGET FOR INCOME TAXES AMENDED THAT BACK IN SEPTEMBER. SO I THINK WE'RE PRETTY, UM, BEING IN LINE WITH THAT WAS A GOOD, UM OUTCOME. WE DID. END UP BRINGING IN LESS THAN INCOME TAX IN THE GENERAL FUND BY ABOUT 200,000, BUT IT IS A MUCH BETTER PICTURE COMPARED TO WHAT WE ORIGINALLY PROJECTED. SO GENERAL FUND DID WELL WITH THAT. WITH THAT BEING SAID, WE HAVE UM, LAPSED ABOUT 12% OF OUR APPROPRIATIONS WITHIN THE GENERAL FUNDS. SO WHILE OUR OPERATIONS AND EXPENSES WE PROJECTED TO BE MORE AND THEY WERE MORE, WE WERE ALSO WITHIN OUR PREPARATIONS AND WERE ABLE TO ADD THAT BACK TO THE FUND BALANCE. UM. DOWN AT THE BOTTOM FOR THE INCOME TAX BREAKDOWN JUST TO GET FURTHER INTO THAT WITH HOLDINGS. ARE WHAT DECREASED PRIMARILY, AND THE NUT PROFITS AND INDIVIDUALS ACTUALLY , UM, INCREASED FROM PRIOR YEARS . WITHHOLDING LIKE IS LESS, UH, IMPACTS FROM REMOTE WORK. MET IT AGAINST INCREASED CONSTRUCTION.

UM WE ANTICIPATED THAT WITH OUR PROJECTIONS, SO. THE NEXT PAGE. GETS IN THE INCOME TAX A LITTLE BIT FURTHER, AND THIS IS SOMETHING THAT I ONLY PRESENT A COUPLE OF TIMES A YEAR, BUT SHOWING UM, THIS I APOLOGIZE FOR HOW SMALL IT IS. THE VERY TOP LINE SHOWS WHAT OUR ACTUAL COLLECTIONS WERE WITHIN THE GENERAL FUND DURING 2022. AND YOU CAN SEE WE WERE OVER BUDGET FOR THAT. UM JUST TAKE A LOOK AT THE NEXT TWO LINES THREE YEAR FORECASTED COLLECTIONS AND THE FIVE YEAR FOURTH CLASSIC COLLECTIONS. THIS PARTICULAR WORKBOOK. OUR WORKSHEET ESTIMATES IF WE WERE IN LINE WITH THE LAST THREE YEARS, ON AVERAGE OF THE LAST FIVE YEARS, ON AVERAGE, THAT'S WHAT WE WOULD HAVE PROJECTED. SO ULTIMATELY WE DID COME IN LESS THAN WHAT THOSE PROJECTIONS WERE, BUT IT WAS STILL AGAIN MORE THAN WHAT WE ANTICIPATED. SO. AND THIS I KNOW IS A PRETTY BUSY WORKSHEET. IF YOU GUYS HAVE QUESTIONS ON IT. AFTER ABLE TO REVIEW IT MORE, UM, CERTAINLY REACH OUT TO ME, AND I CAN HELP YOU. I UNDERSTAND IT A LITTLE BIT BETTER AS WELL.

