[7. BOARD/COMMISSION REPORTS]

. ALRIGHT GORDON, COMMISSIONER REPORTS AND THE UPDATE FROM PLANNING COMMISSION. NO MEETING PARKS AND TRAILS NO MEANING THEY ARE BE MEETING SORRY. EASY INDIAN MEETING SUSTAINABILITY ADVISORY BOARD MEETING ALL RIGHT. THE IDEA IMPLEMENTATION PANEL. NO MEETING A THEME HERE.

CEMETERY RESTORATION. REALLY OF ALL OF IT. I'VE GOT A MEETING. Y'ALL DID? YES THE CARRY RESTORATION BOARD. I WILL SAY WE'RE BACK. WE HAD AN INFORMATIONAL TOUR OF THE CEMETERY RESTORATION GOING ON WAGNER WITH MARK SMITH. GRAVESTONE TRANSFORMATIONS OWNER. UM I NOTABLY WAGNER IS SPELLED WITH AN E W G N ER THERE'S THIS HISTORICAL SENT ACTUALLY SAYS WHY IGNORE, BUT HE'S FOUND CLEANED, PUT UP THE WAGNER FAMILY HEADSTONES. IT'S WAGNER WITH ANY I'VE BEEN GOING BACK AND FORTH. I KNOW IT'S NOT AMAZING TO YOU. IT'S AMAZING TO ME. UM LET'S SEE. UM OH, YEAH, HE REPORTED THE PROJECT WOULD TAKE LONGER THAN THE SUMMER TO COMPLETE. I KNOW. JUST TALK TO YOU ABOUT SOME OF THAT HE'S DISCOVERING NEW STONES AS HE GOES AND TRIES TO LOCATE THE ONES ABUSE FOUND, AND SO HE KEEPS FINDING NEW. THERE'S LITTLE FLAGS ALL OVER THE CEMETERY. IF YOU SEE IT, AND IT'S JUST STUFF HE'S FINDING IS HE'S TRYING TO DIG UP OTHER STUFF. UM WE LEARNED ABOUT HISTORIC CHRISTIAN CEMETERIES AND THE HEADSTONES AND THE FOOT STANDS IN WHICH WAY THEY'RE THEY'RE SET WHAT IS RESTORED AND DISCOVERED THUS FAR. UM UH, ONE OF OUR MEMBERS NOTED THE LIGHT WAS NEEDED FOR THE AMERICAN FLAG AND THAT CEMETERY AND I LET MR BARK MELANIE'S WORKING ON THAT YEAH, IT WAS A FUN, STICKY FIELD TRIP OUT. HMM. BUT YEAH, WE'RE LOOKING AT MAYBE 2024 2025 COMPLETE. THE PROJECT IS VERY COOL, THOUGH. I STOPPED BY FOR A WHILE AND THEN THANK YOU. TOMBSTONES WERE LIKE EARLY 18 HUNDREDS AND THEY'RE FINDING THAT THERE WAS ONE I LIKE I COULDN'T BELIEVE IT WAS LIKE OKAY, HOLDING ENGRAVING. YOU COULD SEE IT, AND IT SAID THIS LITTLE GIRL'S NAME AND SHE HAD LIVED FOR FOUR MONTHS AND TWO DAYS. EIGHT PASSED IN 18 22. IT'S LIKE IT REALLY MAKES YOU REALIZE THE HISTORY THAT WE'RE ROUND OF, YOU KNOW, PULLING BACK OUT THERE AND RESTORING. I THINK IT MAKES YOU REALIZE THE IMPORTANCE OF WHAT THAT IS. IT'S PRETTY COOL. FASCINATING THINGS IS THERE. SAY HEADSTONE. I CAN'T REMEMBER WHAT STONE IT WAS MADE OUT OF, BUT IT WAS JUST CLEAN AND CRISP AND ALL THE ENGRAVING WAS SUPER SHARP AND WE'RE LOOKING AT THIS AND IT DOESN'T LOOK LIKE IT'S STAGE TODAY, AND HE ACTUALLY FOUND IT BURIED UNDERGROUND 68 INCHES, AND THERE HAVE BEEN REPLACED BY A MARBLE. UM HEADSTONE, WHICH WAS ONLY ABOUT YEA BIG COMPARED TO THE ORIGINAL HEADSTONE AND THE MARBLE ONE LOOKED LIKE A MELTED MARSHMALLOW. YOU COULDN'T READ IT, AND APPARENTLY THAT BECAME TRENDY BECAME POPULAR TO HAVE MARBLE. AND SO I THINK THE FAMILY KNOCKED IT DOWN, PUT IT UNDER AND THEN GOT THIS MARBLE THING THAT THEN JUST DETERIORATED OVER THE YEARS. SO, UM, YEAH. WHEN DO WE ANTICIPATE DEFENSE IS GOING TO GO UP FOR UNDER AFTER EVERYTHING IS DONE. WHICH NOW MAY BE A WHILE. YES AFTER THIS YEAR'S WORK HAS DONE WHEN I SPOKE TO HIM THIS AFTERNOON, HE SAID THAT BASED ON THE NUMBER OF HEADSTONES HE'S FINDING OUT THERE IT HE MAY HAVE ANOTHER 40 OR SO HEADSTONES, GIVE OR TAKE. AND HIS SCHEDULE IS ALREADY BOOKED UP THROUGH 2024. SO, HE SAID, IF HE RUNS OUT OF TIME THAT HE MAY HAVE TO COME BACK IN 2025 AND PUT US ON THE CALENDAR, BUT OUR GOAL WOULD BE TO PUT UP THE FENCE AROUND

[00:05:05]

THE PERIMETER AS SOON AS HE'S DONE WITH THIS YEAR'S WORK. AND THERE WAS NO MEETING OF THE PUBLIC RECORDS COMMISSION. THE CITY MANAGER WAS QUICK TO POINT OUT THAT I JUST SKIPPED RIGHT OVER HERE. YOUR VISITORS. I APOLOGIZE. WOULD ANYONE FROM THE PUBLIC LIKE TO ADDRESS COUNCIL REGARDING MATTER THAT IS NOT ON TONIGHT'S AGENDA. IF SO, NOW IS YOUR OPPORTUNITY. ALRIGHT CORRESPONDENCE OR COMMUNICATION . HAS ANYONE FROM THE COUNCIL RECEIVED ANY CORRESPONDENCE OR

[9. SECOND READING OF ORDINANCES AND PUBLIC HEARING]

COMMUNICATION SINCE OUR LAST MEETING THAT THEY WOULD LIKE TO PROVIDE AND NOTHING ON SECOND READING OF ORDINANCES AND PUBLIC HEARINGS ORDINANCE, SO 78 2023 AND ORDINANCE APPROVING THE APPLICATION ESTABLISHING THE NEW ALBANY VILLAGE CENTER COMMUNITY ENTERTAINMENT DISTRICT. THANK YOU, MAYOR. SO SINCE THE FIRST READING OF THIS, I THINK THE APPLICANT HAS MODIFY THE APPLICATION TO INCLUDE A COUPLE OF OPEN PARCELS. I THINK THE 5TH 3RD BANK PARCEL IN THE INSURANCE OF THIS PARCEL WITH THIS APPLICATION. AH THE EMERGENCY CLAUSE HAS BEEN REMOVED BECAUSE THERE'S NO THERE'S NO TIME SENSITIVITY ANYMORE. THIS DOES NOT HAVE TO GO ON THE BALLOT.

THERE WAS SOME DISCUSSION ABOUT THE PARCELS ON HIGH STREET. THOSE ARE NOT OWNED BY THE APPLICANT. SO THE APPLICANTS REQUEST WAS THAT THE OWNERS. VILE THEIR OWN PETITION DO THEIR OWN LIKE WORK IN ORDER TO, UH, IF THEY WOULD CHOOSE TO HAVE SOMETHING ADDED TO THE ENTERTAINMENT DISTRICT. BUT OTHER THAN THAT, I BELIEVE, AND I WAS ABSENT FOR THIS FIRST READING OF THIS ORDINANCE, BUT I BELIEVE THAT THE APPLICANT AND THEIR COUNSEL HAVE ATTEMPTED TO INCLUDE ALL OF THE PARCELS THAT THEY CONTROL OR OR OWN OUTRIGHT. I THINK THE TOTAL ACREAGE IS NOT CHANGED BASED ON THE SIZE OF THE COUPLE OF PARCELS THAT WERE ADDED, WE'RE STILL LOOKING AT APPROXIMATELY 54 ACRES THAT MIGHT HAVE IT INCREASED SLIGHTLY, BUT NOT SUBSTANTIALLY.

AND, UM. THAT WOULD BE IT IF THERE'S NO. IN FACT, I BELIEVE ALL OF THESE ARE OR THE ONES THAT WOULD BE THE MOST APPLICABLE OR ALL ZONED OR RATED AS WET. UH THERE WAS SOME CONCERN EARLY ON ABOUT WHETHER SOME OF THESE MIGHT BE WET AND SOME MIGHT BE DRY AND WHETHER OR NOT THIS, THE DRYING PARCELLS WOULD HAVE TO BE PUT ON THE BALLOT. BUT IT'S MY UNDERSTANDING THAT THAT IS NOT THE CASE. KEEP THE POINT OF CLARIFICATION BASED ON RECOMMENDATIONS FROM CITY STAFF, WE ELIMINATED THE GROUND ON THE SOUTH SIDE OF MARKET STREET THAT WAS IN THE PREVIOUS APPLICATION. AH SO THEY THERE WAS A HORSE OF THAT WE CONTROL THIS HOUSE OUT OF MARKET THAT'S BEEN ELIMINATED. WHAT'S BEEN HAPPENING. THE OTHER PARCELS WE CONTROL 5TH 3RD. UM CVS AND THE OHIO STATE MEDICAL. NOW WE WERE DID YOU GUYS DID WE TAKE A LOOK AT WHAT THIS OTHER PARCELS THAT WERE INCLUDED IN YOUR PROPERTY TO ADD TO THAT? YES SO WE DID NOT ACTIVELY. LOOK WHAT WE THINK WE HEARD FROM THE, UM THE ATTORNEY. THE LAST TIME WE WERE HERE, THERE'S BEEN A TREMENDOUS AMOUNT OF WORK IN EFFORT THAT WE HAVE BEEN UNDERTAKING TO TRY TO GET THIS TOGETHER. IT'S NOT AS SIMPLE AS IS THE PARCEL WET OR IS IT DRY? ITS VARIOUS SHADES OF GRAY, RIGHT? SO WE'VE SPENT A TREMENDOUS AMOUNT OF TIME AND ENERGY AND EFFORT TO GET TO WHERE WE ARE. WE DID NOT GO OUT AND ACTIVELY SOLICIT. AH THE INTEREST OF THE OTHER PARCELS ADJACENT TO THIS. WE DID GET CLARIFICATION THAT THEY ARE ABLE TO DO THAT. IF THEY WOULD CHOOSE TO DO THIS, THERE'S IN NO WAY. DOES THIS LIMIT ANYONE ELSE'S ABILITY TO DO THAT? OKAY. OKAY? JUST CLEAR FORGETTING 54 ACRES COULD POTENTIALLY RESULT IN UP TO 10 LICENSES. IS THAT RIGHT? WHERE IS THAT THE NUMBER SO ONE FOR EVERYBODY. EDUCATION NO, THAT'S OKAY. GUESS WHO. HELLO EVENING JILTING WOMEN WITH 40 STATERS SEYMOUR MPS AND I'M ACTUALLY JOINED THIS EVENING BY TIM BECHTEL, AND THAT'S SEEDORF LIQUOR EXPERIENCE THAN I DO SO THEY MAKE CHIME IN IF YOU HAVE SPECIFIC QUESTIONS. UM BUT TO RESPOND TO YOUR QUESTION IT IS, UH, FOR EVERY FIVE ACRES, ONE PERMIT. UM WE BELIEVE THAT THEY WILL ROUND UP SO THIS IS ACTUALLY 54.5 SOMETHING ACRES, SO WE THINK THIS WOULD PROBABLY RESULT IN 11, BUT WE DON'T KNOW THAT STATUTES JUST NOT THAT SPECIFIC. THIS DOES NOT. THIS DOES NOT INCLUDE THE HAMLET. RIGHT OR DOES THAT'S THE THAT'S

[00:10:11]

