COMMISSIONER READY. I'D LIKE TO CALL THE ORDER. THE PLANNING COMMISSION MEETING FOR MIND OUT [00:00:09] CHILDREN 16TH 2023 CAN I HIT THE ROLL, PLEASE? PRESENT. MR KIRBY PRESENT, MR. WALLACE. PRESIDENT MR SCHELL PRESENT MISS BRIGGS HERE. MR LARSON PRESENT. COUNCIL MEMBER BRISK PRESENT. WE HAVE [III. Action on minutes] FIVE VOTING MEMBERS PRESENT. WE HAVE A QUORUM. THANK YOU. ACTION ON THE NEXT FROM SEPTEMBER 18TH ENCRYPTIONS. CORRECTIONS HERE. NONE HERE. DO I HEAR A MOTION APPROVED THE MINUTES FROM THE SEPTEMBER 18 2023 MEETING US SO SUBMITTED DO I HEAR A 2ND 2ND? AND DISCUSSION OF THE MOTION. THE ROOM, PLEASE. MR WALLACE. MISS BRIGGS. YES MR LARSON ABSTAINED SINCE I WASN'T PRESENT MR KIRBY? YES, MR SHELL. THERE ARE FOUR VOTES IN FAVOR OF THE MINUTES ARE SUBMITTED. MHM. [IV. Additions or corrections to agenda] OTHER ADDITIONS OR CORRECTIONS. SEE AGENDA. YES WE DO HAVE A CORRECTION AS YOU PROBABLY SAW THIS STAFF REPORT FOR THE COURTYARDS AT HAINES CREEK. THEIR APPLICATION IS CONSIDERED INCOMPLETE AT THIS TIME, AND SO SINCE THE STAFF REPORT WENT OUT, THE APPLICANT HAS REQUESTED TO TABLE THE FINAL DEVELOPMENT PLAN AND ALL THREE PLATT APPLICATIONS. AND THE ASSOCIATED PUBLIC HEARINGS FOR THOSE APPLICATIONS UNTIL THE NOVEMBER 20TH PLANNING COMMISSION MEETING. STAFF WOULD SUGGEST THAT YOU GO AHEAD AND VOTE ON THAT TABLE NG AT THIS TIME. OKAY UM, BEFORE WE DO, I WAS GOING THROUGH THAT AND DOING THE REVIEW AND ON. PAGE EIGHT OF THE FINAL DEVELOPMENT PLAN. ITEM TWO ON SPACING ON THE TREES. UM, CAN WE CHECK THE MINUTES IN THE CONDITIONS OF APPROVAL. I BELIEVE THIS ONE. WE TIGHTEN THIS TREE SPACING ON LIKE 24 FT. SURE WE CAN DOUBLE CHECK THAT, OKAY? WE HAD QUITE A BIT OF DISCUSSION AND IN PARTICULAR ABOUT WHERE THE DRIVEWAY IS ALMOST FORCED THAT BECAUSE THEY'RE SO TIGHT. BUT WHERE THERE'S LONG EXPANSES LIKE AROUND THE CORNER AND SUCH THAT THE DEVELOPER WOULD KEEP THE TIGHT SPACING. AND I BELIEVE THAT WAS PART OF THEIR AND I THINK THAT THE MINUTE ANYWAY. STAFF REPORT REFLECTS PROPOSED LANGUAGE WITHOUT HAVING THE CONDITION INTEGRATED. OKAY. WE COULD CHECK THAT. PLEASE. THANK YOU. WE'LL GET. WE'LL GET EVERY OLD WOMAN DO THE THING, BUT THAT THAT MAY INFLUENCE ONLY BRING THE STAFF REPORTS. STUFF BACK, OKAY? DO I HEAR ABOUT YOU JUST TABLE THESE INDIVIDUALLY OR ALL OF THEM. YOU COULDN'T DO THEM ALL TOGETHER, OKAY? I MOVE THAT WE TABLE FILE DEVELOPMENT PLAN 84 2023 ALONG WITH DEVELOPMENT PLANS. YEAH, 87. OH, THERE WE GO. OH, THANK YOU. FROM THE BEGINNING, YOU FOUND DEVELOPMENT PLAN. 87 AND THREE FUN PLANTS AND FINAL PLATZ. 88, 91 AND 92 TO OUR NOVEMBER REGULAR MEETING YOU HERE A SECOND ON THE TABLE. SECOND THAT. AND DISCUSSION ON THAT MOTION. COULD WE HEAR THE ROLL, PLEASE? MR KIRBY? YES, MR. SHOW MR. LARSON. YES MR WALLACE? YES. MS BRIGGS? YES. I HAVE FIVE VOTES IN FAVOR TO TABLE THE APPLICATIONS UNTIL THE NOVEMBER MEETING. UM. WE ALSO HAVE SOME WISH TO SPEAK ON THAT JIM RUSSO COME TO MIC. WE'VE GOTTEN YEMEN ADDRESS AND. OH AND WE'RE ALSO GONNA INVITE YOU BACK FOR NOVEMBER. GO AHEAD, SPEAK TWICE. I'VE BEEN ACCUSED OF THAT A FEW TIMES. UM MY NAME IS JIM REVO. MY WIFE AND I SAM LIVE IN THE TIDEWATER COMMUNITY. WE HAVE DONE THAT FOR EIGHT YEARS. WE WERE A LITTLE OFF THE BEATEN PATH, WHICH IS WHAT WE ENJOYED ABOUT OUR NEIGHBORHOOD. UM SOME PEOPLE WERE AMAZED THAT IT WAS EVEN BACK THERE. BUT ANYWAY, WE ARE A LITTLE CONCERNED ABOUT THE PENDING DEVELOPMENT. UM AT HAINES CREEK THERE IN PARTICULAR , UM ALONG THE JUG ROAD [00:05:02] INTERSECTION, TRYING TO UNDERSTAND SOME OF THE DETAILS, BUT REALLY, WE HAVE TWO THAT WERE PROBABLY MOST CONCERNED WITH ONE IS THE STREET TRAFFIC ON THEIR REALIZE WE SKIP FORWARD PARTLY 31. HERE WE WENT. WE WENT TO TABLE THERE WERE OTHER ASPECTS. I KNOW WHAT TO DO BEFORE WE READ THE MEETING. OKAY WITH ALL THE PEOPLE WHO WISH TO SPEAK TO THE COMMISSION TONIGHT, PLEASE RISE. DO YOU SWEAR TO TELL THE TRUTH AND NOTHING BUT THE TRUTH? WE DO. THANK YOU AND ALL OF US, CHECK OUR PHONES AND MAKE THEM SILENT, PLEASE. UM. AND WE CAN GO AHEAD AND CONTINUE . THANK YOU. SO THERE'S REALLY TWO CONCERNS. UM ONE IS THE STREET TRAFFIC BECAUSE WE AS WE KNOW, WE'VE ALREADY SEEN IT STARTED TO INCREASE WITH THE CONSTRUCTION WITH INTEL AND EVERYTHING ELSE GOING ON THERE AND NECESSARILY. WE DON'T HAVE AN ISSUE WITH THOSE DEVELOPMENTS. WE'VE SEEN OUR PROPERTY VALUES GO UP, BUT WE'RE SEEING MORE AND MORE SEMIS. WE'RE SEEING MORE AND MORE DUMP TRUCKS GOING THROUGH THERE. AND IF YOU'VE EVER DRIVEN DOWN CENTRAL COLLEGE, THAT JUG ROAD IT IS A VERY TIGHT TURN. NOW WE WANT TO PUT. I THINK IT'S 100 AND 51 UNITS IN THEIR, UM, ROUGHLY SPEAKING, IT'S PROBABLY 300 MORE CARS, POTENTIALLY, THAT COULD DRIVE UP AND DOWN THAT ROAD. UM AND WE JUST DON'T FEEL THAT IT'S SUITED FOR THIS KIND OF DEVELOPMENT. WE DON'T THINK IT'S YOU KNOW IF THERE'S SOMETHING TO DO WITH THE TRAFFIC THAT'S GOING THERE FOR THE CONSTRUCTION. WE HAD SEMIS TURNED AROUND IN OUR NEIGHBORHOOD. THAT HAVE DESTROYED LAMPPOST AND TORN DOWN TREES AND RUN OVER THE GRASS AND ASKED THE SERVICE DEPARTMENT FROM THE CITY, ALBANY. HOW MUCH THAT COST TO DO THAT, UM, WE'RE KIND OF CURIOUS THAT THERE WAS EVER ANY KIND OF A ROAD STUDY THAT WAS DONE BY THE DEVELOPER OF THE CITY. I'M NOT SURE HOW THAT WORKS AS TO THE TRAFFIC FLOW THAT'S THROUGH THERE. UM, AND OUR UNDERSTANDING IS THAT EVENTUALLY THESE ROADS ARE SUPPOSED TO THIS DEVELOPMENT SUPPOSED TO CONNECT THE TIDEWATER