CAGE. THANK YOU JUMP IN. TYPICALLY THIS IS INTERESTING TO FOR US TO TRACK IN A MONTH TO MONTH BASIS. WE WANT TO TRY TO TAKE A LOOK AT WHERE WE ARE RELATIVE TO THE THREE YEAR AND FIVE YEAR AVERAGE IN EACH INDIVIDUAL MONTH. SO FOR EXAMPLE , SOMETIMES WE MIGHT BE DOWN A LITTLE BIT IN DECEMBER AND THEN IN THE FOLLOWING YEAR, AND THIS IS MORE OF A TIMING ISSUE. YOU MIGHT SEE A CORRESPONDING INCREASE IN THE MONTH OF JANUARY. SO IT'S REALLY GOOD FOR CHECKING WHERE WE ARE RELATIVE TO TRENDS. NOT JUST IN THE IMMEDIATELY PREVIOUS YEAR, BUT YOU KNOW PRIOR YEARS DATING IN THIS CASE, ALL THE WAY BACK TO 2012. JOE, I THINK OUT. I MEAN, IF YOU LOOK AT THE LAST FIVE YEARS GOING BACK TO 2017% OF BUDGET UH, IS KIND OF WITHIN RANGE WITH THE EXCEPTION. MAYBE 18 OR AS 110% I THINK WE'RE LOOKING LIKE WE'RE RIGHT AT THAT ONE. OH, 321. OH, SIX RANGE EVERY YEAR, SO GIVEN THE SITUATION OF WHAT WE'VE HAD TO DEAL WITH OVER THE LAST COUPLE OF YEARS, AND I THINK THAT'S OUTSTANDING TO BE ABLE TO STAY WITHIN THAT RANGE THAT WE'VE BEEN ABLE TO DO WITHIN THE LAST FIVE YEARS, LOOKING AT A RULING FIVE SO GOOD JOB. THE NEXT PAGE IS THE FUNDS AND WHERE WE STARTED AT THE BEGINNING OF THE YEAR AND THEN OBVIOUSLY WHERE WE ENDED UP AT THE END OF THE YEAR. CASH BALANCES ALSO DETAILS THE ENCUMBRANCES SO CURRENT, UH PURCHASE ORDERS OR CONTRACTS THAT WE HAVE AGAINST OUR CASH BALANCE. UM WHAT WAS INTERESTING TO ME. EXCUSE ME. WHAT WAS INTERESTING TO ME ON THIS PARTICULAR? SHE WAS IF YOU LOOK DOWN ABOUT. 3/4 OF THE PAGE DOWN TO THE CAPITAL PROJECTS FUNDS.

WE CURRENTLY HAVE $73.6. MILLION WORTH OF CONSTRUCTION IN PROGRESS RIGHT NOW CONTRACTS.

[01:10:06]

AND YOU MIGHT SAY, WELL, THAT'S INTEL. AND THAT'S ALL RELATED TO THAT, BUT NO ONLY 51.6 MILLION OF THAT IS SO THAT LEAVES US AT $22 MILLION IN CONSTRUCTION IN PROGRESS RIGHT NOW. THAT WE HAVE GOING ON. UM I THINK THAT'S PRETTY SIGNIFICANT FOR A CITY OUR SIZE, SO I THOUGHT THAT WAS INTERESTING. MOVE TO THE NEXT PAGE. IF YOU DON'T NEED QUESTIONS, THANKS AGAIN TO OUR FRIENDS OF THE GENERAL ASSEMBLY AND THE GOVERNOR'S OFFICE WITH THEIR SUPPORT. ONE NIGHT EVERY TIME, HMM. THE NEXT PAGE IS JUST A SNAPSHOT OF THE CUSTODIAL FUNDS THAT WE HAVE WITH US BANK SO IT'S ONLY OUR INVESTMENTS THAT WE HAVE WITH US PAIN. THAT RED TREE. OUR INVESTMENT MANAGER MANAGES THREE DIFFERENT ACCOUNTS THAT WE HAVE, YOU'LL SEE ARE BROKEN DOWN BETWEEN OUR GENERAL ACTIVITY AT THE TOP. OUR INFRASTRUCTURE REPLACEMENT FUND IN THE MIDDLE AND THEN AT THE BOTTOM ARE STATE INFRASTRUCTURE FUND. PLACE TO SEE EVERYTHING POSITIVE. AND THE YIELD YES. I KNOW THAT AS FAR AS THE INFRASTRUCTURE REPLACEMENT FUND.