THE NEXT SET OF ORDINANCES? ALL RIGHT. ANY QUESTIONS FROM COUNCIL ITS SECOND READING, EITHER TO THE EITHER OF THE REPRESENTATIVES OF THE APPLICANT NO. I JUST APPRECIATE THE TIME AND EFFORT TO GO BACK AND CLEAN IT UP AND ENCOMPASS EVERYTHING YOU GOT. THERE MAKES THE MOST SENSE TO DO IT IN ONE SHOT. AND IF I'M LOOKING AT THE WHITE AREAS, SO IT'S BASICALLY THE LIBRARY, THE HEIGHT CENTER AND THEN OUR GOVERNMENT BUILDING AND KIND OF BEHIND US, RIGHT? THAT'S THE THREE WAY OKAY. AND THEN SOME OTHER. INDIVIDUALS UP THERE IN THE TOP. I WATCHED IT. ALL RIGHT ON. YEAH. OKAY I THINK YOU DID FILL IN SOME OF THOSE OTHER ONES THAT ARE YELLOW, DIDN'T YOU? I THOUGHT THAT WAS ADDED THOUGHT THOSE WERE ADDED. OKAY. GREAT ANOTHER ONE, TOM, A LITTLE CLOSER, DOCTOR AND ARTS BUILDING ON MARKET STREET WAS ALSO OKAY THAT PREVIOUS. GOOD HE'S BEEN DYING TO HAVE A WINE BAR THERE FOR A LONG TIME, PEOPLE COME OVER CAN WE ALL GOT JOKES ABOUT THE DENTIST AND THE BAR? ALRIGHT ANY OTHER QUESTIONS AT ALL FOR THE APPLICANT? WELL, THEN I APPRECIATE YOUR TIME. WE'LL GO AHEAD AND OPEN THE PUBLIC HEARING WHAT ANYONE FROM THE PUBLIC LIKE TO SPEAK REGARDING ORDINANCE 78 2023. HEARING NO PUBLIC OR HEARING NO PUBLIC COMMENT WILL CLOSE THE PUBLIC HEARING AND I WOULD MOVE THE ADOPTION OF ORDINANCE 78 2023 2ND. RESPONDING. COUNCIL MEMBER DEREK. COUNCIL MEMBER. WELL CHILD, YES. MEMBER SHOW? YES, YES, FELLOWS. YES. RISK YES, YES. POSTED ORDINANCE 78 2023. BOARD AND SO 79 2023 NEW ORGANS APPROVING APPLICATIONS ESTABLISHING THE HAMLET SUGAR RUN COMMUNITY ENTERTAINMENT DISTRICT. THANK YOU. AGAIN THE RESPONSE TO FEEDBACK FROM COUNCIL. THIS APPLICATION HAS BEEN MODIFIED. IT'S BEEN REDUCED TO APPROXIMATELY 26 ACRES FROM THE ORIGINAL 35. WHICH WOULD GIVE THE APPLICANT UP TO FIVE LICENSES. UM WE'VE ALSO REMOVED THE EMERGENCY CLAUSE FROM THIS SO IN THE APPLICANT HAS ADVISED US THAT THEIR INTENTION IS TO ADDRESS THE WET, DRY ISSUE ON THE MARCH PRIMARY BALLOT, WHICH IS MARCH 19TH FOR THE AND I'M GETTING INTO THE NEXT PIECE OF LEGISLATION, BUT THEY'RE THEY'RE SOMEWHAT TIED TOGETHER. ANYWAY. UM, THE. THE APPLICANT HAS RESPONDED THE COUNCIL'S FEEDBACK AND REDUCE THE AREA TO THE LEFT OR WEST SIDE OF 605. M AND, UM, CONSEQUENTLY HAS REDUCED THE NUMBER OF POTENTIAL PERMITS. ALSO AND I DON'T KNOW IF THERE WILL BE A PRESENT PRESENTATION ABOUT THIS THIS EVENING. BUT IN MY CONVERSATIONS WITH, UH WITH ONE OF THE APPLICANTS, REPRESENTATIVES WE TALKED ABOUT POSSIBLE SOME POSSIBLE INSIGHT INTO THE TYPE OF RESTAURANTS THAT THEY MAY BE TRYING TO RECRUIT TO THE AREA. I BELIEVE THEIR GOAL WAS TO TRY TO TRY TO ATTRACT TWO OR THREE RESTAURANTS TO THE AREA. THEY'RE STILL WORKING ON THAT. I DON'T THINK ANYTHING'S BEEN DEFINITIVELY AGREED TO, BUT THERE IS A CERTAIN TYPE OF RESTAURANT THAT THEY'RE TRAINED TO ATTRACT. SO SURE. JUMPED HANG HIM IN AGAIN FOR CEDAR SEYMOUR MPS THINK SAME MANAGER DID A GREAT JOB OF SUMMARIZING THE CHANGES THAT WE'VE MADE IN TERMS OF REDUCING THE ACREAGE IN DROPPING ALL THE PROPERTY OUT ON THE EAST SIDE OF CONDUCT ROAD. UM AS THE CITY MANAGER ALLUDED. WE HAVE ASKED RATHER THAN TRY TO DEAL WITH THE WET, DRY ISSUE ON THE NOVEMBER BALLOT. WE'RE GOING TO PUSH THAT OUT TO MARCH, UM, AND THE THAT AS A RESULT, WE REMOVED THE EMERGENCY CLAUSES FROM THE ORDINANCES WERE NOT UNDER ANY TIME CONSTRAINTS AND THE REASON FOR MOVING THAT OUT TO MARCH. UM IS THAT THEY DO WANT TO BE ABLE TO MAKE A MORE PUBLIC ANNOUNCEMENT ABOUT THE RESTAURANTS THAT THEY'RE ATTRACTING. UM AND HOPE TO HAVE COMING TO THIS AREA SO THAT THE PUBLIC PRIOR TO VOTING WILL HAVE , YOU KNOW A LITTLE MORE INFORMATION ABOUT WHO THOSE RESTAURANTS ARE AND WHAT KIND OF TENANTS THEY'LL HAVE. UM, THEY JUST ARE. STILL REALLY BEGINNING THOSE NEGOTIATIONS, SO IT'S JUST NOT AT A POINT WHERE THEY CAN MAKE ALL THAT INFORMATION PUBLIC, BUT THEY FEEL LIKE IT'S I THINK FROM OUR CONVERSATIONS LAST TIME THAT THAT'S AN IMPORTANT PIECE OF THE PUZZLE HERE, AND THE PUBLIC WANTS TO KNOW YOU KNOW WHO'S WHO'S COMING IN OR WHAT TYPE IS COMING IN,

[00:15:04]

AND THEY WANT TO BE ABLE TO GIVE THAT INFORMATION, SO WE'LL PUSH THIS OUT TO MARCH. AND THEN BE ABLE TO MAKE SOME MORE OF THAT INFORMATION PUBLIC PRIOR TO THE PUBLIC VOTING ON THE WET, DRY ISSUE. THANK YOU APPRECIATE, UH , YOU KNOW, ACCEPTING THE FEEDBACK AND MAKE SOME CHANGES.

UM NOT ONLY TO THOSE ACREAGE, BUT TO THE INTENDED USE, MAKING SOME CLARITY AROUND THAT, UM ANY ADDITIONAL QUESTIONS OR COMMENTS FROM COUNCIL ALL RIGHT. THEN WE'LL OPEN THE PUBLIC HEARING WHERE ANYONE FROM THE PUBLIC LIKE TO SPEAK REGARDING ORDINANCE, I WAS 79 2023. DURING THE PUBLIC COMMENT WILL CLOSE THE PUBLIC HEARING. IS THERE A MOTION ON THE ORGANS MOVE IT UP SHOULD HAVE ORDINANCE 79 2023. SECOND. COUNCIL MEMBER SHELL COUNCIL MEMBER WILL TRAP SPALDING. YES, CHRIS YES, YES, YES, YES, YES, YES SUPPOSED ORDINANCE 0 79 2023. ORDINANCE 0 81 2023 AND ORDINANCE REQUESTING THE BOARD OF ELECTIONS TO SUBMIT TO THE ELECTORS OF THE CITY OF NORMALLY THE QUESTION OF WHETHER THE SALE OF BEER AND INTOXICATING LIQUOR SHALL BE PERMITTED WITHIN THE BOUNDARIES OF THE HAMLET, SUGAR RUN COMMUNITY ENTERTAINMENT HISTORY.

JOE. THANK YOU. SO, UM WE'VE AMENDED THIS, UM. ORDINANCE IN TWO WAYS. FIRST WE REMOVED THE EMERGENCY CLAUSE AGAIN BECAUSE WE ARE MOVING THIS BACK. FROM THE REGULAR ELECTION IN NOVEMBER TO THE PRIMARY ELECTION IN MARCH WOULD BE MARCH 19TH 2024 THE FILING DEADLINE FOR THIS LEGISLATION, AND FOR THIS TO BE PLACED ON THE BALLOT WOULD BE DECEMBER 20TH 2023 SO LITTLE GIVE THE APPLICANT PLENTY OF TIME AND AGAIN. THIS IS TO GIVE THE RESIDENTS THE OPPORTUNITY TO DECIDE WHETHER OR NOT THIS THIS PROPERTY SHOULD BE WET OR DRY. HMM. ALRIGHT ANY ADDITIONAL QUESTIONS FROM COUNCIL TO STAFF? JUST TO CONFIRM THAT'S THE ENTIRE CITY VOTING ON THAT. I WOULD BE VOTING ON. THEY HAVE TAKEN CARE TO MAKE ANY OTHER COMMENTS. OKAY AND THEN WE'LL OPEN THE PUBLIC HEARING WHEN ANYONE FROM THE PUBLIC LIKE TO SPEAK REGARDING ORDINANCE, 81 2023. HEARING NO PUBLIC COMMENT WILL CLOSE. THE PUBLIC HEARING IS VERY MOTION ON THE ORDINANCE.

I MOVED FOR THE ADOPTION ORDINANCE 81 2023. SECOND. COUNCIL MEMBER TEST. YES COUNCIL MEMBER SHELL FELLOWS. YES YES, YES, YES, YES, YES. FIRST STOOD UP ORDINANCE 80 2023. WELL I THINK OUR COLLEAGUES FROM BORIS FOR JOINING US THIS EVENING. APPRECIATE ALL THE HARD WORK ON THIS AND YOU GET OUT EARLY. YOU ENJOY THE REST OF THE EVENING. YOU'RE WELCOME. AND THAT TAKES US TO ORDINANCE 0, 85 2023 AND APPROPRIATION AMENDMENT ORDINANCE ORDINANCE TO AMEND APPROPRIATIONS FOR CURRENT EXPENSES AND OTHER EXPENSES DURING THE FISCAL YEAR ENDING DECEMBER 31 2023 CIRCUMSTANCE. I JUST NOTICED THAT THE LEGISLATION SHOULD HAVE A TITLE UPDATE AS WELL. MY APOLOGIES. I GRABBED THAT SLIDE FROM THE LAST TIME WE HAD IT. OKAY? UM IT DOES INCLUDE AUTHORIZED A TRANSFER IN ADVANCE FROM THE GENERAL FUND. OKAY IS THAT NOT ON THE LEGISLATION? THE PAPER LEGISLATION. IT'S ON THE PAPER LEGISLATION. GOOD GOOD. IT'S JUST NOT ON THE SIDE, NOT ON THE SLIDE, APPRECIATE THE CLARIFICATION OF POLITICS. UM THANK YOU, MAYOR. MID. THE MID YEAR REVIEW OF APPROPRIATIONS HAS BEEN COMPLETED AND CONTINUALLY REVIEWED EVEN OVER THE LAST COUPLE OF WEEKS. UM AND WE'VE DONE PRELIMINARY REVENUE PROJECTION UPDATES BASED ON THE FIRST HALF OF THE YEAR'S REVENUE ACTIVITY. THAT LEGISLATION HAS BEEN AMENDED SINCE FIRST READING TO INCLUDE ADDITIONAL ADJUSTMENTS, PRIMARILY RELATED TO CAPITAL PROGRAMS AND THE ADDITION OF TRANSFERS AND ADVANCES FROM THE GENERAL FUND FOR THE TAYLOR FARM TO PROJECT AND ROSE RUN TO UM THE PROJECT SHOULD COUNCIL DECIDED TO MOVE FORWARD. WITH THAT THOSE AMENDMENTS I PASSED OUT THE DETAILED LISTING OF. THE AMENDMENTS THAT WERE MAKING JUST TO ENSURE THAT YOU GUYS HAD IT. I KNOW IT WAS ALSO ATTACHED TO YOUR LEGISLATIVE REPORTS THE BLUE WITHIN THAT REPORT ARE ADJUSTMENTS THAT HAVE BEEN MADE SINCE FIRST READING. UM AND IT CONTAINS EXPLANATIONS ON THAT. I WANTED TO ALSO, UM, BRING

[00:20:02]

PROPOSAL FOR EVEN SINCE WE'VE BEEN ABLE TO SUBMIT THIS, THERE'S BEEN ADDITIONAL REVIEW.

AH AND SO THERE ARE ALSO GREEN. LINES WITHIN THIS, UM, THAT ARE I'M REQUESTING FOR THAT TO BE ADDED AS A FLOOR AMENDMENT AND JENNIFER, I HAVE THOSE WRITTEN OUT FOR YOU ON A LEGISLATION THAT SHOWS THE EFFECT, UM PRIMARILY. THE GREEN ADJUSTMENTS WERE PROPOSING, UM, INCLUDE APPROPRIATING THE TRANSFER THAT WOULD BE RECEIVED BY THE CAPITAL IMPROVEMENTS FOR THE TAYLOR FARM TO PROJECT AND THEN ALSO, THERE IS AN ADDITIONAL $250,000 INCLUDED, UM FOR TWO NEW AND REPLACEMENT DEPARTMENT VEHICLES. THAT WE WERE ABLE TO. UM I GUESS. YOU HAVE TO FIND AND IN THIS ENVIRONMENT AND THEN ALSO, THERE WAS, UH. AN ADJUSTMENT MADE IN REGARDS TO THE ROADS RUN TO APPROPRIATION TO REFLECT THE ADVANCE FOR THAT LIMITED MINISTER PROCEDURES SHOULD WE DECIDED TO GO FORWARD WITH THAT? REVENUE UPDATES HAVE BEEN AMENDED THE GENERAL FUND HAS BEEN UPDATED TO INCLUDE AN ADDITIONAL $2 MILLION IN REVENUE, PARTIALLY BECAUSE OF INCOME TAX REVENUE COMING IN HIGHER THAN ANTICIPATED, UM PRIMARILY FOR NET PROFITS AND INDIVIDUAL NOT NECESSARILY WITHHOLDING. UM SO WE'RE BEING CONSERVATIVE WITH ADJUSTING THAT REVENUE $1.1 MILLION OF THE $2 MILLION INCREASE IN GENERAL FUND IS RELATED TO THAT, UM, THE ADDITIONAL 900,000 IS ATTRIBUTED TO INTEREST REVENUE WE HAVE ALREADY EXCEEDED OUR. ANNUAL PROJECTION FOR INTEREST REVENUE IN THE GENERAL FUND. I THINK BY 30. $1000 JUNE 30. SO UH, WE WERE ABLE TO INCREASE THAT BY THE REMAINDER OF THE $900,000 CONSERVATIVELY IN ORDER TO ALLOW FOR MORE ABILITY FOR THE GENERAL FUND TO SUPPORT THESE EXPENDITURES. IN ADDITION, IF YOU RECALL THE ADOPTED BUDGET THAT, UM WE ADOPTED FOR 2023 HAD IT. $5.4 MILLION THAT WAS ATTRIBUTED TO ACCESS RESERVES THAT WOULD BE ABLE TO ACCOMMODATE THE TRANSFERS AND ADVANCES. ARTIST. I CAN GO THROUGH THE DETAILED LIST IF YOU WOULD LIKE ME TO OR IF YOU HAVE ANY QUESTIONS, I CAN CERTAINLY ANSWER THEM AS WELL. JUST SAY SOME OF THIS WILL INFORMATION ABOUT THOSE VEHICLES. WE HAVE THE EQUIPMENT REPLACEMENT FUND. MONEY IS AVAILABLE IN THAT FUND.