SOMEHOW THROUGH MCCLELLAN. SO SINCE THESE ARE SOME OF THE CONCERNS THAT WE'RE TRYING TO UNDERSTAND AND WORK THROUGH, WE'RE OBVIOUSLY, UM RIGHT NOW. CURRENTLY, THERE'S NO PLANS. IT DOESN'T LOOK LIKE FOR ANY ADDITIONAL SIDEWALKS OR BIKE LANES ALONG THERE. UM AND YOU KNOW, WE ONE OF THE REASONS WE MOVED INTO ALBANY WAS BECAUSE OF A HEALTHY LIFESTYLE AND THE COMMUNITY AND THE GREEN SPACE. UM AND WE'RE JUST CURIOUS ABOUT THOSE KIND OF THINGS SO PRIMARILY, IT'S A STREET TRAFFIC. IT'S ALREADY INCREASED, UM, ARE ASKS, ARE TO REDESIGN OR PUT IN THOSE REDESIGNED AND IMPROVED CENTRAL COLLEGE AND JUG ROAD, UM, PUTTING SIDEWALKS, PUTTING, UM YOU KNOW, MAYBE TURN LANES THAT THAT'S WHAT'S GOING TO BE BIKE LANES AND SO ON, UM, YOU KNOW, TO BE ABLE TO PROMOTE THAT HEALTHY LIFESTYLE HERE IN NEW ALBANY SAFE COMMUNITY. UM AND THAT'S THE OTHER PART OF IT, TOO. WE'VE HAD ENOUGH TICKING CRIME IN OUR NEIGHBORHOOD THAT WE'VE HAD PEOPLE THAT HAVE STOLEN CARS AND COME INTO AND BROKEN INTO CARS IN OUR NEIGHBORHOOD. AS I SAID, WE USED TO BE OFF THE BEATEN PATH. NOT ANYMORE, AND THAT'S BEEN A CONCERN IN YOUR NEIGHBORHOOD FOR THE LAST, ESPECIALLY A COUPLE OF YEARS. UM THE OTHER PART OF IT TO IT COULD BE AS SIMPLE. UM BUT THIS WOULD BE ONE OF THE OTHER ASKS IS TO PUT UP A NO. TRUCK SIGN ON CENTRAL COLLEGE EAST OF 62, SO THAT THERE IS NO CONSTRUCTION TRAFFIC AND THERE ARE NO SOME WAYS THERE. AT LEAST THAT WOULD ALLEVIATE SOME OF THE ISSUES THAT THAT WE'VE EXPERIENCED ALONG THERE. UM AND THEN THE OTHER PART OF IT TO THE SECOND CONCERN IS THE PARK SPACE . UM YOU KNOW, WE DON'T HAVE ANY PARK SPACE IN CENTRAL IN IN IN TIDEWATER. NOW THERE'S NO SWING SETS. THERE'S NOTHING LIKE THAT, UM, THAT WAS EVER BUILT INTO IT. FOR WHATEVER REASON, UM AND NOW THE DEVELOPER WANTS TO BUILD THIS DEVELOPMENT WITHOUT PROVIDING GREEN SPACE. HE'S STATED THAT THEY HAVE THAT THEY WOULD LIKE TO PUT IT ELSEWHERE. THEY'LL PAY THE CITY OF NEW ALBANY, WHICH BASED ON WHAT WE'VE SEEN, UM, IS NOT FAIR MARKET VALUE. UM AND THAT HAS BEEN POSTED ONLINE. I THINK AT THE LAST MEETING, SO OUR ASK IS, IS THAT THE DEVELOPMENT FOLLOW THE STRATEGIC PLAN, WHICH WAS TO HAVE GREEN SPACE THAT'S ACCESSIBLE, WHICH IT WOULD NOT BE BECAUSE WE DON'T HAVE YOU KNOW, SIDEWALKS AND SO ON ALONG CENTRAL COLLEGE TO GET TO THAT SPACE, UM THERE'S ANYTHING ELSE. UM SO YES, UM, WITH THOSE BEING SAID, IT'S NOT THAT WE WANTED TO OPPOSE THE DEVELOPMENT NECESSARILY. BUT WE WOULD LIKE TO HAVE THESE. THESE CONCERNS ADDRESSED, ESPECIALLY WITH WITH WHAT'S GOING ON ON THERE. SO I APPRECIATE THE TIME AND THANK YOU VERY MUCH. SOME OF THOSE WE CAN ACTUALLY ADDRESS RIGHT NOW. AND FIRST OFF, RECOMMEND THAT YOU BUT OKAY, GET A WHOLE WORLD STAFF CAN GO OVER THE FINE DETAILS, BUT HAVING JUST CUTTING UP FROM READING OVER THIS JUST WANT LATE. UM I BELIEVE THIS ONE HAS PASSED INSIDE WALKS BOTH ON CENTRAL COLLEGE AND THROUGH IT THAT WOULD MAKE IT EASIER, SO AT LEAST THEY'RE CHUNK OF CENTRAL COLLEGE WOULD GET A BIKE PATH. IS THIS CORRECT? THAT'S CORRECT, [00:10:02] OK, AND FOR OTHER PARTS OF CENTRAL COLLEGE. IT'S NOT OWNED BY THESE FOLKS. IT IS NOT IN FRONT OF US. TONIGHT THE VILLAGE HAS BEEN TOLERABLY SUCCESSFUL AT CONNECTING PATHS, AND SO, UM, FOR A LONG TIME, I'VE BEEN HERE A LONG TIME WE'VE BEEN PUTTING IN THE BIKE PATH TO NOWHERE LIKE THIS MUCH BIKE PATH AND IT GOES NOWHERE. AND WHEN YOU PUT ENOUGH OF THOSE IN WE CAN GET THE GRANTS THAT BECOME THE FILAMENTS THAT BECOME THE BIKE PATH TO EVERYWHERE. AND SO THE VILLAGE, THE VILLAGE, SO CALLING IT THE VILLAGE, THE CITIES. GOAL IS ALL THE NEW STUFF GETS PEASANT SIDEWALKS. AND THEN WE'LL FIGURE OUT A WAY TO CONNECT THAT AS BEST WE CAN SO THAT ONE'S IN THE PLAN. AS IT SITS, UM. AND THAT WOULD ALSO GIVE ACCESS TO THEIR GREEN SPACE BECAUSE THEIR PAST GO UP TO AND THROUGH SOME OF THEIR GREEN SPACE. MM HMM. MANY THERE'S NOT GONNA BE A TOT LOT THERE, BUT IF YOU WANT TO WALK BY THE PEOPLE WITH THE CORNER, WHERE WITH WESTERN IS THAT JUNK IS GREEN AND THE CURRENT PLAN SHOWS A PATH THAT WOULD WANDER THROUGH THERE. SORT OF CUTTING THE CORNERS THAT WERE UM. SURE FAIR MARKET VALUE, I THINK IS THE REASON WE TABLED. OKAY, SO THAT'S HOPEFULLY GOING TO BE ADDRESSED BY THE TIME WE HEAR THIS IN NOVEMBER, OKAY, UM AND FOR SOME OF THE OTHER SPECIFICS, CHAT WITH STAFF IN YOUR ELECTED OFFICIALS ABOUT COULD WE HAVE A MM. GREEN SPACE. YEAH CONNECTIVITY. UM IT WON'T NECESSARILY CONNECT TO TIDEWATER . IT'S DESIGNED TO BE ABLE TO CONNECT TO THE NEXT MOTTO. SO THAT MINIMIZE THE NUMBER OF CURB CUTS ON CENTRAL COLLEGE AND SUCH AND IMPROVES THE NEIGHBORHOOD TRAFFIC FLOW IF THERE'S LOTS OF LITTLE STREETS THAT CONNECT BACK AND FORTH. UM, BUT THAT JUST GOES PART WAY THERE. UM WHETHER OR NOT CONNECTED TIDEWATER DEPENDS ON THE LAND BETWEEN YOU AND THIS DEVELOPMENT. THAT WAS KIND OF CURIOUS PART OF IT. IF THERE'S NO GREEN SPACE, YOU KNOW NO PARKS THAT'S NEAR TIDEWATER AT THIS TIME. I MEAN, WHAT ARE THE PLANS TO GO FROM HIS RIGHT NOW? AT THE END OF OUR THAT DEVELOPMENT THAT STOPS AND THEN THERE'S THE THREE. I THINK THREE HOMES ALONG THAT WAY ON THE NORTHERN SIDE OF CENTRAL COLLEGE. ALRIGHT YEAH, AND THERE'S NOTHING THAT CONNECTED TO THAT NEIGHBORHOOD. AND SO IS THAT PART OF THE PLAN. UM, I. THE VILLAGE STAFF CAN TALK ABOUT . AH INTENTION TO OUTSIDE WALKS AND STUFF ACROSS PRIVATELY HELD LAND. THAT'S NOT GOING TO DEVELOPMENT. SO THOSE THREE HOMES ARE OWNED BY THREE DIFFERENT HOMEOWNERS. NOTHING. ALBANY