SO WE HAVE VERY CONCERNS ABOUT THAT. WITHIN 800FT, YOU'RE GOING TO HAVE THE EXIT FROM NOTTINGHAM TRACE. PROPOSED THREE LANE ENTRANCE TO THE BUS TERMINAL AND AN EXIT FOR FIRE STATION. IT'S OBVIOUSLY GOING TO HAVE TO BE SOME KIND OF LIGHT FOR THE FIRE STATION. THERE'S ALREADY A LIGHT AT THE CORNER, AND YOU MAY HAVE NEED FOR A LIGHT FOR ALL THE BUSSES TURNING IN AND OUT. BARRIER BETWEEN THE FOR THE SOUND AND THE DIESEL FUMES TO OUR COMMUNITY. I HAVE 30 YEARS WORKING FOR THE LARGEST TRUCK LINE IN THE COUNTRY. I KNOW ABOUT DIESEL EQUIPMENT IDLING AND RUNNING AND OSHA AND EPA TELLING US WHERE WE COULD PARK OUR TRUCKS AND WHERE WE COULDN'T BECAUSE OF THE FUMES, THE WIND IS DIRECTION STRAIGHT INTO OUR COMMUNITY. THE PROBLEMS WON'T BE WITH DIESEL FUMES WON'T BE FROM THE TRAFFIC. IT WILL BE FROM WHATEVER THE NUMBER IS 70, 80, 90 BUSSES IDLING IN THE MORNING AND ALL THOSE FUMES HEADING INTO OUR COMMUNITY. SO I JUST ASK THAT WHATEVER BARRIER, WHETHER IT'S, YOU KNOW, DIRT BERMS WITH PINE TREES ON TOP OR WHATEVER, YOU CAN'T DO TOO MUCH THERE. I'VE HAD OSHA SHUT US DOWN BECAUSE WE WEREN'T EVEN IN A RESIDENTIAL COMMUNITY, AND ONE PERSON INSISTED ON KEEPING THEIR WINDOWS OPEN ALL THE TIME, WHICH THEY HAD EVERY RIGHT TO DO. BUT OSHA CAME IN AND TOLD US WHERE WE COULD PARK AND WHERE WE COULDN'T PARK THE TRUCK. WE HAVE TRAFFIC CONCERNS, WHICH IS ALREADY DIFFICULT AT TIMES TO GET IN AND OUT OF. NOTTINGHAM TRACE RIGHT NOW WITHOUT HAVING ALL OF THE BUSSES AND THE FIRE PEOPLE COMING IN AND OUT. WE HAVE SERIOUS NOISE CONCERNS WITH THE BUSSES AND YOU KNOW, WE ALREADY CAN HEAR A FIRE STATION RIGHT NOW WHERE WE LIVE, AND NOW WE'RE GOING TO HAVE ANOTHER ONE RIGHT ON THE CORNER BY US. THERE ARE ALSO HEALTH CONCERNS, AS ONE OF MY OTHER NEIGHBORS MENTIONED.AND I THINK THOSE ARE SIGNIFICANT. AND THE WIND DOES TRAVEL FROM NEW ALBANY ROAD EAST TOWARD US. SO THE FUMES AND ALL OF THAT ARE GOING TO BE DISTRIBUTED ONTO OUR COMMUNITY, AND SOMETHING THAT MAYBE NOBODY'S MENTIONED, BUT I THINK SHOULD BE A FACTOR. AND THAT IS WHAT THAT DOES TO OUR PROPERTY VALUES. BECAUSE IN ESSENCE, YOU ARE PUTTING AN INDUSTRIAL PARK BESIDE A LOVELY RESIDENTIAL NEIGHBORHOOD, AND THAT CERTAINLY IS NOT GOING TO INCREASE OUR PROPERTY VALUES. SO THANK YOU. I ASKED THEM WHETHER RESIDENTIAL TAXES WERE HIGHER THAN LOWER THAN COMMERCIAL, AND THEY SAID NO COMMERCIAL PROPERTY WOULD BE TAXED AT A HIGHER RATE. AND AS I MENTIONED, WITH THE NEW FEMA MAPS THAT CAME OUT FOR LICKING COUNTY LAST SUMMER, I THINK EVERYONE'S AWARE OF THOSE. THIS WAS A GOOD OPPORTUNITY TO TAKE A