IT JUST WASN'T APPROPRIATED IN THE ORIGINAL BUDGET. THE STATE PURCHASING CONTRACT. HIS FOR THIS YEAR'S MODELS HAS EXPIRED, SO THERE ARE NO VEHICLES AVAILABLE AND STATE PURCHASING.

WE ACTUALLY HAVE BUILDING INSPECTORS CARPOOLING AND WE HAD TO INCREASE THE NUMBER OF STAFF IN ORDER TO ADDRESS THE INCREASE IN THE DEMAND RELATIVE TO THE INTEL PROJECT, AND SOME OF THE OTHER DEVELOPMENT THAT WE HAVE SO CARPOOLING BUILDING INSPECTORS DOESN'T WORK REAL WELL. UM AND WE WERE HAVING A DIFFICULT TIME FINDING VEHICLES WE ACTUALLY WERE ABLE TO FIND.

ACTUALLY A TOTAL OF FOUR VEHICLES THAT WILL ENABLE US TO SHIP VEHICLES AROUND. THOSE ARE TOYOTA RAV FOURS. ONE OF THE ADVANTAGES OF THOSE, ESPECIALLY IN TERMS OF CONSTRUCTION IS THAT THEY HAVE A CORRECT HIGHER GROUND CLEARANCE, AND THEY ARE ALL WHEEL DRIVE, SO WE'VE BEEN ABLE TO TAKE DELIVERY OF TWO OF THOSE WE HAVE TO LOOK FOR THOSE FROM TWO DIFFERENT DEALERS, SO THEY TRIGGER THAT $100,000 THRESHOLD WHERE WE WOULD HAVE TO BRING SOMETHING BACK TO COUNCIL, BUT I WANTED TO MAKE SURE THAT I BROUGHT IT TO YOUR ATTENTION, SO THIS SHOULD ENABLE US TO CONVERT OUR INSPECTOR FLEET TO THESE OTHER VEHICLES. THEIR CURRENT VEHICLES WILL BE REDEPLOYED TO OTHER EMPLOYEES WITHIN THE DEVELOPMENT. AND THEN ALSO RELATIVE TO THE TAYLOR FARM PHASE TWO AND THE ADDITIONAL APPROPRIATION FOR THAT. ADRIAN KIM CAN ADD TO THIS, BUT THE MAJORITY OF THE COST RELATED TO PROBABLY THREE THINGS. ONE WOULD BE THE EXTENSION OF THE UTILITIES. WHEN WE FIRST BUDGETED FOR THE PROJECT. WE DIDN'T ANTICIPATE THE EXTENSIVE COSTS ASSOCIATED WITH BORING UNDER THE BLACK OR THE ROCKY FORK CREEK. IN ORDER TO GET UTILITIES FROM THE WEST SIDE OF THE CREEK TO THE EAST SIDE IN ORDER TO PROVIDE PLUMBING TO THE TO THE PARK. ANOTHER COMPONENT WAS ABOUT. $600,000 ADD TO THE PLAYGROUND EQUIPMENT, WHICH WAS

[00:25:05]

ORIGINALLY PLANNED FOR PHASE TWO. WE MOVED THAT UP TO PHASE ONE BECAUSE THE. THE TRAIL COMPONENT WAS KIND OF WAGGING, AND ā– WE HAD THE OPPORTUNITY TO, UM, ADVANCED THAT THE WHAT WE WERE ABLE TO GET FOR THE BUDGETED AMOUNT WAS UNDERWHELMING. SO I MADE A DECISION TO MOVE THAT UP TO WHAT IT WAS DOING IS BORROWING FROM FUTURE BASE $2. AND WE APPLY THAT TO THE PLAYGROUND EQUIPMENT, SO WE HAVE SOME PHASE TWO WILL INVOLVE UH, THE COMMUNITY GARDEN, THE STRUCTURES THE ADDITIONAL BOARDWALK ADDITIONAL TRAIL. AND THEN THE SOFT COSTS ASSOCIATED WITH WITH THAT SO ALL IN WE'RE LOOKING AT ABOUT A ROUGHLY $2.5 MILLION INCREASED IN THE PROJECT. BUT WHEN THAT'S DONE WE EFFECTIVELY HAVE THROUGH OVER THREE MILES OF LEISURE TRAIL. UH EVERYTHING BUT THE HOMESTEAD AND THE BARN WILL HAVE BEEN. FULLY UM, FULLY DEVELOPED, FULLY FUNDED AND WE RESPECT THAT FACE TO BE COMPLETE. PHASE TWO. WHERE WE ARE NOW WITH JUDGES MENTIONED NOT THE BARN, NOT EVERYTHING ELSE WILL BE BRINGING THAT, UM GUARANTEED MAXIMUM PRICE TO YOU AT YOUR NEXT MEETING, BUT THE CONTRACTORS SCHEDULE HAS THEM.

UM. COMPLETING THE COMMUNITY GARDENS AND APRIL, UM MAY OF NEXT YEAR SO THEY COULD HIT THE GARDENING SEASON. AND THEN THE BOARDWALKS AND SOME OF THAT FINAL WORK WOULD BE DONE THROUGHOUT NEXT SUMMER. THE RESTROOMS GOING IN THIS SPACE WILL BE RESTROOMS IN THAT SAME APRIL MAY PERIOD NEXT YEAR NEXT YEAR. AND THEN THE YEAH RENOVATION OF THE HOMESTEAD AND THEN POTENTIAL RECONSTRUCTION OF A BARN. THERE WOULD BE PART OF THE THIRD PHASE, WHICH WOULD BE COMING SOMETIME DOWN THE ROAD. I DON'T ANTICIPATE THAT BEING A 2024 PROJECT. I THINK THAT WOULD BE MOVED MOVED FURTHER DOWN THE ROAD, DEPENDING ON WHAT COUNCIL'S WISHES ARE HEY, JOE, I THINK, UM AS FAR AS THE FLEET VEHICLES GO. NICE JOB FINDING SOME FLEET VEHICLES. I KNOW THOSE ARE VERY DIFFICULT TO FIND . NOWADAYS THAT INVENTORY IS EXTREMELY LOW, SO I'M GLAD TO HEAR THAT. I HAD ONE QUESTION EITHER FOR YOU OR FOR BETHANY, AND IT'S ON ITEM 11. OF THE APPROPRIATION ORDINANCE, AND THAT'S THAT. CAPITAL. 400,000 IT'S THE BEVEL HAMMER PURCHASE.

I KNOW WE HAD SPENT 4 MILLION TO GO AHEAD AND PURCHASE. CAN YOU JUST ADD SOME CONTEXT AROUND THAT ADDITIONAL 400,000 SURE, JUST TO CLARIFY THAT THAT IS ACTUALLY THE VALUE OF THE DONATION THAT WAS MADE BY THE PROPERTY OWNER. SO THE PROPERTY OWNER UH, I HAD THE PROPERTY APPRAISED AT A PRICE. THAT WAS $400,000 MORE THAN WHAT WE PAID FOR IT. UH SO THIS IS WHAT WE HAVE TO ACKNOWLEDGE THE VALUE OF THAT DONATION ON OUR BOOKS. SO WE'RE NOT. WE'RE NOT DONATING 400,000 TO ANYBODY WE'RE RECEIVING. UH WE'RE RECEIVING VALUE $400,000 MORE THAN WHAT WE PAID FOR THE PROBLEM. OKAY, SO THAT WAS INITIATED ON THE LANDOWNERS RIGHT BEFORE WE GOT THAT'S CORRECT. OK, THANKS. THEN BETHANY JUST BECAUSE IT'S A BIG NUMBER. I'M A WARRIOR, AND I DON'T DO MATH. VERY WELL, ACTUALLY. THAT LOVE. I FEEL LIKE ALL OF THESE ARE BIG MEMBERS, BUT, UM 32 SO THIS IS THE ECONOMIC DEVELOPMENT CAPITAL FUND, AND YOU A TRUE UP UP GREAT LOCAL BALANCE OF PREPARATIONS. NO, IT'S OVER 100 MILLION. SO IS THAT THAT'S REFLECTIVE OF MONEY SPENT MONEY COMING IN, OR JUST AN ADJUSTMENT WITHIN THAT FIGURE. SO ULTIMATELY, UM, THE OVERALL MONEY THAT WE'RE RECEIVING FROM THE STATE IS FROM TWO DIFFERENT SOURCES. SO NUMBER ONE. A BIG PORTION OF THAT ADJUSTMENT DOWN IS MOVING THAT TO THE ARCTIC FUND FOR WHAT WE ANTICIPATE SPENDING FOR THE REST OF THE YEAR IN 2023 TO BE APPROPRIATED.

IN ADDITION THAT I GUESS THAT'S WHAT A DIFFERENT LINE BEFORE THE THREE IS ON A DIFFERENT LINE.

UM, BUT ALSO UM WE WOULD. THE MONEY THAT IS RECORDED IN THAT FUND IS THE G R F MONEY, THE GENERAL FUND MONEY THAT WE RECEIVED IN THAT IS ALSO ADJUSTED DOWN TO WHAT WE ANTICIPATE COMPLETING THROUGHOUT THE END OF THE YEAR, SO THERE WOULD BE AN ADDITIONAL, UM LARGE APPROPRIATION FOR 2024 ONCE, UH, THAT IS DECIDED, AND OR THERE COULD BE AN ADJUSTMENT WITH THE FINAL PREPARATIONS AT THE END OF THE YEAR IF THINGS ARE EXPEDITED. ALRIGHT. ANY

[00:30:05]

ADDITIONAL QUESTIONS, STAN? BEFORE I OPEN THE PUBLIC HEARING AND JUST TO MAKE SURE THAT THE RECORD IS CLEAR TO THE CLERK AND EVERYONE ELSE I WOULD LIKE TO SORT OF AMEND THE ORDINANCE TO INCLUDE THE LANGUAGE THAT'S IN THE PRINTED OFF LEGISLATION IN AND INCLUDE THOSE ITEMS. UH, DIRECT YOUR THOUGHTS PRESENTATION THAT ARE DESIGNATED IN GREEN. SO I MOVED TO AMEND ORDINANCE 85 2023 SO THE TITLE READS AND ORGANS TO AMEND APPROPRIATIONS FOR CURRENT EXPENSES AND OTHER EXPENDITURES DURING THE FISCAL YEAR ENDING DECEMBER 31 2023 AND TO AUTHORIZE THE TRANSFER IN ADVANCE FROM THE GENERAL FUND. SECOND DIRECTOR STARTS PRESENTATION TO COUNCIL REGARDING SUMMARY OF EXPENSES AND PREPARATIONS AMENDMENTS TO INCLUDE THOSE ITEMS DESIGNATED IN GREEN AND HER PRESENTATION. SECOND. TO MAYOR SPAULDING SHELLS RISK? YES COUNCIL MEMBER DEREK FELLOWS? YES KISS? YES. COUNCIL MEMBER. WELL CHILD, YES.

YES, FOLKS TO MEND THE ORDINANCE AS MOVED BY THE MAYOR. AND WE'LL GO AHEAD AND OPEN THE PUBLIC HEARING. WOULD ANYONE FROM THE PUBLIC LIKE TO SPEAK REGARDING ORDINANCE 0 85 2023. THERE IS NO PUBLIC COMMENT WILL CLOSE THE PUBLIC HEARING AND I WOULDN'T MOVE FOR THE ADOPTION OF ORDINANCE. SO 85 2023 SECONDS. THEY'RE STARTING COUNCIL MEMBER KISS? YES. COUNCIL MEMBER, WELL, CHILD COUNCIL MEMBER SHELVES, FELLOWS. REMEMBER DEREK COUNCIL MEMBER BREAST? YES YES. VOTES TO ADAPT ORDINANCE 0 85 2023 AS AMENDED. ORDINANCE 0 86 2023, AN ORDINANCE TO AMEND THE CODE OF ORDINANCES CITY OF THE WOBBLING ON HOW TO PROVIDE NECESSARY AMENDMENTS TO CITY CODE SECTIONS . 187.03187 0.04. 187.07 AND 187.08 REGARDING THE ESTABLISHMENT SPECIAL FUNDS TO ADOPT AN INTERNAL CONTROL POLICY FOR THE MANDATORY DRUG FIND FUND REQUIRED BY OHIO REVISED CODE SECTION 29 25.03 F TWO AND FOR OTHER PURPOSES. GETS DOWN THIS ONE. THAT WOULD BE ME AGAIN.

