[00:10:07]

QUARTER PICK UP, OKAY? UH SO, UM , NOT TO MAKE THIS ALL POLICE MEETING HERE, BUT WE HAVE ONE MORE ITEM THAT WE'D ASK THE MAYOR TO HELP US WITH, UM WE'D LIKE TO, UM, COMMAND OFFICER JAKE STEINBRUCK FOR SOME EXCELLENT WORK. HE DOES. UM HE IS A REPRESENTATIVE FOR THE LOCAL AND THE FEDERAL I CAN IN AN INTERNET CRIMES AGAINST CHILDREN TASK FORCE, AND HE'S BEEN DOING SOME TRULY TREMENDOUS WORK, AND WE WANT TO RECOGNIZE ABOUT ONE CASE IN PARTICULAR.

THANKS CHIEF. I'LL GO AHEAD AND READ THIS CERTAIN CERTIFICATE, UH, RECOGNIZING AND ACCOMMODATING JAKE FREEZE INCREDIBLE WORK WITH THE CITY OF NEW ALBANY POLICE DEPARTMENT.

THIS ACCOMMODATION IS TO FORMALLY RECOGNIZE OFFICER JACOB STEINBERG FOR HIS EXCELLENT WORK IN A RECENT INVESTIGATION THAT LED TO THE INTERSTATE ARREST OF A SEXUAL OFFENDER. STEINBERG'S RELENTLESS PURSUIT OF THIS INVESTIGATION LED DIRECTLY TO THE ARREST AFTER STEINBERG'S QUICK ACTION AND UTILIZATION OF CONTACTS WITH FEDERAL LAW ENFORCEMENT AGENCIES PROVIDED CRITICAL PROVED CRITICAL TO ENSURING A TIMELY ARREST. SPECIFICALLY THE OFFENDER ADMITTED TO HIS INTENT TO ESCALATE THE ABUSE FROM GROOMING TO PHYSICAL ASSAULT OF A MINOR CHILD. IT WAS OFFICER STEINBERG'S THROUGH AND TIMELY INVESTIGATION THAT LED TO THE ARREST OF THE OFFENDER AND THE PROTECTION OF THE VICTIM. HIS ACTIONS CLEARLY INTERRUPTED THE OFFENDERS PLANNED ESCALATION OF SEXUAL ABUSE. THIS AND SIMILAR INVESTIGATIVE EFFORTS ON PART ON PART OF BOTH OUR STATE AND FEDERAL PARTNERS WITH THE INTERNET CRIMES AGAINST CHILDREN TASK FORCE, CONTINUE TO AID AND PROTECTING CHILDREN AND FAMILIES IN OHIO AND HERE INVOLVED WELL DONE, MONSTER, STEINBERG AND THANK YOU FOR YOUR SERVICE.

CHEAP YOURSELF, SO I KNOW. OKAY? 48. THAT'S YOUR GIRL. YOUR PICTURE? NO ONE LAST THING AS FAR AS THE JIG. UM YOU KNOW THIS . OUR INVOLVEMENT WITH THE TEST FORCE WAS SOMETHING THAT YOU KNOW JAKE WASN'T ASSIGNED TO DO AS AN OFFICER. THIS IS SOMETHING THAT, UM HE DEVELOPED A SINCERE PASSION AND TRYING TO MAKE STRIDES IN PROTECTING FAMILIES AND PROTECTING JUVENILES. SO, UM , REALLY, HE'S HE, UM, IS HIS WORK. IT'S REALLY WHAT GOT US INVOLVED IN THE LOCAL TASK FORCE, AND THEN FEDERAL AUTHORITIES ACTUALLY APPROACHED US ABOUT HIM JOINING THE FEDERAL TASK FORCE BECAUSE HE WAS DOING SO WELL AT WHAT HE DID. AND HAVE SOME EXPERTISE THAT THEY DIDN'T HAVE AT LEAST LOCALLY AND IT'S REALLY HELPED THEM OUT. WE ALWAYS WEEK BEFORE A LONG BEFORE HE GOT HIRED AS AN OFFICER. HE WAS A PART OF THE GEEK SQUAD. SO WE'RE LIKE, YOU KNOW, THIS IS THE TRAINING THAT HE RECEIVED, APPARENTLY FOR GEEKS. WATER IT'S REALLY GOING A LONG WAY. SO WHAT WE REALLY APPRECIATE ALL THE WORK YOU'VE DONE, AND IT'S REALLY BEEN OUTSTANDING AND REALLY BUILT POSITION. OKAY? HMM. AND YOU'RE ALL WELCOME TO STAY FOR THE REST OF OUR MEETING, OR HOPEFULLY YOU HAVE SOMEWHERE ELSE BUT SOME OTHER PLANS FOR THIS EVENING. PLEASE GO AND ENJOY AND AGAIN. THANK YOU, EVERYONE FOR COMING TONIGHT . CONGRATULATIONS OFFICER STEINBERG. AND CONGRATULATIONS TO OUR NEWEST OFFICERS. I THINK THAT TAKES US OVER 30 SWORN OFFICERS AND SUPERVISORS NOW SO I CAN DEPARTMENT CONTINUES TO GROW AND THANK YOU ALL FOR YOUR SERVICE.

WE'RE STILL UNDER HEARING OF VISITORS. IS THERE ANYONE FROM THE PUBLIC THAT WOULD LIKE TO ADDRESS COUNCIL REGARDING A MATTER THAT IS NOT ON TONIGHT'S AGENDA? VERY NO PUBLIC COMMENT

[7. BOARD/COMMISSION REPORTS]

WILL MOVE ONTO BOARDING COMMISSION REPORTS IN THE UPDATE FROM THE PLANNING COMMISSION AND BELIEVE MR BULL TROUT ATTENDED A HAD A LENGTHY MEETING LAST NIGHT . UM THE HANDS CROSSING, UH, ITEM WAS NOT ON THE AGENDA. IT'S TABLED TO THE NEXT MEETING. I BELIEVE, BUT THERE WERE SOME RESIDENTS THERE WHO CAME TO SPEAK DURING OPEN COMMENT PERIOD FOR THE ENTERPRISING JIM RUFARO AND ALSO TO PULASKI. UM COMMENTS ABOUT MR POLASKI GAVE SOME COMMENTS ABOUT SOME CONCERNS HE

[00:15:04]

HAS WITH THE NOTTINGHAM. UH TRACE SUBDIVISION, INCLUDING A LACK OF CAPACITY IN THE COMMUNITY CENTER AND SOME CROSSWALKS THAT NEEDS TO BE BUILT AND A LACK OF A DEFIBRILLATOR AT THE OUTSIDE THE BASKETBALL COURTS. I TOLD HIM THAT I WOULD PASS THOSE CONCERNS ALONG ON TO YOU. RANDI. VIS WAS ALSO COMING ALSO CAME AND SPOKE ABOUT THE ROUNDABOUT. AT CENTRAL COLLEGE, KITZMILLER AND 62, WHICH I EXPLAINED HIM WAS SOMETHING THAT WE HAD TALKED ABOUT, UM A LOT AND WAS ON OUR LIST OF UM, ITEMS TO CONSIDER FIXES FOR AND JEFFREY LINDH SPOKE ABOUT THE NEED FOR, UM, IMPROVEMENTS IN THE WALNUT IN BUBBLE HAMMER INTERSECTION AS WELL. UM WE HAVE THE FIRST CASE WAS, UM, RELOCATION OF THE CORNERSTONE ACADEMY THEY WHILE THEY WERE AFTER THEIR AREA WAS REZONED TO BUILD. UM THEY'RE ALL OF THEIR BUILDINGS. ON ONE CAMPUS. THEY MOVED INTO A TEMPORARY BUILDING. UM AND THEY ACTUALLY WANT TO STAY THERE. AND SO IT WAS A, UM, A REZONING THAT WAS APPROVED UNANIMOUSLY. UM AND THEN THE MAJORITY OF THE MEETING WAS SPENT ON THE WALTON FARMS. UM COMMERCIAL PROJECT, WHICH IS THREE LOTS ON DOUBLE HEIMER. IT WAS A PROPOSED C ONE DISTRICT THAT INCLUDED A VARIETY OF SUPPOSED LIKE LOW INTENSITY USES . THERE'S THE RESIDENTS EXPRESSED CONCERN ABOUT TRAFFIC AND USAGE OF THE PLANT, ONE OF THE PROPOSED USES JUST SWIM SCHOOL, AND THERE WAS DISCUSSION ABOUT WHAT? HOW INTENSE THE USE OF A SWIM SCHOOL WOULD BE, UM AND, UH, THAT PAST 3 TO 2 AND, UH, THERE I WOULD EXPECT THERE TO BE RESIDENTS COMING TO SPEAK ON IT WHEN IT COMES TO COUNSEL. UM AND THEN THE LAST WAS THE 5TH AND 6TH PRELIMINARY AND FINAL PLANS FOR 19 COUNTRIES. SO THEY ADDED ABOUT 8016 TO THE COUNTRY'S AND THOSE ARE THE FINAL PLANS FOR THE DEVELOPMENT. MR FELLOWES WAS THERE WAS JUST ONE WOULD WHEN WOULD WE EXPECT NOW THAT THE ZONING FOR THE BEVEL HEIMER REZONING WOULD COME TO COUNCIL BASED ON LAST NIGHT'S MEETING? DO WE HAVE ANY IDEA THAT WHEN THAT MIGHT OCCUR? I DON'T KNOW IF IT WOULD BE BEFORE COUNCIL AT THE NEXT MEETING ON THE 19TH, BUT IF NOT I WOULD HAVE THE FOLLOWING MEETING IN JANUARY. WAS THAT THE FIRST READING? ALRIGHT I THOUGHT THAT WAS THE FIRST READING TO THEM THE PLANNING COMMISSION LAST NIGHT. I THINK IT WAS WELL, BECAUSE THEY DON'T DO 1ST 2ND. OKAY I THOUGHT THEY HAD IT'LL EITHER POP UP ON THE 19 MEETING THE 19TH OF THE FIRST ONE IN JANUARY. I WOULD GUESS SO. OKAY? THANKS. CHIP YOU MIGHT BE THINKING OF SOME OF THE INFORMAL PRESENTATIONS THAT ARE PLANNING COMMISSION. THAT'S JUST TO GET SOME FEEDBACK FROM THE COMMISSION AND MEMBERS OF THE PUBLIC BEFORE THEY COME. FORGET FORMAL READING. THAT'S EXACTLY RETIREMENT. THANK YOU. ANY ADDITIONAL QUESTIONS REGARDING THE PLANNING COMMISSION. ALL RIGHT, THANKS FOR THE REPORT. ANY UPDATE FROM THE PARKS AND TRAILS? NO MEANING. ARCHITECTURE REVIEW BOARD WE NEED NEXT WEEK. REPORTERS JOINING APPEALS. THEY DID HAVE A MEETING ON SEPTEMBER 25TH OR I'M SORRY, NOVEMBER 27TH. UM THEY HAD ONE VARIANTS THAT THEY LOOKED AT AS VARIANTS THAT THE CITY HAD FOR THEM TO REVIEW OFF OF DRUG STREET NORTH.

FOR THE ZONING TEXT TO EXCEED A LOT COVERAGE AND SET PACK REQUIREMENTS FOR TWO PROPERTIES LOCATED ON HORIZON COURT BOTH THE LOT COVERAGE AND SETBACKS OR MINOR, UM AND REALLY APPROVAL.

UM, PRETTY QUICKLY, NOT MUCH DISCUSSION. ALL RIGHT. ANY QUESTIONS? ANY UPDATE FROM THE SUSTAINABILITY ADVISORY BOARD, NO MEETING AND ANY UPDATE FROM THE IDEA AND IMPLEMENTATION PANEL, NO MEETING CEMETERY RESTORATION BOARD, NO MEETING AND THERE WAS NO MEETING OF THE PUBLIC RECORDS COMMISSION. HAS THERE BEEN ANY CORRESPONDENCE OR COMMUNICATION SHARED WITH COUNCIL SINCE OUR LAST MINUTE AND ANYONE WHO WOULD LIKE TO PROVIDE AN UPDATE ON SECOND

[9. SECOND READING OF ORDINANCES AND PUBLIC HEARING]

READING OF ORDINANCES AND PUBLIC HEARING ORDINANCE, 0102 2023 AND ORDERS TO MAKE APPROPRIATIONS FOR CURRENT EXPENSES AND OTHER EXPENDITURES OF THE CITY OF NEW ALBANY STATE OF OHIO DURING THE FISCAL YEAR ENDING DECEMBER 31 2024 STARTS. THANK YOU, MAYOR. I FOR 2024. WE'VE BEEN THROUGH OUR BUDGET PROCESS TO WHERE WE SUPPLIED YOU WITH THE BUDGET ON THE FIRST MEETING AND HAD OUR BUDGET WORKSHOP AND THE CONTINUATION OF THAT DISCUSSION. AND LAST MEETING. UM. THE

[00:20:02]

ORDINANCE AND A PREPARATION AMENDMENT HAS BEEN AMENDED TO INCLUDE THE CHANGES THAT WERE DISCUSSED THROUGHOUT THOSE MEETINGS. I HAVE PROVIDED A PACKET THAT DETAILS WHAT, UH, THE DIFFERENCES ARE, AND THIS IS IMPORTANT BETWEEN THE TWO PIECES OF LEGISLATION. IF YOU LOOK TO THE RIGHT ON THE VERY FIRST PAGE , THERE'S A COLUMN THAT SAYS WHETHER IT'S REFLECTED IN THE BUDGET DRAFT OR NOT, AND, UM, GENERALLY. MOST OF THE CHANGES OR SOME OF I GUESS MOST OF THE CHANGES THAT ARE SIGNIFICANT WORD REFLECTED IN THE BUDGET DOCUMENT THAT WAS PRINTED BECAUSE IT WAS PREPARED AND PRINTED AFTER THE ORIGINAL LEGISLATION, BUT THE PRIMARY ADJUSTMENTS THAT ARE INCLUDED AS A PART OF DISCUSSIONS. UM RELATED IN THE BUDGET PROCESS ARE AS FOLLOWS. IF YOU'RE LOOKING AT THE FIRST PAGE. ABOUT THE THIRD FROM THE BOTTOM. I DID REALLY GOOD ABOUT NUMBERING THE PAGES. BUT APPARENTLY I DIDN'T NUMBER THE ITEM. YOU GUYS. UM THAT IS WHERE IN FINANCE WE MADE THE ADJUSTMENT TO MOVE AND FOR A NEW POSITION INTO FINANCE AND REDUCED AS SOME OF THE, UH, TEMPORARY STAFFING FEES UNTIL WE FILL THAT POSITION ON THE SECOND PAGE. THE BIGGEST ADJUSTMENT. ON THAT PAGE IS WITHIN THE WINDSOR TIFF CAPITAL FUND ABOUT THE MIDDLE OF THE PAGE. AND THAT WAS A RESULT FROM MOVING A COUPLE OF CAPITAL PROJECTS THAT WERE RELATED TO THE WINDSOR TIFF IN ORDER TO PRESERVE FUNDING IN THE CAPITAL FUNDS. SINCE WE DID SHIFT A FEW PROGRAMS OR PROJECTS FROM 25 TO 24. ON THE THIRD PAGE , THE PRIMARILY THE BOTTOM SECTION, AND ALL OF THE CAPITAL FUNDS WERE CHANGES AS A RESULT OF A FEW OF THE PROJECTS MOVING AROUND. PRIMARILY TO MAKE SURE THE FUNDING WAS AVAILABLE FOR EACH OF THOSE WE ALSO DID REMOVE , UH, THE BOND IMPROVEMENT FUND A PREPARATIONS AS DISCUSSED. DOES ANYBODY HAVE ANY QUESTIONS ON THE DETAILS OF THOSE? JUST THAT, I GUESS THE TRANSFER FROM REPAYMENT ADVANCEMENT GENERAL FUND. WHEN WAS THAT ADVANCE MADE? IT'S BEEN REPAID IN 2023, SO WE MADE THE APPROPRIATION AND THE APPROVAL OF THE ADVANCE. I BELIEVE IT WAS A PART OF MID YEAR WHEN WE INITIALLY DECIDED THAT WE'RE GOING TO NEED. FUNDING FOR A LIMITED NOTICE. PROCEED AT THAT POINT, OKAY? ALRIGHT ANY OTHER QUESTIONS ON THE WORKINGS? I DO WANT TO SAY THAT IN YOUR PACKET, JUST FOR YOUR REFERENCE? UH, NOT REALLY, UH, THERE'S AN UPDATED GENERAL FUND ON PAGES FOUR AND FIVE. THE CAPITAL EQUIPMENT LIST DIDN'T CHANGE. I JUST ADJUSTED SOME WORDING RELATED TO, UM ONE OF THE ITEMS, TOO. UPDATE THE DESCRIPTION FOR THE FLOCK SAFETY LICENSE PLATE, WHICH IS NOW AN ANNUAL LEASE FOR EQUIPMENT. WE ALREADY HAVE AND THEN PAGE 89 IS THE UPDATED CAPITAL PROJECTS LISTS. AND THEN FINALLY, 12 AND 13 IS THE CONSOLIDATED FUNDS THAT SHOWS ALL OF THE UPDATES THAT REMAIN. AND THAT'S IT.