COMPANY THEN NOTHING'S HAPPENING UNTIL THOSE GUYS SELL OR DEVELOP OR YOU KNOW THEY'RE SITTING ON THEIR HOUSE WATCHING THE RAIN VALLEYS GO UP. YEAH I'M HAPPY TO GIVE YOU MY CARD TONIGHT AND GO OVER ALL OF YOUR QUESTIONS AFTER THE MEETING. OKAY? DID YOU? UM, GO AHEAD. ACTUALLY I'M GONNA GO AHEAD. GO AHEAD, ERIN. THANK YOU. THANK YOU. ERIN UNDERHILL ON BEHALF OF THE APPLICANT THAT WAS TABLED TONIGHT. I JUST SAT HERE AND REALIZED THAT I AM NOT GOING TO BE ABLE TO BE HERE ON THE 20TH DUE TO ANOTHER COMMITMENT. AND UM SO I'M SORRY I DIDN'T RAISE IT BEFORE, BUT YOU HAVEN'T MEETING IN EARLY DECEMBER. IN THE FOURTH, THE FOURTH WE RECONSIDER THAT TABLING UNTIL DECEMBER 4? THAT'S REALLY IMPORTANT. I'M HERE. I BELIEVE THIS COUNCIL IS INFORMATION WE DIDN'T HAVE WHEN WE MADE THE MOTION AND THEREFORE WE CAN RECONSIDER. YES THAT'S RIGHT. YEAH, MY APOLOGIES. NO PROBLEM. OKAY UM, WHAT WE DO THAT? CAN WE [V. Hearing of visitors for items not on tonight's agenda] HEAR SOME VISITORS? ARE THERE ANY VISITORS WHO WISH TO SPEAK ON AN ITEM? NOT ON TONIGHT'S AGENDA, INCLUDING ITEMS WE TABLED. OKAY NOW GETTING BACK TO THE REGULAR PART OF THE MEETING. I MOVE. WE RECONSIDER OUR PRIOR MOTION TO TABLE. DO I HEAR A SECOND TO RECONSIDER? I'LL SECOND IT, OKAY? AND DISCUSSION ON THE MOTION TO RECONSIDER. CAN YOU ROLL ON RECONSIDERATION? MR KIRBY? YES, MR LARSON? YES, MR SCHELL? YES, MR WALLACE. YES, MISS BRIGGS. I HAVE FIVE VOTES IN FAVOR OF RECONSIDERATION. OKAY, SO. CHECKING THE STAFF. UM ARE WE TALKING ABOUT OUR. FIRST MONDAY SLOT. ARE WE TALKING ABOUT 31 DAY SLIDE? FIRST MONDAY SLOT IS DECEMBER 4TH. ALL RIGHT. NOT MY FAVORITE BECAUSE IT'S HISTORY FINALS WEEK, BUT THAT'S JUST ME. OKAY, UM WHAT'S THE MOST COMMISSION? SO DOING YOU DO WE WISH TO MOVE THAT TO DECEMBER THE FOURTH IF SO, WOULD SOMEONE MAKE A MOTION TO CHANGE THE TABLING TO DECEMBER. THE FOURTH IS, IS THERE GOING TO BE OTHER [00:15:05] ITEMS ON THAT AGENDA ON THE FOURTH? NONE THAT WE KNOW OF AT THIS TIME. DO WE HAVE ANY ON OUR REGULAR DECEMBER MEETING? ALSO NONE THAT WE KNOW OF AT THIS TIME. TO THE QUESTION IS, DO YOU WANT TO CLOSE TO CHRISTMAS IF YOU WANTED FIRST? AND WHAT WHAT'S GOING TO HAPPEN IF WE SET UP ON THE FOURTH WILL HAVE ANOTHER ONE. YEAH. SINCE SINCE I ERRANDS INDICATED HE'S AVAILABLE ON THE FOURTH TWO MONTHS BEFORE THAT'S MY FEELING. I'M FINE WITH THAT. SAME OKAY? LOOK AT MY CALENDAR. DON'T WORRY, IT'S ME. YEAH. I AM SORRY FOR THE INCONVENIENCE. I REALLY AM. I'LL TRY TO FIND GLAD YOU CAUGHT IT NOW. YEAH YEAH, THAT WOULD HAVE BEEN REALLY INCONVENIENT ON ALL RIGHT? YOUR YOUR MOTION TO MOVE THE TABLE DATE FROM NOVEMBER 20TH TO DECEMBER 4TH. SO MOVED YOU HEAR A 2ND 2ND? DESCRIPTION. THE MOTION. SO I HAVE MOTIONS THAT ARE TABLE THAT WE RECONSIDERED HAS BEEN MOVED TO DECEMBER. 4TH. I CAN HEAR THE ROLE, PLEASE, MR WALLACE? YES YES, MR KIRBY. YES, MR LARSON? YES, MR SHELL. I HAVE FIVE VOTES TO GRANT THE MOTION TO TABLE [VI. Cases] UNTIL DECEMBER. 4TH MEETING. THANK YOU. YOU'RE WELCOME. OKAY? NOW WE GET. TO FINAL GOVERNMENT PLAN 84 2023 KILL YOUR FROM STAFF, PLEASE. YEAH. WHAT THANK YOU. CHAIR MEMBERS OF THE COMMISSION. THE. APPLICANT REQUEST REVIEW AND APPROVAL OF A FINAL DEVELOPMENT PLAN AMENDMENT TO ALLOW FOR REVISIONS TO THE PREVIOUSLY APPROVED CHIPOTLE CIRCULATION PATTERN. THIS SITE IS LOCATED IMMEDIATELY NORTH OF JOHNSTOWN ROAD AND GENERALLY SOUTH OF THE INTERSECTION AT DOUBLE HEIMER ROAD AND WALTON PARKWAY. THE SITE AND BUILDING ARE CURRENTLY UNDER CONSTRUCTION . THE PLANNING COMMISSION REVIEWED AND APPROVED THE FINAL DEVELOPMENT PLAN FOR THIS SITE AT THE ACT, OBER 2022 MEETING. THE PROPOSED REVISIONS INCLUDE ADDING A SECOND FULL ACCESS CURB CUT ON THE EAST SIDE OF THE SITE ALONG A SHARED PRIVATE DRIVE. WHICH IS OVER HERE. AND MODIFYING THE PREVIOUSLY APPROVED NORTHWESTERN RIGHT OUT ONLY CURB CUT TO A FULL ACCESS CURB CUT AT THE EXISTING TRAFFIC CIRCLE ON THE SECOND PRIVATE DRIVE. THE REST OF THIS SITE AND THE ENTIRE BUILDING IS UNCHANGED. THESE TWO CHANGES ESSENTIALLY MODIFY THE DRIVE FILE TO THE NORTH OF THE SITE TO ACCOMMODATE TWO WAY TRAFFIC THROUGH HERE. THE APPLICANT HAS ALSO UPDATED THE DRIVE THROUGH TO INCLUDE A CONCRETE CURB ON THE NORTH SIDE. THAT AREA TO ASSIST WITH THE TRAFFIC CIRCULATION. THE CITY TRAFFIC ENGINEER RECOMMENDS A CONDITION OF APPROVAL REQUIRING THE SHORTENING OF THE SOUTHERN CURB CUT OF THE DRIVE THROUGH WHICH IS IN THIS AREA. UM APPROXIMATELY 5 FT. IN ORDER TO HELP CARS TURN INTO THE DRIVE THROUGH FROM THE PARKING LOT. CITY STAFF RECOMMENDS A CONDITION OF APPROVAL THAT THE SOUTHERN CURB IS SHORTENED AND THE USE OF SIGNAGE PROHIBITING U TURNS FROM THE NORTH DRIVE. I'LL BE SUBJECT TO THE CITY TRAFFIC ENGINEER'S APPROVAL. THE PROPOSED FINAL DEVELOPMENT PLAN AMENDMENT IMPROVES THE CIRCULATION ON SITE BY CONVERTING THE ONE WAY DRIVE. I'LL 22 WAY TRAFFIC THE DRIVE THRU STACKING PEDESTRIAN CONNECTIONS AND PARKING LOT CONFIGURATION REMAIN UNCHANGED. THE REVISIONS TO THE SITE PLAN ARE SIMPLY TO IMPROVE THE VEHICULAR CIRCULATION BY ADDING AN ADDITIONAL CURB CUT TO THE EAST AND TRAFFIC FLOW. ONE THING NOT BROUGHT UP IN THE STAFF REPORT IS THE NEED FOR ACROSS ACCESS EASEMENT ALONG THE NEW TWO WAY DRIVE. STAFF RECOMMENDS THE PLANNING COMMISSION REQUIRE THIS CROSS ACCESS EASEMENT. THE PROPOSED PLAN AMENDMENT ALLOWS FOR FLEXIBILITY IN THE DESIGN AND LOCATION OF FUTURE DEVELOPMENT. TO THE NORTHERN PORTION OF THIS SITE. THE