WELL, BILL, THANK YOU FOR INTRODUCING YOURSELF AND TAKING TIME TO TRAVEL AROUND, HOPEFULLY YOU'RE GETTING A WARM RECEPTION OF THE SPOTS YOU'RE VISITING AND APPRECIATE THE EFFORT. LOOK FORWARD TO CELEBRATING, THE 250TH ANNIVERSARY OF THIS COUNTRY WITH ALL OF YOU. AND A YEAR OR SO RIGHT. ALL RIGHT, ALSO UNDER HEARING OF VISITORS, WE HAVE AN UPDATE FROM OUR FRIENDS AT HEALTHY NEW ALBANY, MISS MCLENNAN. THANK YOU. MAYOR SPALDING. MEMBERS OF COUNCIL, I'M PATTY MCLENNAN. I AM WEARING SEVERAL DIFFERENT HATS HERE. THIS EVENING. SO, AS A BOARD MEMBER OF HEALTHY NEW ALBANY, I WAS HERE IN DECEMBER, AND HAVE COME WITH AN UPDATE, SO I WANTED TO SHARE A COUPLE OF SLIDES.

WHEN LAST I WAS HERE, I HAD SHARED THAT, AS A BOARD, WE WERE WORKING WITH OUR GROUP TO REALLY FOCUS ON NARROWING DOWN THE SCOPE OF HEALTHY NEW ALBANY SO THAT WE COULD BE A STRONGER ORGANIZATION. I DON'T EXPECT YOU TO READ THIS, BUT WE HAVE GONE THROUGH AN EXERCISE WHERE WE FOCUS ON FOUR LANES. NATURE NOURISH KNOWLEDGE AND MOVEMENT, AND REALLY PROVIDING SERVICES FOR THE COMMUNITY WITH THE IDEA THAT WE ARE SUPPORTING THIS, HEALTH IN THE COMMUNITY, THAT ANYTHING YOU DO, WE HAVE A CULTURE OF HEALTH HERE IN NEW ALBANY. AND SO WHAT THAT LOOKS LIKE, I'LL WALK YOU THROUGH A LITTLE BIT. SO OUR NATURE PROGRAMS, WE PROVIDE PROGRAMS. A LOT OF THEM ARE FOR CHILDREN, WE HAVE ALSO DONE GUEST PROGRAMING, SUCH AS WALK WITH A DOC AND

[00:05:05]

OTHER PROGRAMS. BUT THESE ARE REALLY FOCUSED ON UNDERSTANDING AND APPRECIATING THAT, NATURE IS PART OF WHAT BRINGS HEALTH TO PEOPLE. AND WORKING WITH THE CITY. AND VERY MUCH YOU'LL SEE THAT THAT HITS WITH NATURE AND NOURISH WITH TAYLOR FARM PARK. I WAS JUST THERE LAST EVENING.

IT'S LOVELY AND WE'VE DONE SOME PROGRAMING THERE AND RIGHT HERE IN ROSE RUN. AND SO, WE HAVE DONE A SERVICED OVER 300 RESIDENTS OF THE COMMUNITY, REALLY, WE EVEN DID SOME WINTER ONES, BUT THAT'S LARGELY BEEN THIS SUMMER, OUR COMMUNITY GARDEN, WE HAVE 45 PURCHASED PLOTS, WHICH ARE THE ONES RIGHT HERE. AND THEN WE HAVE, 86 PLOTS. I THINK SOME OF THEM ARE GOING TO, GOING TO BE COMBINED THAT NEXT SUMMER, WILL BE PURCHASED PLOTS THIS SUMMER. OUR DEMONSTRATION PLOTS AT TAYLOR FARM AND, TWO TOWER GARDENS THAT WE WORK WITH, THE SCHOOL. SO THAT'S LIKE GROWING THINGS ON THOSE INDOOR HYDROPONIC PIECES WITH OVER 100 PARTICIPATING GARDENERS AND, 100 PARTICIPATING STUDENTS AND ALL OF THE STUDENT WORK AND MANY OF THE DEMONSTRATION WORK, THE THOSE THE PRODUCE THERE GOES TO THE, FOOD PANTRY. SO AGAIN, THE SYNERGIES THERE THAT WE'VE BEEN ABLE TO DO AND WHAT WE'VE DONE ON THE NATURE PIECE IS REALLY DO MORE FOCUSED PROGRAMING AND HAVE LEANED OUT, ELIMINATING PROGRAMS THAT DIDN'T HAVE FULL PARTICIPATION, I MENTIONED THE FOOD PANTRY, THE FOOD PANTRY HELPED OVER 1300, INDIVIDUALS.