OKAY. ANY QUESTIONS ON THE ORDINANCE? JUST ONE ON THAT PAGE 10. UM WHY DO WE HAVE OF THEM? ASSUMING IT'S BECAUSE OF THE VILLAGE CENTER IMPROVEMENT FUND, BUT, UM, THE CAPITAL IMPROVEMENT FUND FOR 2025 IS KIND OF SIGNIFICANTLY REDUCED THAN WHAT YOU NORMALLY SEE IS THAT BECAUSE OF MAYBE THE VILLAGE CENTER IMPROVEMENT FUND THAT WE JUST STARTED. YOU YOU MEAN THE TOTAL

[00:25:06]

AMOUNT OF PROJECTS OR THE BALANCE? UM, SO THAT WAS GOOD RESULT OF MOVING A FEW OF THE PROJECTS UP, SO WE WERE SPENDING MONEY IN THAT FUND PRIOR TO RECEIVING THE INCOME TAX AND 2025. SO WE HAD TO MOVE A FEW OF THOSE, BUT YES, UM, WE ARE MOVING THE VILLAGE CENTER AS DISCUSSED, AND THEN WE'RE UM OTHER PROJECTS THAT WORD. PLANNED FOR THAT, SON. UM HMM.

WE'RE UTILIZING MOST OF THAT SOURCE, OKAY? IF YOU LOOK AT THE CAPITAL IMPROVEMENT FUND IN THE MIDDLE OF THE SOURCE, WHERE IT BREAKS IT DOWN THE PROJECTS BY FUNDING UM, WE GENERALLY LATELY HAVE BEEN UTILIZING ABOUT $10 MILLION.11 MILLION DOLLARS OUT OF THAT FUN. IN FACT, I THINK IN 23 OR AT CLOSER TO 15, MAYBE DEPENDING ON THE PROJECTS, AND SO, UM, THERE ARE STILL OBVIOUSLY SIGNIFICANT PROJECTS. WE ALSO DO ACCOUNT FOR SOME GRANTS THAT ARE RELATED TO GENERAL CAPITAL WITHIN THAT FUND , SO THERE'LL BE SOME MATCHING FUNDS WITHIN THAT APPROPRIATION.

BUT THEN IT DOES DROP OFF IN 27. ALRIGHT, SO THAT'S NOT NECESSARILY UM. PREDICTION OF PERCENTAGES BASED ON INCOME THAT WE HAVE COMING IN A REVENUE. I SHOULD SAY NO. I MEAN, IT DOES ACCOUNT FOR THE WORLD. THE CASH BALANCE IS PRIMARILY DUE TO THE AMOUNT OF CAPITAL PROJECTS THAT ARE IN THERE. I DO HAVE THE REVENUE. IT'S DIRECTLY PULLING FROM THE CAPITAL. FUND AND THE FUN SECTION. OKAY, THAT SHOWS THE REVENUE INCREASES FOR INCOME TAX AND THEN THE PROJECTS RELATED TO IT. OKAY THANKS. AN ADDITIONAL QUESTIONS. THEN I WOULD MOVE THAT WE AMEND ORDINANCE OLD 102 2023 TO INCLUDE THE SUMMARY OF CHANGES JUST DESCRIBED BY THE STRUCTURES . FINANCE. UM 12. SECOND. SPALDING COUNCIL MEMBER FELONS. YES COUNCIL MEMBER WILL SHOW.

YES REMEMBER, SEAN? YES. YES COUNCIL MEMBER, DEREK? YES, MEMBER BRISK. YES, YES VOTES ON THE MOTION MOTION PASSES. ALRIGHT COORDINATION. DO YOU HAVE A COPY OF THIS FOR INCLUSION RECOMMENDED OVER MIND? SO THE APPROPRIATION ORDINANCE THAT YOU. INCLUDED IN THEIR ELECTRONIC PACKET DOES INCLUDE ALL OF THOSE ADJUSTMENTS THAT A FAIR ENOUGH ALRIGHT THEN I WILL OPEN THE WELL, I WILL OPEN THE PUBLIC HEARING TO HEAR IF ANYONE LIKE TO SPEAK REGARDING AMENDED ORDINANCE, 102 2023. HEARING NO PUBLIC COMMENT WILL CLOSE THE PUBLIC HEARING. IS THERE A MOTION UNAMENDED ORDINANCE ONE UP TO 2023? I MOVED THE ADOPTION OF 0102 2023. SECOND. COUNCIL MEMBER WILL CHILD YES. REMEMBER, KISS SHELLED COUNCIL MEMBER FELLOWS? YES YES. REMEMBER BRISK

[10. INTRODUCTION AND FIRST READING OF ORDINANCES]

? YES SPALDING. YES, YES, VOTES STOOD UP ORDINANCE 102 2023. INTRODUCTION AND FIRST READING OF ORDINANCES ORDINANCE. 0106 2023 AN ORDINANCE TO ACCEPT THE EXPEDITED TYPE ONE ANNEXATION OF 9.9 PLUS OR MINUS ACRES FROM PLAIN TOWNSHIP, FRANKLIN COUNTY. JUST THANK YOU, MARY. THIS IS THE OAKLAND NURSERY PROPERTY, LOCATED AT THE SOUTHWEST CORNER OF THOMPSON ROAD IN JOHNSTOWN ROAD. IS THE REMAINING MISSING TOOTH DOWN IN THAT AREA. SO IT IS ACTUALLY COVERED BY EXISTING ANNEXATION AGREEMENT THAT WE HAVE WITH PLAIN TOWNSHIP. UH BECAUSE IT ISN'T IN. UM UM PREGNANT COUNTY IS NOT REQUIRE ROAD MAINTENANCE AGREEMENT. IN ADDITION TO THAT, WE ACTUALLY HAVE MAINTENANCE RESPONSIBILITY FOR JOHNSTOWN WROTE IN THOMPSON ROAD ANYWAY, BECAUSE THEY WERE AN X PREVIOUSLY AS PART OF OTHER ANNEXATIONS. SO. THE ANNEXATION PETITION IS AN EXPEDITED TYPE ONE CONSISTENT WITH OUR STANDARD AND FRANKLIN COUNTY APPROVED THE ANNEXATION. PETITIONERS SEPTEMBER 2 OF THIS YEAR THROUGH THAT RESOLUTION. 7 34-23 60 DAY WAITING PERIOD HAS BEEN MET AND COUNCIL CAN BEGIN TO CONSIDER THIS ORDINANCE TONIGHT. JOE DESCENT AREA IN THE DOTTED BLACK LINE THAT'S STILL IN THE TOWNSHIP THAT REMAINS IN THE TOWNSHIP. IS THAT DOTTED THEY'RE

[00:30:03]

TALKING ABOUT THAT LITTLE I DO, BUT I DON'T HAVE AN ANSWER TO YOUR QUESTION. TIME FOR SECOND READING, RIGHT? I THINK IT MAY BE PART OF THEIR PROPERTY THAT IS, UM, POTENTIALLY ALREADY ANNEXED TO THE CITY. BUT I'LL HAVE TO CONFIRM THAT OKAY? AND THEN DO WE KNOW ARE THEY PLANNING TO YOU KNOW DO ANY DEMOLITION ON THAT SITE OR THEY'RE JUST GOING TO UTILIZE THE PROPERTY AS IS, I BELIEVE THEY'RE JUST UTILIZING THAT, AS IS CONFIRMED THAT FOR THE NEXT MEETING AS WELL, GREAT, THANK YOU, JOE. THAT'S AH! THAT'S THE NURSERY RIGHT THERE, RIGHT? YES.

ALL RIGHT, GO AHEAD AND SET THAT FOR UNLESS THERE'S ANY ADDITIONAL QUESTIONS. WE'RE GOING TO SET THAT FOR A SECOND READING IN OUR MEETING ON DECEMBER 18TH ORDINANCE, 0107 2023. NORTON'S TO AMEND APPROPRIATIONS FOR CURRENT EXPENSES AND OTHER EXPENDITURES HAVE RECEIVED LOBBY STATE OF OHIO DURING THE FISCAL YEAR ENDING DECEMBER 31 2023 STARTS.

THANK YOU, MARY. I AM ALSO INCLUDED AS PART OF YOUR LEGISLATIVE REPORT A SUMMARY OF THE ADJUSTMENTS THAT, UM, WOULD BE INCLUDED ALONG WITH THIS, UM, ORDINANCE. THIS ORDINANCE AMENDMENTS THE 2023 APPROPRIATIONS, AND THE STAFF HAS PERFORMED AN INITIAL REVIEW WITH THIS FIRST READING OF WHAT THOSE CHANGES WILL LOOK LIKE FOR THE END OF THE YEAR. THE CHANGES ARE PRIMARILY DUE TO UM, WITHIN THE GENERAL FUND. IT'S RELATED TO BANK FEES AND RITA FEES DUE TO INCREASED REVENUE AND CASH BALANCES. UM WITHIN THE SPECIAL REVENUE FUNDS. IT'S PRIMARILY RELATED TO THE TIP FUNDS AND ADJUSTING FOR THE PROPERTY TAX. UM, AUDITOR AND TREASURER FEES AND REVENUE, SHARING IT IN RELATION TO THOSE FUNDS, AND THEN THE CAPITAL PROJECTS FUNDS.

THERE WAS AN ADDITION. UM IN THE WATER AND SEWER FUND IN RELATION TO GETTING PARKWAY. AH! PART OF AN O. W D, A PROJECT THAT WILL BE REIMBURSED THROUGH LOAN REIMBURSEMENTS FOR THAT, AND I BELIEVE THAT WAS TOO CLOSE IT OUT AND THEN THE OAK GROVE TO INFRASTRUCTURE FUND NEEDED TO BE INCREASED FOR RITA FEES. THERE'S ALSO INCLUDED A SUMMARY OF APPROPRIATION AMENDMENTS WITHIN THE PACKET, AND THAT PROVIDES FOR WHAT THE ORIGINAL APPROPRIATIONS WERE. AND WE ONLY HAD THE MIDYEAR AND THIS PROPOSAL FOR THIS YEAR FOR ANY AMOUNT. MINTZ TO APPROPRIATIONS AND THEN THE FINAL PAGE OF THAT PACKET OR THE FINAL TWO PAGES IS A SUMMARY OF OUR AVAILABLE BALANCES THAT WOULD UM, THE AVAILABLE FOR APPROPRIATIONS. JUST AS A REMINDER, UM, WITHIN THIS PIECE OF LEGISLATION, IT'S A SPECIAL LEGISLATION FOR IN DECEMBER. WHERE FINANCE WE HAVE TO GO THROUGH AND REVIEW AND ENSURE THAT WE ARE COMPLIANT WITH OUR BUDGETARY REQUIREMENTS AS A PART OF OUR OR FOR OUR AUDIT, AND SO THE SECTIONS WITHIN THE ORDINANCE THAT PROVIDES FOR VARIOUS MECHANISMS THAT WE ARE BUILT TO UTILIZE IN ORDER TO MAKE THAT POSSIBLE. UM SECTION TO BEING ONE THAT WE'RE ABLE TO TRANSFER APPROPRIATIONS BETWEEN LINES WITHIN A FUND. UM AND THIS IS IMPORTANT THAT IT'S NOT THE APPROVAL TO APPROPRIATE OR TRANSFER APPROPRIATIONS BETWEEN FUNDS, AND SO IT'S JUST REALLOCATING SOME OF THE APPROPRIATION. DO SOME OF THE LINE ITEMS THAT NEED IT. UM SECTION THREE, RE ALWAYS TALK ABOUT THE $100,000 CONTINGENCY APPROPRIATION. SHOULD SOMETHING COME UP? BEFORE THE END OF THE YEAR BETWEEN COUNCIL APPROVAL, DECEMBER 19TH AND THE END OF THE YEAR IN CASE. FOR SOME REASON, THERE'S A BUDGETARY COMPLIANCE ISSUE WITHIN A FUND. AND WE'VE NOT, UM, HAD TO USE THAT IN THE PAST, BUT IT'S ALWAYS A SAFE BET TO BE ABLE TO DO THAT. AND THEN SECTION FOUR. THERE'S VARIOUS FUNDS THAT HAVE A ZERO BALANCE NATURE WHERE WE HAVE TO MATCH THE APPROPRIATIONS WITH THE RECEIPTS AND THOSE ARE FUNDS SUCH AS THE EOS E, UM, FUNDS WHERE WE PROCESS ALL OF THE INCOME TAX FROM THE BUSINESS PARK THROUGH AND THEN THE HOTEL TAX AND VARIOUS A COUPLE OF THE TIFF FUNDS THAT ARE PAYING LOANS. AND THEN. SECTION SECTION FIVE GIVES THE AUTHORIZATION TO REDUCE ANY APPROPRIATIONS TO ENSURE THAT WE'RE COMPLIANT WITH APPROPRIATIONS OVER ACTUAL RESOURCES RATHER THAN ESTIMATED RESOURCES. AND WE WILL CONTINUE TO REVIEW THAT AND HAVE ANY AMENDMENTS TO THIS FOR A SECOND

[00:35:02]

READING ON THE 19TH. ANY QUESTIONS ON THE ORDINANCE. I DO APPRECIATE THE FINANCES, EFFORTS TO TRY TO LIMIT THE NUMBER OF, UH NOW CHANGES TO BUDGETARY. UH ALLOCATIONS SOME TWICE A YEAR, SEEMS RIGHT INSTEAD OF EVERY OTHER MEETING, SO I APPRECIATE YOU APPRECIATE THE EFFORTS.