AVERAGE YIELD AT COST IS PRETTY LOW COMPARED TO RATES THAT WE HAVE RIGHT NOW, HOWEVER, WHEN THEY DEPLOYED THAT'S A LONG TERM FUND THAT WE'RE PUTTING MONEY ASIDE WHEN THEY DEPLOYED THAT THERE WAS YOU KNOW, IN THE PROJECTIONS, THEY WEREN'T GOING TO BE DOING ANY RATE HIKES FOR ANOTHER YEAR. SO, UM SO, BUT THEY'RE WORKING ON GETTING THAT ROLLED OVER INTO MORE. UM FUNDS AS THEY MATURE. THEY HAVE A HIGHER INTEREST RATE. AND HE AGED FIVE IS THE ACTIVITY FOR THE MONTH OF DECEMBER FOR OUR INVESTMENTS AND THE THREE DIFFERENT ACCOUNTS BUT ALSO INCLUDES ARE STAR, OHIO. AT THE BOTTOM. AND ALONG WITH HER OUR JOINT PARTS DISTRICT. AMOUNT IS THERE. AND THEN FINALLY, THE LAST PAGE IS THE SAME PICTURE THAT I SHOWED YOU WITH THE GENERAL FUND AND COMPAQ'S TREND INCOME TAX TRYING ANALYSIS, BUT THIS IS ALL FUNDS. UM ULTIMATELY WE DID SEE A DECREASE OF ABOUT $2 MILLION COMPARED TO LAST YEAR. THAT WAS PRIMARILY DUE TO WITH HOLDINGS, AND IT WAS SOMETHING THAT WE HAD ANTICIPATED AGAIN WITH THE REMOTE WORK AND, UM, REFUNDS. IF YOU LOOKED AT JUST WITHHOLDING, WHICH IS NOT REPRESENTED ON THIS PAGE, BUT I LOOKED IT UP. IF YOU LOOK AT JUST WITHHOLDING FOR 2021, IT WAS 34.2 MILLION. FOR 2022 IS 32.1 MILLION, WHICH IS $2.1 MILLION LESS OVERALL, AND I THINK THAT IF YOU TAKE INTO CONSIDERATION YOU KNOW THE CHANGES THAT WE'VE HAD WITHIN THE WORKFORCE. I THINK THAT ALTHOUGH IT'S A LARGE DECREASE ITS UM, NOT AS SIGNIFICANT AS WE ANTICIPATED. CAN I JUST ASK YOU ONE QUESTION ON THAT FIRST PAGE THAT WE DID ON THE FINANCIAL SUMMARY? MHM CAN YOU REFRESH MY MEMORY ON ADMINISTRATIVE SERVICES? WHAT EXPENSES DO WE HAVE IN THERE? THAT WOULD IS THAT MORE? YOU HIRES OR. SAID MINISTRATIONS SERVICES IS ESSENTIALLY THE CITY MANAGER'S OFFICE. SO THAT INCLUDES ADMINISTRATIVE SERVICES MAYOR'S COURT I THI. COMMUNITY HR COMMUNITY PROGRAMMING. THAT'S. GOOD OKAY, IT'S YOUR GENERAL ADMINISTRATION. ALL RIGHT. THANK YOU. AND I WELL. I'M SORRY I DIDN'T HEAR YOU. FINANCES ARE DOING THEY'RE DOING WELL AND I AM CURRENTLY WORKING ON PLUGGING IN THE FINAL NUMBERS TO THE BUDGET DOCUMENT. AND SO THE HOPE IS TO HAVE THAT FILED WITH AWAY. UM EARLY FEBRUARY. AND SO HOPEFULLY WE CAN GET IT PRINTED FOR YOU GUYS AND HAVE AN ELECTRONIC LINK ON THE WEBSITE FOR YOU. THANK YOU. UNIT. OTHER THING I'D LIKE TO HAVE IS MY RECOGNITION OF OUR DEPARTMENT HEADS AGAIN. IT'S NOT A TYPICAL PRACTICE TO FIND THAT DEPARTMENTS RETURN MONEY TO THE BLOOD FUNDS. UM. EXPIRE

[01:15:08]

ENCUMBRANCES EXPIRE AND THAT THIS IS SOMETHING THAT WE ESTABLISHED MANY YEARS AGO. HIS LEADERSHIP TEAM CONTINUES TO BUY INTO THAT. SO THE CONSISTENTLY RETURN 10 12% TO THE GENERAL FUND FOR FUTURE USE IF IT'S NOT NECESSARY, AS OPPOSED TO SPENDING IT, UM IS A COMPLEMENT EACH OF THEM. IN THE PAST. YES. ANY UPDATE FROM THE CITY ATTORNEY NO UPDATE. FOR PUBLIC