OKAY UM, THANK YOU. VERY LEGISLATION UPDATES CITY CODE SECTIONS RELATED TO THE ESTABLISHMENT OF SPECIAL FUNDS FOR THE COLLECTION OF CERTAIN COURT COSTS AND FINES TO ALIGN WITH THE REQUIREMENTS SET FORTH IN THE HIGHER ADVISED CODE. IN ADDITION, THE LEGISLATION ADOPTS AN INTERNAL CONTROL POLICY AS REQUIRED BY THE AMENDED LANGUAGE SPECIFIC TO THE MANDATORY DRUG.

FIND FUN. UM THIS PARTICULAR FUNDS THAT HAVE BEEN ESTABLISHED WITH THIS CODE SECTION HAVE BEEN IN PLACE SINCE. LIKE THE NINETIES, UM, AND HAVE NOT BEEN UPDATED TO INCLUDE ADDITIONAL OR CHANGE LANGUAGE OF THE O. R C. AND SO THE UPDATES THAT ARE INCLUDED WITHIN THIS CODE CHANGE OUR THAT IS WHAT THEY'RE DOING, UM, THE FUNDS THAT ARE AFFECTED ARE THE INDIGENT. DRIVERS ALCOHOL TREATMENT FUND, THE ALCOHOL ENFORCEMENT EDUCATION FUND LAW ENFORCEMENT TRUST FUND AND THE MANDATORY DRUG FIND FUND . UM AND THESE PARTICULAR FUNDS COLLECT REVENUES RELATED TO FINES, COURT COSTS AND FORFEITURES, SEIZURE, PROPERTY OR SALE OF SUCH PROPERTY, AND THEY HAVE SPECIFIC USES FOR WHICH THE FUNDS MAY BE UTILIZED. UM AND SO THIS PARTICULAR UPDATE CLEARLY HELPS TO CLEARLY IDENTIFY HOW THOSE FUNDS MAY BE USED. IN ADDITION TO THE UPDATES TO THE CODE, THERE IS A SPECIFIC REQUIREMENT FOR THE MANDATORY DRUG FIND FUND THAT IT REQUIRES US TO ADAPT. THE REQUIRED REQUIRES INTERNAL CONTROL POLICY THAT SPECIFICALLY ADDRESSES THE USE OF THAT PARTICULAR FUND. THE DRUG FINDS THAT OVERSEE VDA. THESE PARTICULAR FUNDS ARE TO BE ALLOCATED DIRECTLY TO THE NORMANDY POLICE DEPARTMENT. AND SHALL ONLY BE USED TO PAY COSTS OF COMPLEX CASES, COSTS OF TRAINING AND PROVIDING TECHNICAL EXPERTISE. LOCAL SUPPORT FOR FEDERAL MATCHING FUNDS PURCHASES , SPECIAL EQUIPMENT AND WHERE OTHER RELATED PURPOSES ONCE ADOPTED, WE WILL PROVIDE THIS TO BOTH FRANKLIN AND LICKING COUNTIES IN ORDER TO MEET THEIR REQUIREMENTS TO CONTINUE THE PAYMENTS THAT ARE MADE TO NEW ALBANY ON BEHALF OF THE FINDS THAT THEY'RE COLLECTING FOR US. I WILL, UM, ALSO INCLUDE THAT WE HAD NOTICED WITHIN ONE OF THEM GOING TO ASK FOR ANOTHER FOUR AMENDMENTS WITHIN THE FOURTH, WHEREAS IT DOES NOT INCLUDE THE LICKING COUNTY MUNICIPAL COURT AND IT SHOULD WE NEED TO ADD THE LICKING COUNTY MUNICIPAL COURT AFTER FRANKLIN ME, JUST CALL COUNTY. RIGHT? AND I CAN ANSWER ANY QUESTIONS YOU HAVE. HMM.

[00:35:22]

OKAY. NICE CATCH. I DIDN'T WANNA HAVE TO COME BACK AGAIN. WARRIOR SITTING NEXT TO YOU. YEAH. HMM.

ALL RIGHT. ANY QUESTIONS OF STAFF BEFORE WE AMEND THE ORDINANCE AND THEN PRESENTED FOR PUBLIC HEARING ALRIGHT THEN I MOVE THAT WE AMEND ORDINANCE 0 86, 2023 AND SORT OF THE FULL LEGISLATIVE, UM LANGUAGE READS IN PARAGRAPH FOUR. WHEREAS SPECIFICALLY AS CURRENTLY ENACTED CITY CODE SECTION 187.9 AUTHORIZES CREATION OF A MANDATORY DRUG FIND FUND INTO WHICH SHALL BE DEPOSITED PROCEEDS BY THE FRANKLIN COUNTY MUNICIPAL COURT AND THE LICKING COUNTY MUNICIPAL COURT TO BE ALLOCATED ONLY TO THE CITY POLICE DEPARTMENT FOR CERTAIN PRESCRIBED PURPOSES. HERE YOU HAD SAID, UH, 09. AND I THINK YOU MEANT NO, THANK YOU. NO PROBLEM. SECOND THANKS, SIR. TWO. RESPONDING YES, YES, WELL, TROUT COUNCIL MEMBER KISSED, YES , YES, YES, YES. VOTES TO AMANDO 86 2023 FOR THE MAYOR'S MOTION AS CORRECTED BY COUNCIL MEMBER SHELL. ALL RIGHT, THEN WE'LL OPEN THE PUBLIC HEARING WITH ANYONE FROM THE PUBLIC LIKE TO SPEAK REGARDING AMENDED ORDINANCE 86 2023. HAVING NO PUBLIC COMMENT WILL CLOSE THE PUBLIC HEARING AND I WOULDN'T MOVE FOR THE ADOPTION OF AMENDED ORDINANCE 86 2023 2ND. MAYOR SPAULDING ERIC COUNCIL MEMBER WILL TRAP YES. COUNCIL MEMBER SHELLS? YES KISSED. REMEMBER, FELLAS? YES FOR US. YES YES. VOTES TO ADOPT ORDINANCE SO 86 2023 AS AMENDED. INTRODUCTION

[10. INTRODUCTION AND FIRST READING OF ORDINANCES]

AND FIRST READING OF ORDINANCES ALSO KNOWN AS THE CHRIS CHRISTIANS FOR YOU. GO AHEAD AND START WITH ORDINANCE 0 87 2023 AN ORDINANCE TO AMEND CHAPTER 1169 OF THE PLANNING AND ZONING CODE OF THE CITY OF NORTH QUALIFIED ORDINANCES, AS REQUESTED BY THE CITY OF NORTHERN MR CHRISTIAN. YES THANK YOU. AS YOU MENTIONED. THIS ORDINANCE PROPOSES TO UPDATE CHAPTER 11 69 OF THE CITY'S ORDINANCES CHAPTER 11 69 IS OTHERWISE KNOWN AS THE SANG CODE. OUR CITY STAFF PREPARE THESE UPDATES TO PROVIDE TO PERMIT AND PROVIDE REGULATIONS FOR ELECTRONIC DRIVE. THRU MENU BOARDS SIGNS AS REQUESTED BY THE PLANNING COMMISSION AND AS WELL AS CITY COUNCIL. OVER THE PAST YEAR AND A HALF OR SO THE PLANNING COMMISSION HAS REVIEWED AND APPROVED SEVERAL VARIANTS IS TO ALLOW ELECTRONIC MINI BOARDS TO BE INSTALLED ON PROPERTIES.

CURRENTLY, COACHES NOT PERMIT THEM TO BE INSTALLED. SOME OF THESE ELECTRONIC MANY WORDS SIGNS YOU MAY HAVE SEEN THROUGHOUT THE COMMUNITY THEY'VE BEEN INSTALLED AND BUSINESSES LIKE DUNKIN DONUTS, POPEYE'S AND WENDY'S, WHICH IS CURRENTLY UNDER CONSTRUCTION. WE ALSO ANTICIPATE SIMILAR VARIANTS REQUEST AT LEAST TWO OR THREE VARIANTS REQUESTS COMING IN THE NEAR FUTURE FOR THE SAME SIGN TYPE. AND EACH OF THESE CASES, THE PLANNING COMMISSION APPROVED THE VARIOUS REQUESTS WITH VERY SIMILAR SIMILAR CONDITIONS OF APPROVAL, WHICH ARE LISTED HERE ON YOUR SCREEN A B AND C. SO WE'RE DONE WITH OUR CODE UPDATE IS WE'VE AGAIN PERMITTED THE USE OF ELECTRONIC MENU BOARD SIGNS AND PROVIDED THESE THREE ADDITIONAL, UM, DEVELOPMENT STANDARDS OR REGULATIONS THAT MUST BE MATCH IF ONE IS PROPOSED TO BE INSTALLED. I CAN GO THROUGH THEM PRETTY QUICKLY AGAIN. THESE ARE ALL APPLIED. THESE HAVE ALL BEEN APPLIED TO THE VARIANCES THAT THE PLANNING COMMISSION HAS APPROVED IN THE PAST. SO THE FIRST ONE IS THAT SIGN MUST BE STATIC AND IT MUST NOT PERMIT OR IT'S NOT PERMITTED TO DISPLAY ANY FLASHING OR ANIMATED GRAPHICS. AUTOMATIC. DENVER MUST BE INSTALLED ON THE SIGN IN ORDER TO ENSURE THAT'S OVERLY BRIGHT, BRIGHT, LIKE AT NIGHTTIME, ESPECIALLY AT NIGHTTIME, AND THEN AGAIN AT NIGHTTIME. WE WOULD LIKE TO SIGN TO BE TURNED OFF WHEN THE BUSINESSES CLOSED. THE PLANNING COMMISSION DID REVIEW AND RECOMMEND THE ADOPTION OF THESE CO CHANGES DURING THEIR MEETING LAST MONTH, AND I'M HAPPY TO ANSWER ANY QUESTIONS THAT YOU GUYS HAVE. I'M TRYING TO REMEMBER THE PLANNING COMMISSION AND THERE'S A LOT OF DISCUSSION AROUND SORT OF WHERE THE SIGN MAY BE FACING, YOU KNOW. PEDESTRIAN ORIENTED. IT'S NOT TOWARDS THE STREET. IS THERE ANYTHING IN THE CODE THAT DEALS WITH THAT ISSUE? YEAH YOU'RE RIGHT. THERE WAS A LOT OF DISCUSSION ABOUT THAT. AND THEN WE ULTIMATELY DETERMINED THAT NUMBER TWO AND I APOLOGIZE FOR

[00:40:01]

NOT MENTIONING THAT MENTIONING THIS BUT THE EXISTING REGULATIONS FOR DRIVE THROUGH MANY BOARD SIGNS, IS THAT IT? THEY'RE NOT PERMITTED TO BE VISIBLE FROM ANY PUBLIC RIGHTS OF WAYS TO EITHER. IN MOST CASES THEY'VE BEEN INSTALLED BEHIND BUILDINGS. YEAH, YEAH, YEAH. UM . WHAT THESE LIMITED FOR CERTAIN TYPES OF ESTABLISHMENTS OR COULD COULD YOU KNOW, THE INSURANCE COMPANY ON THE CORNER PUT UP A SIGN. I THINK WE HAVE SOME PROHIBITIONS AGAINST SORT OF, YOU KNOW, ELECTRONIC BILLBOARDS, I GUESS IS THE WAY WE DESCRIBE THEM IN THE PAST. YEAH, THIS WOULD BE JUST, UM DRIVE THROUGH MANY BOARDS, SIGNS THAT ARE LESS THAN 32 SQUARE FEET IN SIZE, OKAY? BUT YEAH, TYPICALLY THERE UM THEY'RE BEING INSTALLED IN RUSSIA RESTAURANTS. UNLESS YOU'RE GONNA DROP THE RED SHIRTS. THANKS WE'RE GOING THIS LIMITED TO THERE IS JUST GONNA BE ONE SET OF SIGNS. AND I KNOW THEIR SQUARE FOOTAGE BECAUSE THAT SQUARE FOOTAGE BE DIVIDED BETWEEN MANY BOARD AND A PRE SALE BOARD. IT COULD BE AND IT HAS BEEN DONE THAT WAY IN THE PAST, UM BUT USUALLY THOSE SIGNS DEPENDING ON THE ZONING DISTRICT, BUT NINE TIMES OUT OF 10, THE PLANNING COMMISSION IS ALREADY REVIEWING REVIEWING AND EVALUATING THE APPROPRIATENESS OF THE SIGNS AS PART OF A PLAN OF DEVELOPMENT PLAN. WE HAVE SEEN A COUPLE OF FREE SOFTWARES THAT HAVE BEEN APPROVED THAT OUR DIGITAL AS WELL, BUT USUALLY THOSE ARE YOU KNOW, MUCH SMALLER IN SIZE COMPARED TO THE ACTUAL COURT ITSELF. OKAY? YEAH. CHRIS HAD A QUICK QUESTION ON I GUESS IT WOULD BE SECTION 11 69.04 PROHIBITED SIGNS. AND I. IS THAT GEARED TOWARDS PERMANENT? SIGNAGE THAT IS PROHIBITED OR CAN IT BE USED ON A TEMPORARY BASIS? SOME OF THE THINGS THAT ARE OUTLINED THERE LIKE THANK SEARCHLIGHTS. I'M THINKING OF SOMEONE'S OPENING UP. YOU HAVE BALLOONS, AND SOME OF THOSE THINGS IS THAT AVAILABLE, LIKE PROGRAMMED OPENING OR SOMETHING LIKE THAT, OR JUST NEVER. NOT TYPICALLY NOW, UM, THIS WOULD NOT. IT DOES PROHIBITIONS THAT APPLY TO PERMANENT AND TEMPORARY SCIENCE. YEAH. DID I KNOW THAT. JUST STICK TO THE CANNON.

