BOARD AND COMMISSION REPORTS, I KNOW THE PLANNING COMMISSION WAS ACTIVE LAST NIGHT, AND COUNCIL MEMBER SHAUL HAS AN UPDATE. YES. THANK YOU MAYOR. THERE IS FOUR CASES IN FRONT OF PLANNING COMMISSION LAST NIGHT. I'LL GO AHEAD AND RUN THROUGH SOME OF THEM FOR YOU ALL. SO THE FIRST ONE I'M GOING TO START WITH WE'LL DO THE EASIER ONES FIRST. WE GOT F M 16 2026 STACK FINAL DEVELOPMENT PLAN MODIFICATION. THIS IS A REQUEST TO MODIFY THE FINAL DEVELOPMENT PLAN STACK DATA CENTER TO ALLOW THE RELOCATION OF THE ENTRY, DRIVE AND STORMWATER BASIN ON 16.81, PLUS OR MINUS ACRES OF LAND GENERALLY LOCATED NORTH OF NEW ALBANY ROAD EAST AND ON THE EASTERN SIDE OF CEDAR ROAD. SO THIS DEVELOPMENT PLAN REALLY THE CITY CODE IS SILENT ON THE MAJOR VERSUS MINOR FINAL DEVELOPMENT PLAN MODIFICATIONS. AND REALLY ANY CHANGE IS REQUIRED TO BE REVIEWED AND APPROVED BY THE PLANNING COMMISSION. THE STACK DATA CENTER SUBMITTED AND WAS APPROVED FOR FINAL DEVELOPMENT PLAN WITH CONDITIONS ON DECEMBER 15TH. AND THEN SINCE THEN, THEY'VE HAD SOME MINOR MODIFICATIONS THAT HAVE BEEN REQUESTED. ONE WAS TO SHIFT THE ENTRY DRIVE AND WET DETENTION BASIN ON THE NORTHWEST PORTION OF THE SITE. THIS REALIGNMENT IS NECESSARY DUE TO THE ADDITION OF A 100 FOOT WIDE PRIVATE UTILITY EASEMENT ALONG SITE. ALSO, THEY'LL BE THROWING SOME ADDITIONAL LANDSCAPING ADDED TO THE STREET ON THE NORTH SIDE. EVERYTHING MEETS CONDITIONS OF APPROVAL FROM THE ORIGINAL DEVELOPMENT PLAN AND STAFF, AND THE CITY LANDSCAPE ARCHITECT REALLY HAD NO COMMENTS OR CONCERNS WITH THESE CHANGES, AND THAT WAS VERY SIMILAR WITH PLANNING COMMISSION. THERE REALLY WASN'T MUCH COMMENTS, SEEMED FINE AND THEY APPROVED IT FOR ZERO.

THAT'S THE FIRST ONE. THE SECOND ONE, THIS WAS A FINAL DEVELOPMENT PLAN MODIFICATION.

SO ABOUT THE SAME TYPE OF CASE THAT THEY LOOKED AT. THIS ONE WAS TO REQUEST TO MODIFY THE FINAL DEVELOPMENT PLAN FOR FOREST DRIVE OFFICE BUILDING TO REVISE THE PARKING LOT LAYOUT ON 1.13 ACRES OF LAND, AND THE KENNEDY TRUST CORPORATION. BASICALLY, THE APPLICANT WAS REQUESTING MINOR PARKING LOT LAE APPLICANT HAD STATED THAT DURING THE PREVIOUS

MODIFICATION PROCESS, A PROSPECTIVE TENANT REQUESTED RELOCATION OF A BUILDING ENTRANCE. ALTHOUGH THE TENANT DID NOT ULTIMATELY OCCUPY THE SPACE, THE ENTRANCE RELOCATION REMAINED PART OF THE APPROVED PLAN AND AT THAT TIME, THE WALKWAYS WERE NOT UPDATED TO REFLECT THIS REVISED ENTRANCE LOCATION. SO THE PROPOSED REVISIONS REALIGN THE WALKWAY TO CONNECT DIRECTLY TO THE RELOCATED ENTRANCE AND REMOVE SEGMENTS OF THE CONCRETE WALKWAY THAT WOULD BE SUSCEPTIBLE TO DAMAGE FROM ROUTINE SNOW REMOVAL OR SERVICE VEHICLES. AGAIN, THEY'LL ADD SOME ADDITIONAL THINGS LIKE BIKE RACKS AND WHAT HAVE YOU.