NUMBER AND LOCATION OF CURB CUTS [00:20:04] CONNECTING THIS PORTION OF THIS SITE TO THE NORTHERN PORTION WILL BE EVALUATED WITH FUTURE APPLICATIONS. SHOULD THE PLANNING COMMISSION APPROVED THE APPLICATIONS STAFF RECOMMENDS THE CONDITIONS LISTED IN THE STAFF REPORT AND WE ARE AVAILABLE FOR ANY QUESTIONS. THANK YOU. TELL YOU REQUESTED THE COST ACCESS EASEMENT. AS A CONDITION OF APPROVAL. YES THAT WOULD BE A THIRD CONDITION BECAUSE I DON'T SEE IT IN THE CORRECT. YOU HEAR FROM US AGAIN, PLEASE THEIR ENGINEERING ON THIS. BEFORE ENGINEERING HAS THREE COMMENTS. UH THE MONUMENT ATION NOTE TO SHE SEE ONE. PLEASE SHORTEN THE LENGTH OF THE CURVE WERE INDICATED TO MILITATE TURNING MOVEMENTS FOR THOSE WISHING TO UTILIZE THE DRIVE THRU LANE. EMPLOYEES AT A SAFE DISTANCE TRIANGLES TO ALL CURB CUTS TO ENSURE THAT LANDSCAPING FENCING DOES NOT IMPEDE OVER HIS VIEW. GO AHEAD. AND LET ME JUST COME. QUICK QUESTION. UM THE. THE REPORT AND THEN THE STAFF REPORT AND HAS A 5 FT FIGURE IN THERE, BUT I DIDN'T I DON'T SEE IT IN THE ENGINEERS MEMO, AND I JUST WANTED TO MAKE SURE THAT OUR THAT OUR CONDITION THAT JUST SAYS THE COMMENTS OF THE CITY ENGINEER ARE ADDRESSED IS CLEAR. THAT WAS THAT THERE'S ENOUGH SPECIFICITY THAT WE KNOW WHAT THE CONDITIONERS THAT IS CORRECT . 5 FT WOULD BE SUFFICIENT. ALRIGHT. SO IS IT. IS IT CLEAR THAT OKAY? IF YOU LIKE. WHEN WE DO THE RECORD OF ACTION, I CAN SPECIFICALLY PUT THAT SECTION OF THE REPORT IN THERE. THERE WAS ALSO A REFERENCE TO THE. SOUTHERN CURB CUP NOT ONLY BEING SHORTENED, BUT USE OF SIGNAGE PROHIBITING U TURNS FROM THE NORTH DRIVE. I'LL YEAH. YOU MENTIONED THAT AS WELL. AND I DIDN'T SEE THAT SPECIFICALLY IN THE CONDITION EITHER OR SO I DON'T THINK SPECIFICALLY IN THE ENGINEER'S REPORT, SO I WANT TO MAKE SURE THOSE ARE CLEAR FOR THE RECORD AS WELL. THANK YOU. THANK YOU. SORRY. I'M STEVE FOX WITH PRIME E CIVIL ENGINEER ON THIS PROJECT. SO WE SIMPLY WANTED THE INCREASE THE CIRCULATION FOR THE POTENTIAL DEVELOPMENT OF PROPERTIES. IN THAT EPISODE, IT'S ADDING ESSENTIALLY 12 FT OF PAYMENT FROM THE MOST SIDE OF THIS PROJECT. IN THAT ADDITIONAL ACCESS TO THE ACCESS DRIVE ON THE EAST SIDE. THIS IS ALL ON PRIVATE PROPERTY. THESE EXCESS DRUGS THAT ARE PRIVATE PROPERTY. THERE'S ACROSS ACCESS EASEMENT BETWEEN ALL THE OWNERS IN THIS SUBDIVISION. FOR MAINTENANCE, ACCESS AND WHATNOT. WE DO AGREE TO ADHERE TO ALL OF THE CONDITIONS. PROVIDED BY THE CITY ENGINEER. WE DID HAVE A MEETING WITH HIM TO KIND OF GET TO THE POINT THAT WE ARE RIGHT NOW. AND MORE CAVEATS THAT YOU DON'T SEE AS AS AN ISSUE. WE DON'T KNOW EXACTLY WHAT WE'RE DOING TO THE NORTH. WE HAVE SOME CONCEPTS, BUT WE DON'T HAVE ANY END USER. WE JUST KIND OF MORE CAPACITY. WHAT CAN WE DO? OBVIOUSLY WE KNOW THAT THE NORTH STEP BRANCH COME BACK TO YOU WITH THE BOARD AND KIND OF FIGURE OUT WHAT WE CAN DO AND HOW WE DO IT. YOU KNOW THAT HIMSELF. HERE TO ANSWER ANY QUESTIONS THAT WE HAVE MY CORRECT THAT YOU'RE THE AFRICAN UNION'S BOTH PARCELS. IT IS ACTUALLY ONE PERSON. IT'S NOT TOO PERSONAL. YOU USED THAT YET, BUT IT'S COMBINED. SO IT IS ONE PARCEL SO AS FAR AS ACROSS ACCESS SEASON, THERE MAY BE A LEASE LINE AT SOME POINT, MAYBE EVEN A PROPERTY LINE IF WE SPLIT IT, BUT THERE WILL BE A REQUIREMENT TO HAVE ACROSS ACCESS EASEMENT AT THAT TIME, BUT WE HAVE TO IDENTIFY THE USER IDENTIFIED THE USE THE GEOMETRY AND IN SUCH TIME SO THAT WE HAVE NO PROBLEM PROVIDING THIS, BUT IT'S NOT NECESSARY BEING UP TO 15 1 MILE. UNTIL WE DIVIDED OUR LEASE LINER SUCTION OFF. CAN WE MAKE HAS GOT THAT SO THAT IF A LOT SPLIT HAS CONTEMPLATED THAT THE CROSS SASCHA'S IS A CONDITION BEFORE THE LOT SPLIT IS GRANTED. CONNECTION STRONG I. ACTUALLY, IT MIGHT WAS ON YEAH, I THINK THAT'S A GOOD IDEA. THE PLANNING COMMISSION WANTS TO MAKE THAT A CONDITION OF APPROVAL. WE CAN WORK WITH THE APPLICANT. SO WHO DOES THE MAINTENANCE ON THE SHARE? PRIVATE DRIVES. IT'S SHARED AMONGST ALL THE PROPERTY OWNERS. THERE'S AT LEAST FOUR HAVE LEAVE. YEAH. HOW IS THAT? MONETARILY SPLIT. I THINK IT'S PARADED DEPENDING ON HOW MUCH WOULD YOU HAVE? CAN YOU. IF YOU [00:25:14] WOULD COME TO THE MIC AGAINST YOUR NAME AND ADDRESS I'M GRANT MONSTER NEIGHBOR. OKAY I DON'T KNOW THAT TO WRITE IT ON IF YOU'RE WRONG, BUT THERE'S A LINE. SHARED ROAD. THANK YOU COVERS THAT I HAD REACHED OUT TO BUSINESS PARK. I JUST WANT TO SO RIGHT THERE. THAT LINE, I THINK DELINEATES WHO COVERS WHAT? WHICH IS ONE OF MY CONCERNS. I REACHED OUT INVOLVING THE COMPANY AND THE BUSINESS PARTIES. IF THERE'S SOME SHOULD AS IT'S DEVELOPED, AND I BROUGHT THIS UP FOR A MONTH AND A COUPLE OF MONTHS AGO. IS IT TIME FOR THE CITY? IT'S REALLY IN THE BUSINESS PART. TAKING OVER THE MAINTENANCE OF THAT. I MEAN, THERE'S A LOT OF TRAFFIC. NOW THIS THIS CITY HAS CHANGED. THE TRAFFIC FLOWS CHANGED. YOU KNOW THE ACCESS AND EGRESS HAS CHANGED, SO THERE'S A LOT GOING ON IF YOU ADD THAT IN AND OUT RIGHT THERE THAT ADDS MORE TRAFFIC. FOR CHIPOTLE. THIS IS REALLY I KNOW THEY CALL IT ONE LOT, BUT IT'S REALLY GOING TO BE TOO UM, AT SOME POINT, UM BUT THAT THAT WAS ONE OF MY CONCERNS IS WHO MAINTAINS THAT I'M FOR CARD TODAY AND THEY'RE GOING TO BE 500. RIGHT AND THE DEVELOPMENT OF IT HAS JUST SHOOT IT UP DRAMATICALLY. SO I AM HOPEFUL THAT THE BUSINESS PART TAKES OVER THAT. PLOWING AND MAINTENANCE, BUT I DON'T HAVE A FALSE SOLUTION YET, AS I SAID, I'VE REACHED OUT TO NEW ALBANY COMPANY, AND I THINK THEY'RE LOOKING AT IT. BUT, UM. BY THE WAY ON A DIFFERENT NOTE THAT LITTLE AREA THERE WHEN I LOOKED AT ORIGINAL PLANS I THOUGHT WAS GOING TO BE GREEN SHIELDING, YOU KNOW FROM ACROSS THE STREET, BUT IT LOOKS LIKE IT'S PARKING NOW. SO THAT UM PHOEBE IS A LITTLE DIFFERENT. IT PROVED PREVIOUS PLAN DOESN'T CHANGE THAT. THIS IS ON PRIVATE PROPERTY AS WELL. IT'S ALL COVERED BY ARIA. QUITE CLASSES BEING IN SECURITY. TO THE MIC COME TO MIC EVEN HAVE AN ADDRESS. TOP WAIT, SIR. TO THE MIC ADDRESS. 