[15. POLL FOR PUBLIC COMMENT]

COMMENT. ANYONE FROM THE PUBLIC THE MAN TO YOUR LEFT HAS A GREAT IT'S TRADITION NOW, JESS. THIS DIDN'T MOVE DOWN. STOP THREE REALLY QUICKLY. OKAY SO COUNCIL GAVE ME AUTHORIZATION TO ENTER INTO ALL CONTRACTS NECESSARY FOR THE CONSTRUCTION OF INFRASTRUCTURE TO SERVE THE INTEL PROJECT. BUT I WANTED TO BRING THIS LATEST INFRASTRUCTURE ITEM TO YOUR ATTENTION. JUST SO YOU'RE AWARE OF IT. WE PUT A, UH TWO MILLION GALLON ELEVATED STORAGE TANK WATER TANK OUT TO BID OUR ENGINEERS ESTIMATE WAS $10,500,000. WE HAD THREE BIDS AND THE APPARENT LOW BIDDER AT LEAST AT THIS POINT. IS $9.247 MILLION BY CALDWELL. THE ENGINEERING TEAM IS REVIEWING THE BID. TO MAKE SURE THAT IT'S COMPLETELY COMPLIANT SO BUT A GOOD OUTCOME, ESPECIALLY IN THIS KIND OF A MARKET MATERIALS AND LABOR SHORTAGES, INCLUDING OPINION LOGO ON THE WATER INCLUDE THE WATER. MY GUESS IS THAT THERE IS NOTHING IN THE SUSPECT THAT SAYS THAT WE HAVE THE LOGO ON THE CITY. WE CAN ASK STUDENTS NEEDED. WHERE IS IT GOING TO BE LOCATED? SO IT WOULD BE LOCATED ON, UM I WILL SEE IT SHOULD BE UP ON GREEN CHAPEL CLOSE TO CLOVER VALLEY REMEMBER PREGNANT? YES, JUST SOUTH OF GREEN CHAPEL ON CLOVER VALLEY. ALL THOSE FOLKS COMING INTO THE BUSINESS PARK IN THE FUTURE. LOOK UP TO ALBANY. INTERESTING EFFECT. WHAT ABOUT THAT TANK IS THAT IT'S GOING TO BE THE TALLEST ON CITY OF COLUMBUS IS ENTIRE SYSTEM BECAUSE THINGS ARE SO FLAT OUT THERE AND JUST WHERE IT FALLS IN THE DISTRIBUTION SYSTEMS. GOOD PLACE FOR THAT LITTLE BIT SIGHTLINE BETWEEN THAT WATER TOWER IN THE JOHN SANDLER TYRANT JUST NORTH. BEING TESTED. YEAH. MM HMM. PART YOU YOU'RE NOT GONNA FIND SOME MONEY TO PAINT IT. WE CAN DO THAT.

SOUNDS LIKE WE HAVE A LITTLE LEFTOVER LEFT OVER BUDGET SOMEWHERE ELSE. THE SECOND ITEM . UH WE JUST RECEIVED WORD TODAY. I DON'T KNOW IF ANY OF YOU REMEMBER JOE RIDGWAY. HE WORKS FOR FERRIS AND SERVED AS OUR TRAFFIC ENGINEER FOR MANY YEARS. HE PASSED AWAY LAST WEEK.