BUT AGAIN, NOT MUCH CONVERSATION HERE AND WAS ALSO APPROVED FOR NOTHING. ALL RIGHT, NOW WE'LL START GETTING INTO SOME MORE INTERESTING ONES. THE NEXT ONE IS ZCO5 2026 COMMUNITY FACILITIES REZONING. SO THIS WAS A REQUEST FOR A ZONING CHANGE FROM AGRICULTURAL DISTRICT AG TO COMMUNITY FACILITIES FOR 69.654 PLUS OR MINUS ACRES OF LAND TO ALLOW FOR A COMMUNITY FIELD HOUSE, POLICE TRAINING FACILITY AND ASSOCIATED GREEN SPACES AT BILHEIMER PARK. AND REALLY WHAT THIS IS DOING IS IT'S ESTABLISHING A CONSISTENT ZONING DISTRICT THAT SUPPORTS COHESIVE DEVELOPMENT PATTERNS IN THE AREA. THE PROPERTY'S INTENDED FOR REZONING WERE NOT REZONED AT THE TIME OF ANNEXATION INTO THE CITY, AND AS THEY WERE UNDEVELOPED WITH THE PROPOSED DEVELOPMENT, THE REZONING WOULD FACILITATE CONSTRUCTION OF SEVERAL IMPROVEMENTS, INCLUDING A NEW POLICE TRAINING FACILITY, A PUBLIC SERVICE DEPARTMENT, STORAGE BUILDING ON THE EXISTING PUBLIC SERVICE FACILITY SITE, CURRENTLY ZONED COMMUNITY FACILITIES. WE'RE ALSO GOING TO HAVE A PUBLIC PARK RESTROOM, WHICH WE APPROVED THIS YEAR IN OUR BUDGET WITHIN BILHEIMER PARK, ALSO ZONED COMMUNITY FACILITIES AND A COMMUNITY FIELD HOUSE, WHICH HAS BEEN APPROVED BY THE ARCHITECTURAL REVIEW BOARD AND IS CURRENTLY UNDER CONSTRUCTION. SO REALLY, WHAT THIS REZONING WAS, I KNOW WE LIKE TO SOMETIMES CALL IT HOUSE CLEANING, BUT THERE IS PARCELS OUT THERE AT BETHLEHEM PARK THAT JUST WERE NOT YET PART OF THE FACILITY'S DISTRICT. AND SO THIS KIND OF BRINGS EVERYTHING THAT'S OUT THERE NOW INTO ONE DISTRICT FOR FACILITIES. AND IT ALSO INCLUDES SOME OF THE THINGS THAT WE'VE APPROVED IN OUR BUDGET FOR THIS YEAR TO BE OUT THERE. AS FAR AS DISCUSSION GOES ON, THAT REALLY THERE IS ONLY ONE DISCUSSION THAT CAME UP CONSISTENTLY FROM THE MEMBERS IN THE AUDIENCE, AND THAT HAD TO DO WITH THE POLICE FACILITY TRAINING SITE AS IT RELATED TO THE PROPOSED GUN RANGE THAT IS OUT THERE. AND QUESTIONS REALLY WERE ABOUT THE LOCATION AND POTENTIAL NOISE THAT COULD COME FROM IT. AND, YOU KNOW, STAFF DID A REALLY GOOD JOB DISCUSSING THAT, ESPECIALLY MR. MAYOR. HE, HE DISCUSSED, YOU KNOW, THE POTENTIAL OTHER SITES IN THE CITY THAT WE COULD DO, WHICH AREN'T REALLY THAT MANY SEEM LIKE A NICE FIT OUT THERE. SOME OF THE CONCERNS ARE POTENTIALLY WITH THE PICKLEBALL PLAYERS AND MAYBE SOME OF THE KIDS PLAYING SPORTS. MOST OF THE TIME WHEN THAT FACILITY IS USED JUST FOR THAT ONE SPECIFIC. GUN RANGE IS USUALLY DURING THE DAY, AND WE REALLY DON'T HAVE MUCH ACTIVITY GOING ON OUT THERE. AS FAR AS THE SOUND GOES, IT'S LESS THAN OR EQUAL TO A PASSING CAR DRIVING BY. ACCORDING TO THE SOUND STUDY, WHICH WE ACTUALLY HAD MUCH LOUDER SIGNS AND MUCH LOUDER RESULTS FROM PICKLEBALL COURTS. AND SO, SO REALLY, I THINK THAT EASED EVERYBODY'S TENSION. IPD TO BE KNOWN AS THE PRAIRIE HOUSE NEIGHBORHOOD. THE PROPOSAL PROPOSED ZONING PERMITS 39 SINGLE FAMILY DWELLING PARKLAND AND OPEN SPACE. THE REZONING AND PRELIMINARY DEVELOPMENT PLAN ARE SCHEDULED TO BE HEARD BY CITY COUNCIL. AS YOU KNOW, ANTICIPATED FIRST READING AROUND MAY 5TH. SO OUR NEXT TWO MORE MEETINGS, WE'LL PROBABLY HAVE THAT IN FRONT OF US IN A