AFTER SOME QUESTIONS ON THE ORGANS, WE'LL GO AHEAD AND SET THAT FOR A SECOND READING OUR MEETING ON DECEMBER 19TH. ORDINANCE 0108 2023 IN ORDER TO AMEND CHAPTER 181 INCOME TAX OF THE CITY OF ROBIN E. OHIO'S CLARIFIED ORANGES, AS REQUESTED BY THE CITY OF NEW ALBANY AND DECLARING AN EMERGENCY STOCKS. THANK YOU, MAYOR. UM THE HOUSE BUILD 33 OF 135TH GENERAL IS, UM BLE THAT WAS ADOPTED THIS YEAR HAD AMENDED THE, UM INCOME TAX CODE FOR MUNIS. MUNICIPALITIES IN RELATION TO, UM, REQUIREMENTS FOR AGE EXEMPTION THAT PROFIT ALLOCATION THAT PROFIT FILING EXTENSION DUTY CORRESPONDENTS LATE FILING PENALTY AND MUNICIPAL NET PROFIT STATE.

FILING OPT IN REQUIREMENTS, AND THOSE PARTICULAR CHANGES ARE REQUIRED TO BE IMPLEMENTED INTO OUR TAX CODE BY THE END OF THE YEAR, AND RITA HAS PREPARED A MODEL LANGUAGE FOR US TO BE ABLE TO DO THAT AND MAKE THOSE CHANGES WITHIN OUR INCOME TAX CODE. SO THIS PARTICULAR LEGISLATION IS ALLOWING US TO MAKE THOSE CHANGES TO THE INCOME TAX CODE AND THE ATTACHMENT A OR EXHIBIT A IS THE RITA MODEL LANGUAGE AND THEN WHEN WE GO TO SECOND READING WILL INCLUDE THE ACTUAL CHANGES THAT WE'RE MAKING IN RELATION TO THOSE REQUIREMENTS FOR RITA. BECAUSE THIS IS SOMETHING THAT NEEDS TO BE PASSED BY THE END OF THE YEAR. THE ORDINANCE DOES INCLUDE EMERGENCY LANGUAGE IN ORDER TO WAIVE THE REFERENDUM PERIOD. UM TO BE EFFECTIVE BY DECEMBER.

31ST 2023. ALRIGHT. ANY QUESTIONS ON THE ORDINANCE? ALL SIT THERE FOR A SECOND READING

[11. RESOLUTIONS AND PUBLIC HEARING]

AT OUR PUBLIC HEARING ON DECEMBER 19TH THANK YOU. RESOLUTIONS RESOLUTION ARE 53 2023 A RESOLUTION AUTHORIZING THE ADOPTION OF THE 2023 2024 FRANKLIN COUNTY MULTIJURISDICTIONAL HAZARD MITIGATION PLAN UPDATE AND THANK YOU, MAYOR. UM. DUE TO THE DISASTER MITIGATION ACT OF 2000. FEMA REQUIRES COUNTIES IN OHIO AND THEIR MUNICIPALITIES TO DEVELOP OR UPDATE A HAZARD MITIGATION PLAN EVERY FIVE YEARS TO REMAIN ELIGIBLE FOR CERTAIN TYPES OF PRE AND POST DISASTER MITIGATION FUNDING. SO FRANKLIN COUNTY EMERGENCY MANAGEMENT AND HOMELAND SECURITY IS CURRENTLY LEADING AN UPDATE OF FRANKLIN COUNTY'S HAZARD MITIGATION PLAN, UM FOR THE COUNTY AND ITS JURISDICTIONS, INCLUDING NEW ALBANY, THIS COUNTYWIDE HAZARD MITIGATION PLAN CONTEMPLATES A VARIETY OF POTENTIAL HAZARDS THAT COULD AFFECT SOME OR ALL OF NEW ALBANESE RESIDENTS. AND ALLOWS THE COUNTY AND NEW ALBANY TO REMAIN ELIGIBLE FOR FUTURE MITIGATION FUNDING FROM FEMA. THE GOAL OF THIS PLAN IS TO IDENTIFY PROJECTS THAT CAN REDUCE PHYSICAL, EMOTIONAL OR FINANCIAL LOSSES CAUSED BY NATURAL AND NON NATURAL HAZARDS.

THESE HAZARDS COULD INCLUDE FLOODING SEVERE WINTER OR SUMMER STORMS, TORNADOES AND, UM MORE.

THIS PLAN INCLUDES A RISK ASSESSMENT AND A HAZARD MITIGATION STRATEGY. FOR THE COUNTY IN AN ANNEX THAT'S SPECIFIC TO NEW ALBANY. THE STUDY FOCUSES ON EXISTING BUILDINGS AND POTENTIAL FUTURE DEVELOPMENT, INFRASTRUCTURE AND CRITICAL FACILITIES THAT MIGHT BE IMPACTED BY A POTENTIAL HAZARD EVENT. AND THOSE CRITICAL FACILITIES INCLUDE THINGS LIKE HOSPITALS, TRANSPORTATION SYSTEMS LIKE FLYING UTILITY SYSTEMS, HIGH POTENTIAL LOSS FACILITIES AND HAZARDOUS MATERIAL FACILITIES. SO JUST AS AN EXAMPLE WHEN RECURRENT DISASTERS HAPPEN, FOR EXAMPLE, RIVERINE FLOODING WHEN THESE HAPPEN, THE TREND IS IT'S DAMAGED. YOU REPURPOSE IT, YOU FIX IT UP, AND THEN THERE'S POTENTIAL FOR A HAZARD TO COME AND WIPE IT OUT AGAIN. AND SO HAZARD MITIGATION PLANS REALLY ATTEMPT TO BREAK THAT CYCLE. UM WHICH CAN BE VERY EXPENSIVE IN THE LONG RUN, SO HAS MEDICATION PLANNING TAKES A LONG TERM VIEW OF REBUILDING AND RECOVERING FROM DISASTERS. AND THEY DO THIS THROUGH MITIGATION PLANS OR MITIGATION ACTIONS. SO THE MITIGATION PLAN INCLUDES ACTIONS THAT THE CITY IS ALREADY TAKING, UM, TO REDUCE DAMAGES FROM FUTURE HAZARDS IN ALBANY, SO THESE MITIGATION ACTIONS CAN

[00:40:06]

GENERALLY BE CATEGORIES CATEGORIZED AS ONE OF THE FOLLOWING TYPES OF PROJECTS. THE FIRST BEING LOCAL PLANS AND REGULATIONS. SO FOR EXAMPLE, UM THIS WOULD BE INCLUDING THE HAZARD MITIGATION PLAN IN FUTURE STRATEGIC PLAN. UPDATES FOR THE CITY, UM, AND A MORE REGULATORY EXAMPLE OF THIS IS SOMETHING WE ALREADY DOING, MAINTAINING THAT, UM, COMPENSATORY STORAGE REQUIREMENTS FOR DEVELOPMENT IN THE 100 YEAR FLOOD PLAIN. THE SECOND TYPE OF PROJECT THAT'S INCLUDED IS STRUCTURE AND INFRASTRUCTURE PROJECTS. SO UM, ONE STRATEGY WE INCLUDED IN THE PLAN IS SOMETHING WE'RE ALREADY PLANNING TO DO. THE REGIONAL STORM WATER BASIN, UM THE THIRD TYPE OF PROJECT INCLUDED IS NATURAL SYSTEMS PROTECTION AND AGAIN. WE'RE ALREADY DOING THIS A LOT IN OUR WORK WITH THE TAYLOR FARM, FOR EXAMPLE, UM, THAT WETLAND PROTECTION AND INSTALLATION OF NATIVE SPECIES AT TAYLOR FARM TO PROTECT THAT WETLAND. UM AND THEN THE FINAL TYPE OF PROJECT THAT CAN BE CONSIDERED IS THE EDUCATION AND AWARENESS PROGRAMS. AND I THINK JOSH DOES A GREAT JOB OF THIS ALREADY, UM, IN POSTING UM IMPORTANT INFORMATION THAT WE NEED TO COMMUNICATE TO THE PUBLIC ON SOCIAL MEDIA OR THROUGH CONNECTS THINGS LIKE WHAT TO DO IN CASE OF A TORNADO OR IF WE'RE HAVING A SEVERE HEAT EVENT. WHERE CAN PEOPLE GO IF THEY LOSE POWER TO MAINTAIN AIR CONDITIONING AND THAT KIND OF THING? SO THIS PLAN WAS MADE AVAILABLE. UM SORRY. THIS PLAN WAS MADE AVAILABLE TO THE PUBLIC FOR A COMMENT PERIOD. BACK IN THE SUMMER. UM, IT WAS A 30 DEEP 30 DAY PUBLIC COMMENT PERIOD PARTICIPATION IN THIS PLAN.

UPDATE SATISFIES FEMA REQUIREMENTS FOR NEW ALBANY TO REMAIN ELIGIBLE FOR CERTAIN TYPES OF PRE AND POST DISASTER MITIGATION FUNDING. AND YOU MIGHT HAVE NOTICED THAT THE PLAN PROVIDED TO YOU. IT'S STILL CURRENTLY IN DRAFT FORM. FEMA HAS ADVISED JURISDICTIONS TO ADOPT THE PLAN AND ITS DRAFT STATE TO AVOID ANY LAPSE IN PLANNED COVERAGE. THE CURRENT PLAN IS SET TO EXPIRE DECEMBER 28TH AND SO, UM WE'RE TRYING TO GET AHEAD OF THAT AND ADOPTED.

BEFORE ITS IN ITS EXACT FINAL STATE. UM. AND WITH THAT BEING SAID THOSE CHANGES THAT COULD OCCUR AS A RESULT OF THE STATE EMERGENCY MANAGEMENT AGENCY REVIEWING IT. THOSE ARE MINIMAL CHANGES. UM AND THE CITY WILL NOT BE REQUIRED TO RE ADOPT ANY FURTHER ITERATION OF THIS PLAN.

SO THIS RESOLUTION MAY BE ADOPTED THIS EVENING, AND I'M HAPPY TO ANSWER ANY QUESTIONS.

IN MY CURRICULUM, FRANKLIN COUNTY APPROVED OR AUTHORIZED ACCEPTANCE OF THE PLANT AND THIS EARLIER TODAY. SO THE PLAN GOES TO THE STATE EMERGENCY MANAGEMENT AGENCY FOR REVIEW FIRST, AND THEY REVIEWED IT. THEY'VE ALREADY DONE THAT FIRST ITERATION OF REVIEWS. UM AND THEY ANTICIPATE THAT WITH JUST A FEW MINOR CHANGES, UH THE STATE E. EMMA WILL PROVIDE THE APPROVED PENDING ADOPTION STATUS TO IT. WHICH MEANS THAT ONCE ALL OF THE MUNICIPALITIES AND THE COUNTY AS A WHOLE HAVE APPROVED PLAN THAN UM, IT'S OFFICIALLY READY TO GO AND CAN BE USED. I WANTED TO ACKNOWLEDGE AND HIS WORK ON THIS ISSUE. VERY THOROUGH JOB REPRESENTING ME AT THESE MEETINGS. IT'S GOT A LOT OF TIME WORKING ON THE PROJECT, SO SHE DID A GREAT JOB. ALL RIGHT. ANY QUESTIONS REGARDING THE RESOLUTION? GORDON OPENED THE PUBLIC HEARING. ANYONE FROM THE PUBLIC LIKE TO SPEAK REGARDING RESOLUTION ARE 53 2023. HEARING NO PUBLIC COMMENT WILL CLOSE. THE PUBLIC HEARING IS THE EMOTION ON THE RESOLUTION. I'M OVER ADOPTION OF RESOLUTION ARE 53 2023 2ND. MEMBER WILL TROUT COUNCIL MEMBER DARK, YES, YES, YES. COUNCIL MEMBER KISS? YES COUNCIL MEMBER SHELVES? YES SEVEN. YES. VOTES WITHOUT RESOLUTION ARE 53 2023.

THANK YOU, ANNA. THANK YOU. RESOLUTION ARE 54 2023 A RESOLUTION AUTHORIZING THE CITY MANAGER AND EXECUTE THE SECOND AMENDMENT TO THE 2014 LEASE AGREEMENT, AND 2023 AMENDED OPERATING AGREEMENT WITH HELP INVOLVEMENT. THANK YOU, MAYOR, HIS COUNSELOR WHERE OUR RELATIONSHIP WITH HEALTHY NEW ALBANY STARTED OUT MANY YEARS AGO, ACTUALLY CONSISTENT WITH THE CONSTRUCTION OF THE HEIGHT CENTER. UH THEIR THEIR PURPOSE WAS TWOFOLD. ONE WAS TO OUTFIT THE SPACE THAT THE COMMUNITY SPACE AND THE SECOND WAS TO OFFER COMMUNITY PROGRAMMING,

[00:45:02]

WHICH THEY'VE DONE IN THE IN DIFFERENT WAYS OVER TIME. INITIALLY WHEN WE KNOW WHEN WE IMPLEMENTED THE HEALTHY NEW ALBANY PROGRAMMING COUNCIL I WANTED TO DO SOMETHING IN THE AREA OF, UH, SENIOR HEALTH AND WELL BEING AND HEALTHY TO ALBANY SERVED THAT PURPOSE FOR SEVERAL YEARS AND THEN OVER TIME COUNCIL DECIDED THAT, UH, THERE WAS A NEED TO EXPAND THE PROGRAM DUE TO THE GROWING SENIOR POPULATION . SO THE CITY TOOK THAT RESPONSIBILITY BACK ON. UM AS A RESULT OF THE GROWTH OF THE PROGRAM, THERE IS A NEED FOR ADDITIONAL USE OF ADDITIONAL SPACE AND USE OF SPACE DURING MORE FREQUENT PERIODS OF THE OF THE OF THE WEEK OR MONTH. IN ADDITION TO THAT HEALTHY INVOLVED BENEATH THE 501 C THREE ORGANIZATION HAS HAD SOME STRUGGLES WITH THEIR REVENUE STREAM. UM THEIR THEIR SPONSORSHIP THROUGH OS YOU IS DOWN IN THEIR RACE REVENUE IS DOWN, OR AT LEAST IT HAS BEEN OVER THE LAST SEVERAL YEARS. SO AS A RESULT OF THIS, THIS, UH AGREEMENT. WHAT WE WOULD DO TO MODIFY THIS POLICE WOULD BE TO GIVE THE CITY GREAT REFLECTS ABILITY IN USING THE SPACE AND IN EXCHANGE FOR THE INCREASED USE OF THE SPACE. WE WOULD PROVIDE THE HEALTHY NEW ALBANY ORGANIZATION THREE YEAR RENT HOLIDAY ON THE CAM CHARGES. THEY'RE ALREADY GETTING THE SPACE FOR NO CHARGE ON THE BASE RENT, BUT THIS WOULD GIVE THEM A THREE YEAR RENT HOLIDAY BEGINNING JANUARY, 24 AND RUNNING THROUGH DECEMBER OF 26. THE VALUE OF THAT IS APPROXIMATELY $50,000 A YEAR, SO THE TOTAL WOULD BE ROUGHLY $150,000 OVER THREE YEARS. AND THAT'S THE BASIS OF THAT AS WELL BECAUSE THAT THEY WILL BE REQUIRED THE USAGE OF MORE SPACE AS IT RELATES TO THE SENIOR CONNECTIONS PROGRAM, DIFFERENT AREAS OF THE SPACE OR OF THE FIRST FLOOR. UM, THE. THE SPACE THAT WE WERE ORIGINALLY OCCUPYING, OR HAD FIRST CLAIM TO WAS CONSIDERED LIKE THE COMMUNITY GATHERING SPACE AT THE BACK OF THE BUILDING WHERE THE FIREPLACE IS LOCATED. HEALTHY NEW ALBANY HAD PRIMARY USE OF ALL OF THE REST OF THE SPACE. SO THE ROOM IN BETWEEN THAT GATHERING SPACE AND KITCHEN OR THAT YOU KNOW THE SPACE WHERE THE FOOD PREP AREAS AND THEN ALSO THE FRONT MEETING RULE. THIS WILL GIVE US GREATER FLEXIBILITY AND USING ALL OF THOSE SPACES. UH AND IT WILL ALSO INCREASE OUR UH, ACCESS TO EACH OF THOSE SPACES MORE REGULARLY. SO AS OPPOSED TO MAYBE, YOU KNOW, 11 MORNING PER WEEK. NOW WE HAVE THE ABILITY TO USE IT DIFFERENT TIMES OF THE DAY OR EVENING AS WELL AS DIFFERENT DAYS OF THE WEEK OR WEEKENDS OR THAT INCLUDE FUNCTIONS OUTSIDE OF THE SENIOR CONNECTIONS PROGRAM. SAY, FOR EXAMPLE OF THIS IF WE WANTED TO HOLD A MEETING MEETING OVER THERE BECAUSE TYPE OF SPACE THAT IT PROVIDES. THAT WOULD PROVIDE US THAT OPPORTUNITY MORE READILY. YES. AND WE WERE WE WERE COMPENSATING THEM FOR USE OF THE SPACE. UH IN ADDITION TO OUR SUPPORT OF THE SENIOR CONNECTIONS PROGRAM BEFORE WE BEFORE WE TOOK IT OVER AND AGAIN ONCE WE TOOK IT OVER THE PAYMENT TO HEALTHY NEW ALBANY TO MANAGE THE SENIOR CONNECTIONS, PROGRAMMING WENT AWAY. BUT THE RENT OR THE FEE FOR THE USE OF THE SPACE WAS STILL BEING PAID TO THEM. SO THIS IS IN EXCHANGE FOR US ENTERING INTO THIS MODIFIED AGREEMENT WILL BE NO MORE FEES ASSOCIATED WITH THE USE OF THE SPACE WILL STILL BE A FEE FOR USE OF PROGRAM SOFTWARE. UH TRACKS UM MEMBER PARTICIPATION THOSE KINDS OF THINGS. BUT IT'S A IT'S MORE OF A STREAMLINE APPROACH TO THE USE OF THE SPACE AND IT DOES. IT DOES HELP. UM, HEALTHY NEW ALBANY STABILIZE ITS FINANCIAL SITUATION FOR THE NEXT THREE YEARS, COMFORTABLE WITH THE VALUE THAT IT BRINGS TO THE CITY. BY DOING THIS, WE'RE GOING TO GET THE VALUE OUT OF THAT. JOE, JUST A COUPLE OF FOLLOW UP QUESTIONS, AND I APOLOGIZE FOR NOT ASKING HIS EARLIER BUT IT'S BEEN A LITTLE BIT SINCE HELPING YOU ALREADY CAME AND GAVE HER PRESENTATION AND SHARED WITH THIS THEIR BUDGET OUTLOOK. UM OVER THE LAST SEVERAL YEARS, WE'VE ALLOWED THEM TO RENT THE SPACE AGAIN. THE CITY OWNS IT.