COMPREHENSIVE REVIEW OF THE CODE AS IT CURRENTLY STANDS, AND SEE WHAT IMPROVEMENTS WERE WARRANTED AT THIS TIME. NOW THAT WE HAVE THOSE MAPS IN PLACE, AND WE UNDERSTAND THAT THERE WILL BE UPDATES FOR THE FRANKLIN COUNTY PORTION HERE IN THE NEAR FUTURE. NEXT SLIDE. SO SPEAKING FIRST ON CHAPTER 1155, AND THIS CHAPTER FOCUSES SPECIFICALLY ON THE FLOODPLAIN REGULATIONS. THIS CHAPTER HAS TWO PURPOSES. THE FIRST PURPOSE IS IT IMPLEMENTS THE FEDERAL MINIMUM STANDARDS THAT THE CITY HAS AGREED TO ADMINISTER IN ORDER TO PARTICIPATE IN A NATIONAL FLOOD INSURANCE PROGRAM. AND THERE'S ALSO AN OPPORTUNITY FOR THE CITY TO ADD ADDITIONAL, HIGHER STANDARDS SHOULD YOU DEEM APPROPRIATE FOR REGULATING DEVELOPMENT IN YOUR COMMUNITY. AND YOU HAVE DONE SO, AND WE WILL CONTINUE TO KEEP THOSE IN SOME OF THOSE EMPLOYEES. NEXT SLIDE. SO SPECIFIC TO CHAPTER 1155. THE CITY PLANNING COMMISSION WILL CONTINUE TO HEAR ALL VARIANCES AND APPEALS. THE REQUIREMENT FOR FLOODPLAIN COMPENSATORY STORAGE VOLUME WILL REMAIN IN PLACE. IF YOU'RE NOT FAMILIAR WITH THAT TECHNICAL ASPECT. IN SHORT, THAT JUST REQUIRES THAT A DEVELOPER EXCAVATE THE SAME AT LEAST 105% OF PROPOSED BUILD VOLUME WITHIN A FLOODPLAIN. SO THAT WAY YOU HAVE NO LOSS OF STORAGE VOLUME WITHIN THE FLOODPLAIN. IN ORDER TO PROPOSE ONE OF THOSE DEVELOPMENT TYPES IN A FLOODPLAIN, THE APPLICANT WOULD HAVE TO SECURE A VARIANCE FROM THE FLOOD CODE, AND WITH THE NEW MAPS THAT CAME OUT, ESPECIALLY IN LICKING COUNTY AND SOME OF THE MORE AGRICULTURAL AREAS, AS YOU CAN IMAGINE, FLOOD PLAINS FOLLOW THE TOPOGRAPHIC CONTOUR OF THE SURFACE. THEY'RE REGULAR SHAPES. THOSE SHAPES DON'T WORK WELL WITH A SITE PLAN FOR A DEVELOPMENT SITE. SO THE WAY THE CODE IS CURRENTLY WRITTEN, THERE IS NOT AN OPPORTUNITY FOR THAT AREA TO BE ENGINEERED IN A MANNER THAT'S HARMONIOUS, BOTH FOR DEVELOPMENT, BUT ALSO TO MAINTAIN THE FLOOD PROTECTION OR THE FLOOD CONVEYANCE THAT'S PROVIDED BY THE WATERCOURSE. WITH THIS CHANGE, WE'RE ELIMINATING THAT PROHIBITION. SO DEVELOPMENT WITHIN THOSE FLOOD PRONE AREAS OR FLOODPLAIN MAPPED AREAS WOULD BE PERMITTED. IF THE DEVELOPMENT FOLLOWS THE OTHER STANDARDS OF THE CODE. AGAIN, THE COMPENSATORY STORAGE, YOU HAVE NO NET LOSS IN FLOOD STORAGE VOLUME. AND ANY BUILDINGS ARE AT LEAST TWO FEET ABOVE THAT 100 YEAR FLOOD ELEVATION. CAN YOU EXPLAIN FLOOD STORAGE VOLUME? I'M NOT PICKING UP ON WHAT THAT MEANS. IS THAT LIKE A RETENTION POND OR NOT NECESSARILY. SO IF YOU CAN IMAGINE THERE'S A FLOOD EVENT, YOU HAVE A 100 YEAR FLOOD EVENT AND THEN INUNDATES A CERTAIN AREA, THE AREA BETWEEN