124 16 COME APART. RIGHT INTENTIONS OF ROAD THAT CUTS, I GUESS. PARALLELS JOSH TOWN TO TREAT US JUST AS PART OF OUR WE'VE ALWAYS ASSUMED THAT WAS ALREADY WELL MAINTAINED THAT RESPONSIBILITY. SO AS A GROUP ARE PARKING LOT. COULD YOU MAYBE IDENTIFY THE AREA? YOU'RE. THAT LITTLE MOTHER. THERE'S SOMETHING HAS ALWAYS BEEN THAT JUST WOULD BE MAINTENANCE, BUT THAT'S MUCH MORE COMING BACK FROM MARKET EXTREMES. I EXPECT YOU TO ASK FOR THAT. DON'T HAVE PAYMENTS READY? I COULD GIVE YOU TALKING. I THINK THE ATTORNEYS HAD SOME WELL, THAT WAS MY QUESTION. I HOPE YOU DO THAT. I ACTUALLY THINK IT'S TIME FOR THE BUSINESS PART TO TAKE IT OVER. NOT YOU OR ME, BUT THEN MY QUESTIONS THIS ONE WITH NOW YOU CAN GET IT OUT OF HERE OR CUT THROUGH THERE. THAT'S GOING TO PICK UP BUT IT ALREADY HAS TRAFFIC TO GET OVER THE WALL PARKWAY. THAT THAT WAS. MY CONCERN IS THAT PIECE. IS IT NOW? IS THIS THE ONLY SINCE EVERYTHING'S RIGHT IN AND RIGHT OUT? YOU CAN'T IT REALLY DOES CHANGE THE FLOW AND FORCES PEOPLE. SO I CAN UNDERSTAND WHY YOU WANT TO CUT BECAUSE EVENTUALLY YOU DIDN'T DEVELOP THAT YOU NEED TO BE ABLE TO GET IN AND OUT. LONGER TERM THAT PROBABLY BENEFITS ME, BUT FOR NOW, IT'S YOU KNOW, TRAFFICS. PICKED UP AND LOOK, IT'S NOT A TEENAGER ANYMORE. THIS IS A BUSY , BUSY AREA, SO THINGS NEED TO CHANGE. YOU KNOW IF IT'S GROWN INTO ADULTHOOD. GREAT WHAT WAS THE RESPONSE FROM NEW ALBANY COMPANY? UM SO I SPOKE TO GAVIN CARTER, MAN, AND I SPOKE TO TOM THEY SORT OF THOUGHT IT MADE SENSE NOW, BUT I DIDN'T GET DEFINITIVE. WE GOT IT, WHICH I WAS HOPING FOR THE THOUGHT IT MADE SENSE, BUT I DON'T. I'M SORRY THAT NO MAN WOULD HAVE LOVED IT AND WRITING. UM I THINK THEY AGREED WITH ME, BUT IT'S NOT IN RIGHT, SO I DON'T I DON'T KNOW. THERE ARE OTHER AREAS FURTHER LIKE WE'RE GARY QUEEN IS AND SOME OF THOSE OTHER AREAS WHERE I THINK THIS IS THE BUSINESS PARK IS MANAGING THE FILING AND MAINTENANCE. BUT I DON'T. I DON'T KNOW. I MEAN, I DON'T KNOW THERE'S PROBLEMS, SO I'M NOT PROVING THAT BUT I LOVE THEM. I THINK IT'S TIME FOR THE BUSINESS PART OF THE CITY TO TAKE OVER THAT. ARE YOU SPENDING MONEY ON THIS ROAD NOW? AH I HAVE TRYING TO FIND WHAT IT NEEDED PLOWING. WHICH I WAS TOLD IT WAS PROBABLY PART OF THIS. BUSINESS PARK YOU DO BUT IT NEEDS TO BE REPLACED. SO UM, [00:30:06] IT'S JUST SO YOU KNOW, AND NOW THERE'S A TON OF CONSTRUCTION TRAFFIC, SO WHICH IS GOING TO HAPPEN. SO THE OTHER PART. I JUST DIDN'T FEEL LIKE YOU HAVE TO PAY FOR IT. YOU KNOW? AND THIS IS ONE BUSINESS OWNER TO ANOTHER. I'M ASSUMING THIS INCREASED TRAFFIC FLOWS. GIVES YOU ADDITIONAL CARS AND VISIBILITY ON YOUR BUSINESS. I'M FOR I'M FOR CAR TODAY. I MEAN, PEOPLE ARE. MY POINT IS, IF YOU HAVE AN EXTRA 500 CARS GOING PAST YOUR BUSINESS, THAT'S NOT A HORRIBLE NO, IT'S NOT, BUT I MEAN THERE. CIRCULAR. IT'LL BE INTERESTING TO SEE WHAT GETS APPROVED. RIGHT, SO THERE'S CIRCULAR MOTION. YES LONGER TERM THAT CUT THROUGH COULD BE BENEFICIAL. YEAH. NIKKI. I'M JUST TRIMMING AND WAS DID BEN OR SOMEBODY OVER THE STAFF HAVE A COMMENT THERE QUICKLY? LOOKS LIKE IT'S JUST GONNA SAY ALL THIS TALK ABOUT MAKING THAT PRIVATE ROAD CITY ROAD IS NOT WITHIN THE JURISDICTION OF WHAT THE PLANNING COMMISSION DOES TONIGHT. SO YOU CAN HEAR THE CONCERNS JUST WANT TO BE CLEAR WHAT YOUR ROLE IS. YES, AND REASONABLE CONDITIONS ON THE CURRENT PROPERTY THAT CONSIDERED ARE IN THE PERIMETER. OH, AND A COUPLE OF LEADING QUESTIONS OUT OF CURIOSITY, SO THAT BECOMES A TWO WAY DR. I'LL CORRECT, OK? UM IS IT? ONE. WOULD YOU BE WILLING FOR IT TO BE PUBLIC RIGHT AWAY? BECAUSE IT'S YOUR PROPERTY, YOU GET TO CALL ALONE AS A PROPERTY OWNER DEVELOPER THAT OWNS THIS PROPERTY CANNOT COMMIT TO THAT. IT HAS TO BE A COLLABORATIVE EFFORT AMONGST ALL THE PROPERTY OWNERS TO DO THAT, BECAUSE OF RESTRICTIONS OF THAT AREA. YOU OWN IT, BUT YOU ALSO HAVE RESTRICTIONS ON IT THAT DON'T LET YOU DO THAT. SO WHILE THERE VERY WELL MAY BE A NEED ON HOW WE ADDRESS, MAINTENANCE AND WHATNOT, IT'S GOT TO BE A COLLABORATIVE EFFORT AMONGST ALL THE OWNERS TO COME TO AGREEMENT. WITH YOUR ATTORNEYS ON WHAT THEIR RESPONSIBILITIES ARE ON THIS ARIA. QUESTION. ENGINEERING. DOES THIS MEET? THAT THAT TWO WAY DRIVE. I'LL HOW CLOSE TO HOW CLOSE IS THAT IN STANDARDS, TOO? I DON'T KNOW. WE HAVE AN ALLEY AS A STREET CLASS OR NOT. IT'S PROBABLY NOT A 25 MILE AN HOUR ROAD. I BET IT BECAUSE OF ALL KINDS OF STUFF, BUT I DON'T KNOW HOW CLOSE IS THAT TO BEING SOMETHING THAT COULD BE PUBLICLY IF THEY ALL SAID, LET'S MAKE IT PUBLIC. AND WE LOOK AT THE STANDARDS IT WAS BUILT TO WHEN WE WANT WOULD IT BE MADE TO THE STANDARDS OF THE VILLAGE WITH DEMAND IF IT WAS PLANNED FROM THE BEGINNING TO BE PUBLIC RIGHT AWAY? SO I CAN ANSWER SOME OF THAT. I THINK WHEN WE LOOK AT PUBLIC RIGHT AWAY, THAT'S PROBABLY JUST ONE OF A FEW FACTORS TO LOOK INTO. SO I THINK ONE OF THEM IS CONNECTIVITY TO OTHER PUBLIC STREETS. ONE IS ST TYPOLOGY, SO THAT STREET TREES AND SIDEWALKS AND TREES, LAWNS AND THE OTHER ONE IS THE CONSTRUCTION. SO WE HAVE CITY