WE'VE ALLOWED THEM TO RENT IT AND KEEP THE RENT PROCEEDS. DO WE KNOW ON A LOOKING BACK, YOU KNOW, BASIS HOW MUCH REVENUE THEY WERE ABLE TO GENERATE FROM THAT ACTIVITY. UH I BE ABLE TO

[00:50:03]

GET THAT INFORMATION FOR YOU. I DON'T HAVE IT OFF THE TOP OF MY HEAD. WE ACTUALLY HAVE A MEETING WITH HEALTHY NEW ALBANY. TOMORROW THEY HAVE THEIR BOARD MEETING, SO I'LL REPORT THAT PASSAGE. ALRIGHT AND THIS WON'T LIMIT THAT REVENUE OPPORTUNITY. IF THEY'RE RUNNING IT TO ACTUALLY CHAMBER FOR USE, IT WAS STILL KEEP THEIR RENT REVENUE. IT'S ONLY WHEN THE CITY USES THE SPACE. WE DON'T HAVE TO PAY THE RENT OUR OWN SPACE. YES. OKAY? AND THEN WHO DOES THIS? SET UP AND TEAR DOWN? YOU KNOW, WE'RE HAVING ALL STAFF MEETING OVER THERE, AND WE NEED THE TABLES AND CHAIRS ARRANGED IN A CERTAIN WAY. IS OUR STAFF RESPONSIBLE FOR USING THE SPACE THAT THAT SET UP AND TEAR DOWN? AFTER THE FOR THE ADRIAN ON THAT TOWARD THE SENIOR CONNECTIONS PROGRAMS. UM, WE DID RIGHT INTO THAT OPERATING AGREEMENT THAT, IF ANY WOULD PROVIDE THOSE SERVICES.

I'M NOT SURE WE'VE CONTEMPLATED LIKE A CITY EVENT AND HOW THAT WOULD WORK ONE THING IN THE UPPER TRADING AGREEMENT, WE'RE GOING GOING TO MEET ON A UM, TRY ANNUAL BASIS TO LOOK AT KIND OF THE UPCOMING FOUR MONTHS. LOOK AT THE SCHEDULE, SO I THINK THERE'LL BE AN OPPORTUNITY FOR MORE COLLABORATION THAT WAY. OKAY YOU KNOW, WE HAVE WE HAVE THE GUARANTEED TIMES AND DATES IN THIS AGREEMENT, BUT WE HAVE SOME ABILITY TO WORK WITH THEM AS WE KNOW WHAT'S COMING UP IN THE FUTURE MONTHS. SO WE CAN BRING THAT TOPIC UP WITH THEM DURING ONE OF THOSE MEETINGS AND THEN MY FINAL QUESTION, AND HE MAY KNOW THE ANSWER TO THIS, TOO. BUT JUST LIKE IN A DAILY MAINTENANCE STANDPOINT, YOU KNOW WHO CLEANS THE FACILITIES AND ROOMS ON A REGULAR BASIS. SO THERE'S A JANITORIAL CREW THAT DOES THE ENTIRE BUILDING. OKAY AND THAT'S PART OF THE CAMP CHARGE. THAT'S UM ALLOCATED TO ALL OF THE TENANTS BASED ON THEIR SQUARE FOOTAGE. RIGHT SO THAT BUT CITY PAYS FOR THAT THE FOLKS RENTING SPACE FOLKS RUNNING THE SPACE PAY FOR THAT AS PART OF THEIR CAMP CHARGE. IN THIS CASE WITH THIS MODIFICATION TO THE LEASE, THE CITY WOULD PICK UP THAT THAT EXPENSE FOR HEALTH, EVEN ALBANY. THAT'S A BIG PART OF THE CAMP FOR THE BUILDINGS, SO WE'LL PAY ARE PRO RATED SHARE OF WHATEVER THEY WERE BACK, BUT THAT DOESN'T DEAL WITH THINGS LIKE WHEN WE HAVE JUST TO CLARIFY BECAUSE I KNOW THERE'S BEEN SOME ISSUES BEFORE.

IT DOESN'T DEAL WITH THINGS LIKE CLEANING THE CHAIRS BEFORE THEY GET PUT AWAY. AFTER AN EVENT, FOR EXAMPLE, THAT SORT OF THING. I'M NOT SURE THERE'S A CLARIFICATION IT, DO WE, YOU KNOW, ADRIAN. IF THERE'S ANY KIND OF CLARIFICATION OF RESPONSIBILITY FOR THAT SORT OF THING, BECAUSE I FEEL LIKE THAT'S BEEN PART OF THE DISCUSSION. CAM IS THE BUILDING ITSELF. IT'S NOT YOU'RE PUTTING A FOLDING CHAIR AWAY AND SOMEBODY SMEARED SOME FOOD ON IT THE RIGHT FOOT AWAY. I DON'T KNOW IF WE'VE HAD, YOU KNOW DETAILED DISCUSSIONS ABOUT THOSE SITUATIONS YET, BUT WE CAN CERTAINLY TALK TO THEM WHEN YOU TALK ABOUT WHO'S PUTTING WIND SETTING UP TO MAKE SURE THAT THAT'S PART OF IT. JOE HOW DO WE SETTLE ON THREE YEARS ON THIS? WE COME TO THE THREE YEAR NUMBER AS FAR AS HOLIDAY, SO THEY AT SOME OF THEIR PRIOR BOARD MEETINGS. THEY DISCUSSED A THREE YEAR PLAN TO, UH GROW THEIR REVENUE STREAM THEY ARE ATTEMPTING TO BRING ON MEMBERS OF THE TEAM, TOO. PERFORM. CERTAINLY. CASTS YOU KNOW, THEY HAVE A LOT OF VOLUNTEER STAFF. THEY HAVE PEOPLE THAT ARE GENERAL WAS BUT WHAT THEY'RE TRYING TO DO IS BRING IN PEOPLE THAT ARE, UM MORE EXPERT IN MARKETING AND IN FUNDRAISING AND THOSE TYPES OF THINGS THEY ARE REACHING OUT TO OTHER SPONSORS. THEY'RE LOOKING AT TRYING TO SHORE UP RACE REVENUE. OHIO STATE WAS A LARGE SUPPORTER EARLY ON HIS YOU KNOW THAT WAS ONE OF THEIR THREE PRIMARY REVENUE STREAMS. THE RACE WAS THE SECOND STREAM AND THEN THE REYNOLDS OF THE SPACE FOR COMMUNITY, UM, COMMUNITY. GATHERING THOSE TYPES OF THINGS WAS THE THIRD THE THIRD FUNDING SOURCE BECAUSE OF COVID. A LOT OF THOSE THINGS DROPPED OFF. I THINK THE ONLY ISSUE SPONSORSHIP WAS WAS ALREADY TRENDING DOWNWARD PRIOR TO THAT, BUT THEY'RE TRAINED TO REESTABLISH THEIR FUNDING STREAM. AND THEY THINK THAT THAT THREE YEAR PERIOD WOULD BE, UM, A CRITICAL TIME FOR THEM TO EITHER ACCOMPLISH THAT, OR, YOU KNOW, REASSESS. SO IF WE WERE TO RENT THIS SPACE IS A CITY UM, WITH THAT. MONEY FOR THE SPACE APPLIED TOWARDS THEIR REVENUE STREAM. WE WOULD HAVE NO NO RENTAL CHARGE, IN FACT, UH, IF WE'RE NOT USING IT FOR REGULAR PROGRAMMING, FOR EXAMPLE, IF WE HAVE A STAFF MEETING THERE, OR I

[00:55:05]

THINK WE'VE HOSTED THE CENTRAL OHIO MAYORS OF MANAGERS GROUP AND THE COUPLE OF OTHER EVENTS.

THERE HAS BEEN NO CHARGE FOR THAT. UM, I'D LIKE TO UNDERSTAND. HOW WERE.

DETERMINING WHAT THAT WHAT IT MEANS THAT WE HAVE MORE OF A PRIORITY FOR THIS SPACE AND HELP. WHAT WHAT DOES THAT MEAN ON A DAY TO DAY BASIS? MAYBE ADRIAN CAN PROVIDE SOME MORE DETAIL ON THAT. BUT BASICALLY WE HAVE TO FIND SPECIFIC DATES AND TIMES OR TIMES OF THE MONTH THAT WE WILL RECEIVE. PRIORITY USE OF THE SPACE SO THEY CAN'T THEY CAN'T PROGRAM THE SPACE AND THOSE DATES OR AT THOSE TIMES. THAT'S CORRECT. AND THEN IN THE AGREEMENT IT REFERENCES BY AREA UM SO CERTAIN AREAS LIKE, UH I DON'T REMEMBER EXACTLY. WHICH LETTER IT IS, BUT LIKE 12 TO 5 MONDAY THROUGH FRIDAY, WE HAVE FIRST RIGHT OF REFUSAL ON THAT SPACE, SO IT'S RESERVED FOR CITY USE ON THURSDAYS, FOR EXAMPLE, WE'VE RESERVED THE ENTIRE FIRST FLOOR FOR A CERTAIN PERIOD OF TIME, AND THAT IS REFLECTED IN THE AGREEMENT SO WE CAN HAVE ALL THOSE SPACES FOR THE REGULAR THURSDAY PROGRAMS. UM, THE CLASSROOM, WHICH IS THAT MIDDLE UM, PEACE WITH WE'VE TALKED THROUGH AND DELINEATED DAYS AND TIMES THAT THE CITY NEEDS THE ABILITY TO USE THAT SPACE, SO I THINK IT IT IT SETS SOME CLARITY THAT WE HAVEN'T HAD BEFORE, AND WE'VE HAD A SERIES OF MEETINGS WITH THE HEALTHY NEW ALBANY STAFF, SO THEY UNDERSTAND. WHAT THAT REALLY MEANS AND THAT, YOU KNOW THEY CAN'T SCHEDULE DURING THAT TIME AT ALL. UM OKAY. TRIANGLE MEETING IS THEN INTENDED TO WE HAVE THOSE DAYS AND TIMES RESERVED. BUT LET'S TALK EVERY FOUR MONTHS AND SAY, HEY, IF WE'RE NOT YOU KNOW WE'RE NOT DOING CARDS ON TUESDAY IN THE NEXT FOUR MONTHS FOR SOME REASON, IF YOU GUYS HAVE SOMETHING WE CAN WORK THROUGH THAT, SO I THINK I THINK IT WILL BE. MORE COLLABORATIVE, BUT WE ALSO HAVE A HIGHER PRIORITY AND UM, YOU KNOW, IN THE USE OF THOSE SPACES THAT I THINK WILL BE HELPFUL FOR SENIOR CONNECTIONS IS THE OUTDOOR SPACE. A PORTION OF THAT THE OUTDOOR SPACE? YEAH THAT IS INCLUDED. THERE'S ACTUALLY THREE DIFFERENT THAT'S IN THE OPERATING AGREEMENT AS A LETTER SPACE AS WELL, SO IT TALKS ABOUT USE OF THOSE SPACES SPECIFICALLY LAID OUT. WHO GETS FIRST. RIGHT? RIGHT? OKAY THE FORMER RELEASE IN THE FORMER AGREEMENT WERE SET UP. THEY REALLY CONTEMPLATED THE SPACE BEING KIND OF TURNKEY FOR THE CITY THAT WE DIDN'T HAVE A SIGNIFICANT INVOLVEMENT IN THE SPACE. UH LOOK AGAIN, OUR PROGRAMMING WAS ACTUALLY NON EXISTENT, VERY MINIMAL. EVERYTHING WAS FOCUSED ON HELPING YOU ALREADY PROVIDING THE SERVICES ON BEHALF OF THE CITY. AND NOW WITH THE CHANGING CIRCUMSTANCES AGAIN THE GROWTH OF THE SENIOR CONNECTIONS PROGRAM UM. THROUGH THE CITY'S EFFORTS. IT SEEMED TO MAKE SENSE THAT WE RESTRUCTURE THE OPERATING AGREEMENTS, WHICH THEN IN TURN TRIGGERED THE NEED TO RESTRUCTURE THE LEASE. WE NEED THE SPACE MORE SO MAKES SENSE THAT THE ONE THING I CAN'T REMEMBER IS HOW THIS ENDED UP WORKING OUT WITH THE ENTIRE BUILDING. ARE WE REAL ESTATE TAX FREE ON THE ENTIRE BUILDING. OTHER THAN WHERE THE GYM IS, IS THAT WE CALL THAT CORRECTLY, SO THAT WAS THAT'S REGARDLESS, THIS AGREEMENT WON'T CHANGE THAT.