THE TOP OF THE WATER AND THE GROUND SURFACE. THAT'S THE SPACE THAT THE FLOOD WATERS OCCUPY. WE'RE PRESERVING THAT SPACE. SO IF A DEVELOPER PROPOSES TO FILL IN THAT SPACE SO THEY HAVE MORE ROOM FOR THEIR PROPERTY, THEY HAVE TO CREATE AT LEAST 105% OF THE FILL THAT THEY'VE PLACED. SO THERE'S NO NET LOSS IN THE FLOODPLAIN. FROM A VOLUMETRIC PERSPECTIVE, JUST VOLUME. YOU CAN'T LOSE THE VOLUME THAT WOULD NORMALLY BE PART OF THAT FLOOD PLAN. CORRECT. ALL RIGHT, I GOT IT. THIS RESOLUTION DOES TWO THINGS. FIRST, IT AUTHORIZES THE ANNUAL DISTRIBUTION OF FUNDS FROM THE CITY'S ECONOMIC DEVELOPMENT FUND, HELD IN TRUST AT THE NEW ALBANY COMMUNITY AUTHORITY. AND THEN IT ALSO AUTHORIZES THE ASSIGNMENT OF ECONOMIC DEVELOPMENT FUND TO THE NEW ALBANY EAST COMMUNITY AUTHORITY. UPON THE DISSOLUTION OF THE ORIGINAL AUTHORITY. THAT'S A LOT OF AUTHORITY. AT LEAST ANNUALLY, THE CITY HAS REQUESTED FUNDING FROM THE NEW ALBANY COMMUNITY AUTHORITY FOR PROJECTS AND OTHER EXPENSES RELATED TO ECONOMIC DEVELOPMENT. THE MONEY IS DRAWN FROM THE ECONOMIC DEVELOPMENT FUND THAT'S HELD IN TRUST. THE FUND IS WAS CREATED TO RECEIVE A DISTRIBUTION FROM THE CITY'S INCOME TAX, COLLECTED IN THE FRANKLIN COUNTY PORTION OF THE NEW ALBANY BUSINESS PARK. THE FUND RECEIVES ANYWHERE FROM 30 TO 50% OF THE FIRST DOLLAR EARNED, OR OF ANY DOLLAR EARNED IN THAT PORTION OF THE BUSINESS PARK. THE CURRENT YEAR REQUEST IS $11.225 MILLION, AND IS BASED ON EXPENSES AND PROJECTS APPROVED WITHIN THE ADOPTION OF THE 2025 ANNUAL BUDGET. MOST OF THE COSTS OF ROUTINE AND ASKED FOR EACH YEAR. THE NEW ITEMS ARE RELATED TO SPECIFIC PROJECTS THE CITY HAS IDENTIFIED FOR WHICH TO USE THE FUNDS. THE LIST OF PROJECTS WAS ATTACHED TO THE ORDINANCE OR THE RESOLUTION, AND JUST TO HAVE A HIGH LEVEL LIST OF THEM. THE FIRST REQUEST IS FOR $2.5 MILLION TO PAY INCENTIVES, SECONDARY INCENTIVES, JOB CREATION INCENTIVES WITHIN THE BUSINESS PARK TO SUPPORT ECONOMIC DEVELOPMENT. THIS IS IN LINE WITH PREVIOUS YEARS THAT WE'VE PAID BEFORE. THE SECOND IS PAYMENT OF CIC OPERATING COSTS. THIS IS ALSO A ROUTINE EXPENSE THAT WE HAVE REQUESTED FUNDING FOR. THE CIC OPERATES THE INNOVATE NEW ALBANY, AND NOW IT IS LOCATED WITH BRICKHOUSE BLUE.WE WILL EVALUATE IN COMING YEARS WHETHER OR NOT I WILL CONTINUE TO REQUEST THAT FUNDING. THE THIRD IS PAYMENT FOR THE LOCAL ECONOMIC DEVELOPMENT ORGANIZATION, SUPPORT FOR REVLON AND MID-OHIO, MID-OHIO DEVELOPMENT EXCHANGE FOR THEIR SUPPORT OF ECONOMIC DEVELOPMENT.
AND THEN THERE IS A SECTION FOR MISCELLANEOUS PROFESSIONAL COSTS THAT WE UTILIZE. THE FUND FOR.