CONFETTI THAT'S A LITTLE KID SEEMS TO WORK WELL, ALL RIGHT. ANY OTHER QUESTIONS? QUESTIONS TO CHRIS. EXCUSE ME. THANK YOU FOR DOING THIS. I APPRECIATE IT. I KNOW IT'S BEEN YEARS IN THE MAKING. IT FEELS LIKE I'M SURE FOR THE PLANNING COMMISSION IN PARTICULAR. ALL RIGHT, THEN WE'LL GO AHEAD AND SET THAT FOR SECOND READING OF PUBLIC HEARING AT OUR NEXT MEETING THAT TEXAS TO ORDINANCE 0 88 2023, NORTHERN'S TO AMEND THE ZONING ORDINANCE OF THE CITY OF NEW ALBANY BY MEETING THE ZONING MAP TO REZONE 78.16 PLUS OR MINUS ACRES OF LAND LOCATED IN THE EAST SIDE OF BABBITT ROAD FROM AGRICULTURAL, AGGIE AND LIMITED GENERAL EMPLOYMENT. LG TO LIMITED GENERAL EMPLOYMENT LG FOR AN ALREADY BE KNOWN AS THE BABBITT EAST ZONING DISTRICT, AS REQUESTED BY N. B. J HOLDINGS. LLC CARE. ERIN UNDERHILL, ESQUIRE. CHRISTIAN. THANK YOU.

SO, AS YOU MENTIONED THIS IS A REZONING APPLICATION REQUEST FOR APPROXIMATELY 78 ACRES LOCATED ON THE EAST SIDE OF BABBITT ROAD AND FRANKLIN COUNTY. SOME OF YOU MAY REMEMBER. EARLIER IN JULY CITY COUNCIL APPROVED THE ANNEXATION OF APPROXIMATELY 62 OR 63 ACRES, AND THIS GENERAL AREA WHICH IS INCLUDED IN THIS RESENTING YOUR QUEST. THE PROPOSED CLASSIFICATION IS LIMITED GENERAL EMPLOYMENT OR L G. IT WILL BE KNOWN AS THE BABBITT ROAD. LG'S ONLY DISTRACT , AND IT SERVES AS AN EXPANSION OF THE NORMALLY BUSINESS PARK. IN CASE YOU AREN'T FAMILIAR WITH WHERE THIS IS SOME LITTLE HARD TO READ THE WRITING ON THIS. I APOLOGIZE. BUT THIS RIGHT HERE IS BABBITT ROAD. WE'RE LOOKING AREA EAST OF THAT. THIS IS CAPTAIN PARKWAY. THIS IS AMGEN CURRENTLY UNDER CONSTRUCTION AND STATE ROUTE 1 61 UP HERE. SO IS THAT PART OF ANY HOLLAND UH, THE GENERAL AREA? YES. MHM. SO THE PROPOSED REZONING AREA IS ROUGHLY OUTLINED IN A STAR HERE , APOLOGIZE. THAT'S NOT SUPER SPECIFIC, BUT SOME OF THE NEIGHBORING USERS INCLUDE UNINCORPORATED AGRICULTURAL AND RESIDENTIAL LAND. IT'S EVERYTHING THAT IT'S REALLY GENERALLY NOT COLORED IN ON THE MAP IS AN INCORPORATED OR NOT IN THE CITY. AS WELL AS SOME OTHER COMMERCIALLY ZONED PROPERTY TO THE NORTH AND THE EAST. GENERALLY SAY ANYTHING IN BLUE AS A COMMERCIAL EXISTING COMMERCIAL ZONING DISTRICT. AND THE PROPOSED CLASSIFICATION IS VERY CONSISTENT AS WELL. UM YOU MENTIONED THAT THE PRESENTATION WITH THOSE EXISTING ADJACENT COMMERCIAL ZONING DISTRICTS AS WELL. IT'S JUST ANOTHER VIEW. ANOTHER SITE PLAN PROVIDED AS PART OF THE APPLICATIONS OF THE PROPOSED REZONING AREAS IN THIS YELLOWISH COLOR, AND THEN THE EXISTING COMMERCIAL ZONING DISTRICTS KIND OF SURROUND IT AND THIS PURPLE, REDDISH AND

[00:45:02]

BLUISH COLOR DOWN HERE. AS MENTIONED LEGISLATIVE REPORT, A LIMITATION TAX CAN ONLY ESTABLISH MORE RESTRICTIVE REQUIREMENTS THAT ARE THEN THOSE FOUND IN THE CITY CODE. THE PROPOSED TEXT INCLUDES MANY OF THE SAME REGULATIONS FOUND IN OTHER SIMILARLY ZONED ALGAE ZONING DISTRICTS IN THE IMMEDIATE AREA. I WILL JUST BRIEFLY MENTION A FEW OF THOSE.

THIS ISN'T MEANT TO BE CONSIDERED, LIKE AN ALL INCLUSIVE LIST SPENDING INS THAT PERMITTED USES IN THE ZONING DISTRICT INCLUDE MANUFACTURING PRODUCTION, GENERAL AFFECTS ACTIVITIES, WAREHOUSE AND DISTRIBUTION, DATA CENTER RESEARCH AND PRODUCTION USERS AGAIN ACTUALLY GENERATE. THOSE ARE CONSISTENT WITH THE PERMITTED USE SINCE AROUND THE SITE. MAXIMUM BUILDING HEIGHT OF 65 FT, WHICH IS CONSISTENT WITH OTHER COMMERCIALS ON PROPERTIES THAT ARE ADJACENT TO EXISTING RESIDENTIAL PROPERTIES. FORESIGHTED CITING SOUNDS SCREENING FOR ALL ROOFTOP MECHANICAL EQUIPMENT. IT'S A VERY TYPICAL STANDARD OPENING REQUIREMENT IN THE BUSINESS PARK. AS WELL AS AN INCREASED 100. FT. SETBACK FROM ANY RESIDENTIAL IS ON PROPERTY WITHIN THE 100. FT SETBACK, DEVELOPERS REQUIRED TO INSTALL 6 FT MOUND. AND A LANDSCAPE BUFFER ON TOP OF THAT MOUND, PROVIDING 75% OF PASSED THE SCREENING WITHIN FIVE YEARS OF PLANTING. THE PROPERTY OR THE REASON AREA AGAIN. GENERALLY OUTLINED ARE IDENTIFIED WITH THE STAR HERE IS LOCATED AND THE ENGAGED NORMALLY STRATEGIC PLANS MIXED USE FUTURE LAND USE CATEGORY. OFFICE AND COMMERCIAL USES LIKE THOSE PROPOSED ARKANSAS ARE JUST A COMPONENT OF THE NEXT USE. LINDY'S CATEGORY THE STRATEGIC PLANS INTENT FOR THIS AREA, IT'S PRIDE FOR EMPLOYMENT CENTER USES WHILE ALLOWING FOR THE INCORPORATION OF RETAIL OR EVEN RESIDENTIAL TYPE USES, IF APPROPRIATE, BASED ON, YOU KNOW, KIND OF THE CONTEXT OF UH, THE REZONING AREA. AS MENTIONED. THE PROPOSED USES ARE CONSISTENT WITH THE ZONING AND THE SURROUNDING AREA AND THE TEXT MEETS THE STANDARDS AND THE STRATEGIC PLAN AND IS CONSISTENT WITH OTHER AREAS IN THE BUSINESS PARK, THE ROCKY FOR A BLOCK OF REPORT AND PLANNING COMMISSION.

BOTH REVIEWED THE APPLICATION DURING SEPARATE MEETINGS. BOTH PARTIES UNANIMOUSLY PASSED MOTIONS RECOMMENDING APPROVAL OF THE REZONING REQUESTS, AND I'M HAPPY TO ANSWER ANY QUESTIONS.

CAN YOU CLICK BACK TO ANOTHER SCREEN, SIR? OBVIOUSLY THERE'S A UNIQUE FEATURE THERE WITH THE LAND CONNECTING TO GETTING PARKWAY? MM HMM. AND THAT'S JUST AS A REMINDER THAT THERE'S LIMITED OR NO ACCESS ON BATTERY ROAD FROM THE COMMERCIAL SIDE THAT IS CRACKED. I APOLOGIZE FOR NOT MENTIONING THAT IS THAT ARE THOSE MY PHONE'S NOT WORKING WELL, WE HAVE TO PULL UP ON GOOGLE MAPS, BUT ARE THERE RESIDENTIAL UNITS ON THE EAST SIDE OF FABRIC ROAD? THERE ARE A FEW, YES, SCATTERED AROUND IT SO THAT YOU CAN KIND OF MAKE THEM OUT THEIR LITTLE THEIR OUTLINED THESE LITTLE DOTS. OR AT LEAST RESIDENTIAL STRUCTURES. I'M SORRY ON THE EAST SIDE AND THE REASON I ASKED SOME MOUNTING REQUIREMENTS THAT HAVE BUT ANY RESIDENTIAL AND I JUST IS THERE ENOUGH LAND THERE FOR THAT MOUNTING IF IT'S REQUIRED. YES ACTUALLY. ON THE ON THE SOUTH END. DISCUSSED IN HELL.

WORKS GREAT. COME UP WITH SOME. THEY'RE SCREENING NEEDS SOONER THAN THE FIVE YEAR GROWTH REQUIREMENT. OKAY CORRECT. BASED ON BOTH EXISTING PLANT MATERIAL , AS WELL AS MOUNTING IN THE CHOICE OF PLAIN MATERIAL. CORRECT THAT WAS IT. IT WAS NOT A LIKE A FIRM SPECIFIC RIGHT? IT WAS JUST AN AGREEMENT THAT SHOULD SIT DOWN TOGETHER AND COME UP WITH SOMETHING THAT WORKED FOR EVERYBODY KNOWING WHERE THEIR HOUSES ARE. VIEWS ARE WHERE ANY CYCLE PLAN BUILDINGS WOULD BE LOCATED. STILL HAVING THE OPACITY REQUIREMENT AFTER THE FIVE YEARS, BUT SOMETHING TO SOMETHING TO GET THEM IN. YEAH IN ADDITION, SOMETHING SOONER, RIGHT RIGHT TO ANTICIPATE MY NEXT QUESTION, SO THANK YOU, TOM. APPRECIATE IT ANY OTHER QUESTIONS REGARDING THE ORDINANCE? WE'LL SET THAT FOR A SECOND READING IN PUBLIC HEARING AT OUR MEETING ON AUGUST 15TH. ORDINANCE 0 89. 2023 IN ORDINANCE TO AMEND THE ZONING ORDINANCE THAT THE CITY OF NEW ALBANY BY MENDING THE ZONING MAPS TO REZONE 11.4, PLUS OR MINUS ACRES OF LAND, LOCATED GENERALLY THE NORTHEAST CORNER OF BEACH ROAD IN GANDHI PARKWAY FROM AGRICULTURAL AGING AND LIMITED GENERAL EMPLOYMENT. LG TO INFILL PLANNED UNIT DEVELOPMENT I P U D FOREIGN AREA TO BE KNOWN AS CANTON BEACH NORTHEAST ZONING DISTRICT, AS REQUESTED BY N. B. J HOLDINGS LLC CARE ERIN UNDERHILL, ESQUIRE. MR CHRISTIAN. YES THANK

[00:50:01]

YOU. AND I WOULD JUST STATE ON THE OUTSET THAT THIS PRESENTATION THE NEXT PRESENTATION ARE VERY, VERY, VERY SIMILAR. SO IF IT SOUNDS LIKE I'M REPEATING MYSELF, I AM UM SO AS YOU MENTIONED THIS IS A REASONING REQUESTS FOR APPROXIMATELY 11.4 ACRES. THIS PROPERTY IS LOCATED AS YOU MENTIONED AT THE NORTH EAST CORNER OF THE BEACH ROAD AND, UM, PARKWAY. INTERSECTION IF YOU ARE UNFAMILIAR WITH WHERE THIS IS TRY TO ORIENT YOU HERE, SO DOWN SOUTH HERE, THIS IS THE EXISTING META CAMPUS OR THE FACEBOOK DATA CENTER CAMPUS.

THIS IS A VERTEX, THE RECYCLING CENTER FOR AXIOM AND THEN STATE ROUTE. 1 61 IS JUST OFF THE PAGE HERE AT THE TOP OF THE NORTH SIDE OF THIS IMAGE. AS YOU MENTIONED, THIS PROPERTY IS PROPOSED TO BE ZONED EU DE OR INFILL PLANNING DEVELOPMENT DUE TO THAT ZONING CLASSIFICATION.

