UH, WE'VE ALREADY DISCUSSED IT, BUT I'LL GO AHEAD AND PRESENT THE APPLICATIONS, UH, BOTH AT THE SAME TIME, SINCE THEY ARE RELATED TO ONE ANOTHER.

UH, REAL QUICK BEFORE WE DIVE INTO THE DETAILS OF THE APPLICATION. I JUST WANNA LET UM EVERYONE KNOW KIND OF SOME MORE INFORMATION ABOUT THE REZONING PROCESS AND THE DEVELOPMENT APPROVAL PROCESS FOR THE SITE. SO UM, IN ORDER TO GET THE PROPERTY REZONED. IT REQUIRES REVIEW AND APPROVAL BY THE PLANNING COMMISSION, WHICH IS THE FIRST STEP HERE WHERE WE'RE AT TONIGHT. UM THEY ARE PLANNING COMMISSION WILL REVIEW AND MAKE A RECOMMENDATION TO NEW ALBANY CITY COUNCIL, WHICH IS THE NEXT STEP HERE WHO TAKES FINAL ACTION ON A ZONING APPLICATION. THERE IS, UM, AN OPPORTUNITY TONIGHT. ANOTHER OPPORTUNITY AT THE CITY COUNCIL HEARING FOR MEMBERS OF THE PUBLIC TO COME. COME AND, UM UH, SHARE ANY COMMENTS ON THE APPLICATION. ONCE A REASONING APPLICATION IS APPROVED BY CITY COUNCIL 30 DAYS AFTER AN ORDINANCE IS PASSED, IT BECOMES LEGALLY EFFECTIVE AND THE APPLICATION IN THIS INSTANCE WOULD BE WOULD GO STRAIGHT TO ENGINEERING AND BUILDING PERMIT REVIEWS, WHICH WILL BE REVIEWED BY UM CITY STAFF, INCLUDING OUR CHIEF BUILDING OFFICIAL AND AN EX OFFICER, UM, FOR THE APPLICATION. SO AS NOTED IN THE STAFF REPORT, UM THIS PROPERTY WAS REZONED BACK IN 2020 ACTUALLY, TO ITS CURRENT, UH, ZONING CLASSIFICATION OF LIMITED GENERAL EMPLOYMENT. THE BEACH ROAD EAST LIMITATION TAX APPLIES TO THE PROPERTY. THE PURPOSE OF THIS REZONING IS TO ADD INDUSTRIAL PRODUCT SALES AS A CONDITIONAL USE, WHICH IS THE, UM EXISTING, UM, BY RIGHT STANDARD FOR, UH, LIMITED OR FOR GENERAL EMPLOYMENT USES IN OUR CITY CODE. AS WELL AS MODIFY, UM SOME DEVELOPMENT STANDARDS AND THE ZONING TAX, WHICH I'LL GO OVER HERE IN JUST A SECOND. SO THE PROPERTY IS OUTLINED HERE IN RED, UH, JUST TO HELP ORIENT SOME FOLKS, THIS IS INNOVATION. CAMPUS WAY. THIS IS BEACH ROAD.

