AND I WANTED TO ADDRESS A FEW COMMENTS ABOUT THE BUS GARAGE. FIRST OF ALL, I HAD A FEW CONCERNS ABOUT THE TRAFFIC STUDY. I HAVE BEEN UNABLE TO DETERMINE WHETHER A TRAFFIC STUDY HAS ACTUALLY BEEN INITIATED ON THIS PROJECT. THE APPLICATION THE REZONING APPLICATION SAYS THAT, QUOTE, A TRAFFIC STUDY IS IN PROCESS. I EMAILED WITH SIERRA SIMMERING ON THE PLANNING COMMISSION STAFF AND SHE HAD NO UPDATE ON WHETHER REPORT HAS BEEN STARTED. AND I ASKED THIS BECAUSE I IT WAS MY BELIEF AND UNDERSTANDING THAT WHEN WE MET WITH THE SCHOOL SUPERINTENDENT THIS PAST MONDAY AT NOTTINGHAM TRACE, HE STATED THAT HE HAD NOT ORDERED A TRAFFIC STUDY YET BECAUSE HE DIDN'T WANT TO PAY FOR IT UNLESS THE PROJECT WAS GOING TO GO THROUGH. SO I GUESS THAT'S JUST ONE THING THAT I WANTED TO POINT OUT. THAT SEEMS A BIT UP IN THE AIR. SO IT WOULD BE NICE TO KNOW IF THAT HAS BEEN ORDERED AND STARTED. AND AGAIN, TURNING TO THE REZONING APPLICATION THAT WAS FILED WITH THE CITY. THE ZONING CODE REQUIRES A ZONING AMENDMENT APPLICATION TO CONTAIN CERTAIN INFORMATION. THIS IS ZONING CODE SECTION 111.03. THE APPLICATION IS SUPPOSED TO CONTAIN. I'M QUOTING A STATEMENT AS TO HOW THE PROPOSED AMENDMENTS WILL IMPACT ADJACENT AND PROXIMATE PROPERTIES. THAT SUBSECTION G, THE REZONING APPLICATION IN THIS SITUATION SIMPLY READS. THE PROPOSED

CHANGE WILL ALLOW DEVELOPMENT OF THE SITE FOR SCHOOL TRANSPORTATION, FACILITY AND FIRE SUBSTATION. NOWHERE DOES IT ATTEMPT TO ADDRESS THE IMPACT ON ADJACENT AND PROXIMATE PROPERTIES, AND THIS IS DEFINITELY SOMETHING THAT'S CONSPICUOUSLY MISSING FROM THE REZONING APPLICATION. THE APPLICANT ALSO MUST PROVIDE A CLEAR JUSTIFICATION FOR THE REQUIRED ZONING CHANGE, EXPLAINING WHY IT IS NECESSARY AND BENEFICIAL TO THE COMMUNITY.THIS ALSO HAS NOT BEEN DONE. THE ONLY REASON THIS PROJECT, IT APPEARS, IS EVEN BEING DISCUSSED AT THIS LOCATION IS BECAUSE THE LAND IS FREE TO THE SCHOOL DISTRICT. THE PROPOSED CHANGE HAS TO PROMOTE THE PUBLIC WELFARE AND NOT NEGATIVELY IMPACT SURROUNDING AREAS. THE PROPOSED REZONING SHOULD NOT POSE A THREAT TO THE HEALTH, SAFETY OR GENERAL WELFARE OF THE COMMUNITY. I BELIEVE THIS PROPOSED BUS GARAGE IS A THREAT TO THE HEALTH OF THE RESIDENTS OF NOTTINGHAM. TRACE, AS DEMONSTRATED BY A WHITE PAPER WHICH HAS BEEN PREPARED BY DOCTOR SANDRA SOLANO. I DON'T KNOW IF THAT'S BEEN PRESENTED TO YOU YET, BUT WE DO HAVE A PAPER FROM HER, AND SHE SHE'S A PUBLIC HEALTH PHYSICIAN, AND WE WILL BE SURE THAT YOU'RE PROVIDED WITH THAT. THE PROPOSED BUS GARAGE ALSO NEGATIVELY IMPACTS