HE WAS 83 YEARS OLD. SO I BELIEVE THERE IS A SERVICE FOR HIM THIS THURSDAY. I CAN GET MORE INFORMATION OUT TO YOU TOMORROW TUESDAY, 83. SO HE DID A FANTASTIC JOB FOR THE CITY, ESPECIALLY WHEN WE DIDN'T HAVE SUCH A LARGE TEAM WORKED VERY CLOSELY WITH ME. AND WITH MARK NAMIK OVER THE YEARS, SO GOOD MAN. AND THEN FINALLY, UH, SOME AND ON A POSITIVE NOTE. THIS IS SCOTT MCAFEE'S LAST OFFICIAL COUNCIL MEETING. AH THAT'S A POSITIVE. NO THANK GOD. SO I JUST WANTED TO ACKNOWLEDGE HIM TONIGHT FOR HIS GREAT SERVICE TO THE COMMUNITY OVER THE LAST 14 YEARS OF DEDICATION AND DO A GREAT JOB BUILDING OUT. AND THAT'S ALL I HAVE. WELL, LET ME JUST ECHO JOE'S COMMENTS ABOUT SCOTT. REMEMBER WHEN HE FIRST CAME TO WORK FOR THE CITY? TO SAY WE HAD A COMMUNICATIONS DEPARTMENT MAY HAVE BEEN A STRETCH. UH CERTAINLY NOT A SOCIAL MEDIA PRESENCE MELON NEWSLETTER. THE ANNUAL REPORT WAS SHORT AND AVERAGE DESCRIPTIVE. AND SO I, YOU KNOW, GIVE A LOT OF CREDIT TO SCOTT FOR HAVING VISION. UM HOW THE CITY COULD COMMUNICATE WHAT WE'RE DOING TO THE PUBLIC TO OUR BUSINESS PARTNERS TO OUR REGIONAL PARTNERS. JUST HATS OFF TO HIM, AND NOW JOSH FOR DOING SUCH A GREAT JOB OF TELLING THE NEW ALBANY STORY AND, UH, ANYONE THAT CAN HELP WRITE SPEECHES FOR ME AND ACTUALLY MAKE THEM COHERENT, YOU KNOW, IS A HARD TASK, SO I APPRECIATE ALL OF THE EFFORTS OVER THE YEARS THAT SCOTT HAS PUT INTO THE VARIOUS SPEECHES THAT WE PUT ON TOGETHER . HE GETS AS MUCH CREDIT FOR WRITING IT AS I DO FOR DELIVERING IT. ACTUALLY, I THINK IT GETS MORE CREDIT, BUT SCOTT,

[01:20:04]

YOU'LL BE MISSED. LUCKILY YOU'RE JUST A PHONE CALL AWAY A AND UNDERSTAND FROM JOE THAT YOU'RE GOING TO BE ON A MAYBE A AS NEEDED BASIS CONTRACT. JUST IN CASE I NEED SOME HELP WITH THE SPEECH. ALRIGHT THAT'S AWESOME. AND AGAIN. CONGRATULATIONS I KNOW WE KID YOU A LITTLE BIT ABOUT STARTING TO WORK WHEN YOU WERE 12 YEARS OLD, BUT YOU HAVE GOTTEN YOUR EARS AND WITH THE SYSTEM AND CERTAINLY DESERVE THE OPPORTUNITY TO SPEND SOME MORE TIME WITH THEIR FAMILY AND YOUR KIDS AREN'T GETTING ANY YOUNGER AND THOSE DAYS ARE PASSING US ALL BY, SO I'M GLAD YOU GET AN OPPORTUNITY TO ENJOY THAT AND MAYBE SPEND A LITTLE BIT MORE TIME IN FLORIDA. I HEAR IT'S KIND OF NICE THIS TIME OF YEAR. SCOTT THANK YOU FOR ALL YOU'VE DONE AND BUILDING THE BRAND FOR NEW ALBANY. EXCELLENT JOB. IN HERE. ALRIGHT AND IT SKIP ANYONE UNDER THE CITY OFFICIALS THAT I AM GOOD TO MOVE ON. SO MAKE SURE CHECKED ALL THE BOXES. PULL FOR PUBLIC COMMENT ANY ADDITIONAL

[16. POLL FOR COUNCIL COMMENT]

PUBLIC COMMENT. PULFORD COUNCIL COMMENTS AND ADDITIONAL COUNSEL COMMENT. I BROUGHT UP THE PICTURES FROM OH, YEAH. YOU'VE READ ON THAT CREW? YEAH. CASEY IS RUNNING THAT PROGRAM THERE FOR SECOND ALREADY BEEN DEPUTIZED. JOE GOT ALL THESE CRAZY QUESTIONS. BUT THAT WAS THE THAT WAS THE HIGHLIGHT OF THE NIGHT ASKING ALL THESE PERSONAL QUESTIONS. WE KIND OF THOUGHT IT WAS JUST GONNA ASK THE SAME QUESTION OVER AND OVER AGAIN. NO COMPLETELY DIFFERENT.