UM SO ANYTHING IN B IN BLUE OR EVEN THIS GREEN DOWN HERE ALL OUT FOR A COMMERCIAL TYPE USES TO BE DEVELOPED FAITH LIFE CHURCH DOES HAVE ITS OWN SPECIAL ZONING CLASSIFICATION TO ALLOW THE OPERATION OF A CHURCH ON THEIR PROPERTY. THERE ARE SEVERAL OTHER PROPERTIES THAT ARE ZONED AND USED FOR RESIDENTIAL PURPOSES, UM, THAT ARE LOCATED OUTSIDE THE CITY OF WAN, BUT DIRECTLY ADJACENT TO THE SITE. AS I MENTIONED, THE APPLICANT PROPOSES TO USE THE EXISTING BEACH ROAD EAST ZONING TAX AS A BASE AND THEN MAKE SOME SLIGHT MODIFICATIONS TO THAT ZONING TO ALLOW, UM THE PROPOSED USE OR AT LEAST AS A CONDITIONAL USE. IN ADDITION TO MODIFYING SOME DEVELOPMENT STANDARDS, I PROVIDED THOSE HERE ON THE SLIDE AND THEY'RE OUTLINED IN YOUR STAFF REPORT AGAIN. WE'RE ADDING , UH, INDUSTRIAL PRODUCT SALES AS A CONDITIONAL USE. WHICH REQUIRES REVIEW AND APPROVAL BY THE PLANNING COMMISSION FOR REDUCING THE BRE PAVEMENT SETBACK FROM 50 FT TO 25 FT, WHICH IS NOT INCONSISTENT WITH OTHER, UH, ROADS IN THE NEW ALBANY BUSINESS PARK. WE ARE MODIFYING THE REQUIRED REAR YARD SETBACK TO MATCH THE BASE CODE REQUIREMENTS SET BACK WHICH STATES THAT FOR ANY STRUCTURE OR SERVICE AREA ALONG THE EASTERN BOUNDARY, THE REQUIRED YEAR REAR YARD SHOULD NOT BE LESS THAN 25 FT. AND THEN WE'RE ADDING SOME PRETTY STANDARD BOILER PLATE SOLAR PANEL LANGUAGE THAT WE'VE USED ELSEWHERE AND THE MULTI BUSINESS PARK AND THEN SEVERAL, UM TYPOS WERE CORRECTED. UM AND THIS VERSION, UH, THE ZONING TEXT, WHICH IS ALWAYS ALWAYS GOOD. SO ZOOMING IN A LITTLE BIT MORE ON THE CONDITIONAL USE ITSELF. THE SITE PLAN WAS SUBMITTED AS PART OF THAT, UH, CONDITIONAL USED APPLICATION, UM, SHOWING, UH, THE PROPOSAL? UM FOR CRIME LUMBER. SO UM, I'LL READ SOME STATS OFF HERE THAT ARE INCLUDING YOUR STAFF REPORT, THE APPLICANT PROPOSES TO BUILD AN 18,000 SQUARE FOOT BUILDING.

UH FOR TIME LUMBER. THIS BUILDING WILL INCLUDE A SALES OFFICE SHOWROOM AND DISTRIBUTION WAREHOUSE. THE APPLICANT STATES THAT THE OPERATION IS BUILDING IS FOCUSED ON MEETING THE NEEDS OF COMMERCIAL AND RESIDENTIAL BUILDING CONTRACTORS BY FACILITATING PRODUCT SELECTIONS.

UH UH, AT CONSTRUCTION JOB SITES. AND THE AND IN THE PROPOSED SHOWROOM BY DISTRIBUTING PRODUCTS FROM THE CROWS WAREHOUSE COMPONENT OF THE BUILDING. BASED ON THE DESCRIPTION OF THE USE PROVIDED BY THE APPLICANT, THE CITY ATTORNEY STATES THAT THAT THIS USE IS BEST CLASSIFIED AS INDUSTRIAL PRODUCT SALES. THEREFORE CONDITIONAL USE APPLICATION IS REQUIRED TO BE REVIEWED AND APPROVED BY THE PLANNING COMMISSION. AFTER SOME ADDITIONAL REVIEW WITH OUR, UM OUR, UH, ECONOMIC DEVELOPMENT STAFF. WE DO BELIEVE THAT THE PROPOSED USE SPECIFICALLY LUMBER DOES COMPLEMENT THE OFFICE DATA CENTER AND DISTRIBUTION USES, WHICH ARE PERMITTED IN THE OVERALL AREA SURROUNDING THE SITE. THE OPENING VISIT. THE OPEN BUSINESS PARK CONTAINS FIVE INDUSTRY CLUSTERS. THIS PORTION OF THE NEW BUSINESS PARK IS HOME TO LARGE MANUFACTURING, WAREHOUSE AND DISTRIBUTION COMPANIES, INCLUDING A PLASTICS CCL AND K DC. THE PROPOSED USE IS SIMILAR TO THESE SURROUNDING USES IN TERMS OF PROVIDING MATERIALS THAT SUPPORT OTHER INDUSTRIES. JUST WANNA GO BACKWARDS A LITTLE BIT OR NOT BACKWARDS, A LITTLE BIT FORWARDS HERE, UM, AND TALK ABOUT SOME OF THE ZONING TEXTS. AND HOW ARE SOME OF THE ZONING TEXT REQUIREMENTS AND HOW THE APPLICANT PROPOSES TO MEET THEM IN THE EXISTING TAX THAT WAS APPROVED IN 2020. THE THERE WAS COMMITMENT MADE TO PROVIDE A VERY SUBSTANTIAL LANDSCAPE OF EARL ON THE BEECH ROAD. FRONTAGE OF THE PROPERTY, UH, TO PROVIDE 75% OF HASLEY SCREENING FOR THE USE OF THE RESIDENTIAL USES THAT ARE ACROSS THE STREET. THE APPLICANT DID SUBMIT A LANDSCAPE PLAN AS PART OF THE CONDITIONS APPLICATION THAT SHOWS THIS REQUIREMENT AS BEING MATS, UH AND AGAIN, EVEN WITH THE PROPOSED REDUCTION IN THE, UM THE PROPOSED REDUCTION IN THE SETBACK ON LONG BEACH ROAD, WE WOULD A COMBO SHOULD MEET THOSE REQUIREMENTS. IN ADDITION IT WAS TALKED ABOUT. I WENT BACK AND LOOKED AT SOME MEETING MINUTES.