THE SURROUNDING PROPERTIES AND THE NEIGHBORHOOD CHARACTER. NOTTINGHAM TRACE IS ZONED INFILL PLANNED UNIT DEVELOPMENT. SOME OF THE STATED PURPOSES FOR THE IPAD CLASSIFICATION, AS CONTAINED IN SECTION 1159 .02 OF THE NEW ALBANY ZONING CODE, ARE ONE. CO-LOCATION OF HARMONIOUS USES. TWO ENSURING A RATIONAL AND COMPATIBLE RELATIONSHIP BETWEEN RESIDENTIAL AND NONRESIDENTIAL USES FOR THE MUTUAL BENEFIT OF ALL, AND THREE TO PROVIDE AN ENVIRONMENT OF STABLE CHARACTER COMPATIBLE WITH SURROUNDING AREAS. WHEN MY NEIGHBORS AND I BOUGHT OUR PROPERTIES IN NOTTINGHAM TRACE, WE RELIED UPON THE FACT THAT THE ENVIRONMENT WOULD HAVE A STABLE CHARACTER AND THAT THE SURROUNDING LAND WOULD BE DEVELOPED IN A MANNER THAT WAS COMPATIBLE AND HARMONIOUS WITH OUR NEIGHBORHOOD. WE ALSO RELIED UPON THE FACT THAT FURTHER DEVELOPMENT FOR RESIDENTIAL AND NONRESIDENTIAL USES, WHICH IS PERMITTED UNDER THE IPOD, WOULD BE FOR THE MUTUAL BENEFIT OF ALL. PLACING A BUS GARAGE AT THE CORNER OF STATE ROUTE 605 AND NEW ALBANY ROAD EAST IS THE ANTITHESIS OF THIS NOTION OF NEIGHBORHOOD STABILITY, COMPATIBILITY, AND HARMONY. THE THIRD PROPOSED DESIGN, WHICH WAS PRESENTED FOR THE BUS GARAGE AND THE FIRE SUBSTATION AT THE MEETING THAT WE HAD ON MARCH 10TH AT THE COMMUNITY, IS NOT COMPATIBLE WITH THE EXISTING NEIGHBORHOOD OR WITH THE BRICK AND WHITE BOARD FENCES UBIQUITOUS THROUGHOUT NEW ALBANY. I'D LIKE TO TALK FOR A MINUTE ABOUT ESTHETICS. THE OHIO SUPREME COURT HAS HELD THAT THE APPEARANCE OF A COMMUNITY RELATES CLOSELY TO ITS CITIZENS HAPPINESS, COMFORT, AND GENERAL WELL-BEING. THERE IS A LEGITIMATE GOVERNMENTAL INTEREST IN MAINTAINING THE ESTHETICS OF THE COMMUNITY, AND THE ESTHETIC CONSIDERATIONS COULD BE TAKEN INTO ACCOUNT BY THE LEGISLATIVE BODY IN ENACTING ZONING LEGISLATION. THE COURT ALSO HELD THAT A CONCERN FOR MAINTAINING PROPERTY VALUES IS ALSO ANOTHER LEGITIMATE INTEREST OF A MUNICIPALITY. THIS IS THE CASE OF HUDSON VERSUS ALBRECHT, INC. NINE OHIO STATE THIRD 69, 1984. I'M WONDERING IF THE PROPOSED DESIGN HAS BEEN SUBMITTED AT ALL FOR REVIEW BY THE ARCHITECTURAL REVIEW BOARD, BECAUSE THE DESIGN DOES NOT APPEAR TO MEET THE NEW ALBANY DESIGN GUIDELINES AND REQUIREMENTS AS ADOPTED BY THIS CITY IN SECTION 1157 .01 OF THE NEW ALBANY ZONING CODE. SECTION ONE OF THESE GUIDELINES STATES THAT, QUOTE, THE DESIGN OF NEW BUILDINGS IN NEW ALBANY WILL BE BASED ON THE PRECEDENT OF AMERICAN ARCHITECTURAL STYLES AND DESCRIBES VARIOUS METHODS, STYLES, METHODS SUCH AS GEORGIAN, FEDERAL, GREEK REVIVAL, GREEK