OKAY? WE'RE WORKING TO GET THAT ISSUE RESOLVED THIS ONE, OKAY? COMMENTS. I'D LIKE TO MAKE IT CLEAR THAT THIS IS A THREE YEAR KIND OF RUNWAY AND NOT AN INDEFINITE CONDITION. AND THAT'S WRITTEN INTO THE LEASE. ARE WE ALL COMFORTABLE WITH THREE YEARS TO ME THINK THIS NEEDS TO BE AN ANNUAL YEAR TO YEAR. WELL, IT SOUNDS YOU FIGURED THE COST INTO THE NEW PERSONNEL. THAT'S PROBABLY CLOSE TO THE 150 OR UNDER THAT, AT LEAST, I MEAN, SOUNDS LIKE BASED ON THEIR GOALS. FRANKLY, IF I'M WRONG THREE YEARS IS REFLECTIVE ON THEIR NEEDS TO MOVE FORWARD AND GET BACK TO A REVENUE STREAM. THAT WOULD BE POSITIVE. I'M ASSUMING THAT'S WHY IT'S MAYBE NOT 12 OR FIVE OR WHATEVER IS IT? SOUND WRITER CAN'T BE ALL AT ONCE, THOUGH. IT MUST HAVE REALLY ACCUSE MYSELF. I SIT ON THE BOARD FOR HELPING YOU, ALBANY SO I DON'T KNOW IF APPROPRIATE FOR YOU TO ANSWER OR VOTE. YOU HAVE TO TELL ME. I BELIEVE I SHOULD KNOW THAT'S IT.

WHAT'S THAT? I WOULD THINK HE COULD SHARE INFORMATION, COMFORTABLE SHARING IF IT'S NOT

[01:00:04]

PRIVATE, AND THEN SIT ON THE BOARD. SO YOU TELL ME WHAT I CAN DO SO TO THE EXTENT THAT YOU'RE COMFORTABLE SHARING INFORMATION THAT'S PUBLIC AND OTHERWISE GAINED. THAT'S PRIVATE AND CONFIDENTIAL YOU COULD SHARE. BUT IF YOU'RE NOT COMFORTABLE SHARING, YOU CAN RECUSE. RECUSE YOURSELF. AND QUITE QUITE CANDID. IF YOU'RE GONNA RECUSE YOURSELF FROM ANY VOTE, YOU PROBABLY SHOULD RECUSE YOURSELF FROM ANY DISCUSSION. LEAVING MY KIDS. OKAY IF YOU'RE ACCUSED YOURSELF WORK WITH JODI, GET THAT ANSWER. I'M NOT TRYING TO AVOID IT. I ALSO DON'T WANT TO CREATE A CONFLICT EITHER. I THINK THAT I CAN'T SHARE. I THINK IT IS NOT ALIGNED. AS JOE SAID. THERE'S A THERE'S A BOARD MEETING TOMORROW IS TO REALLY LOOK AT IT EVALUATE CURRENT SITUATION TO GO FORWARD PLANNING STRATEGY. FOR THE FINANCIAL FUTURE AND DEVELOPMENT OF THE.

OF HEALTHY NEW ALBANY. UM, I DON'T THINK IT'S ANY SECRET THAT REVENUES FROM WALKS AND OTHER THINGS HAVE BEEN DOWN OVER SEVERAL YEARS, NOT JUST FOR HEALTHY BUT OTHERS SO THAT IMPACTS THEIR FINANCIAL STRUCTURE AND WHAT THEY'RE LOOKING AT, SO THEY'RE LOOKING AT HOW THEY'RE GOING TO REPOSITION CERTAIN THINGS. WHAT THAT IS, I DON'T KNOW THAT WILL BE DETERMINED AND DISCUSS TOMORROW. BUT I CAN CERTAINLY APPRECIATE FROM A PLANNING STANDPOINT, YOU WANT TO HAVE A MULTIYEAR RUNWAY? YEAH I'M NOT SURE. WHAT'S MAGIC ABOUT THREE? I COULDN'T TELL YOU. THE ANSWER TO THAT. DON'T KNOW HOW IT'S THREE VERSUS TWO FOR ONE, BUT, UM, I DO KNOW THAT IT'S NOT. IT'S NOT GOING TO BE AN EASY ONE YEAR FIXED IN MY OPINION. I I'M GOING TO COME OUT. I CAN'T SAY JOE TELLS US HE FEELS STRONGLY DIFFERENTLY. AND I RESPECT THAT AND LISTEN TO IT, BUT I PERSONALLY AM NOT LOVING A THREE YEAR COMMITMENT TO THIS, UH, AGREEMENT. I DON'T KNOW WHY. UH WE HAVE TO MAKE A COMMITMENT ON OUR END TO DO THIS FOR THREE YEARS. THAT WE COULD BE SAYING THAT WE'RE GOING TO REVIEW EVERY YEAR AND SEE IF IT'S OBVIOUSLY IF IT'S HELPING HEALTHY NEW ALBANY AND IT'S NOT HURTING US. I GOTTA BELIEVE WE'LL SAY OKAY, LET'S GO ANOTHER YEAR AND ANOTHER YEAR, BUT I WOULD LIKE TO BE ABLE TO RE EVALUATE HOW IT'S GOING FOR US AND HOW IT'S GOING FOR THEM AT THAT POINT. JOEY, IS THIS RESOLUTION TIME SENSITIVE. FOR THE FIRST OF THE YEAR, OR I THINK THEY'D LIKE TO HAVE IT WRAPPED UP BY THE FIRST OF THE YEAR. WE COULD CERTAINLY TABLE IT UNTIL THE NEXT MEETING. IT SOUNDS LIKE I MEAN, YOU SAID THE MEDIA'S TOMORROW. I'D LOVE TO GET THROUGH THAT PLANNING MEETING AND THEN POSSIBLY HAVE SOMEBODY FROM THE NEW OMNI CAN TO THE NEXT COUNCIL MEETING IN PAST MY ANSWER SOME QUESTIONS AND PRESENT. THAT'S RIGHT. MM IDEA. MHM VERY GOOD IDEA CAN BETTER UNDERSTAND THE THREE YEAR PERIOD. WHAT THEY REALLY NEEDED. I WANT TO MAKE A MOTION. I'D LIKE TO MOVE TO TABLE RESOLUTION ARE 54 2023 TO THE NEXT COUNCIL MEETING ON THANK YOU. DECEMBER 19TH DECEMBER, 19TH. IS THERE A SECOND? SECOND COUNCIL MEMBER KISSED COUNCIL MEMBER WORLD TRAVEL YES. COUNCIL MEMBER FELLOWS YES, MEMBER DURING THE WEEK ABOUT ON THAT, OR REFUSED JUST RECUSED MYSELF. COUNCIL MEMBER BRISK. YES SPALDING COUNCIL MEMBER SHOP. YES, I HAVE. SIX YES VOTES AND ONE RECUSAL ON THE MOTION TO TABLE RESOLUTION ARE 54 RESOLUTIONS FOR 2023 IS TABLED. RESOLUTION ARE 55 2023 AND RESOLUTION AUTHORIZING CITY MANAGER TO EXECUTE A THIRD AMENDMENT TO THE LEASE AGREEMENT WITH NATIONWIDE CHILDREN'S HOSPITAL. THIS ONE'S A LITTLE EASIER. OSUN CHILDREN AGREED TO SWAP SPACE ON THE SECOND FLOOR OF THE CLINICAL SPACE THAT OCCURRED ABOUT AND LITERALLY SWAP SPACE IS JUST A PORTION OF IT. SO ALWAYS YOU REDUCED ITS PRESENCE THERE WHEN THEY DECIDED TO MOVE FROM A MUSCULAR, SKELETAL PRACTICE TO A MENTAL HEALTH PRACTICE AND THEY REDUCE THEY WANTED TO REDUCE THEIR SPACE BY ABOUT 1700 SQUARE FEET. CHILDREN'S WANTED TO INCREASE IN SPACE BY 1700 SQUARE FEET SO EFFECTIVELY WHAT THEY DID IS PICK UP THAT SPACE. BEN AND I DISCUSSED THE OS, YOU LEASE MODIFICATION. UH AND BEN'S OPINION WAS THAT I DIDN'T NEED TO BRING THAT BACK TO COUNCIL BECAUSE THERE WAS NO IT WAS NOTHING SIGNIFICANT FROM A FINANCIAL PERSPECTIVE HAPPENING THERE, ESPECIALLY SINCE SINCE CHILDREN'S IS GOING TO PICK UP THE SPACE. THE REASON THAT THIS NEEDS TO COME TO COUNSELORS BECAUSE OF THE SECOND ITEM THAT WE INCLUDED, WHICH IS A AN EARLY TERMINATION PROVISIONS IN THE LEASE, WHICH WE BELIEVE WILL BE BENEFICIAL NOT ONLY TO CHILDREN'S BUT ALSO TO THE CITY IN THE EVENT THAT THE CITY WOULD WOULD NEED THE SPACE. YOU KNOW, AT SOME POINT IN THE FUTURE, WHICH WAS NOT CONTEMPLATED WHEN

[01:05:05]

WE BUILT THE BUILDING, SO, UM THERE IS AN EARLY TERMINATION PROVISIONS THAT WE ADDED, WHICH IS BASICALLY A BY DOWN OF THE LEASE, WHICH IS AGREEABLE TO AND, UM. THAT IN ADDITION TO THE EXCHANGE OF ROUGHLY 1700, IT'S ACTUALLY 1739 SQUARE FEET ARE THE ONLY CHANGES TO THE LEAST.

ANY QUESTIONS ON THE RESOLUTION. MAKE A COMMENT THAT I THINK HAVING THAT EARLY TERMINATION IS A MAJOR. WHEN FOR US HAVING THAT OPTION OUT THERE, I SAID FOR QUITE SOME TIME, THE BIGGEST PART OF WHO I AM. HAVING ISSUES WITH THE LEAST WE DISCUSSED THE MOMENT AGO. I THINK THAT AS WE GROW, THAT BUILDING IS A HAS THE POTENTIAL TO BE A TREMENDOUS ASSET TO US IS THE SAME AS THE CITY AND IT MIGHT BE REALLY NICE TIME IN THE NOT TOO DISTANT FUTURE FOR US, TOO. BE ABLE TO TAKE THAT BACK, AND WE HAD NO ABILITY AT ALL TO DO THAT WITHOUT THIS AMENDMENT. SO IT'S A BIG DEAL. ALSO GIVES NATIONWIDE CHILDREN'S LITTLE FLEXIBILITY TO STRIP BOTH SIDES.

OBVIOUSLY GOOD FOR THIS CITY. I'M VERY IN FAVOR OF IT, ALL RIGHT, IN THE ADDITIONAL QUESTIONS ON THE RESERVATION, OPEN THE PUBLIC HEARING ANYONE FROM THE PUBLIC PUBLIC LIKE TO SPEAK REGARDING RESOLUTION ARE 55 JUST HAD A QUESTION. I'M SORRY. I JUST I JUST HAD REALLY THE EARLY TERMINATION PROVISIONS THAT DON'T GO BOTH PLEASE THE LEGISLATIVE REPORT LANGUAGE, DO WE? WHAT IS OUR WHAT IS THERE? WHAT HAPPENS IF WE TERMINATE EARLIER? DO WE GIVE THEM BECAUSE I SEE HERE? THAT THANKS DOESN'T GO BOTH WAYS. IT DOESN'T OPTION TO BUY OUT AND THERE WAS A LOT OF DISCUSSION BACK AND FORTH ABOUT, UH, NATIONWIDE HAVING ABILITY TO OPT OUT BY OUT EARLY.

OKAY YEAH. EARLY TERMINATION. WE GET, WE GET ADDITIONAL COMPENSATION. STAY BEHIND. BUT I THOUGHT WE HAD THESE ABILITIES TO FLY. I THOUGHT THAT WAS PART OF THE JOB THAT IT WAS GOING TO BE MATURE. I DIDN'T WRITE THIS RIGHT. MISS MISS STATED THAT IT'S NOT MUTUAL IT WELL, IT'S MUTUAL NATIONWIDE ONES THAT WE DON'T HAVE THE RIGHT TO HAVE THE RIGHT TO HAVE THE RIGHT TO KICK THEM OUT. WHILE THE LEAST WE DID WANT TO REDUCE THEIR PRESENCE OVER THERE OR GO ELSEWHERE. THEY WOULD HAVE THE ABILITY TO BUY THEIR WAY OUT BACK. EVERYTHING I SAID A FEW MINUTES AGO, I THOUGHT IT WAS GOING TO BE A MUTUAL DEAL THAT IT WAS GONNA BE RECIPROCAL TERMINATION. OKAY? NEVER MIND. ADDITIONAL QUESTIONS . NO, NO ADDITIONAL QUESTIONS. OK, I'LL GO AHEAD AND OPEN THE PUBLIC HEARING ANYWHERE PUBLIC LIKE SPEAKER HERE IN RESOLUTION, 55 HURRY. NO PUBLIC COMMENT WILL CLOSE. THE PUBLIC HEARING IS VERY EMOTIONAL RESOLUTION TO ACCEPT RESOLUTION ARTICLE 2023.

SECOND. COUNCIL MEMBER, FELLAS. YES KISS YES. COUNCIL MEMBERSHIP ? YES COUNCIL MEMBER WILL TRAVEL . YES MAYOR, SPAULDING COUNCIL MEMBER OF RISK, NO COUNCIL MEMBER DEREK YES, YES VOTES AND ONE NOTE ON THE MOTION TO ADOPT THE RESOLUTION RESOLUTION WAS ADOPTED ANYONE CARE TO MAKE A STANDING COMMITTEE REPORT? FRIENDS, MORSI AND THE UPDATE. WE TALKED ABOUT THE A. TALK ABOT THE WORK THAT MORSI HAD DONE. ON BEHALF OF THE RAIL. THE THREE C RAIL PROGRAM. APPARENTLY THAT'S BEEN MOVED ALONG. UM THE FEDERAL GOVERNMENT IS CONSIDERING THAT PROJECT. UM I THINK IT'S A THREE C PORTION. IT'LL TAKE THE THEY DIDN'T MENTION ANYTHING ABOUT THE PITTSBURGH TO DETROIT PORTION, BUT THEY ALSO TALKED ABOUT THE OTHER, UM PROGRAMS THAT THAT MORSI HAS OFFERED THIS. THE REASON RELATIVE TO THE . OH SORRY. BLANKING ON THE FIVE RAPID RAPID FIVE. THEY WENT THROUGH THEIR VALUES AND THEIR VALUES STATEMENT. UM TRYING TO THINK OF SOME OTHER TRANSPORTATION PLANS. AND THEY HIGHLIGHTED A LITTLE BIT MORE ABOUT THE, UM, ENGAGEMENT WITH LICKING COUNTY THAT THERE'S MORE CITIES AND TOWNSHIPS AND VILLAGES ARE BEING PART OF WARP. SEE EVER MORE THAN EVER BEFORE, WHICH IS THEY'RE EXCITED ABOUT AND THEN, OF COURSE, ALWAYS TALK ABOUT THE RETURN ON INVESTMENT.