ANY DEVELOPMENT ON THE SITE IS SUBJECT TO THE FINAL DEVELOPMENT AND REVIEW PROCESS, WHICH, AS YOU KNOW, IS REVIEWED AND APPROVED BY THE PLANNING COMMISSION AT A LATER DATE. THIS IMAGE HERE IS THE ZONING MAP AND THEN AGAIN, VERY ROUGHLY IDENTIFIES THE PROPOSED ENDING AREA IN A STAR HERE. AS YOU CAN SEE, THE PROPERTY IS COMPLETELY SURROUNDED BY LG ARE LIMITED GENERAL EMPLOYMENT COMMERCIAL TYPE DISTRICTS. SO REALLY, WHAT THIS PROPOSAL OWNING IS ATTEMPTING TO DO OR DOES IS CARRY OVER THE SAME REGULATIONS FOR RETAIL TYPE DEVELOPMENT THAT EXISTS AND BEACH CROSSING, WHICH IS AT THE CENTER, GENERALLY AT THE CORNER OF SMITHVILLE ROAD AND BEACH ROAD. SOME OF THE DEVELOPMENTS THAT ARE KIND OF GOING ON IN THE AREA, INCLUDING HOTEL ON BEACH ROAD AS WELL AS I'M SURE YOU HAVE SEEN THE DUKE AND DUCHESS BOOK, WHICH LOOKS VERY SIMILAR TO THE ONE THAT EXISTS OUT HERE IN THE U. S. 62. SO THIS PROPOSED ANY DISTRICT CARRIES OVER MANY OF THOSE EXISTING DEVELOPMENT STANDARDS. LIKE CROSSING THE PROPOSED ANY DISTRICT WOULD FACILITATE THE DEVELOPMENT OF OFFICE SERVICE, RETAIL, RESTAURANT AND GASOLINE SERVICE STATION USERS TO SERVE EMPLOYEES WITHIN WITHIN THE NORMAL BUSINESS PARK AS WELL AS ANYONE TRAVELING ALONG STARE AT 1 61. THE TAX CARRIES OVER MANY OF THE DEVELOPMENT STANDARDS THAT EXIST IN OTHER RETAIL TYPE ZONING DISTRICTS THAT HAVE PROVEN DV TO BE VERY SUCCESSFUL OVER TIME. SOME OF THESE STANDARDS INCLUDED PROVIDING PEDESTRIAN CONNECTIVITY THROUGHOUT, PRESENTING DISTRICT PROVIDING STRONG INSTINCT ARCHITECTURAL, UM, ARE PROVIDING STRONG AND DISTINCT ARCHITECTURE REQUIREMENTS AS WELL AS SCREENING FOR ALL ROOFTOP MECHANICAL UNITS. DUE TO THE CRAP THE PROPERTIES PROXIMITY TO THE STATE ROUTE. 1 61 INTERCHANGE STAFF DOES BELIEVE THAT PROVIDING THESE SORTS OF USES AS APPROPRIATE IN THIS AREA AND WILL SERVE TO PROVIDE AMENITIES AGAIN AS I MENTIONED TO OUR BUSINESS PARK EMPLOYEES AS WELL AS THOSE TRAVELING ON ALONG THE RIGHT 1 61. LIKE THE SITE THAT I JUST TALKED ABOUT.

THE SITE IS LOCATED AND THE ENGAGEMENT NOMINEE. STRATEGIC PLANS MIXED USE FUTURE LAND DISTRICT AS I MENTIONED, UM BE INTENT OF THIS DISTRICT IS PROVIDE EMPLOYMENT GENERATING USES BUT ALSO ALLOWED FOR, YOU KNOW, RETAIL AND DIFFERENT TYPES OF COMMERCIAL DEVELOPMENT HAPPENED WHERE APPROPRIATE. UM IN JULY, THE COMMISSION DID REVIEW THE APPLICATION AND PASSING UNANIMOUS MOTION TO RECOMMEND ADOPTION FROM THE COUNCIL. I'M HAPPY TO ANSWER ANY QUESTIONS. ALRIGHT. ANY QUESTIONS TO STAFF REGARDING ORDINANCE REALLY NICE. AND WE WILL SET THAT FOR A SECOND READING IN PUBLIC HEARING IN OUR MEETING EYES 15. HMM ORDINANCE SO 1920 23. NORTON'S TO AMEND THE ZONING ORDINANCE IN THE CITY OF NEW ALBANY BY MANY OF THE ZONING MAP TO REZONE 12.8 PLUS REMINDED ACRES OF LAND. GENERALLY LOCATED TO THE SOUTH, WEST OF AND ADJACENT TO STAY AROUND 1 61 BEACH ROAD INTERCHANGE FROM OFFICE. CAMPUS DISTRICT. OCD TO INFILL PLANNED UNIT DEVELOPMENT I P U D. FOR AN AREA TO BE KNOWN AS BEACH INTERCHANGE SOUTHWESTERN DISTRICT DISTRICT, AS REQUESTED BY N. B. J HOLDINGS CURE UNDERHILL, ESQUIRE. MR CHRISTIAN. YES AGAIN. THANK YOU . AND AGAIN. THIS IS WHAT I'M ABOUT TO SAY. IT'S VERY SIMILAR TO WHAT WAS SAID BEFORE, SO I'LL TRY TO BE BRIEF, BUT GIVE YOU KIND OF A GENERAL IDEA OF WHAT'S HAPPENING, SO THE REQUEST IS FOR APPROXIMATELY 12.8 ACRES TO BE REZONED TO STUDY AS GENERALLY OUTLINED IN THE IMAGE HERE IN RED UH, VERY, VERY CLOSE TO THE AREA THAT WE WERE JUST DISCUSSING THE BIG ROAD HERE IS STAYING AT 1 61 HEARS AXIOMS VERTEX RECYCLING PLANT AND THEN THAT AREA WE WERE JUST TALKING ABOUT IS JUST OFF THE PATRIOT OF THE SOUTH. SO LIKE THE OTHER APPLICATIONS, THE PROPOSED ZONING CLASSIFICATION IS IT PD, WHICH WE REQUIRE ANY FUTURE DEVELOPMENT TO BE REVIEWED BY THE PLANNING COMMISSION VIA

[00:55:02]

FINAL DEVELOPMENT APPLICATION? SOME OF THE SORRY I'M JUMPING AHEAD OF MYSELF. SO WE HAVE THE SITE OUTLINES KIND OF IN THIS RED STAR HERE AGAIN. IT IS, AS YOU CAN SEE, SURROUNDED BY COMMERCIAL, UM, ZONING CLASSIFICATION, SOME OF WHICH INCLUDE LG OFFICE CAMPUS AND IPTV. I WON'T REITERATE EVERYTHING I SAID DURING THE LAST PLACE OF PRESENTATION, BUT THE PROPOSED OWNING CLASSIFICATION DOES ALLOW FOR RETAIL TYPE USERS OFFICE ACTIVITIES, GAS SERVICE STATION FACILITIES, AS WELL AS RESTAURANTS THAT WILL SERVE AS AMENITIES AND THE NOBODY BUSINESS PARK. THE SITE IS ALSO AGAIN LOCATED IN THE ENGAGEMENT COMEDIES. STRATEGIC PLAN. STRATEGIC PLANS. MIXED USE, LAND USE CATEGORY. THE PLANNING COMMISSION DID ALSO REVIEW THIS APPLICATION IN JULY AND RECOMMENDED UNANIMOUSLY RECOMMENDED APPROVAL OF THE REASONING REQUEST. I'M HAPPY TO ANSWER ANY QUESTIONS. JUST A QUICK QUESTION WERE JUST HAD A SITE COMMENT THERE USED THERE WAS OR IS A FITNESS CENTER THERE THAT EDGE ATHLETIC AND FITNESS CENTER AND THEN OR IS IT STILL THERE? OR IS IT NOT THERE ANYMORE, IS NOT. THERE'S NOT A STRUCTURE ON THE SITE, RIGHT? THANK YOU. AND THAT LITTLE NOTCH PIECE THERE AND ENVIRONMENTAL REASONS WHY THAT'S NOT PART OF THE PARCEL. LET TOM TAKE THAT ONE IS NOT AN ENVIRONMENTAL. IT IS HEAVILY WOODED EQUIPMENT ON THAT PARCEL. WE DON'T CONTROL THAT PIECE. WE HAVE ACTIVELY TRIED TO ACQUIRE THAT PIECE FOR A VERY LONG TIME AND HAVE NOT BEEN ABLE TO COME TO ANY KIND OF AGREEMENT WITH THAT PROPERTY. INTER THEY LIVE GEORGIA, FLORIDA SOMEWHERE SOUTH UM SO WE'RE PROCEEDING WITH THIS APPLICATION WITHOUT IS THERE ANY REQUIREMENT FOR RIGHT AWAY DEDICATION SO THEY COULD GET THE ROADWAY OR GOOD QUESTION SO THAT PARTIALLY USED TO BE LARGER. AND IT WAS TAKEN. IT WAS A TAKE. EXCUSE ME BIO DOT DOT WHEN 1 61 WAS BUILT, UNDERSTOOD? OKAY ANY OTHER QUESTIONS REGARDING THE ORDINANCE? AND IT'S JUST WOODED, RIGHT? YEAH IN THERE ARE WEAPONS IN THAT IN THAT PIECE IS INHABITED BY THE PROPERTY OWNER.

THERE ARE NO STRUCTURES ON. ANY ADDITIONAL QUESTIONS. AND WE'LL SET ORDINANCE 90 FOR SECOND FOR SECOND READING PUBLIC HEARING IN OUR MEETING ON AUGUST 15TH. RESOLUTIONS ON PUBLIC HEARING NON NON TONIGHT'S AGENDA. WOULD ANYONE CARE TO MAKE A STANDING COMMUNITY REPORT? REPORTS YOUR

[13. REPORTS OF REPRESENTATIVES]

REPRESENTATIVES JOANIE UP THERE FROM OR NO MEETING, THEY WILL BEGIN THEIR THE SECOND HALF SCHEDULE IN AUGUST. THEY WERE THEY HAD A BREAK DURING THE MONTH OF JULY, OKAY? ANY UPDATE FROM THE PARKS AND TRAILS? NO, THEY HAVE A MEETING NEXT WEEK, SO I'LL HAVE A REPORT ON OUR NEXT COUNCIL MEETING. AND LOCAL SCHOOLS, NO MEETING ANYTHING FROM THE TOWNSHIP, NO BEATING, BUT THEY ARE MEETING TOMORROW AND THEY WILL BE COMPLETING THE DECISION ON THE STORAGE FACILITY ON WALNUT. BUT THEY HAVE EXTENDED FOR A MONTH FROM THE PRIOR MEETING. UNDERSTOOD WHAT TIME IS THAT MEETING 6 30 TOMORROW AT THE FIRE STATION FIRE STATION. NORMALLY THEY MEET AT SEVEN. BUT IT'S 6 30 TOMORROW. I AM OR PM? YEAH OKAY . I ASK BECAUSE THEY THEY'VE DONE MORNING MEETINGS. YEAH. SEVEN O'CLOCK. ALRIGHT REPORTS YOUR REPRESENTATIVES AGAIN AND

[14. REPORTS OF CITY OFFICIALS]

THANKS TO EVERYONE THAT HAD THE CHANCE TO ATTEND THE TASTE OF THE ALBANY. IT WAS A GREAT EVENT. EVERYTHING WAS GREAT WITH THE WEATHER UNTIL I MENTIONED THE WEATHER, AND THEN IT RAINS ON MY CHEAP WITHOUT A LID, WHICH IS GREAT. NO, REALLY. IT'S ALL WATER RESISTANT, RIGHT? BUT AGAIN, IT WAS, YOU KNOW, SOME SOME NEW PARTICIPANTS. UH, YOU KNOW, AND THAT SEEMS TO GROW EVERY YEAR WE HAD ALMOST ALMOST 1000 REGISTERED GUESTS. SO THE EVENT YOU KNOW IT WAS AGAIN WELL PLANNED, WELL EXECUTED. I HOPE NO ONE LEFT HUNGRY. THE LINES GOT A LITTLE LONGER TIMES, BUT, UM, THERE WAS PLENTY OF FOOD TO GO AROUND. SO AGAIN, JUST ANOTHER GREAT NIGHT IN NEW ALBANY. UM AS A FRIENDLY REMINDER THURSDAY, I THINK CONCLUDES OUR FREE CONCERT SERIES. THE BAND IS A JOURNEY COVER BAND, WHICH STAFF IS REALLY EXCITED ABOUT, I GUESS THEY THEY'VE BEEN PLAYING IT THROUGHOUT THE BUILDING FOR SOME TIME, SO EVERYONE'S JAZZED UP FOR IT SO HOPEFULLY, WE'LL SEE YOU OUT THERE AT SEVEN O'CLOCK ON THURSDAY FOR ANOTHER BEAUTIFUL NIGHT AT THE AMPHITHEATER. IF YOU HAVEN'T HAD A CHANCE TO COME OUT FOR ONE OF THOSE, IT'S UH IT'S PRETTY FUN. IT'S A NICE, YOU KNOW, VERY RELAXED ATMOSPHERE AND A

[01:00:03]

BEAUTIFUL SETTING. HMM AND THANKS TO CRUCIAL PULLING THIS ALL TOGETHER. I MEAN, SHE'S BEEN A LOT IN A SHORT PERIOD OF TIME. THIS JOURNEY COVER BAND MEAN ONLY JOURNEY SONGS. OR UH, YOU KNOW, I ASKED THAT I ASKED THAT SAME QUESTION. I GOT THE IMPRESSION THAT THEY DO PLAY OTHER MUSIC, BUT THAT'S THEIR THAT'S WHAT THEY'RE KNOWN FOR. BECAUSE OF THEIR ANOTHER BAND, ALSO PLAYING, UM YOUNGER GROUPS FROM NEW ALBANY. WE ACTUALLY HAD TWO BANDS THAT WERE NEW ALBANY PERFORMER. STUDENTS ONE DROPPED OUT IN ONE BROKE UP, SO WE FOUND OUT THE JOURNEY COVER BAND.