CONSTRUCTION STANDARDS , SO OUR PUBLIC STREETS ARE BUILT TO HIGHER STANDARDS THAN SAY, LIKE A DRIVE. I'LL SO I THINK THE THREE OF THOSE ARE WHAT'S LOOKED AT WHEN EVALUATING ALONG WITH THE STRATEGIC PLANS, RECOMMENDATIONS. WE CERTAINLY DO . HAVE UM I WOULD SAY FOR OUR RETAIL DEVELOPMENT HAVING PRIVATE STREETS SERVE AS I WOULD SAY, LIKE SECONDARY STREETS THAT SERVE THE PUBLIC STREETS. CERTAINLY THIS IS DONE WHERE TURKEY HILL IS ACROSS THE STREET , WHERE ALL THE IS AND THEN BE TRUE, TOO. SO I THINK IT'S THE CITY WE FIND THAT PRIVATE STREETS DO SERVE AN IMPORTANT ROLE IN ORDER TO PROVIDE ADDITIONAL CONNECTIVITY. ABOVE AND BEYOND WHAT WE HAVE FROM THE PUBLIC STREET STANDARDS. I DON'T KNOW IF I AND I DON'T THINK JUST LOOKING AT IT THAT THIS WOULD SORT OF MEET THAT CRITERIA, UM, THAT THE CITY WOULD IN ORDER FOR THE CITY TO DESIRE THIS BEING A PUBLIC STREET IN THE FUTURE, BASED ON ITS CHARACTER, LOCATION AND CONNECTIVITY TO OTHER PUBLIC STREETS. AND WE WOULD HAVE TO RESEARCH I DON'T BELIEVE THAT IT'S BUILT A PUBLIC STREET STANDARDS ALONG WITH ALONG WITH THE OTHER ONES. DID YOU HAVE ANYTHING THERE? I WOULD AGREE WITH WHAT STEVE SAID. THERE REQUIRE FURTHER LOOK TO MAKE SURE THAT IT MEETS THAT STANDARD . BUT I WOULD AGREE THAT AT THIS TIME MAYBE YOU CAN'T MAKE A JUDGMENT CALL SAYING THAT IT WILL I'M GOOD, BUT FOR THE APPLICANTS, PURPOSES AND FOR THE NEIGHBORS PURPOSES, ONE OF THE THINGS I WANTED TO TEASE OUT HERE WAS, IT'S QUITE POSSIBLE THAT A IT'S NOT BUILT TO PUBLIC STANDARD, AND IT'S NOT DESIRABLE FOR IT TO BE A PUBLIC STREET. AND SO IT STAYS, BUT IT'S LIKELY TO IT IS NOT UNLIKELY THAT IT STAYS OF PRIVATE ROAD. THERE'S NO SURPRISE TO ANYBODY. I'M GOING DO THE DEVELOPMENT. WE'RE [00:35:02] NOT SOMEBODY ELSE WAS GOING TO BUY THE PARCEL TO THE NORTH. THAT WAS NOT SO THAT'S WHY THE INITIALLY WE COULD HAVE ONE WAY IN ASSUMING EVENTUALLY WE WOULD WORK WITH WHOEVER IT WAS TO GET THE TWO WAY ONCE, OBVIOUSLY WHEN THEY DROPPED THE CONTRACT TO SIGN THE VIRUS, ALSO THAT THAT'S THE REASON I JUST HAD THE ONE WE KNEW IT ALWAYS MAKE IT TWO WAY JUST INCAN JUDGMENT AND DROPPED OUT, OBVIOUSLY TO KEEP THE CURB CUTS FROM THEM ON THE PRIVATE RISK, OKAY, BATTING AVERAGE ON PUBLIC AND PRIVATE STREETS ISN'T PERFECT BY THE HOTEL'S IT SEEMS TO BE WORKING WELL. YOU KNOW OTHER PLACES CHESWICK, MOST NOTABLY, NOT SO MUCH. CASTLE GROUP. THE EXTENSION OF A ROAD THAT WAS PLANTED WAS DENIED BY THE MAJOR WAY BECAUSE IT WAS A PUBLIC PRIVATE STREET. AND THAT SCREWED WITH THE PLANT DEVELOPMENT. UM GO AHEAD. I'M SORRY COMMENTS. IT'S JUST THIS IS ALSO FOR STAFF AS WE EVALUATE PRIVATE ROADS. IT IS WHAT WHAT DO WE DO TO MAKE THEM THE ONES THAT WORK? AND NOT THE ONES THAT HAVE TENSION AMONGST THE DIFFERENT OWNERS. OKAY? OTHER QUESTIONS AND COMMENTS FROM THE COMMISSION. MHM ONE FROM THE PUBLIC HAVE ANYTHING THEY'D LIKE TO ADD ON THIS PARTICULAR I DON'T KNOW. THE ORIGINAL. I DID THINK THERE WAS THAT GREEN SPACE , BUT IF THERE'S GOING TO BE ACCIDENT RIGHT THERE THAT WOULD HAVE BEEN NICE LIKE WE HAVE GREEN SPACE AND SO MANY OTHER AREAS. WHAT WAS THAT? THE QUESTION IS, WHY WASN'T THAT GREEN SPACE RENDERING OR WAS, BUT NOW IT'S NOT UM, I MUST HAVE MISSED THAT CHANGED TO BRING UP THE FREE AND POST. THIS IS. THAT SAYS. ORIGINALLY APPROVED. MORE PERHAPS FOUND THAT WE GET THIS ONE ON THE LEFT APPROVED. WE'VE HAD MULTIPLE RENDER EXTREME TO GET TO A POINT. WE'VE GOT ENOUGH PARKING. MAYBE THERE WASN'T ENOUGH PARTNERS, SO THAT'S WHY THAT HAPPENED, BUT YOU GET THE ONE OF THE LEFT APPROVED BACK IN 2022. YEAH, ADDITIONAL THIS ONE. IT'S JUST HAVING MORE 12 MORE FEET OF PAPER. ON THE NORTH SIDE. WOULD YOU BE CLOSED POPULISM TREES? ON THE EAST SIDE. THERE'S NOT ENOUGH ROOM TREES. OUR SITE. BECAUSE WE HAVE TO MAINTAIN THE PARKING BECAUSE IT'S MINIMUM REPORTING OR WELL, I'VE GOT A LITTLE. WELL, IT'S A LEGIT QUESTION, BECAUSE IF YOU'RE NOT REQUIRED TO DO ANYTHING ON ANYONE ELSE'S LAND IF YOU WANT TO OFFER IT AS AN ENTICEMENT, YOU'RE FREE TO DO SO. EDUCATION. UNDERSTAND WHAT. OKAY WE HAVE SPOKEN BEFORE. PROBABLY BE HELPFUL FOR YOU GUYS. RIGHT, MIKE? YEAH REALLY? OKAY OKAY. 11 AT A TIME, PLEASE. MR CHAIR. THERE ARE TREES AND SHRUBS AND IN THE AREA. YES, RIGHT. IT'S HARD TO SEE YOU. THANK YOU. THANK YOU. THOSE THINKING THERE HAD TO BE SOME LANDSCAPING ON THERE JUST DIDN'T KNOW WHERE I WAS GOING TO ASK SCREENING BUDGETARY. QUESTIONS AND COMMENTS. OKAY OKAY, SO I HEARD THREE DIFFERENT CONDITIONS. UM ONE WAS THE BASIC CROSS ACCESS EASEMENT THAT WAS REQUESTED BY STAFF. THAT'S NUMBER THREE. OKAY UH, THE LANGUAGE ABOUT NO U TURNS. THAT'S IN TWO THAT'S IN TEARS. OH, I'M SORRY. ONE WAS THE ONLY ONE I WAS CONCERNED ABOUT, BECAUSE WHEN I LOOKED AT THE COMMENTS IT DIDN'T HELP 5 FT. OKAY? AND SO THEN I THINK THAT'S CLAROS. YEP AND ARE LEFT. UM NO LAST WENT WITHOUT ACROSS ACCESSES MY TWO NEW PARCEL. A LOT. YEAH. WITHOUT A CROSS ACCESS EASEMENT TO THAT NEW LOT. DO WE WANT TO MAKE IT CLEAR REGARDING THOSE TREES ON THE [00:40:06] EAST SIDE? DID YOU GUYS JUST MENTIONED THAT? I'M SORRY? PROOF PLAYING AND WERE NOT MODIFIED HERE. LET ME CHECK WITH STAFF TO MAKE SURE THAT IS EXACTLY THE CASE. THE LANDSCAPING YOU JUST SHOWED US IS IN THE APPROVED PLAN. IT IS NOT MODIFIED BIGGEST MODIFICATION. SORRY. IT WAS FROM THE PREVIOUSLY APPROVED PLAN. CORRECT. OKAY, GOOD. ALL RIGHT, SO LET ME GET HERE. WE ACCEPT THE DOCUMENTS AND DOCUMENTS INTO THE RECORD FOR FINAL DEVELOPMENT PLAN 84 2023 