THIS COULD BE LEGAL FEES. MISCELLANEOUS PLANS, OR INSPECTION OR ENGINEERING SERVICES RELATED TO OTHER PROJECTS. THE NEXT ONE, THAT IS A USUAL EXPENSE THAT WE REQUEST IS FOR THE SHUTTLE PROGRAM WITHIN THE BUSINESS PARK, AND THAT IS AN ANNUAL COST THAT WE DRAW DOWN. THAT COST IS SUPPLEMENTED BY REVENUE THAT WE RECEIVE FROM THE BUSINESS PARK ASSOCIATIONS LOCATED WITHIN THEIR. AND THEN WE ALSO HAVE A $35,000 REQUEST FOR INFRASTRUCTURE MAINTENANCE WITHIN THE BUSINESS PARK. THIS IS SOMETHING THAT THE PREVIOUS

OKAY. GOING TO THE NON ROUTINE REQUEST, THE BIGGEST THE MOST SIGNIFICANT WITHDRAWAL WOULD BE 6.5 MILLION FOR THE CONSTRUCTION OF GANTMAN PARKWAY PHASE ONE INFRASTRUCTURE. AND THAT IS TO DEVELOP THE SOUTH OR AS THE BUSINESSES DEVELOP AND DEVELOPMENT HAPPENS WITHIN THE CORRIDOR THAT'S SOUTHWEST OF STATE ROUTE 161 AND BEACH ROAD INTERCHANGE, IT'S NECESSARY TO EXTEND THAT. IN ORDER TO PROVIDE FOR THE INFRASTRUCTURE, FOR INFRASTRUCTURE, FOR SCHOOL FACILITIES, FOR TOWNSHIP FIRE FACILITIES, AND THIS WAS CREATED AND A CHARGE WAS ASSESSED TO THOSE RESIDENTS AND TAXPAYERS OF NEW ALBANY. IT WAS SET UP IN ORDER TO PROVIDE FOR THE DEBT PAYMENT THAT WAS RELATED TO THOSE PARTICULAR CONSTRUCTION PROJECTS, AND THAT FINAL DEBT PAYMENT WAS MADE IN OCTOBER. SO THE ORIGINAL PURPOSE OF THE AUTHORITY WAS TO PROVIDE FOR THAT IN. I HAD MY DATE, BUT IN 20 I THINK 20. LATER WE ENDED UP CREATING THE ECONOMIC DEVELOPMENT FUND AND THE ECONOMIC DEVELOPMENT FUND WAS CREATED AGAIN TO RECEIVE THE INCOME TAX. AND THAT WAS SET UP AS A SEPARATE TRUST AGREEMENT AND SEPARATE FUNCTION OF THE ORIGINAL AUTHORITY, WITH THE ORIGINAL AUTHORITY HAVING THAT LAST DEBT PAYMENT. THE TRUE PURPOSE OF THAT AUTHORITY IS NO LONGER THERE, AND WE HAVE A ADDITIONAL COMMUNITY AUTHORITY THAT WAS SET UP AS A MUNICIPAL AUTHORITY THAT ALSO SUPPORTS THE BUSINESS PARK. WITH THAT BEING SAID. NACURH PASSED A RESOLUTION IN DECEMBER OF THIS YEAR AND DETERMINED THAT THEY ARE WANTING TO DISSOLVE THE ORIGINAL AUTHORITY BECAUSE THAT CHARGE IS NO LONGER EXISTENT AND ASSIGN THE REMAINING FUNDS. AND THE MAIN REMAINING PURPOSE THAT WE SET UP ORIGINALLY FOR ECONOMIC DEVELOPMENT TO THE EAST, AUTHORITY THAT IS PRESENT WITHIN THE KING COUNTY. SO THIS RESOLUTION ESSENTIALLY DESCRIBES THAT WHAT'S GOING TO HAPPEN, THAT ECONOMIC DEVELOPMENT FUND WILL BE MOVED OVER THE ACTUAL ASSETS. RELATED TO THAT, THERE IS A DEBT PAYMENT THAT COMES ALONG WITH IT. THERE'S A LOAN RECEIVABLE THAT COMES ALONG WITH IT, AND THEN THE REVENUE SOURCE WILL ALSO BE TRANSFERRED TO THE EAST AUTHORITY. SO ONCE THIS IS APPROVED, WE'LL HAVE THE MEETING. THEY'LL HAVE THE FINAL MEETING OF THE NACA. WE'LL ALSO MEET WITH