THAT'S HOW WE GOT OKAY. THE OTHER TWO FREE CONCERTS WE DID THIS SUMMER BOTH AND THEY WERE WONDERING. YEAH THEY WERE REALLY WONDERFUL, UNFORTUNATE AND ROLL MAN SOUNDS SOUNDS LIKE QUITE THE JOURNEY. JOURNEY KEEPS GOING ON. AND A REPORT FROM THE CLERK. I'M SO EXCITED TO ANNOUNCE THAT OUR CAPITAL PROJECTS WORKSHOP WILL BE MONDAY. SEPTEMBER 11TH. WE'RE GOING TO START AT 10 10 AM COME COUNCIL MEMBER WILL TRY IT WILL BE RUNNING TO JOIN US, BUT WE'LL PROBABLY RUN ABOUT LIKE 10 TO 4 ISH LUNCH WILL BE PROVIDED AND I WAS GOING TO ASK COUNSEL IF YOU HAD ANY TASTE IN NEW ALBANY RECOMMENDATIONS CRUMBLE COOKIES ON TOP FROM FROM YOUR TASTING, IF NOT THINKING CHICKEN SHOT.

CHICKEN SALAD CHICK IS VERY EASY TO CATER. UM BUT HAPPENED TO TAKE SUGGESTIONS. BUT WE HAVE SOME TIME TO WORK ON THAT. YOU JUST LET ME KNOW AND ALSO REGARDING THE WATER BOTTLE IDEA , COUNCIL MEMBER DIRECT. REMEMBER THAT WE HAVE MANUFACTURER. IN WHAT? BILLY BOTTLES? YEAH SO, UM SARAH FROM DEVELOPMENT IS FOLLOWING UP ON THAT TO SEE IF YOU CAN PURCHASE THEM DIRECTLY FROM THEM BY LOCAL BUT YOU'RE ALSO WELCOME. BRING IN SOME, AND I WILL USE THOSE AS WELL. APPRECIATE COUNCILS INTEREST IN MY LITTLE PROJECT FRIENDS BRINGING MY OWN WITH SOME WATER BALLS BECAUSE I KNOW THEY WANT TO HELP SPONSOR ALREADY BEING DISCUSSED PURPOSE WHEN YOU'RE DONE, JUST WALK AWAY . LEAVE HIM THERE. I WILL SHARPEN. SHARPEN YOUR INITIALS ON THE BOTTOM UNDERSTAND THAT WILL GO IN THE DISHWASHER. SOMETIMES THEY HAVE PAINT THAT MAY DEGRADE OVER TIME. IF YOU'RE OKAY WITH THAT, UM, THAT'S THAT'S WHAT'S IN THE WORK, AND MAYBE THERE'LL BE SOME MORE BOTTLES TO CHOOSE FROM SOON. OKAY THAT'S IT FOR ME WAS THE TIME AGAIN FOR SEPTEMBER. 11 A.M. THAT'S A SERVICE EMAILS AND CALLS IN EARLY AT THE SERVICE.

NOW WE WILL BE UP TO PUBLIC SERVICE AGAIN. RIGHT? OKAY? ALRIGHT. ANYTHING FROM THE FINANCE DIRECTOR? YES UM, FIRST I WANTED TO LET YOU GUYS KNOW THAT OUR AUDIT HAS BEEN COMPLETED AND SUBMITTED TO THE STATE AND HAS BEEN SUBMITTED TO GF AWAY FROM THE CERTIFICATION PROGRAM. UM THANK YOU TO ALL THE STAFF AND EVERYBODY THAT HELPED WITH THAT. UM. THE NEXT I DID PASS OUT THE JUNE AH MONTHLY SUMMARY, AND, UM, JUST A COUPLE OF HIGHLIGHTS. WE ARE AHEAD AND REVENUE WERE ABOUT 65% OF COLLECTIONS OF OUR BUDGET COMPARED TO 50% COMPLETION OF THE YEAR AND WE'RE ONLY APPROXIMATELY 38% OF EXPENDITURES FOR THE GENERAL FUND OPERATING WHICH IS A PLUS SIDE. CURRENTLY WE'VE ADDED $9.2 MILLION TO THE GENERAL FUND. UM AND CASH. SOMETHING YOU KNOW IF YOU LOOK DOWN AT THE INCOME TAX BREAKDOWN, UM YOU KNOW, INCOME TAX REVENUE IS, YOU KNOW THE MOST THE MAIN REASON FOR THE INCREASE IN REVENUE? OBVIOUSLY THERE'S ABOUT A $2.6 MILLION INCREASE, HOWEVER, THAT INCREASES ATTRIBUTED TO NET PROFITS AND INDIVIDUAL TAX WITHHOLDING IS ACTUALLY LAGGING A LITTLE BIT BEHIND, BUT IT'S SIMILAR TO LAST YEAR, SO WE'RE CONTINUING TO LOOK INTO THAT AND ENSURE THAT OUR REVENUE PROJECTIONS ARE KEEPING PACE AND UP TO DATE. RIGHT. THANK YOU. UM AND THEN THE SECOND PAGE IS YOUR ALL FUNDS. I CAN ANSWER ANY QUESTIONS ON THE ACTIVITY THERE , AND THE LAST PAGE IS THE INVESTMENT SUMMARY. UM LAST TWO PAGES, I SHOULD SAY AND JUST, UH , I'M SURE YOU'RE AWARE OF THE FED RAISED THE RATES AGAIN LAST WEEK. BY 0.25% SO OUR STAR OHIO RATE AT 6 30 WAS AT 5.41% WHICH IS WHERE A LOT OF OUR FUNDS ARE . THAT AREN'T AREN'T, UM, SHOWN ON THE CUSTODY STATEMENTS ON THE LAST PAGE, AND THEN TODAY A. IT'S APPROXIMATELY 5.59% WHICH IS REPRESENTATIVE OF THAT INCREASE. OKAY. ANY QUESTIONS? SO THE MANAGER ANY UPDATE JUST A COUPLE OF QUICK THINGS. I THINK

[01:05:10]

WE ARE FINALLY SEEING SOME PROGRESS ON THE PAVING OF THE LEISURE TRAILS AT THE FIRM UNDER PHASE ONE. AND I'VE BEEN TOLD THAT THEY SAID THEY HAVE ABOUT FOUR DAYS OF PAVING. SO HOPEFULLY IF WE DON'T GET ANY SUBSTANTIAL RAIN TOWARD THE END OF THIS WEEK, WE MIGHT FINALLY SEE THAT PART OF THE PROJECT COMPLETED. MY FINGERS CROSSED, OKAY. AND THEN AS I WAS HEADED UP TO THE WAGNER CEMETERY THIS AFTERNOON TO TALK TO THE CONTRACTOR I DROVE PAST THE I DON'T KNOW. 60 TO 1 61 PROJECT AND I WAS PLEASANTLY SURPRISED AT THE PROGRESS THAT THEY'RE MAKING OUT THERE THERE WELL AHEAD OF SCHEDULE, AND THE PROJECT IS REALLY STARTING TO SHAPE UP. YOU CAN KIND OF GET A FEEL FOR WHAT IT'S GOING TO BE LIKE WHEN IT'S COMPLETED. MIKE, I THINK THAT WAS THE RIGHT REQUIRED COMPLETION DATE AND THAT WAS NOVEMBER DECEMBER. IT'S THE END OF THE YEAR, BUT IT WAS GENERALLY TRACKING TOWARDS THE BEGINNING OF DECEMBER, BUT I THINK THAT I THINK WE'RE GOING TO BE BEATING THAT, UM BY FAIR AMOUNT. THERE'S STILL A LOT OF FINISHED WORK AND KIND OF THE SPECIAL MATERIAL WORK TO COME, WHICH I THINK THAT TAKES A LITTLE MORE TIME, BUT SHOWING SANDS HAS DONE I THINK PARTICULARLY GREAT JOB OUT THERE MANAGING TRAFFIC AND MANAGING SCHEDULE AND JUST KEEPING THE PROJECT MOVING IN THE FORWARD DIRECTION, SO IT'S BEEN IT'S BEEN GREAT, GREAT PARTNER. WHEN THE BRIDGE WORKS GOING TO BE DONE BY ODA THERE. DO WE KNOW WHEN THAT'S GOING TO START THE WHITE, ANOTHER BRIDGE? MHM YEAH , I CAN. I CAN GET A BREAKDOWN OF THAT SCHEDULE. I BELIEVE THAT YOU KNOW, CORNER CAUSING HAS BEEN AWARDED THE PROJECT. THEY'RE MOBILIZING TO THE SITE NOW. UM, SO YOU'LL NOTICE A LOT OF CONES ALONG 1 61. THEY HAVE A CONSTRUCTION ZONE LAY DOWN AREA ALREADY SET UP. I THINK IT'S AT THE BEACH ROAD INTERCHANGE RIGHT NOW. UM SO I WILL. I'LL FOLLOW UP ON THAT AND GET YOU A MORE DETAILED TIMEFRAME AS TO WHEN WE SHOULD EXPECT TO SEE THE WORK ON THE BRIDGE AT 62. I'M ASSUMING THAT THEY DO ANY DAMAGE TO OUR EXISTING TO OUR NEW WORK THERE. THEY WILL. A PAIR OF THAT HAVEN'T EVEN AS THEY FOUND IT TO SPEAK CORRECT AND OUR OUR TEAM AND A LARGE PART GOES OUT TO PRIME CMS WHO IS THE CONTRACTOR THAT IS HELPING FACILITATE MANAGE THE 60 TO 1 61 PROJECT BOARD FOR THE CITY. THEY HAVE ALSO BEEN HIRED BY OH DOT TO DO THAT SAME ROLE FOR THE 62 WIDENING PROJECT. SO WE WERE VERY FORTUNATE TO HAVE HAD AN ACTIVE SEAT AT THE TABLE AND HAVE OH DOT INVOLVED IN OUR PROGRESS MEETINGS. SUCH THAT THERE WAS A VERY HIGH LEVEL OF COORDINATION TO THE WORK BOTH ALONG 62 FOR OUR PROJECT, AND THEN THE SUBSEQUENT WORK THAT OH, DOT IS GOING TO BE DOING THEY'RE GOING TO NEED ACCESS TO THE UNDERSIDE OF THE BRIDGE STRUCTURE THAT ACCESS IS GOING TO BE ACHIEVED THROUGH OUR PROJECT. SO WE, UH, WITH WORKING WITH SHELLY AND SANDS, WE WE'VE ACCELERATED CERTAIN PORTIONS OF THE PROJECT TO BE TO ENSURE THAT WE'RE OUT OF THEIR WAY. JUST WORKING VERY COOPERATIVELY AS A TEAM, SO I THINK IT'S BEEN A GOOD A GOOD SHOW OF COLLABORATION ON ALL INVOLVED, SO I THINK WE'RE IN A GOOD PLACE. THAT'S GREAT PLANNING. THANK YOU. YEAH IT'S FANTASTIC WORK. YEAH THANK YOU. THEN UM, YEAH, JUST I THINK THERE'S SOME TIME FOR US TO MAKE A FINAL DECISION. BUT IS THERE ANY INTEREST IN GETTING ON OUR CONTRACTORS CALENDAR FOR 2025 IN THE EVENT THAT HE'S NOT ABLE TO FINISH ALL THE WORK THIS YEAR. LISTEN TO THE GRAVESTONE RESTORATION CONTRACTOR. AGAIN WE HAVE TIME. I DON'T WANT TO JUMP THE GUN. HE I THINK HE IS SCHEDULED TO HAVE PROBABLY SIX MORE WEEKS OF WORK BEFORE HE HAS TO MOVE ON TO HIS NEXT SCHEDULED CONTRACT, BUT. HE SAID. AS OF TODAY, HE'S BOOKING WORK INTO JUNE OF 2025. WOW HE'S THE ONLY GUY RIGHT GOING ANYWHERE SOON.