SO ICEBREAKER, EVERYBODY DIFFERENT QUESTION. IT WAS LIKE SOME OF THEM ARE OUT THERE.

YEAH. YES I THINK CASEY HAD SOMETHING LIKE WHAT WAS THE MEANING OF LIFE TYPE OF DEPTH OF QUESTIONS LIKE, YOU KNOW, THE GUY BEFORE ME WAS LIKE, WOULD YOU WANT TO BE WHEN YOU GROW UP LIKE I WAS ALREADY FOR THAT ONE? ALWAYS WANT TO BE A FIREFIGHTER? YEAH. THAT'S THE MEANING OF LIFE . HOW OFTEN DOES THAT MEAN? HOW MANY MORE CLASSES DO YOU GUYS HAVE EIGHT MORE SESSIONS AND ITS ANNUAL RIGHT CHIEF? YEP. ONCE A MONTH OR. EVERY WEDNESDAY FOR NINE CONSECUTIVE CORRECT. BUT IT WAS IT WAS INTERESTING TO SEE THE OTHER COMMUNITY MEMBERS PARTICIPATING. A LOT OF A LOT OF THEM HAD JUST MOVED INVOLVING IN THE LAST COUPLE OF YEARS. UM AND WANTED TO, YOU KNOW, GET ENGAGED. LEARN A LITTLE BIT MORE ABOUT HOW THINGS OPERATE HERE. SO IT WAS GOOD TO SEE THAT FEEDBACK FROM FOLKS THAT HAVE JUST MOVED TO THE COMMUNITY. AND LOOKING FORWARD TO LEARNING A LITTLE BIT MORE ABOUT THEM. AS WE MOVE FORWARD CASES YOU GET TO TURN ON THE SIGN. NOT YET. WAIT A MINUTE TO PLAY WITH NOTHING WAS POWERED ON MAYBE ON PURPOSE, NOT EVEN THE DRONE. BY THE WAY, THEY'RE DRAWN TRAILERS PRETTY COOL. I THINK THAT WAS THE HEAD OF THE DISPLAYS HER DOG AND THE DOG WRONG. HE DIDN'T HAVE EITHER ONE OF THOSE WHEN I DID IT, I'M GOING TO HAVE TO COME BACK.

WE'RE CONSTANTLY TRYING TO IMPROVE IT. CHIEF. HOW MANY APPLICANTS DO WE HAVE? ARE WE ABLE TO ACCOMMODATE EVERYBODY THAT APPLIED FOR THE NO. I THINK THAT WE HAD SOME KIND OF PEOPLE THAT WERE IN RESERVE IN CASE PEOPLE DROPPED OUT, BUT WE'RE EXCITED THAT THAT THAT WE HAD MORE THAN WHAT WE CAN HOLD, AND WE'RE CERTAINLY THEY DON'T MAKE IT IN. WE'RE GOING TO OFFER THEM NEXT YEAR AS WELL. BUT THERE'S ACTUALLY THINK, 25, WHICH IS KIND OF OUR LIMIT FOR, LIKE MORE OF THE INTERACTIVE STUFF JUST TO KEEP THE NUMBERS DOWN, SO EVERYBODY GETS A CHANCE. ANY ADDITIONAL COUNSEL COMMENT. THEN UNDER OTHER BUSINESS, WE HAVE BOARDING COMMISSION

[17. OTHER BUSINESS]