THE EAST AUTHORITY, PRESENT THIS FOR THEM TO ACCEPT THE ECONOMIC DEVELOPMENT FUND AND PROCEED WITH FOR THE REMAINDER OF THE YEAR, TO BE ABLE TO TRANSFER THAT LEGALLY. THE GOAL IS TO HAVE THAT DONE BY 1231, 2025. SO THIS WOULD BE THE LAST YEAR THAT THE ORIGINAL AUTHORITY WOULD HAVE TO REPORT FINANCIALLY. AND I THINK I CAN ANSWER ANY QUESTIONS RELATED TO THAT. I KNOW THAT, YOU KNOW, AGAIN, LIKE YOU SAID, IT IS A MUNICIPAL AUTHORITY. IT WILL COVER EVERYTHING. BUT THE EAST AUTHORITY, AS IT WAS ORIGINALLY SET UP, WAS ORIGINALLY SET UP TO ASSESS THE CHARGE RELATED TO ITS AREA, EVEN THOUGH IT BENEFITS THE ENTIRE CITY. IT'S RELATED TO THE EASTERN PORTION OF OUR BUSINESS PARK, SO THAT WOULD BE THE ONLY DIRECTIONAL PORTION THAT COULD BE IN THERE. BUT IT'S SOMETHING I CAN CERTAINLY BRING UP TO THE BOARD AND BRING UP TO WHAT DIRECTION THEY'D WANT TO DIRECTION THEY'D WANT TO GO IN. THAT'S THAT'S LIKE NEXT, NEXT LEVEL. RIGHT. WE'LL GET THROUGH THE FIRST PHASE. SO THE EXISTING ONE, THE ONE THAT WILL REMAIN WAS ALWAYS A MUNICIPAL BOUNDARY.

SO TYPICALLY, THE COMMUNITY FACILITIES HAVE TO BENEFIT THE AREA THAT THE CHARGE IS ASSESSED. SO BUT WITH IT BEING MUNICIPALITY, IT MAKES MORE SENSE FOR ANY AREA WITHIN THE MUNICIPALITY WOULD BENEFIT THE AREA THAT IS ASSESSED. THE DIFFERENCE BETWEEN A COUNTY AUTHORITY WHICH WAS THE ORIGINAL AUTHORITY AND THE MUNICIPAL AUTHORITY IS BASICALLY WHICH POLITICAL ENTITY APPOINTS THE MEMBERSHIP OF THE BOARD. OKAY, AND IN THE ORIGINAL AUTHORITY, MEMBERSHIP WAS APPOINTED BY THE COUNTY. THE MAJORITY OF MEMBERSHIP WAS APPOINTED BY THE COUNTY IN THE MUNICIPAL AUTHORITY. IN ADDITION, IF YOU RECALL, IN THE FALL I BROUGHT A RESOLUTION TO APPROVE A COOPERATIVE AGREEMENT WITH THE EAST AUTHORITY WITH THE CITY, AND THAT OUTLINED WHAT THE ALLOWABLE EXPENDITURES AND COSTS WERE AND PROJECTS THAT COULD BE PAID FOR WITH THE CHARGE THAT COMES IN CURRENTLY, IT'S PAYING THE DEBT PAYMENTS THAT'S RELATED TO INFRASTRUCTURE THAT'S IN THE BUSINESS PARK. NEW ALBANY HAS PRIMARILY USED THESE MUNICIPAL BONDS, DEBT, AND DEBT INSTRUMENTS TO FINANCE VARIOUS PUBLIC FACILITIES AND INFRASTRUCTURE IMPROVEMENTS.MOST RECENTLY, THE FIRST PHASE OF ROSE ONE RUN IN 2018. FURTHER, THE 2025 ADOPTED BUDGET REFLECTS A PLANNED MUNICIPAL BOND ISSUANCE OF APPROXIMATELY $55 MILLION FOR THE ROSE RUN TWO PROJECT. THIS INCLUDES THE PLANS FOR THE MEMORIAL, PROVIDE FOR PARKING IMPROVEMENTS AND IMPROVEMENT OF FACILITIES, WHICH INCLUDES EXPANDING THE POLICE FACILITIES. UNLIKE CORPORATE DEBT ISSUES, THE INTEREST RECEIVED BY HOLDERS OF TAX EXEMPT BONDS IS EXEMPT FROM FEDERAL INCOME TAXES CURRENTLY, AND MAY ALSO BE EXEMPT FROM STATE AND LOCAL INCOME TAX.