[01:10:03]

HERE'S HERE'S ALL THE THINGS MORE PC DOES. FOR YEARS. ONE CITY WERE MEMBERS OF THE PUBLIC ASKED. WHY ARE WE PAYING THIS FEE TO MORPH? SEE WE CAN EXPLAIN SOME OF THE VALUES THAT WE RECEIVED IN EXCHANGE. UM WHICH I THINK JOHN. I CAN BOTH ENJOY FOUND THEM EXECUTIVE BOARD FOR EVER AND EVER. AND I'VE BEEN PRIVILEGED TO PARTICIPATE IN A LOT OF MORE EVENTS, AND THEY REALLY ARE GOOD PARTNERS, BUT I THINK YOU KNOW WE GET A LOT OF BANG FOR OUR BUCK. ANYTHING ELSE, OKAY? UM. UPDATE FROM THE JOINT PARKS. THEY HAD A MEETING YESTERDAY. JUST A COUPLE OF THINGS HERE. THEY'RE GONNA THEY'RE GONNA UPDATE THEIR WEBSITE USE BUCKEYE INNOVATIVE, SIMILAR TO WHAT WE'RE DOING WITH OURS, AND WE'RE GOOD, BRAD. THERE THEY HAVE YARD SOLUTIONS.

THEY HIRED AGAIN BACK TO TAKE CARE OF THEIR LAWNS AND LANDSCAPED THAT THEY HAVE OUT THERE AND DO TO THE REASON ASSESSMENTS THERE ARE ABLE TO ROLL BACK THERE. CORRECT BOND A LITTLE BIT SOONER THAN THEY THOUGHT. SO THAT'S KIND OF WHAT THEY'VE GOT GOING ON THERE. AND THEN WE DID A REFINANCE TO HELP OUT IS THAT THIS IS A DIFFERENT BOND. OKAY I THINK THIS IS THE NEW ONE ORIGINAL ONE. I THINK THIS MAY BE THE LAST YEAR 20 LAST YEAR OF IT, OKAY? THAT'S GOOD TO HEAR. ALL RIGHT IN THE, UH, ANY UPDATE FROM NOBODY PLAYING LOCAL SCHOOLS, NO MEETING AND THE TOWNSHIP NO. ME. ALL RIGHT. DON'T FORGET TOMORROW , THE TOWNSHIP FIRE DEPARTMENT IS GOING TO GET THEIR UPDATES THE COMMITTEE. YOU'RE GOING TO DO THIS STRATEGIC PLAN UPDATE.

THEN THEY'LL FOLLOW AT 630 WITH A NORMAL TENSION. AND THAT IS THAT THE VIRUS STATION OR PLAYERS STATION? OKAY, THANK YOU . LIBRARY HAVE AN EVENT TOMORROW AS WELL TONIGHT TONIGHT. YEAH YEAH. YOU GOTTA READ CALENDAR FOR TOMORROW. WELL. YEAH THEIR 20TH ANNIVERSARY AND IT WAS THE REALLY NICE CELEBRATION. THAT'S 150 YEARS FOR THE CENTRAL OHIO LIBRARY. 20 YEARS FOR THE NEW ALBANY LIBRARY. DID THEY GET THEIR DATES WRONG BECAUSE I HAD IT ON TOMORROW'S CALENDAR. TWO.

IT WAS ORIGINALLY THEY SENT IT OUT. TOOK HER TOMORROW AND THEN THEY SENT OUT A CORRECTION SINK WAS TODAY. LUCKILY I DON'T READ THINGS TILL IT'S LATER. ER WELL, THAT'S I DIDN'T GO TO THAT WASN'T YEAH, WELL, I HAD IT ON TOMORROW. HOPE YOU COVERED FROM, UH, HAD OURSELVES SAYING A THING OR TWO. I'M SORRY. I'M GOING TO RETURN SOMETHING THEY DIDN'T CALL ON. ALL RIGHT. WELL ALMOST DIDN'T CALL HIM MARY LIKE BODY AND SHE HAD A PROCLAMATION TO REMIND THEM GOT ABSOLUTELY ALRIGHT. WELL AGAIN. I APOLOGIZE. VERY SHORT, VERY INFORMAL. BUT VERY NICE. OKAY AND. LIKE AND I WERE THERE REPRESENTING THE CITY'S THANK YOU FOR GOING. NOTHING. WHERE'D YOU SAY? IT WAS LAST YEAR. ABSOLUTELY NOT GREAT PARTNERS AT THE COLUMBUS LIBRARY, YOU KNOW, HAVING PAT LIVE IN THE COMMUNITIES HELPFUL AS WELL. BUT SORRY, MR I'M GLAD THAT CAME UP BECAUSE I WOULD HAVE SHOWED UP TOMORROW TOWNSHIP AND I WOULD HAVE BEEN, WE WOULD HAVE BEEN TOGETHER. MAN MADE DINNER TOO MUCH STARTED A BOOK CLUB, CLAUDIA. ALRIGHT SO, UH, THE

[14. REPORTS OF CITY OFFICIALS]

REPORTS THE CITY OFFICIALS. UM I DON'T THINK I HAVE MUCH OF AN UPDATE. I KNOW THAT, LIKE ALTMAN IS HAVING A HANUKKAH WEEK OF HANUKKAH FESTIVALS ARE FESTIVITIES. EXCUSE ME ON THURSDAY NIGHT AT FOUR O'CLOCK, 430 OR 30. OKAY I THINK I'D PROBABLY PUT A FORCE ON THAT LATE, BUT FOR 30 BELL BEHIND THE PARK WILL BE HAVING A COMMUNITY CELEBRATION. UH, I LOVE YOU ARE WELCOME TO ATTEND IT, BLAKE. I THINK THAT'S ALL THE UPDATE. I HAVE TURNED OVER THE CLERK AND THE UPDATE JUST A REMINDER FROM SENIOR CONNECTIONS. THANK YOU. I'M GONNA CHECK HER. NO OKAY, LET ME KNOW JUST AS SHE KNOWS NOT TO LOOK LIKE A REALLY NICE EVENT. YES. AND THAT'S IT FROM THE CLERK AND THE UPDATE FROM THE FINANCE DIRECTOR. YES FIRST. I WANT TO APOLOGIZE FOR THE JP DE COMMENT THIS YEAR. WE DID RECEIVE PAYMENT JUST RECENTLY FOR THAT BOND ISSUE, AND THEN WE HAVE ONE MORE YEAR LEFT ON IT. GUARD FOR A SECOND.

[01:15:07]

UM, BUT I DID PROVIDE THE OCTOBER REPORT. IT'S A LITTLE BIT OLD NEWS BUT GIVES YOU A SUMMARY FIRST PAGE, AS ALWAYS, IS THE GENERAL FUND. UM REVENUES ARE UP EXPENSIVE. THEY'RE UP THE PRIMARY EXPENSE. THAT'S UP AS PERSONNEL AS WE EXPECTED WITH OPERATIONS, UM WITHHOLDING IS STANDING STEADY THE NET PROFITS AND INDIVIDUALS, UM, INCOME TAX IS MORE VOLATILE, BUT IT TENDS TO BE POSITIVE AND LATELY SO WE'RE STILL APPREHENSIVE ABOUT THOSE PARTICULAR REVENUES. THE SECOND PAGE IS YOUR FUNDING SUMMARY AND SO HISTORY OF THE FUND BALANCES FOR THIS YEAR. AND THEN THERE'S THE INVESTMENT INFORMATION THAT'S INCLUDED ON THE LAST TWO PAGES. UM I WAS LIKE TO INCLUDE THE STAR OHIO RATE IS UPWARDS OF. I THINK IT WAS 5.72% AS OF TODAY AND TO YOUR TREASURY IS 4.92% AND WE'VE BEEN ABLE TO TAKE ADVANTAGE OF THOSE PARTICULAR RATES AS WELL.

SO. THAT'S WHAT I HAVE ANY QUESTIONS ALRIGHT, THAT TAKES US TO THE CITY MANAGEMENT. CONSIDER MENTAL UPDATE CITY TURNING ANY UPDATE, UPDATE. FOURTH YEAR SCINTILLATING PRESENTATION NEXT WEEK AT THE PROSECUTORS ASSOCIATION. IT WILL BE WILD. WHAT'S THE TITLE OF IT AGAIN DO THE SIGNS AND POLITICAL ACTIVITY . WE HAVE SOME NICE TRANSITIONS IN THE POWER POINT SOME NICE VIDEOS TO KILL SOME TIME. ALRIGHT, LOOKING FORWARD TO IT. ALRIGHT PAUL FOR PUBLIC COMMENT AND ADDITIONAL PUBLIC COMMENT. MHM. ALRIGHT CALL FOR COUNCIL COMMENTS AND THE ADDITIONAL

[16. POLL FOR COUNCIL COMMENT]

COUNSEL COMMENT. I HAVE A COMMENT THAT I'D LIKE TO INDULGE JUST COUNCIL FOR JUST A SECOND.

I DID WANT TO JUST BRIEFLY REVIEW THE PROPOSED THRIVE COMMUNITIES THAT HAVE PASSED THE . PASSED THROUGH THE WALKING FOR BLACK LIQUOR ACCORD AND JUST WANTED TO KIND OF TALK AND PROVIDE MY THOUGHTS ON THE COMMUNITY AND FIRST TAKE A LOOK AT JENNIFER, IF YOU COULD ADVANCE THE SIDE. YOU GOT IT. YOU HAVE THE POWER THE POWER SO THAT THE PROPOSAL THAT PASS ROCKY FORK BLACK LOOK RECORD. UH IS THAT 7745 WALTON PARKWAY? WHICH IS JUST TO THE WEST OF, UH OF THE WATER, WATER'S EDGE BUILDING AND TO THE TO THE EAST. UH WHAT WAS THE STATE FARM BUILDING? THAT IS A 10 ACRE SITE AND ON THAT 10 ACRE SITE, IT'S BEEN PROPOSED THROUGH THE THRIVING COMMUNITIES THAT THEY WILL BUILD 408 APARTMENT UNITS AND JUST FOR CLARIFICATION.

THAT'S JUST OUTSIDE OF CORPORATE STANDARDS. THAT IS JUST OUTSIDE OUR CORPORATE BOUNDARIES, BOUNDARIES. SO THE WATER'S EDGE OF WATER'S EDGE DEVELOPMENT IS A NEW ALBANY. UH SITE THAT 7745 IS IN THE CITY OF COLUMBUS. YOU ALSO PLEASE CLARIFY WHAT SCHOOL DISTRICT THAT IS, UH, WILL BE THE CITY OF COLUMBUS AND NOT NEW ALBANY SCHOOLS. SO THE PROPOSAL AS IT IS, IT DOESN'T MEAN THAT IT'S GOING TO HAPPEN. BUT THIS IS AS IT IS PROPOSED. THERE'S 408 UNITS ON 10 ACRES. THAT'S A 42 1 RATIO PER ACRE. NOW YOU MAY RECALL WHEN WE WERE DISCUSSING THE HANDLE IT WHEN THEY ORIGINAL PROPOSAL FOR THE HANDLE IT THAT WAS 12 UNITS PER ACRE. AND THEN, UH, WORKING WITH COUNCIL AND THE DEVELOPER WERE ABLE TO REDUCE THAT TO LESS THAN SIX UNITS PER ACRE. THIS PROPOSAL AGAINST 40 UNITS PER ACRE AND SINCE I CAN ADVANCE THE SIDES, THIS IS AN OVERVIEW OF THE PROPOSAL. IT HAS , UH YOU CAN SAY 1234567. BUILDINGS THAT ARE ON THAT SITE AND 10 ACRES. THERE IS NO PARKING GARAGE THAT'S CURRENTLY PART OF THE PROPOSAL. SO IT'S ALL OPEN AIR PARKING, WHICH WILL INCLUDE AT LEAST 400, PLUS PARKING SPOTS THAT WILL SURROUND THAT DEVELOPMENT THE NORTH. PART OF THAT SLIDE IS WALTON PARKWAY AND ON THE SOUTH OF THAT WOULD BE 161. YOU CAN ALSO SEE THAT THERE ARE NO EDGE LINES OR TRANSITIONS TO THE BUDDING PROPERTIES. ALSO AS PART OF THIS , THERE IS NO GREEN SPACE OR PARKLAND THAT IS ASSOCIATED WITH THIS PROPOSED DEVELOPMENT. UM.

SO THE BUILDINGS OF FOUR STORY WALK UP WITHOUT ASSESS ABILITY TO THE UPPER FLOORS WITH THEIR

[01:20:09]

WOULD BE NO ELEVATORS. SO THERE'S SOME QUESTIONS AROUND ACCESSIBILITY TO THESE BUILDINGS . THE PROPOSAL DEVIATED FROM THE ORIGINAL ARE FDA OR ROCKY CORP NOT LOOK. ACCORD DENSITY STANDARDS BY GOING TO 40 UNITS PER ACRE. THAT DOES NOT RE MEET THE ORIGINAL TOWN FORM OF DEVELOPMENT DEVELOPMENT AS PART OF THE ORIGINAL ROCKY FORK, BLACK LIQUOR ACCORD DOCUMENTS AND WHAT THAT MEANS IS THERE'S NO MIXED USE RETAIL COMMERCIAL NO STREET NETWORK. IT'S JUST THE DEVELOPMENT HAS PROPOSED IS JUST A MASSIVE PARKING LOT, UM WITH LARGE SCALE HIGH DENSITY APARTMENT BUILDINGS. AND ALSO, IT DOES NOT AS PROPOSED IS NOT ADEQUATELY ADDRESS TRAFFIC CONGESTION, MANAGEMENT, TRAFFIC CONGESTION AND MANAGEMENT AND INFRASTRUCTURE NEEDS IN THE AREA . AS I UNDERSTAND IT ALSO, CHIP ISN'T IT 400 PARKING SPACES FOR 400 UNITS? THAT'S RIGHT, HUNDREDS OUT, SO YOU'VE GOT ONE. SPACE PER UNIT. REGARDLESS OF HOW MANY BEDROOMS, GUEST PARKING. DO WE KNOW WHAT THE BEDROOMS ARE PRETTY? WE KNOW HOW MANY BEDROOMS THEY'RE NOT ALL SIMILAR. THERE ARE 408 UNITS. 80% OF THE UNITS WILL BE ONE BEDROOM APARTMENTS. OKAY OKAY, SO PROBABLY NOT A LOT OF FAMILIES MOVING THERE IS I FORGET THE TOTAL NUMBER OF BEDROOMS. BUT I DO HAVE THAT I CAN GET IS 1% OF THOSE UNITS WILL BE ONE BEDROOM. SO THE QUESTIONS THAT I HAVE IS, DOES THE MASTER AND I'M GONNA WRITTEN THIS DOWN, SO I WANT TO BE CLEAR. DOES THE MASTER PLANNED COMMUNITY THAT WE WHEN I SAY WE I MEAN THE CITY TOWNSHIPS, THE SCHOOL'S NEKO OTHER IMPORTANCE STAKEHOLDERS DEVELOPERS ALONG WITH OUR RESIDENTS AND LOCAL BUSINESSES, DOES THE MASTER PLAN COMMITTEE THAT WE WORKED SO HARD TO DEVELOP? STOPPED AT NEW ALBANY BORDER OR SHOULD IT STOP THAT NEW ORLEANS BORDER? IT'S MY OPINION. IT'S VITAL THAT WE WORK TOWARDS PURPOSEFUL AND NEAR SEAMLESS TRANSITIONS AT OUR BORDERS. THAT'S WEST EAST, NORTH AND SOUTH. THAT CLOSELY ALIGNED TO OUR STRATEGIC PLAN AND WELL ESTABLISHED NEW ALBANY DEVELOPMENT STANDARDS SUCH AS DENSITY. ACCESSIBILITY GREEN SPACE PARKLAND, CONNECTIVE, ITTY AESTHETICS, CHARACTER, ARCHITECTURE AND INFRASTRUCTURE. MAINTAINING THESE STANDARDS.