WHEN THIS WAS RESIGNED IN 2020. THERE WAS A LOT OF DISCUSSION ABOUT, UM, PRESERVING THERE'S A REALLY, REALLY HEALTHY TREE STAND AREA ON THE SOUTHERN PORTION OF THE SITE. UM AS NOTED ON THE, UM THE LANDSCAPE PLAN, THE APPLICANT DOES PROPOSE TO MAINTAIN THOSE HEALTHY EXISTING MATERIALS. UM, AT BORDER OF THE SITE. CHRIS IS THAT CHRIS IS THAT IN THE TEXT THAT IS IN THE TEXT FOR THE SOUTHERN BORDER? YEP, OK. UH, JUST MORE CONDITIONAL USE TO STANDARDS THAT WE JUST LIKE TO ADDRESS, UH, ON THE RECORD, THE APPLICANT STATES THAT THE EFFECTS OF NOISE GLARE, ODOR, LIGHT AND VIBRATION ON ADJACENT PROPERTIES IS NOT ANTICIPATED TO BE PRESENT AS A PART OF THIS USE FOR KIND LUMBER. IN ADDITION, THE APPLICANT SEATS THAT PROPOSED USE WILL NOT INVOLVE ACTIVITIES PROCESSES OR MATERIALS, EQUIPMENT OR CONDITIONS OF OPERATION THAT WOULD BE DETRIMENTAL TO ANY PERSON PROPERTY OR THE GENERAL WELFARE.

OVERALL THE PROPOSAL APPEARS TO BE CONSISTENT. BOTH PROPOSALS APPEAR TO BE CONSISTENT WITH CO CODE REQUIREMENTS FOR REZONING AND CONDITIONAL USE APPLICATIONS . THE PROPOSALS ALL ALSO MEET

THE DEVELOPMENT STANDARDS AND RECOMMENDATIONS CONTAINED IN THE ENGAGEMENT ARMY STRATEGIC PLAN AS WELL AS THE NEW ALBANY, UM, ECONOMIC DEVELOPMENT STRATEGIC PLAN. THE PROPOSED INDUSTRIAL PRODUCT SALES USE TO COMPLEMENT THE PERMITTED USES WHEN IT'S IN THE ZONING DISTRICT AND THE OVERALL NO BUSINESS PARK CAMPUS THAT IT'S A PART OF UM, THERE ARE TWO CONDITIONS OF APPROVAL THAT WERE INCLUDED IN THE CONDITIONAL USE APPLICATION, THEY'RE NOTED NOTED IN YOUR STAFF REPORT, BUT I'LL JUST READ THOSE OFF FOR THE RECORD. UM SO AS PART OF THE CONDITION YOU USE APPLICATION STAFF BELIEVES THAT IT'S IMPORTANT FOR THE EMBROIDERED TO CONSIDER, UM, SUBJECTING ANY APPROVALS THAT MAY OCCUR TONIGHT THAT, UH, NUMBER ONE. THE ZONING TEAM APPLICATION MUST BE ADOPTED BY CITY COUNCIL. AND IF IT'S NOT A BY CITY COUNCIL, ANY CONDITION USE APPROVAL TONIGHT WOULD BECOME NULL AND VOID. AND THEN THE SECOND, UH, CONDITION OR THE SEC SECOND CONDITION OF APPROVAL . IS THAT THE CONDITIONAL USE APPROVAL, UM ONLY APPLIES TO THE OPERATION OF TIME LUMBER AND NOT INDUSTRIAL PRODUCT SALES AS A WHOLE ON THE SITE.