YEAH GOING IN. REALLY YEAH. I MEAN, YOU CAN ONLY DO IT WITH HIM. ARE YOU GONNA DO I MEAN, YOU COULD TENTATIVELY HE AND HE SAID HE'S NOT WORRIED, HE SAID, IF YOU DECIDE LATER THAT YOU WANT TO CANCEL, HE SAYS HE HAS PLENTY OF WORK TO FILL IN, SO HE'S NOT WORRIED ABOUT IT. BUT I JUST WANT TO KNOW IF YOU WANTED TO GET A TENTATIVE SPOT ON THIS CALENDAR. I THINK WE SHOULD FINISH IT. COME TOO FAR ENOUGH. OKAY AND THEN THE LAST BACK TO TAYLOR FROM A QUICK HIS FACE MINOR SCOPE OF WORK DONE. ONE ST PAVED WITH PHASE ONE. AND THEN HE ADDED HIM THEY SHOULD BE OUT OF THERE. YES THEY'RE NOT ON THE HOOK FOR ANYTHING FACE TO KNOW THEY HAVE NO INVOLVEMENT WITH

[01:10:04]

PHASE TWO. SO ONCE THE PAYMENT IS DOWN, THERE'S A FINAL RESTORATION EFFORT, WHICH IS KIND OF RECEDING SOME AREAS AND JUST UM, KIND OF JUST SOME CLEANUP OF SOME SOME AREAS THAT THEY'VE WORKED IN WITHIN THE PROJECT AREA. BUT BEYOND THAT THERE'S SCOPE OF WORK IS VERY NEAR. TO THE END HERE, SO IT'S GOOD. AND THEN THE COUNCIL WHEN WE WERE DEALING WITH THE HAMLET PROJECT COUNCIL COMMITTED TO THE RESIDENTS THAT WE WOULD HAVE A SERIES OF MEETINGS TO DISCUSS TRANSPORTATION AND PEDESTRIAN ACCESS. SO I'LL BE SENDING YOU OUT AN EMAIL. I THINK WE'VE SCHEDULED MEETINGS ON MONDAY, AUGUST 28 AND WEDNESDAY, AUGUST 30TH SO WE WILL BE SENDING OUT MORE INFORMATION PROBABLY TOMORROW, BUT NO LATER THAN THURSDAY. THAT'S ALL HIM. IT COULD HAVE BEEN UP. ALRIGHT MR MOSHER. ANY UPDATE FROM LEGAL COUNSEL? THANK YOU. I GUESS I'LL JUST INTRODUCE MYSELF TO THOSE WHO DON'T KNOW ME BECAUSE I DIDN'T HAVE ENOUGH TIME TO INTRODUCE MYSELF BEFORE I GRABBED MY CHAIR TONIGHT, SO I'M DAVID MOSER ARE NOT BEEN ALBRECHT, OBVIOUSLY SO I'M YOUR ASSISTANT DIRECTOR OR DEPUTY LAW DIRECTOR. WHATEVER YOU'D LIKE TO CALL ME. UM BEN HAD A HEARING PUBLIC HEARING IN ANOTHER AREA. THAT STARTED LAST NIGHT THAT TRAILED OVER INTO TONIGHT. SO UNEXPECTEDLY, HE WAS PRETTY MUCH LAST MINUTE UNABLE TO BE HERE, SO THANK YOU FOR MAKING MY JOB EASY TONIGHT, AND I HAVE NO OTHER REPORT. ALL RIGHT. THANK YOU FOR JOINING US. APPRECIATE IT. PAUL FROM PUBLIC COMMENT ANYONE FROM THE PUBLIC LIKE TO

[16. POLL FOR COUNCIL COMMENT]

ADDRESS COUNCIL REGARDING A MATTER THAT WE DISCUSSED ON TONIGHT'S AGENDA. PUFFER COUNCIL COMMENT AND ADDITIONAL COUNSEL COMMENTS. UH UM, I THINK THEY'RE YEAH, THERE'S GONNA BE SOME PICTURES. I JUST WANT TO SAY THANKS TO CHIEF AND HIS STAFF. I WAS A NEIGHBORHOOD TIME BUT THE COPS AND BARBERS EVENT AND WE'RE JUST LOOKING AT THE PICTURES AND SOME FOLKS AROUND THERE SEEMS LIKE IT WAS A HOME RUN AND ANOTHER EXAMPLE OF, UH THE DEPARTMENT REACHED OUT CREATING RELATIONSHIPS WITH THE RESIDENTS . SO COULD HAVE CHIEF AND I DON'T KNOW IF YOU WANT TO ADD ANYTHING OR YOU KNOW. IT WAS ABOUT 85 KIDS CAME OUT WITH IN MOST OTHER FAMILY WITH THEM AND UM, THERE WAS AWARDS HANDED OUT FOR THE LARGEST FISH, THE SMALLEST FISH AND THE MOST FISH AND THE MOST FISH. I MEAN, IT WAS DON'T KNOW, LIKE 12 OR SOMETHING LIKE IT WAS JUST AN UNREAL CATCHING THE SAME FISH. UH SUSPECTED, UM, THERE WAS A LOT OF BLUEGILL AND SOME BASKETS AND THE BEST THE LARGER THE BEST, SMALLER THE KIDS SO YEAH, ONE LITTLE GIRL GOT A GOOD SIZED BASS. AND SHE GOT IT WITH A BARBIE POLE. THAT WAS ONLY ABOUT THIS LONG, BUT, UH, I FEEL LIKE I UNHOOKED MORE FISH THAN I'VE EVER DONE MY WHOLE LIFE, BUT BUT IT WAS A GOOD TIME. AND, UH, YOU KNOW, WE REALLY GLAD SO MANY PEOPLE WERE ABLE TO COME OUT AND WE LOOK FORWARD TO NEXT YEAR IS THAT THE PROBLEM BY THE SERVICE STATION? YEAH, IT WAS. YEAH RIGHT. PICKLE BALL COURTS AND WALNUT. YEAH YEAH, THEY THE. MOST EFFICIENT MADE IT BACK. BUT SOME OF THE KIDS WERE SO PROUD THAT FISH DIDN'T MAKE IT BACK IN OUR WAS THERE, AND THEY SAID THE BLUEGILL LOOKED A LITTLE UNDERSIZED, SO IT'S PROBABLY OVERPOPULATED ANYWAY. SO YEAH, IT WAS. IT WAS A GREAT, EXCITED , RUN AROUND WITH THEIR FISH. IT WAS A GREAT EVENT. I GOT THERE A LITTLE BIT LATE, AND IT WAS STILL PACKED. YEAH I THINK YOU SAID EARLIER IN THE MORNING. IT WAS ALL THE WAY AROUND. THE WHOLE WAY AROUND WAS FULL OF KIDS. SO WHAT A GREAT EVENT AND THERE WAS A LOT OF PEOPLE THAT THINK THE POLICE ON THE WAY OUT. IT WAS JUST A GOOD PRESENCE. AND JUST A NICE ATMOSPHERE. YEAH IT'LL BE A DAY THAT THOSE FISH WON'T WON'T FORGET HOME MIGHT HAVE TO STOCK IT NOW, RIGHT? IS THAT IS THAT PLANT OPEN TO FISHING? REGARDLESS THERE, THERE'S PEOPLE THERE. I MEAN, WE SEE PEOPLE REGULARLY. NOT THAT MANY, BUT OKAY. I USUALLY SEE THERE'S PEOPLE THERE ALMOST EVERY NIGHT, FINISHING EVERY TIME I GO OUT TO PLAY PICKLEBALL . THERE'S ALWAYS AT LEAST THREE OR FOUR PEOPLE FISHING IN THAT POND. I DIDN'T THINK THERE WAS THAT MANY FISH UNTIL YOUR INVENTION. EVERYBODY WAS PULLING FISH OUT OF THE THING. I THINK I THINK THE PARK'S DISTRICTS ACTUALLY STOCKS THAT CONTINUES TO STUDY. THAT'S A VERY NICE POND, AND IT'S A VERY NICE AMENITY. WE'VE TALKED IN THE PAST AND MAYBE PLAY SOME MORE BENCHES AND SHADE TREES OUT ALONG THERE SO IT COULD BE MORE WIDELY USED. IT REALLY ISN'T ANY PLACE TO SIT AND RELAX AROUND THAT POND. THINK MAYBE ONE BENCH. BUT THAT'S SUCH A NICE AMENITY CONNECTED TO THE PARK AND YOU CAN FISH THERE. FOR VERY LOW COST. WE COULD LIKELY ADD SOME BENCHES, SHADE TREES, A TRASH CAN OR WHATEVER, SO THAT COULD BE MORE WIDELY USED AND ENJOYED. IN MY OPINION. I GUESS WHAT WE GOT YOU, CHIEF. I JUST HAVEN'T LEARNED AND IT WAS A NOTE THAT I THINK EVERYBODY SAW

REGARDING SAFETY TOWN. AND ACCESS TO IT. I KNOW HE TALKED IN THE PAST ABOUT UNLOCKING IT THE MORNING AT NIGHT AND HAVE WE HAD ISSUES WITH VANDALISM THERE . YEAH IT'S UM SO WE'VE HAD A LOT OF DAMAGE AND THEN SOME OUTRIGHT VANDALISM. UM PEOPLE GETTING ON THE ROOFS, DAMAGING THEM, UM, THE DOOR'S BEEN KICKED IN WHERE WE STORE THE CARS SEVERAL TIMES. UM PEOPLE ETCHING STUFF INTO THE, UM FAKE WINDOWS AND THE FAKE GARAGES AND SOME OF THE BRICKS. SO IT'S YOU KNOW, THE PROBLEM WE HAVE IS IT'S NOT REALLY, YOU KNOW, PLAYGROUND EQUIPMENT IS KIND OF BUILT FOR THAT KIND OF, UM, USE AND IT'S PRETTY STURDY. UM THIS ISN'T REALLY BUILT TO THAT LEVEL. THIS IS MORE LIKE RESIDENTIAL STICK BUILDING BUILDINGS ARE GETTING DAMAGED. SO, UM, WHAT WE'D LIKE TO DO IS, UM YOU KNOW, KEEP IT CLOSED JUST BECAUSE WE'RE HAVING TO REPAIR IT SO MUCH AND FIX THINGS. AND THEN, UM, THE IDEA WAS TO COME UP WITH A PLAN SECURITY PLAN, MAYBE ADD CAMERAS. WE WERE PRETTY CLOSE, BUT THE SCHOOLS WHEN THEY SWITCHED THEIR CAMERAS OVER IT KIND OF CUT OFF AN AVENUE FOR US TO PUT CAMERAS IN. WE'RE HOPING TO FIND ANOTHER AVENUE TO GET SOME OF THE SECURITY MEASURES IN PLACE THAT WE COULD OPEN IT UP. BECAUSE IT COULD. COULD WE KEEP IT OPEN DURING THE DAY, LIKE JUST DURING THE SUMMER, OR UM, YEAH, CLOSE IT UP. BUT THAT'S WHEN SOME OF THE SOME OF THE PROBLEMS HAVE HAPPENED. YOU KNOW, UM THE SCHOOL RESOURCE OFFICERS HAD KICK PEOPLE OFF THE ROOFS. UM AND THE SO I THINK WE PROBABLY NEED TO KINDA UM, I THINK IT'S SOMETHING WE WANT TO WORK TOWARDS. BUT I THINK WE NEED TO KIND OF A PLAN TO MAKE SURE THAT WE HAVE PROTECTED AS WELL. YEAH. THANKS, CHIEF. ANY OTHER COUNCIL ECONOMY. UM, NOTHING. WE HAD A NICE TAKE THE EVENT. MAYBE YOU SHOULD DESCRIBE WHAT WE'RE SEEING. WELL WE, UH MAYOR SPAULDING AND CANCELED WOMEN RISK AND I WERE ABLE TO WATCH THE INTEL PRESENTATION AT EAGLE'S NEST SUMMER CAMP AND WATCH CHILDREN DESCRIBE THEIR GAMES THAT THEY MADE AS A BUT UNTIL BASICALLY TAUGHT THREE DAYS OF THIS SUMMER CAMP ENDED PLAN ACTIVITIES WITH THEM AND MAKING BOARD GAMES WAS A WAY FOR THEM TO COME UP WITH SOMETHING INNOVATIVE AND WORK TOGETHER AND THEN DESCRIBE IT TO THE AUDIENCE , AND IT WAS REALLY IT WAS REALLY IT WAS REALLY COOL. AND THE INTEL TEAM AND THERE WERE SOME, YOU KNOW, IT WASN'T JUST YOU KNOW, A COUPLE OF ENGINEERS DOWN THE STREET. THESE WERE LIKE HIGH LEVEL PEOPLE IN THE ORGANIZATION THAT WERE THERE FROM THE FOUNDATION FROM THE SCIENCE SIDE AND ABSOLUTE. EMILY SMITH, WHO'S REALLY FUNNY. SHE WAS REALLY GREAT WITH THE KIDS. SO IT WAS, YOU KNOW, AGAIN, JUST A GREAT OUTREACH FOR THEM, TAKING TIME TO MAKE SCIENCE COOL , AND YOU KNOW IT WAS. IT WAS GREAT TO SEE THE KIDS ENGAGED WAS SUPER DIVERSE GROUP OF KIDS. UM AND THE YOU KNOW, THE FUN PART WAS TO HEAR THEM. GIVE HER PRESENTATION ON HOW THEY SORT OF DEVELOP THEIR GAME AND HOW YOU PLAY IT WITH THE GOAL OF THE GAME IS I THINK IT'S LIKE A COUPLE. THEN YOU KNOW, LOVE THE MICROPHONE. I THINK MORE THAN THE GAME SO I CAN UNDERSTAND HOW THAT HAPPENS, BUT, UM, BUT NOW IT WAS. IT WAS A GREAT DAY, ALL JOKING ASIDE AND JUST REALLY APPRECIATE INTEL'S OUTREACH, AND EMILY WAS SAYING THEY'VE BEEN OVER 100 OF THESE ACROSS THE CENTRAL HIGH REGION IN THE LAST TWO YEARS, SO AGAIN. SUPER SUPER LEVEL OF ENGAGEMENT FROM, YOU KNOW, FRANKLY, AN EMPLOYER THIS NOT EVEN HERE YET, SO I SHOULDN'T SAY THAT THEY ARE HERE. THEY'RE DEFINITELY HERE. THEY'RE NOT MAKING CHIPS JUST YET. ALRIGHT. ANY OTHER COUNCIL CONNOR? ALRIGHT ANY OTHER BUSINESS FOR CONSIDERATION? RIGHT THEN I MOVE THAT WE ADJOURN. HEY, SECOND. AND WE ARE ADJOURNING AT 7 50 PM GOODNIGHT . ALL GOODNIGHT SWAGGER.