IMPACT AND IMPROVE THE OVERALL QUALITY OF LIFE FOR RESIDENTS ARE WORKERS, BUSINESSES AND VISITORS AND VISITORS AND NEW ALBANY AND OUR NEIGHBORING COMMUNITIES. WE CAN GO BACK JUST OVER A YEAR OR TWO AGO AND RECALLED THE DISCUSSION AND IMPORTANCE OF THESE STANDARDS CONSIDERING THE HAMLET DEVELOPMENT. AT THAT TIME, THERE WAS NO DOUBT WHERE RESIDENTS STOOD. THEY PASSIONATELY DEMANDED THE CITY ADHERE TO THE STANDARDS BUILT INTO OUR STRATEGIC PLAN, AND AS A COUNCIL WE AGREE WITH THEM AND WORK DILIGENTLY DILIGENTLY AND WITH INTENT. TO MAKE IMPROVEMENTS TO THE HAMLET THAT CLOSELY ADHERED TO THE STATE PRESTIGIOUS PLAN TO ENHANCE THE QUALITY OF LIFE IN OUR COMMUNITY, ALTHOUGH THE PROS THE PROPOSED RIGHT COMMUNITY IS NOT A NEW ALBANY BUT JUST ON OUR WESTERN BORDER IN THE CITY OF COLUMBUS, WE NEED TO FIND WAYS TO PARTNER WITH THE LANDOWNER TO INCORPORATE NEW ALL NEED DEVELOPMENT STANDARDS. FOR A PLAN AND SEAMLESS TRANSITION FROM NEW ALBANY TO OUR NEIGHBORING COMMUNITIES. WHAT IS CURRENTLY PLANNED FOR THE THREAT COMMUNITY DOES NOT ALIGN. WITH OUR DEVELOPMENT STANDARDS OR THEIR ORIGINAL INTENT OF THE ROCKY COURT. BLACK NICK ACCORD AS NEW ALBANY GROWS RAPIDLY TRANSFORMS INTO THE SILICON SILICON HEART MAN IT'S EXTREMELY IMPORTANT NOW, MORE THAN EVER THAT WE HAVE STRONG PARTNERSHIPS WITH LANDOWNERS AND DEVELOPERS. TO MAINTAIN THE WORLD CLASS COMMUNITY THAT WE ALL WORKED SO HARD TO CREATE. THESE STRONG PARTNERSHIPS MUST BE BUILT AND MAINTAINED THROUGH TRUST WITH THE AGREEMENT THAT WOULD HAPPENS ON BOTH SIDES OF OUR BORDER MATTERS TO THE OVER ALL QUALITY OF LIFE AND SUCCESS OF OUR CITY AND LOCAL AREA. WITH THAT IN MIND, I ENCOURAGE NEKO AND ANY OTHER LAND ORDER AND DEVELOPMENT. DEVELOPERS TO PARTNER WITH THE CITY TO CREATE A DEVELOPMENT TO CREATE A DEVELOPMENT AT 7745 WATT PARKWAY THAT MORE CLOSELY ALLIANCE WITH NEW ARMY AS WELL AS THE ABLEST STANDARDS, WHICH HAS MADE US NEW ALBANY ONE OF THE BEST CITIES TO LIVE, RAISE A FAMILY WORK AND DO BUSINESS, THE UNITED STATES.

THAT'S RIGHT COMMENTS. THANK YOU. I COULDN'T ECHO MORE WHAT YOU SAID. IN TERMS OF WHAT WE'RE FACING AND WHAT WE SHOULD HAVE SOME INPUT AND INVOLVEMENT IN. THIS IS THE FIRST TIME I'VE SEEN

[01:25:03]

THIS DRAWING. UM YES, 400 UNITS WITH ONE ENTRANCE AND ONE ENTRANCE OUT. ONTO A TWO LANE ROAD. SO WHATEVER PLANNING, FORESIGHT, WHATEVER. I DON'T KNOW. UM I ALSO WORRY 2 DEGREES ABOUT THE LAND. THAT'S NORTH OF THAT. THE LARGE LOT WORTH OF THAT AND THE EMPTY PROPERTY LEFT OF IT. YEAH I DON'T KNOW WHO OWNS THOSE PROPERTIES. HIGHER HEALTH PHONES THAT YEAH, I'M NOT SURE WHO OWNS THE STATE FARM, THE OLD STATE FROM VOTING AT THIS POINT IN TIME. AND THE PROPOSED HANDLE IT IS JUST WE'RE HERE TO THE NORTH SIOUX EAST. CLEARLY WE'RE LOOKING AT TWO LARGE PART PROPERTIES. IN ADDITION TO THIS COULD POTENTIALLY BE AS DENSE OR DENSER THAN WHAT WE'RE LOOKING AT YAHOO AND WHAT IMPACT THAT WILL HAVE ON ROADS AND INFRASTRUCTURE. ENTRANCE RAMPS ONTO, UM, YOU KNOW, 161 TRYING TO GET ON THERE. BUY NEW ALBANY ROAD OR EVEN AS IT TRIES TO SPREAD ITSELF TO THE EAST TO GET OVER TO 65 OR WHATEVER IT'S GOING TO DO. IS GOING TO BE INCREDIBLY DIFFICULT AND BEING KIND. IT'S GOING TO BE A MESS.

AND, UM. YEAH, THIS QUICK, CLEARLY WHOEVER SOLD THE LAND OR THEY'RE GOING TO DO WITH IT. IT DIDN'T MUCH MATTER AND I'VE NEVER SEEN SUCH A DENSE PROJECT IS THAT SO I DON'T KNOW WHAT OUR OPTIONS ARE. I DON'T KNOW WHAT ARE TURNING GIVES OUR LANDING AT CITY COLUMBUS. I GET THAT. BUT AGAIN, WE'RE LIVING ON THE BORDER OF ALL THIS. WE KNOW WHERE IT'S AT IN THE OBVIOUSLY MADE IT OUT OF ROCKY PORK. DOES IT GO TO CITY OF COLUMBUS? PLANNING COMMISSION NEXT DO WE KNOW WHEN THOSE MEETINGS ARE POSSIBLY GET. I MEAN, IT'S THE SAME PROCESS THAT WE'VE RIGHT.

YEAH WE DEALT WITH AND IF WE WANT TO IMPACT THAT WE CAN SHOW UP PROCESS IS A LITTLE DIFFERENT . BUT YEAH, THERE ARE STILL SOME PUBLIC HEARINGS. YEAH I'VE TALKED WITH THE MEMBER OF THE TOWNSHIP AND TRUSTEES AND. THEY HAVE VERY SIMILAR, VERY CONCERNED. YEAH RECOMMENDED THAT PERHAPS CITY COUNCIL MEMBERS. TOWNSHIP TRUSTEES TRY TO WORK WITH AND MEET WITH REPRESENTATIVES OF THE CITY OF COLUMBUS. SOMETHING THAT WE HAVEN'T REALLY LOOKED TO DO IN THE PAST, BUT WE SHOULD PROBABLY START DOING MORE OF THAT MODELING WITH CITY COLUMBUS, BUT WITH ALL OUR OTHER NEIGHBORING COMMUNITIES AS NO, OUR GROWTH IS GOING TO BE TURBOCHARGED, BUT AS A RESULT OF EVERYTHING THAT'S HAPPENING HERE, AND WE NEED TO MAKE SURE THAT TO THE EXTENT WE CAN THAT WE'RE IN ALIGNMENT. AND THAT STANDARDS ARE WITHHELD IN TERMS OF THIS RAPID DEVELOPMENT THAT'S COMING ON. JUST JUST A QUICK QUESTION. CHIP. YOU MENTIONED THAT THE THIS IS DIFFERENT THAN THE MASTER PLAN THAT BLACK LIQUOR ACCORD APPROVED. DID YOU SAY THAT OR DID I EVER HEAR THAT WRONG? WE SAID THAT SO IF YOU LOOK BACK AT THE ORIGINAL DOCUMENTS OF THE ROCKY COURT BLACK RECORD AND THIS KIND OF KIND OF WAVERED OR HASN'T BEEN MANY AMENDMENTS TO THOSE THAT THESE ARE NOT IN SUPPORT OF THOSE THOSE ORIGINAL DOCUMENTS AROUND DENSITY AND WHAT TYPE OF DEVELOPMENTS SUGAR KIRK BUT THEY APPROVED IT ANYWAY . YOU CAN SEE I HAVE THE REPORT FROM THE ROCKY HOOK. THE SCORING REPORT FROM THE ART BE A COURT TO GET COPIES OF THAT. AND THERE ARE MANY THINGS ON HERE THAT THEY'VE CHECKED OFF THAT COULD BE DISPUTED WHETHER THIS DEVELOPMENTS ACTUALLY MEETING WHAT THEY CURRENT SCORECARD. SO YOU HAVE TO READ THROUGH IT.

LOOK AT IT AND SAY THAT I DON'T KNOW THAT THAT'S YOU KNOW, PARK SPACE? NO, THERE'S NOT PARK SPACE. THERE'S A SWIMMING POOL AND YOU KNOW SOME OTHER AMENITIES. DON'T THINK THERE ARE ANY AMENITIES. THERE'S NOT. I DON'T SEE. I DON'T KNOW WHAT POOL SO I MEAN, YOU CAN SEE THERE'S CHECKLISTS AND ALSO LIKE QUESTION MANY OF THESE THINGS ON HERE HOW DID IT EVEN GET APPROVED? WHICH ALSO SPEAKS TO THE FACT THAT WE NEED TO BE MORE YOU KNOW, SPEAK WITH OUR REPRESENTATIVES OF THE ROCKET LOOKED LIKE THE ACCORD ABOUT THESE THINGS ARE COMING UP. WAS IT A UNANIMOUS VOTE? I THINK IT WAS 3 TO 1. OR WHATEVER. THERE WAS 11 AGAINST 31. I BELIEVE WRITING FOR SURE. NINE I THOUGHT THERE WAS A LOT MORE SOMETHING THAT MAY NOT BE THINKING. I'M THINKING SOMETHING ELSE, BUT THERE WAS ONE. I THINK I'M THINKING OF THE PLAIN TOWNSHIP.

OR PLANNING COMMISSION MEETING LAST NIGHT AND AGAIN, THERE WAS ONE OBJECTION TO THIS. I BELIEVE. EVEN GOING TO WORK. YOU CAN LOOK AT THE WEBSITE. YEAH MINUTE MEETINGS, PRESENTATIONS TO THE COMMITT THERE'S SEVERAL RENDERINGS OF THIS. DEVELOPMENT PROPOSED DEVELOPMENT PROJECT.

[01:30:02]

AGAIN. IT'S A IT'S A PROPOSED DEVELOPMENT PROJECT IS NOT A FINAL DEVELOPMENT PLAN. UM YOU KNOW, WE'VE OFTEN SEEN PLANS THAT GET CHANGED, SOMETIMES DRAMATICALLY FROM THEIR FIRST PRESENTATION TO SOMETHING MORE ACCEPTABLE TO THE COMMUNITY. UM SO YOU KNOW, THIS JUST MAY JUST BE THE FIRST SUBMISSION AND IT'S GONNA CHANGE. I DON'T KNOW. I HAVEN'T TALKED TO ANYONE THRIVE OR CITY COLUMBUS TO SEE WHAT THE INTENTIONS ARE. DOWN. AND STOP THE FINANCE THIS THING TOO, SO, YEAH, MARKETS HAVE ALL TOUGH RIGHT NOW. INTEREST RATES ARE HIGH IN BANK START LOANING MONEY, SO WE SHOULD I THINK CHIPS, RIGHT? I THINK WE'RE I THINK WE NEED TO FIND OUR AVENUES TO VOICE BECAUSE I WAS DISGUSTED BY THIS. THEY WANT TO FIRST SAW THIS. I THINK THIS IS A TERRIBLE THING FOR US TO HAVE RIGHT BESIDE IT. WE'VE WORKED SO HARD AS A COMMUNITY TO BECOME WHAT WE ARE AND WHAT WE ARE BECOMING BASED ON THE STANDARDS THAT WE HAVE CREATED HERE. AND THE DEVELOPERS HAVE BEEN PARTNERS WITH US ALL ALONG THE WAY AND CREATING THE STANDARDS INSIDE OUR BORDERS. NOW THOSE SAME DEVELOPERS, I BELIEVE SHOULD BE MAINTAINED THAT, UH, SAME UNIQUE PARTNERSHIP THAT WE HAVE FOR THE DEVELOPMENTS THAT ARE JUST ON THE OTHER SIDE OF OUR BORDERS TO MAINTAIN OVERALL QUALITY OF LIFE. THAT WE ALL ENJOY AROUND CONGESTION, TRAFFIC DENSITY, ACCESSIBILITY CONNECTIVITY, ALL THOSE THINGS THAT I'VE LISTED THAT WE SHOULD ENCOURAGE. OR PARTNERS. TO WORK WITH US TO RESPECT EVERYTHING THAT WE'VE CREATED HERE IN NEW ALBANY AS AS THIS GROWTH CONTINUES. AND I WOULD SAY IN GENERAL, THERE HAS BEEN THAT WORKING RELATIONSHIP. THIS HERE JUST FLIES AGAINST EVERYTHING THAT WE'VE I BELIEVE THAT WE'VE DONE SO I'M AMAZED THAT THIS WAS EVEN PROPOSED AND THE LAND WAS SOLD WITH THIS POTENTIAL IN USE IN THE FIRST PLACE, BUT THAT'S NOT FOR OUR DECISION TO MAKE. I'M JUST WOULD ASSUME THAT WE WOULD CONTINUE ON THAT WORKING RELATIONSHIP. IT SEEMS THAT MAYBE THAT DIDN'T HAPPEN HERE.