REVIVAL, EXCUSE ME, AND SO ON. SECTION EIGHT OF THE GUIDELINES AND REQUIREMENTS SAYS THIS SECTION APPLIES TO ALL CIVIC AND INSTITUTIONAL PROJECTS IN NEW ALBANY, INCLUDING FIRE STATIONS AND SERVICE STRUCTURES. CIVIC AND INSTITUTIONAL DESIGNS SHOULD FOLLOW THE PRECEDENTS OF TRADITIONAL AMERICAN ARCHITECTURAL DESIGN. I DON'T SEE ANYTHING IN THESE GUIDELINES AND RECOMMENDATIONS THAT PERMIT THE TYPE OF PROPOSED BUILDING LARGE PARKING AREAS VISIBLE TO THE GENERAL PUBLIC. THERE WERE SEVERAL THINGS, BASICALLY THAT ALERTED ME, AND I BECAME QUITE CONCERNED. MY WIFE AND I MOVED HERE JUST TWO YEARS AGO. THIS WAS TO BE OUR LAST HOUSE. WHERE WE GO AFTER THIS IS GOING TO BE WILLING US IN WHEELCHAIRS, AND WE PROBABLY WON'T EVEN KNOW.OKAY, BUT THIS WAS OUR LAST HOUSE. WE JUST MOVED FROM WESTERVILLE, FIVE MILES. WE RECOGNIZE THE CHANGES THEY PROPOSED IN ORDER TO TRY TO MAKE THIS PROJECT MORE PALATABLE, BUT WE REMAIN ADAMANT THAT THE CLOSE PROXIMITY TO RESIDENTIAL AREAS, ALONG WITH THE BUSY INTERSECTION AT HIGHWAY 605 AND NEW ALBANY ROAD EAST, IS A TERRIBLE LOCATION FOR THIS TYPE OF FACILITY. AMONG OUR MANY CONCERNS ARE TRAFFIC CONGESTION AT THE INTERSECTION OF HIGHWAY 605, THE ENVIRONMENTAL IMPACT OF AIR NOISE AND LIGHT POLLUTION, THE UNATTRACTIVE AND INCONSISTENT NATURE OF THE BUS BAN'S EFFECT ON THE CHARACTER OF THE SURROUNDING AREA, AS WELL AS PROPERTY VALUES. MIGHT SURPRISE SOME PEOPLE THAT OHIO'S EXPECTED TO LOSE 675,000 POPULATION IN THAT TIME PERIOD AND DROPPED FROM SEVENTH TO NINTH IN TOTAL POPULATION. HOWEVER, FRANKLIN COUNTY IS GOING TO GROW 12%, AND WE ALL KNOW THIS AREA WILL GET MORE THAN ITS SHARE OF THAT. OF THE FOUR FASTEST GROWING COUNTIES IN OHIO, THREE OF THEM ON THE NORTH SIDE OF COLUMBUS. WE HAVE. UNION, DELAWARE, AND LICKING. THE FOURTH COUNTY IS WORN DOWN BY CINCINNATI. DELAWARE COUNTY IS THE. THAT WILL BE THE FASTEST GROWING COUNTY IN THE STATE OF OHIO. NOT ONLY THE FASTEST GROWING, BUT MORE THAN TWICE AS FAST AS ANY OTHER COUNTY IN THE STATE OF OHIO. AND I THINK WE ALL KNOW WHERE ALL THE EMPTY LAND IS.
SUNBURY AND EAST OF THERE. ALL YOU HAVE TO DO IS DRIVE UP THERE AND GO UP TO THE 37 AND ACROSS, AND YOU'LL SEE THEY'RE PUTTING ROUNDABOUTS ALREADY OUT IN THE BOONDOCKS. THE PLANNERS KNOW THAT THE POPULATION EXPLOSION IS COMING UP THERE, AND THAT GROWTH HAS NOWHERE TO GO TO THE METRO AREA OTHER THAN THE 605. THERE'S TWO ROUTES PROPOSED, ONE GOING FROM PITTSBURGH TO CHICAGO, THE OTHER COMING THROUGH CINCINNATI. AT THE CLEVELAND, THE STATE NEEDS TO SHOW SUPPORT FOR THOSE.