REAPPOINTMENTS. DEPUTY CLERK, CHRISTINA PREPARED, SENT OUT EMAILS TO HIT EVERYONE UP AND PREPARED THE MEMO, WHICH COUNCIL CAN ADOPT BY REFERENCE, AS FAR AS WE APPOINTING THOSE WHO ARE READY TO BE REAPPOINTED TO SEE THERE ARE TWO OPEN POSITIONS AND I'LL ASK COUNCIL ABOUT THAT NEXT. GOOD. I THOUGHT OF THE APPOINTMENTS. THANKS YOU KNOW, ISSUES. ANY QUESTIONS? ALL RIGHT , THEN I WOULD MOVE FOR THE ADOPTION OF THE 2023 BOARDING COMMISSION APPOINTMENTS AS DESIGNATED IN THE JANUARY 13TH MEMO. SECOND NO. YES YES, MEMBER DEREK? YES. COUNCIL MEMBER FELLOWS? YES YES, YES. SEVEN YES VOTES TO REAPPOINT THE MEMBERS WERE UPPER APPOINTMENT AS SPECIFIED IN THE GENERAL 2023 MELLOW TWO OPENINGS. I JUST WANT TO MAKE SURE COUNCIL WAS GOOD WITH DOING WHAT WE'VE BEEN DOING, WHICH IS TO ADVERTISE IT. LEAVE IT OPEN FOR ABOUT A MONTH AND THEN TAKE THOSE APPLICATIONS IN AH, I WONDERED ABOUT THE CEMETERY BOARD SINCE IT'S MOSTLY

[01:25:03]

INACTIVE RIGHT NOW, DO WE WANT TO FILL THAT NOW? AND JUST KIND OF ADVISED THE APPLICANTS THAT IT IT? IT'S GOING TO BE INTERMITTENT, UM, AND MAY NOT REALLY BECOME MORE ACTIVE UNTIL WE GET CLOSER TO DOING THAT MEMORIAL AREA AROUND THE RESTAURANT TO THAT'S THAT'S WHAT I'M ANTICIPATING RIGHT NOW. THEY ARE WORKING. ALSO ON THE OTHER CEMETERIES. WAGNER. THANK YOU.

WAGNER CEMETERY, SO THERE'S A LITTLE BIT OF WORKERS. WHAT ARE THEY DOING THERE? UM RIGHT NOW, I BELIEVE THAT'S CONTRACTED TO BE RESTORED. IS IT DURING THIS YEAR DURING NEXT YEAR, REMEMBER THERE WAS A DELAY. WE HE'LL START WORK THIS SUMMER. OKAY 2023 TO GET THOSE HEADSTONES BACK UP, AND THERE'S SOME ISSUES ABOUT LIKE WHAT WE WANT TO DO WITH FENCING AND THINGS LIKE THAT DEFENSE OUT THERE. COUNCIL WAS DEBATING WHAT TYPE OF OFFENSE TO USE, POSSIBLY HORSE FENCE. I THINK SOME OF THE MEMBERS OF THE BOARD WERE INTERESTED IN SOME OTHER TYPE OF A OKAY? WHAT I EARN APPEARING EVENTS. ANYTHING IS BETTER THAN WHAT'S THERE, WHICH IS THE CHAIN LINK FENCE RUSTED OUT, PLEASE. SO I MEAN, THERE ARE A FEW THINGS WE CAN GO AHEAD AND APPOINT A NEW MEMBER JUST KIND OF GIVE APPLICANTS A HEADS UP THAT IT WON'T BE DIVE RIGHT IN.

IT COULD BE SMALL TIME. YEAH, I THINK WE SHOULD ADVERTISE WHAT'S HAPPENING, RIGHT? WE'LL ADVERTISE THIS TOGETHER. IF SOMETHING DOES COMING OVER, YOU DON'T NEED TO PANIC AND AGREE.

AGREED. AND THE OPENING ON THE AIR B. THAT ONE MEMBER DECIDED DIDN'T WANT TO SERVE ANY LONGER.

YEAH MR. THOMAS DID SAY THAT HE WAS HE WAS GETTING BUSY. OKAY THAT IS NOT. I BELIEVE ONE OF THE POSITIONS. MR MALLETS HOLDS THE POSITION THAT'S REQUIRED TO BE WITHIN A CERTAIN PROFESSION.

SO THIS WAS ON THAT ON THE AIR B FOR 15 20 YEARS SOMEWHERE LIKE THAT, SO I WILL MAKE SURE BEHALF OF COUNSEL TO HIM, THANKING HIM FOR HIS YEARS OF SERVICE. OKAY. I THINK I'VE GOT THE DIRECTION GREAT ANYTHING ELSE UNDER OTHER BUSINESS. THERE'S NO FURTHER BUSINESS MOVEMENT. WE JOURNEY.

AND WE ARE ADJOURNING AT 7 59. PM