22ND ON THE DOCUMENTS MOTION SECOND. DISCUSSION OF THE DOCUMENTS MOTION ITSELF. YOU HEAR THE ROLE, PLEASE. MR. KIRBY MR WALLACE? YES MR LARSON. MISS BRIGGS? YES MR SCHELL THOUGHT VOTES TO ADMIT THE DOCUMENTS. DO I HEAR A MOTION ON FINAL DEVELOPMENT PLAN. 84 ITSELF MOVED TO APPROVED FINAL DEVELOPMENT PLAN AMENDMENT FTP FTP 84 2023. SUBJECT TO THE. 32 CONDITIONS IN THE STAFF REPORT, INCLUDING THE COMMENTARY REGARDING THE SPECIFICS OF THE CITY ENGINEERS COMMENTS. PLUS, UM ADDITIONAL. CONDITION NUMBER THREE THAT CROSS SEX, CROSS ACCESS EASEMENT BE REQUIRED AND DOCUMENTED. I THINK THAT'S SUBJECT TO STAFF APPROVAL AND THEN CONDITION. NUMBER FOUR IS NO LOTS WORK WITHOUT ACROSS, ACCESSES ACROSS ACCENT ACROSS ACCESS EASEMENT TO THE NEW PERSONAL HMM. PARCEL. YES, THIS ONE. DO I HEAR A SECOND? I'LL SECOND IT. DISCUSSION ON THE MOTION. PLEASE. MR WALLACE? YES MR LARSON? YES, MR SCHELL? YES MISS BRIGGS? YES, MR KIRBY? YES? PURIFY VOTES TO APPROVE THE APPLICATION WITH THE CONDITIONS IN THE STAFF REPORT TO ADDITIONAL CONDITIONS ADDED BY THE COMMISSION. THANK YOU VERY MUCH TAKES US TO ZONE CHANGE IN 90 84.736 ACRES, HARRISON ROAD AND LOOKING COUNTY. ACTUALLY BEFORE WE INTRODUCE THAT, UM ON CON. WE HAVE A LOT OF UNDERLYING TEXT. YEAH AND IF THAT'S NOT REVISED, WOULD IT BE SO KIND WITH THE UNDERLYING AS YOU DO THE UNDERLINES IN THE STAFF REPORT IF YOU'RE GOING TO REDO IT. MARK, WHICH CONDITION THIS IS PICKED UP ON CONDITION X SO THAT WE CAN GO THROUGH ALL THE UNDERLINES WALK THROUGH ALL THE CONDITIONS AND MAKE SURE THAT WE'VE GOT THEM ALL BECAUSE I HAD AS A AS A MARKER, PROBABLY 20 MINUTES OF US WALKING THROUGH EVERY ONE OF THOSE UNDERLINES AND TRYING TO FIND THE CONDITION OF THE THREE LEVELS OF ROMAN NUMERALS AND SMALL NUMBERS OF CONDITIONS. THANK YOU. PLEASE PROCEED. OKAY THANK YOU. CHAIR MEMBERS OF THE COMMISSION. THIS APPLICATION IS FOR A REZONING OF 84.736 ACRES. OVERALL SITE CONSISTS OF 16 PARCELS, AND IT'S LOCATED WITHIN LICKING COUNTY. THE SITE IS LOCATED AT THE SOUTHWEST CORNER OF JUNK STREET ROAD, SOUTHWEST AND HARRISON ROAD NORTHWEST. THE NEIGHBORING ZONING DISTRICTS INCLUDE L, G E AND THE TECHNOLOGY MANUFACTURING DISTRICT. THE REQUEST PROPOSES TO CREATE A NEW LIMITED TEXT FOR AN AREA TO BE KNOWN AS JUG STREET, SOUTH EXPANSION ZONING DISTRICT AND WILL BE ZONED LIMITED GENERAL EMPLOYMENT. THE PROPOSED REZONING SERVES AS AN EXPANSION TO THE NEW ALBANY INTERNATIONAL BUSINESS PARK. THIS INCLUDES THE SAME USES AND DEVELOPMENT STANDARDS AS THE SURROUNDING LG. THESE PERMITTED USES INCLUDE GENERAL OFFICE ACTIVITIES, DATA CENTERS, WAREHOUSE AND DISTRIBUTION AND RESEARCH AND PRODUCTION USES. THE SUBJECT. PARCELS ARE CURRENTLY BEING ANNEXED INTO THE CITY. THE ANNEXATION WAS APPROVED BY CITY COUNCIL ON SEPTEMBER 19TH. AND THE 30 DAY REFERENDUM PERIOD EXPIRES THIS THURSDAY. OCTOBER 19TH. THE ZONING TEXT WOULD CREATE THE SAME OR SIMILAR STANDARDS AS THE SURROUNDING LG DISTRICTS. THESE ONLY IN TEXT PERMITS. 80 FT TALL BUILDINGS. THIS IS CONSISTENT WITH OTHER PROPERTIES WHERE THERE ARE NO RESIDENTIAL. THERE IS FORESIGHTED SCREENING FOR SIGHT AND SOUND OF ROOFTOP MECHANICAL EQUIPMENT. THE TEXT ESTABLISHES SIMILAR OR SAME [00:45:02] SETBACKS FROM ROADS AND STREET AS THE SURROUNDING COMMERCIAL DISTRICTS SINCE THE SITE IS SURROUNDED BY OTHER COMMERCIAL ZONING ON ALL FOUR SIDES STAFF IS RECOMMENDING A CONDITION OF APPROVAL THAT IS LISTED IN YOUR TEXT AS MANY CONDITIONS OF APPROVAL. UM THAT THE TEXT BE REVISED TO REQUIRE CONSISTENTLY ESCAPING, FANCYING AND EASEMENTS AS THE DEBRIS INSIGHTS TO ENSURE COORDINATED DESIGN ALONG THE PUBLIC ROAD WAYS SO THAT IT FITS WITHIN THE BUSINESS PARK. THE SITE IS LOCATED AND THEY ENGAGE NEW ALBANY STRATEGIC PLANS. NORTHEAST AREA ADDENDUM EMPLOYMENT CENTER LAND USE CATEGORY. THE TEXT MEETS THE STANDARDS IN THE STRATEGIC PLAN, AND IT'S CONSISTENT WITH OTHER PORTIONS OF THE BUSINESS PARK SHOULD BE PLENTY COMMISSION APPROVED. THE APPLICATION STAFF RECOMMENDS THE CONDITIONS LISTED IN THE STAFF REPORT AND STOP THIS AVAILABLE FOR QUESTIONS. THANK YOU. IN THE ENGINEERING. ENGINEERING HAS NO COMMENTS. THANK YOU. CAN WE HEAR FROM THE APPLICANT? GET NO GOOD EVENING. MY NAME IS JACK REYNOLDS. I'M AN ETERNALLY SMITH AND HAIL AND I'M HERE ON BEHALF OF THE OWNER AND APPLICANT DBT NEW ALBANY L C. THIS IS KIND OF FILLING IN THE WHOLE OF THE DONUT. AS YOU SAW ON THE SITE PLAN STAFF WAS VERY HELPFUL. THE INDICATED THAT THERE HAD BEEN A NUMBER OF THE L G E S APPROVED IN THE AREA AND THAT WE SHOULD NOT BE SCREENED FAR FROM WHAT HAS ALREADY BEEN APPROVED. SO HAVING WORKED WITH STEVE AND STAFF FOR FIVE YEARS. I LISTENED TO THEM AND I'M HERE BEFORE YOU THIS EVENING COMPLYING WITH THEIR REQUEST, LEADING ALL OF THE STANDARDS THAT HAVE ALREADY BEEN APPROVED. WE HAVE LOOKED AT THE STAFF COMMENTS AND CONDITIONS AND THE ONLY COMMENT THAT WE HAVE WE WOULD LIKE THEY WERE CONCERNED ABOUT, UH, LET ME LOOK AT IT HERE. IT'S IN THE STAFF REPORT NUMBER TWO AS I PASSED THIS THROUGH THE OWNER'S REPRESENTATIVE, THEY ASKED THAT WE TAKE OUT THE TWO WORDS AS POSSIBLE. WE DIDN'T FEEL THAT WE WANTED ANY MORE WIGGLE ROOM THAN WHAT IS GREAT BLACK OR WHITE. SO WE SIMPLY WANTED TO TAKE AS POSSIBLE OUT OF THAT SENTENCE. SO THAT IT BE SIMPLE AND UNOBTRUSIVE AND BUILDINGS SHALL AVOID OVERLY BRIGHT OR JARRING COLLARS. SO WE JUST WANTED TO TAKE SUBJECTIVE NOUS OUT OF THAT SENTENCE AND JUST HAD IT SO THAT EVERYBODY CAN JUDGE TWO