THIS SLIDE HERE SHOWS THE PROPERTY OUTLINED IN RED. AGAIN, THIS IS WITHIN THE NEW ALBANY LAKE SUBDIVISION. THIS IS CENTRAL COLLEGE ROAD DOWN HERE AT THE BOTTOM OF YOUR SCREEN. THIS IS DEAN FARM ROAD GOING NORTH. AND GRAY LOOP COMES OFF OF DEAN FARM ROAD HERE AGAIN, THAT PROPERTY IS OUTLINED IN RED. SO ON THIS SCREEN HERE WE HAVE THE EASEMENT AREA SHOWN AGAIN THE PROPERTY BEING OUTLINED IN RED.AND THEN THE EASEMENT AREA BEING SHADED IN THIS RED COLOR HERE IT'S ALONG THE REAR PROPERTY LINE. THE APPLICANT IS REQUESTING A VARIANCE TO ALLOW PAVER PATIO TO ENCOURAGE APPROXIMATELY THREE FEET INTO THAT EASEMENT AREA. I THINK THAT ONE OF OUR PLANNERS DID A GREAT JOB EXPLAINING KIND OF THE HISTORY OF THE ACTION. THE BOARD HAS TAKEN ON SIMILAR VARIANCE REQUESTS IN THE NEW ALBANY SUBDIVISION. YOU KNOW, WE ALWAYS LOOK AT THESE THINGS, YOU KNOW, INTENTLY TO MAKE SURE THAT THERE'S NO IMPACTS TO PUBLIC UTILITIES OR ANY DRAINAGE WITHIN THE NEIGHBORHOOD. WE DIDN'T FIND ANY OF THOSE CONDITIONS PRESENT HERE WITH THIS VARIANCE REQUESTA CONDITION THAT IF THE BOARD WERE TO APPROVE THE VARIANCE THAT THE PROPERTY OWNER ENTERED INTO A HOLD HARMLESS AGREEMENT WITH THE CITY. THE HOLD HARMLESS AGREEMENT IS RECORDED WITH THE COUNTY AND WILL FOLLOW PROPERTIES DEED THROUGH FUTURE SALES. AND THAT AGREEMENT JUST STATES THAT IF A UTILITY PROVIDER OR THE CITY HAD TO COME IN AND DO WORK ON THAT EASEMENT THAT, YOU KNOW, THE THE PROPERTY OWNER WOULD BE RESPONSIBLE FOR ANY DAMAGES THAT ARE DONE TO THOSE IMPROVEMENTS WITHIN THE EASEMENT AREA. AND THEN JUST TO GIVE YOU A LITTLE BIT OF AN IDEA OF WHAT'S INSIDE THAT EASEMENT. SO WE HAVE A SANITARY SEWER THAT'S RUNNING ALONG THAT EASEMENT AREA BACK HERE THAT'S SHOWN IN RED. THERE'S ABOUT 9 TO 10FT OF DISTANCE BETWEEN THE THE PAVER PATIO AND WHERE THAT LINE IS LOCATED WITHIN THE EASEMENT. SO THERE IS SOME SEPARATION. THIS IS HARD TO TELL HERE ON THE SCREEN.