SECOND READING ON MAY 19TH. ONCE THE REZONING APPLICATION HAS BEEN APPROVED BY CITY COUNCIL, THE APPLICATION MUST RETURN TO THE PLANNING COMMISSION WITH A FINAL DEVELOPMENT PLAN APPLICATION. DUE TO THE INFILL PLANNED UNIT DEVELOPMENT, ZONING CLASSIFICATION. THIS ONE I'LL LET YOU KNOW WAS APPROVED. I'LL JUMP TO THE END AND LET YOU KNOW. IT WAS A FOUR. OH, BUT IT HAD 17 CONDITIONS ATTACHED TO THIS ZONING. AND SOME OF THOSE CONDITIONS I CAN KIND OF READ OFF TO YOU JUST TO GIVE YOU A PREVIEW OF WHAT PROBABLY HAVE DISCUSSIONS ON WHEN THEY COME BACK. OKAY. I HAVE IT RIGHT HERE. LET'S SEE HERE. I CAN REMEMBER IN MY HEART WASN'T TOO LONG AGO I WAS HERE. ALRIGHT, SO SOME OF THE CONDITIONS ARE LOOKING FOR. I'LL TOUCH ON SOME. THEY'D ALSO LIKE SETBACKS ON THE WESTERN BOUNDARY LINE TO BE 40FT CONSISTENT IN THE TEXT. IT KIND OF HAS A SECTION WHERE IT'S 30 FOOT AND TEN FOOT, AND THEN THERE'S ALSO A SECTION WHERE IT'S LISTED AS 40 FOOT. AND THE THE COMMITTEE THOUGHT THAT IT WOULD BE THE BOARD THOUGHT IT'D BE GOOD JUST TO KIND OF ALIGN ALL THAT AND JUST SAY 40. IT KIND OF MAKES IT MORE SIMPLE TO UNDERSTAND, BUT THAT'S ON THE WESTERN SIDE, A MINIMUM OF FIVE FEET BETWEEN ALL STRUCTURES, WHICH INCLUDES GARAGES, VARIANCES FOR POOLS AND SPAS ARE STRONGLY DISCOURAGED. AND SO SOMETHING JUST TO BE AWARE OF. THE OTHER THING THAT CAME UP SECOND WAS THE RETAINING WALL. THEY PUT THE RETAINED RETENTION WALL IN THE BACK OF THE PROPERTY, WHICH I HEARD DIFFERENT HOW HIGH IT'S GOING TO BE, BUT I COULD BE RIGHT AROUND 15FT HIGH AND THEY'LL BACK UP RIGHT TO THOSE FOLKS ON THE EAST. THEY'RE STILL PLANNING ON 2.1 HOMES PER ACRE. SO EVEN THOUGH THERE WAS THAT CHANGE FROM A ZONING OR FROM A DENSITY PERSPECTIVE, IT REMAINS THE SAME AS CURRENTLY PLANNED. AND DEFINITELY AS COMPLICATED AS IT WAS LAST NIGHT. GOT EVERYTHING IN. OKAY. ALL RIGHT. AND THAT WAS PLANNING COMMISSION MEETING. I FORGOT HOW FUN THOSE CAN BE. SO ANY IDEA WHEN THE TRAFFIC STUDY WOULD BE COMPLETED? THAT I DO NOT KNOW. OKAY. THAT WAS JUST SOMETHING. AND THERE WAS A PROPOSAL OF THE DRIVE AISLE TO THIS PRAIRIE HOUSE COMMUNITY WOULD ALIGN WITH PICKETT PLACE.

STAFF STARTED THE CODE VIOLATION PROCESS, NOTIFIED THE PROPERTY OWNER AND AND THEN OBVIOUSLY, THEY THEN WANTED TO SUBMIT A BUILDING PERMIT, BUT IT WAS DENIED. AND MAINLY THE HOCKEY RINK IS NOT CONSIDERED A STRUCTURE. IT CONTAINS A DEFINED SURFACE AND THEREFORE IS CLASSIFIED AS A RECREATIONAL AMENITY UNDER THE CITY CODE. SO STAFF ALSO CONSULTED WITH THE CITY ATTORNEY WHO INDICATED THE HOCKEY RINK IS A FUNCTIONALLY SIMILAR, FUNCTIONALLY SIMILAR TO A DECK OR PATIO AND EQUIPMENT USED FOR RECREATION ACTIVITY AND ALIGNS WITH THE GENERAL CONCEPT AND SPIRIT OF RECREATIONAL AMENITY, WHICH IS WHAT PUT US BACK INTO THIS BUCKET TO TRY TO GET IT APPROVED. AS YOU KNOW, ANY HOUSE ON A CORNER LOT, THEY ALWAYS KIND OF WHAT'S THE FRONT OF THE HOUSE, RIGHT? AND IT'S ALWAYS THE SHORTEST DISTANCE TO THE CLOSEST ROAD, WHICH IS CEDARBROOK FOR THEM.