COLORS. I WILL NOTE THAT STAFF IS AGREEABLE WITH THIS. AND OTHER THAN THAT, WE'RE HERE TO ANSWER ANY QUESTIONS. OBVIOUSLY THIS IS JUST THE REZONING ANY PRELIMINARY FINAL DEVELOPMENT PLANS CURB CUTS. EVERYTHING ALONG THAT LINE WILL COME BACK THROUGH YOUR BODY TO BE APPROVED . OKAY I PRESUME THIS DOES MEET THE NEIGHBORING IT USES IDENTICAL TEXT IN THE NEIGHBORING PARCELS. BYE. THANK YOU. THAT WAS MY WAY. NOT SURE, REMOVING AS POSSIBLE IS GOING TO TAKE THE SUBJECTIVITY OUT. BUT AS LONG AS STAFF IS OKAY WITH IT. IT SEEMS TO ME SIMPLE AND UNOBTRUSIVE, HAS A SUBJECTIVE QUALITY TO IT. UM BUT IT IS SUBJECT TO STOP APPROVAL, SO THEY'RE GOING TO ULTIMATELY BE THE ARBITER OF WHAT IS SIMPLE AND WHAT IS UNTRUE. CORRECT. IT WAS SIMPLER. TAKING THAT OUT PROBLEM. YOU KNOW, THERE HAVE BEEN SOME ZONING CHANGES THAT HAVE PUT A RESTRICTION TO 65 FT. ON THE ON THE BUILDINGS. THIS ONE IS 85. IS THERE ANY CONCERN FROM STAFF ON THAT THERE'S NO CONCERN. THE 65 FT TALL BUILDINGS WERE FOR AREAS THAT WERE ADJACENT TO RESIDENTIAL USES. THERE'S NO RESIDENTIAL ADJACENT TO THIS SITE. THAT'S WHAT I THOUGHT. I JUST WANTED TO MAKE SURE OKAY? AGAIN THE SAME SECTION YOU REFERENCED EARLIER IN ITEM NUMBER SIX. IT SAYS THAT THERE WOULD BE AN EXCEPTION FOR TRANSMISSION LINES THAT ARE ELECTORATE TO BE NOT HAVE TO GO UNDERGROUND. WHAT IS THE REASON FOR THAT? THEY'RE HUGE. SORRY YEAH. UM I HAVEN'T SEEN THE LINES THERE. THESE ARE HUGE V SHAPED TRANS TRANSMISSION LINES, NOT THE ONES YOU CAN HANG YOURSELF SIDE OFF. OKAY, THAT MAKES SENSE. KIM. OKAY I WAS ENVISIONING THE SMALLER VERSION, SO OKAY. I BELIEVE THAT [00:50:05] TRANSMISSION IN THIS SENSE IS A TERM OF ART REGARDING HOW MUCH POWER IS COMING DOWN THE LINE AND ITS VOLTAGE AND SUCH. YEAH, IT'S OKAY. WELL AS LONG AS THE RESTRICTION IS CLEAR. I GUESS WE'RE OKAY. ANY CONCERNS AND STAFFS ARE FROM THE POINT THAT FIRST MADE NO. WE HAVE NO CONCERN YET THE TRANSMISSION LINES ARE EXACTLY WHAT NEIL KIRBY SAID THERE. THE LARGER, UM GIANT LINES YOU SEE OVERHEAD, SO THOSE DO COME INTO CERTAIN SITES PROVIDE POWER. BUT THERE'S ALSO THE DISTRIBUTIONS. THAT'S MORE OF YOUR TYPICAL LIKE SMALL TELEPHONE POLES AS I WOULD CALL THEM, SO THE SHORTER ONES THAT ARE LIKE 30 40 FT. THOSE WE'VE ALWAYS HISTORICALLY RESTRICTED GOING INTO SITES, BUT THE TRANSMISSION LINES DUE TO A P BEING A PUBLIC UTILITY BY PROVIDER THAT'S CONSISTENT WITH THEIR WITH THEIR REQUIREMENTS THAT THOSE TRANSMISSION LINES BE OVERHEAD AND BE INSTALLED WITH THOSE OTHER LIGHTS BECOME DISTRIBUTION LINES IN EACH OTHER DIFFERENCE. YES THE TRANSMISSION POLES ARE VERY LARGE ONES AND THEN DISTRIBUTION OR THE SMALLER POLLS THAT TYPICALLY RUN ALONG THE STREETS. THANK YOU. I MOVED TO ACCEPT AND STAFF REPORTS RELATED DOCUMENTS INTO THE RECORD IS ONLY CHANGED MINE 2023 . SO HERE A SECOND ON THE DOCUMENTS SECOND. DISCUSSION ON THE DOCUMENTS MOTION. FEW OF THESE, MR KIRBY. MR WALLACE? YES? YES. MR LARSON? YES SHELL FIVE VOTES TO ADMIT THE DOCUMENTS BEFORE WE TAKE A MOTION. DOES ANYONE IN THE PUBLIC WE SHOULD SPEAK ON THIS ITEM? CARING NONE. DO I HEAR A MOTION FOR IS ONLY CHANGED 19. I MOVED TO RECOMMEND APPROVAL OF CITY COUNCIL APPLICATION ZONING CHANGE 1922 23 WITH THE SIX CONDITIONS IN THE STAFF REPORT, WITH THE ONE CHANGE IN ITEM NUMBER TWO, REMOVING THE TWO WORDS AS POSSIBLE. FOR YOUR 2ND 2ND. DISCUSSION ON THE MOTION OF THE ZONING CHANGE. CANADA ROAD, PLEASE. MR SHELLS? YES, MISS BRIGGS? YES KIRBY. MR LARSON. MR WALLACE? YES? THERE ARE FIVE VOTES TO APPROVE THE REZONING WITH THE CONDITIONS AND THE STAFF REPORT AS AMENDED THE REMOVAL OF AS POSSIBLE CONDITION NUMBER TWO. THANK YOU. THANK YOU, FOLKS. THANK YOU. THANK YOU. TAKES US TO FINAL. PLATT, 94 AND IN QUICK SUCCESSION 95. CAN WE PERSON STAFF. THANK YOU SO STAFF WILL PRESENT BOTH OF THESE PLANS APPLICATIONS AT THE SAME TIME SINCE THEY'RE RELATED. SO UM, BACK IN EARLIER THIS YEAR , THE PLANNING COMMISSION IN APRIL APPROVED A PRELIMINARY PLATZ POUR THE ROADWAY SHOWN HERE IN RED AND SO TONIGHT IS THE FINAL PLATZ THAT'S COMING IN IN TWO PHASES. AND SO THE ROADWAY IS NAMED BRISCOE PARKWAY. AND SO IT'S COMING IN TWO PHASES. PHASE ONE EXTENDS FROM HORIZON COURTS OVER TO HARRISON ROAD AND THEN PHASE TWO WILL RUN FROM HARRISON RODE OVER TO CLOVER VALUE. SO THIS IS FOR A PUBLIC STREET IMPROVEMENT PROJECT TO PROVIDE INTERCONNECTIVITY BETWEEN WHAT IS NOW THE COLDEST SECT HORIZON COURT ROAD. AND SO THIS WAS ALSO DISCUSSED AT THE TIME OF THIS TO ENVISION THIS EXTENSION, SO THE PROPERTY OWNERS ARE PROVIDING THE CITY 60 FT OF RIGHT OF WAY. IN ADDITION TO A 25 FT EASEMENT ON BOTH SIDES OF THE STREETS. SO BASED ON THAT TOTAL OF 110 FT OF RIGHT OF WAY AND EASEMENTS THAT'S CONSISTENT WITH THE STRATEGIC STRATEGIC CLAIMS RECOMMENDATIONS FOR THAT AREA. MOREOVER AT THE PRELIMINARY PLATZ FOR PHASE TWO, THE PLANNING COMMISSION PUT A CONDITION OF APPROVAL THAT THAT 25 FT EASEMENTS BE 50 FT. AWAY FROM THE CENTER LINE OF THIS CREEK HERE. SO THAT HAS BEEN MET AND IT MIGHT BE A LITTLE HARD TO SEE HERE BUT CENTERLINE OF CREEK 25 FT EASEMENT. THERE IS 50 FT BETWEEN THOSE LINES HERE FOR THE PHASE TWO PLANET. SO THIS ROADWAY DOES PROVIDE ALL NECESSARY RIGHT OF WAY AND EASEMENTS FOR THE INSTALLATION OF THE FUTURE PUBLIC ROADWAY HERE, AND STAFF. UM I BELIEVE HAS NO CONDITIONS OF APPROVAL FOR THESE TWO PLANTS. HAPPY TO ANSWER ANY QUESTIONS ENGINEERED NO COMMENTS. THANK YOU. WASHINGTON COMING FROM THE COMMISSION. NOPE. NICE NAME.