HOPE IN THE FUTURE THAT DEVELOPERS AND SO MORE LAYING FOR THE SAME PURPOSE. MHM. WELL IT SEEMS THAT WOULD BE A GOOD COMMERCIAL USE, HENCE ALL THE BUILDINGS AROUND ALL THREE OF THOSE PIECES, AND THAT IS PROBABLY IF NOT THE WORST. IT IS IN THE TOP TWO OR THREE TRAFFIC ISSUES IN AND AROUND OUR CITY BORDERS IS THAT LITTLE WISHBONE RIGHT THERE, AND YOU PUT THAT IN THAT SPOT. WE'RE GOING TO BE HEARING IT ALL THE TIME, AND IT'S NOT EVEN OUR ISSUE, BUT WE'RE GOING TO BE HEARING ABOUT HIS OUR ISSUE. IT'S OUR ISSUE BECAUSE BACK RIGHT UP INTO ALL OF OUR ROOMS BECAUSE CHIEFS GOING TO GET EVEN MORE PHONE CALLS THAT ARE OUT OF HIS JURISDICTION, AND IT'S JUST CITY SERVICES FROM COLUMBUS HOPING WOULD BE GOOD, BUT WHO KNOWS WHAT THOSE ARE GOING TO LOOK? I MEAN, IT'S JUST SO MANY ISSUES THAT ALRIGHT PLAY THAT ARE AT PLAY INTO MIKE'S POINT. THE LAND RIGHT NEXT DOOR ACROSS THE STREET. WHO'S TO SAY THAT CAN'T BE WE GO FROM 400 TO 800. HMM. ALL INTO THE SAME FROM HERE, DO WE? THERE IS A WAY FOR US TO FIND OUT HOW TO GET OUR CONCERNS VOICED IN THIS PROCESS. WE ENCOURAGE OUR RESIDENTS ALL THE TIME TO COME AND YOU KNOW MAYBE WE NEED TO FIND A WAY TO MAKE SURE OUR VOICES HEARD ON THIS BEFORE IT GETS FURTHER DEMOCRATIC. YEAH I MEAN, THIS PLAN. LOOKS LIKE I'M GONNA STICK AS MUCH ON THIS PIECE OF PROPERTIES I CAN AND THEN IT'S GOING TO GET SOMETHING GOING TO GET CALLED BACK. AND I MEAN, IT'S JUST LIKE THERE'S GONNA BE TRAFFIC STUDIES. THEY'RE GETTING I MEAN, IF THERE'S REALLY ONLY 400 SPOTS FOR 400 UNITS AND SOMEWHERE TO BETTER IT'S UNDER PARKED, SO THERE'S I MEAN, THE TYPICAL ONE UNIT IS NOT ONE PERSON TO CHANGE. THIS HAS TO GET BETTER. IT'S ALMOST HAPPENING. CAN'T GET ENGINEER BUT I WANT TO SEE HIM PULL A FIRE TRUCK IN THERE. WOULD IT BE POSSIBLE FOR, UM, THE CITY TO HELP US FIND LIKE A SCHEDULE FOR WHEN THIS IS GOING TO GET PRESENTED AS YOU KNOW, I WILL OBVIOUSLY REACHED OUT TO ANYBODY THAT I KNOW THAT COULD HELP. YOU KNOW, IN ADDRESSING CONCERNS ON THIS PROJECT THAT CONVERSE GOVERNMENT AND THE PROPERTY OWNERS AND DEVELOPERS AND, YOU KNOW, I THINK THAT'S THE BEST THING FOR US ALL TO DO TO KIND OF TAKE THIS PROJECT TO MAKE IT BETTER. I MEAN, OBVIOUSLY THERE'S A NEED FOR HOUSING AND THE AREA OBVIOUSLY. THERE ARE WAYS TO MAKE, UM THESE RESIDENTIAL PROJECTS, YOU KNOW A GOOD ASSET FOR THE COMMUNITY. THIS IS NOT IT. THIS IS NOT WHAT

[01:35:04]

WE WOULD DO HERE AND IN MY OPINION, BUT I THINK YOU KNOW IF WE WORK TOGETHER AND THE ART OF THE POSSIBLE YOU KNOW, THERE, WE MIGHT BE ABLE TO MAKE OUR VOICES AT LEAST MAKE OUR VOICES HARD AND THEN YOU MAKE IT BETTER. GREAT. THAT'S ALL I HAVE, JOE. MAYBE. PERHAPS IS THERE ANY WAY THAT THE CITY CAN HELP US ORCHESTRATE A MEETING FOR DISCUSSION PURPOSES WITH OUR CITY FOR THE CITY OF COLUMBUS STATE? UH REPRESENTATIVES THAT MANAGE COUNCIL, THE COUNCIL? YES, WE CAN REACH OUT. I KNOW THE TOWNSHIP. CHRISTIE WOULD LIKE TO ALSO BE INVOLVED IN THAT TYPE OF DISCUSSION AS WELL. AND I THINK THERE ARE ALSO PURSUING IT FROM THEIR SIDE.

ALL RIGHT, DANNY PERSONAL COMMENTS UNDER COUNCIL COMMENT CASEY, DID YOU WANT TO SAY ANYTHING ABOUT YOUR EVENT? YES IT WAS FOR MULTIPLE REASONS. IT WAS A GREAT THANKSGIVING, BUT WE STARTED OFF AND I SAW A LOT OF YOUR FACES OUT THERE AND THANKSGIVING MORNING. UH, THE WEATHER WORKED OUT. IT WAS DRY, LITTLE CHILLY TO START AND THEN THE SUN CAME OUT ONCE THE EVENT GOT GOING, UM WE HAD A FANTASTIC DAY. RECORD NUMBERS WERE 3200 FOLKS THIS YEAR, SO WE'RE TO WRITE CHECKS FOR THE BIGGEST CHECK WE'VE EVER WRITTEN FOR OUR CHARITIES. SO THAT WANTED SPECIFIC THING. REALLY BIG CHATS. BUT WHAT WERE THE DOLLAR AMOUNTS LIKE $20 ON THE FIRST ONE? THAT'S REAL FUNNY. STARTED THE AMOUNT. THEY'RE YOUNG MAN. UM BUT NO, IT WAS ACTUALLY 100,000 AND I THINK 11,000 AND THAT'S ACTUALLY GOING TO BE ON THE LIGHT. AND WE WANT TO BE SAFE UNTIL WE GOT ALL DIFFERENT DONATIONS. AWESOME. RECORD YEAR AND IT WAS WE CAN'T DO IT WITHOUT THE SUPPORT OF THE CITY, NOT JUST THE GRANT, WHICH WE'RE EXTREMELY GRATEFUL FOR, FOR THE IN KIND, BUT MIKE STAFF SERVICES BECAUSE I DON'T KNOW IF YOU SEE WE HAVE HARD CLOSURES WE'VE GOT YOU KNOW THE SIGNS OUT BEFORE THE EVENT. THEY'RE OUT THERE. THEY'RE OUT THERE ON THANKSGIVING MORNING, SO THEY'RE SPENDING TIME AWAY FROM THEIR FAMILIES AND THEN CHIEF ALL HIS STAFF, AND I DON'T KNOW IF EVERYONE COUNCILS WERE BUT AFTER AN INCIDENT WITH ANOTHER EVENT WHERE SOME CONTRACTING POLICE DIDN'T SHOW UP. THE EVENT ALMOST HAD CANCELED. SO THESE ARE ALL NEW ALBANY POLICE OFFICERS OUT THERE THAT MORNING. I THINK WE'RE UP TO NINE. NOW UH, ON THE EVENT CHIEFS OUT THERE EVERY EVERY THANKSGIVING AND GIVE HIM A HIGH FIVE. WE COULD GO BY. UM BUT IT IT'S GREAT BECAUSE HAVING OUR STAFF OUT THERE BETWEEN SERVICE AND POLICE, YOU FEEL LIKE IT'S GOING TO BE TOP NOTCH FIRST CLASS DON'T HAVE ANY ISSUES, AND EVERY YEAR IT GOES OFF WITH THAT HITCH, SO I COULDN'T DO WITHOUT THE CITY'S SUPPORT ON THAT. IT WAS IT WAS A GREAT MORNING. GREAT ABOUT. OKAY. THANK YOU. AND SPEAKING OF THE CHIEF SO WHERE'D IT GO? THERE IT IS. YOU ALSO HAD AN EVENT. TORTURE. YEAH, IT WAS ANOTHER FAMILY THAT ACTUALLY GOT THIS STARTED MOVED OUT OF THE COMMUNITY. SO WE WERE A LITTLE WE WERE WONDERING HOW IT WAS GONNA GO STOLE OVER OUR FIRST YEAR, FIRST SOLO YEAR. UM BUT THERE WAS A GREAT TURNOUT. IT WAS OVER. I CAN'T REMEMBER THE EXACT NUMBER BUT WELL OVER 700. YES, WERE COLLECTED AND THEY WERE DELIVERED YESTERDAY MORNING TO THE WAREHOUSE. SO APPRECIATE EVERYBODY'S SUPPORT. AND UM, IT WAS. IT WAS JUST FUN DAY AND IT WAS GOOD TO GET BACK TOGETHER. IT'S ALL THIS STUFF, GREAT LOOKING ELVES AND WHO'S WHO'S THE WHO'S THE WHO'S THE JOLLY OLD ELF? THERE YOU'LL RECOGNIZE THAT STICK. FISHER. YEAH YEAH, THAT'S UH, AND THE ELVES ARE NETO, ONE OF OUR DISPATCHERS AND HER DAUGHTER. SO NICE, CUTE. SO MR FISHER IS NOT AN AUXILIARY OFFICER. STILL AS ANYWHERE DO WE STILL HAVE THAT? AH HE KIND OF IS JUST THERE, SO NO, HE'S NOT AN AUXILIARY OFFICER. BUT I'LL TELL YOU WHAT HE SHOWS UP AT FROM C P A AND EVENTS LIKE THIS. IT'S LIKE SAM AROUND. SO BIG SUPPORTER. YEAH. ALRIGHT ANY OTHER COMMENTS BEFORE WE ADJOURN TO EXECUTIVE SESSION? THE LAST THING I GIVE A SHOUT OUT TO MIKE , BUT I'D LIKE TO DO IT HERE TONIGHT THERE WAS A TRAIL THAT

[01:40:01]

GOT LOST KIND OF BY ROSE RUN KIND OF WHEN WE DID THE CLEANING THE UNDERBRUSH. IT WAS THE ONE PASSED THE BRIDGE FURTHER WEST OF THE BRIDGE. IT WAS LIKE A KIND OF AN OFF ROAD TRAIL THAT WENT DOWN BY ROSE, RUN AND KIND OF GOT LOST. SO, UH, MIKE AND HIS TEAM GOING THERE AND REDEFINED IT. SO UM, IT'S KIND OF COOL BECAUSE IT'S IT COMES OUT ON THE BACKSIDE OF RUSH PARK DOWNWARD. THE ROCKS ARE OKAY. IS IT A NATURALIZED PART? YES IT'S NOT IMPROVED. SO THAT GOT REESTABLISHED. AND THEN I WAS HAPPENING ABOUT TODAY IN THE BRIDGES ON BOTH SIDES OF HARLEM ARE GOING IN TO CONNECT. I DIDN'T THINK WAS GONNA HAPPEN THIS YEAR. I HAD I WAS LOSING FAITH ME TO EQUIPMENT. ALL OF SUDDEN. IT WAS LIKE, AND THEY ARE FLYING, UM IN THE 37 DEGREES AND RAIN AND THEY'RE OUT THERE ROLLING. SO I'VE GOT HIGH HOPES NOW THAT THOSE ARE GOING TO BE COMPLETED, AND I MEAN IT. IT MAY BE REALLY UNCOMFORTABLE GOING OVER THERE AND DUMPING PEOPLE OUT RIGHT ON, YOU KNOW, HARLEM ROAD THAT ARE COMING OUT OF THE PARK. UM YOU MET THE TRAIL THE TRAIL PEOPLE NATURALLY. OKAY STOP DOING THAT. YES SO, UM, SO THAT MAKES ME FEEL A LOT BETTER THAN THOSE ARE UNDERWAY AND TAKEN CARE OF. MY ONLY OTHER QUESTION THEY HAD NOW THE THOUGH MID BLOCK CROSSING THAT WE HAVE ACROSS DUBLIN, GRANVILLE THAT YOU KNOW WHERE THE LEISURE PATH TURNS YOU OUT WHEN YOU COME OUT OF GREENS WARD AND IT TIES INTO ACROSS ARE WE GONNA SIGNALIZED THAT? YES WE HAVE A CONTRACT WITH THINK IT'S PAUL PETERSON GOING TO BE INSTALLING THAT BASICALLY, THEY JUST FINISHED THE RECEIVING SIDE OF THAT PROGRAM IS DONE. EVERYTHING'S BEEN PURCHASED JUST REALLY NEED SCHEDULED WITH PAUL PETERSON TO GET THAT INSTALLED SO THAT WILL BE FORTHCOMING. I CAN GET A SCHEDULE UPDATE FOR YOU ABSOLUTELY SIGNALIZED CROSSINGS LIKE A SIMILAR ARTISTRY INACTIVATED CROSSING, AND IT'LL HAVE THE RAPID FLASHING IN THOSE ARE REALLY SUCCESSFUL ACROSS THOSE BUSIER ROADS WILL BE A GOOD IMPROVEMENT MICHAEL THAT BE DONE AT THE SAME TIME AS THE HARLEM ONE OR THE HARLEM ONE B IN A LITTLE BIT FIRST, RIGHT THERE SOUTH OF 161 THAT HARLEM CROSSING. I KNOW WE ORDERED THE STATE TO THAT ONE. SO THIS WILL HAPPEN BECAUSE THIS ONE WILL GO IN BEFORE THAT WHEN WE HAVEN'T WE WERE STILL IN THE PROCESS OF GETTING THE PAPERWORK TOGETHER. YOU GET THAT ONE ORDERED. OKAY GREAT ONE UPON. WALNUT STREET, THOUGH I BELIEVE IS ON ORDER. CORRECT THEY'RE THEY'RE THE ONE ACROSS DUBLIN, GREENVILLE ROAD ACROSS THE TAYLOR FARM AND THE ONE ON ONE STREET ARE PROBABLY WITHIN THE NEXT 4 TO 6 WEEKS THEY'LL BE FULLY INSTALLED AND OPERATIONAL. ONE I WANT IS TO BE THAT'S THE PURPLE SECTION OF DOUBLE HOME APART. TO THE EAST OF THE FARM. THAT'S WHERE THAT'S GOING IN. IS IT? NOT SURE IT'S A SCARLET BERNIE LINK? STRIDE LIKES DR. YEAH THAT'S RIGHT. SO THERE'S CURRENTLY A NON LIGHTED CROSSING THERE, AND WE'RE BASICALLY GOING TO PUT THIS PROTECTOR INACTIVATED. IT'S JUST AN M PLACE THERE, SO WE'RE JUST ENHANCING SAFETY WISE. WHAT'S ALREADY IN PLACE NOW. WE ALSO CONSIDERED DOING THE SAME OF THE DEAN FARM AS WE GO ACROSS TO THE METRO PARK. BECAUSE THAT'S ALSO ANOTHER CROSS POINT. THAT'S VERY SIMILAR TO THINK THERE'S ONE AND THERE'S ONE THERE THAT THE COUNTY UNSOLD UPPER CLARITIN. UPPER CLEARING TO CROSSING OVER TO THE METRO PARK. IT'S NOT LIGHTED TO DRIVE DOWN THE LINE 100% SO YOU HAVE TO PUT IN A PATH TO MAKE THE CONNECTION. I'M NOT EVEN SURE THERE'S A LEISURE TRAIL COMING OFF THE SIDEWALK COMING UP THROUGH UPPER CLEAR INTENT TO IT DOESN'T GO ALL THE WAY TO. NO, NO. YEAH I'LL LOOK INTO THAT. I KNOW THAT WE'RE LOOKING AT PRETTY EXPANSIVE PEDESTRIAN CONNECTIVITY IN CONJUNCTION WITH THE ROUNDABOUT AT WALNUT AND BE BILHEIMER ROAD. AND I KNOW ONE OF MY GOALS IS TO GET A LEISURE TRAILS FROM BASICALLY FROM PEOPLE HAMMER ROAD ALL THE WAY OVER TO, UH, THE METRO PARK. OKAY SO I'LL DEFINITELY TAKE A LOOK AT THAT, AND THAT'S SOMETHING THAT CAN BE IMPROVED. WE'LL SEE ABOUT INCORPORATING THAT INTO OUR PROJECT. SO THE ONE THAT LINKS STRIKE CAME OUT OF THAT MEETING WITH THE RESIDENTS THERE, SO, YEAH, SO WE WERE ABLE TO GET THAT ONE STARTING A LITTLE BIT EARLIER. BUT THE ONE I'M HARLEM ROAD NORTH OF DUBLIN. GRANVILLE ROAD IS, UM MAYBE THAT WILL BE FOLLOWING SHORTLY BEHIND. ANY ADDITIONAL COUNCIL COMMON. THANK YOU FOR YOUR QUICK WORK EXCITED ABOUT HAVING ACCESS NOT BEING DUMPED OUT ONTO THE ROAD. IT IS. IT IS UNCOMFORTABLE DUMPED OUT DOWN ON THE ROAD WITH MY CHILDREN HAPPENS, PLUNK. ALL RIGHT. THERE'S NO ADDITIONAL

[17. EXECUTIVE SESSION]