THIS IS 2023 NUMBER. SO WE ARE STILL OBVIOUSLY IN THE MIDDLE OF THE YEAR THIS YEAR, THE FOOD PANTRY IS WORKING VERY HARD WITH THE SCHOOLS, WE ARE CURRENTLY LOCATED IN THE OLDEST BUILDING THAT THE SCHOOL WILL BE TAKING DOWN. SO WE NEED TO BE OUT BY THE END OF THE SCHOOL YEAR. AND SO WE HAVE A COUPLE OF LEADS THAT WE'RE WORKING ON AND VERY FOCUSED ON MAKING SURE THAT WE CAN CONTINUE TO SUPPORT OVER 600 STUDENTS IN COMMUNITY IN THE NEW ALBANY, SCHOOLS WHO ARE REFERRED TO US. MANY OF THEM ARE ENGLISH LANGUAGE LEARNERS. SO WE DO SOME WRAPAROUND AND SUPPORT SERVICES FOR THEM. SO, WORKING ON THAT. AND THEN WE ALSO SUPPORT THE DISTRIBUTION LIKE THE MEALS ON WHEELS, IF YOU WILL, TO MANY IN PLAIN TOWNSHIP. AND SO THAT IS A GROWING PROGRAM, HERE. AND AS THE COMMUNITY GROWS, THE MINDSET AROUND THE FOOD PANTRY USED TO BE, YOU KNOW, COME AT THE END OF THE MONTH AND GET YOUR PEANUT BUTTER AND NOW IT IS LET'S OFFER FRESH FRUIT AND VEGETABLES AND FOODS THAT FAMILIES CAN STOP IN BEFORE THEY GO TO THE GROCERY SO THAT THEY CAN TAKE THEIR BUDGET AND EXTEND IT BY GETTING SOME OF THOSE THINGS THAT HAVE BECOME VERY EXPENSIVE EGGS, MILK, CHEESE, AND THEY CAN GET THOSE FOR FREE, AND THEN THEY CAN USE THE, THE REST OF THEIR MONEY FOR THE OTHER VERY EXPENSIVE GROCERIES. SO, THAT'S BEEN AN IMPORTANT PIECE OF GROWING THE FOOD PANTRY, MANY OF YOU ARE FAMILIAR WITH THE FARMER'S MARKET. THERE IS ONE ON THURSDAY THIS WEEK. WE HAVE BEEN BLESSED WITH FAIRLY DECENT WEATHER FOR THIS YEAR'S FARMER'S MARKET.

LAST WEEK IT RAINED AT THE END OF THE WEEK, THIS YEAR WE ARE SCHEDULED TO HAVE 27 MARKETS, SO THAT'S EVERY WEEK IN THE SUMMER AND THEN MONTHLY IN THE WINTER. WE HAVE OVER 80 VENDORS AND WE HAVE IN THE SUMMER IN PARTICULAR, WE HAVE OVER A THOUSAND WEEKLY, SHOPPERS. SO, IT CONTINUES TO BE OUR MOST POPULAR EVENT. AND, WE'RE VERY HAPPY THAT WE'VE EXPANDED OVER TOWARDS ROSE RUN AND THE REIGNS BRIDGE. THIS YEAR. AND THAT HAS GONE VERY, VERY WELL. SO, EVERYBODY LOVES THE MARKET AND WE'RE PROUD TO BE THE SPONSORS OF THE MARKET, WE DO DO RACES AND EVENTS, THEY BRING PEOPLE TOGETHER AND CREATE THAT MOVEMENT IDEA, BUT THEY ARE ALSO FUNDRAISERS FOR US. SO, WE'VE HAD, IN THE LAST 18 MONTHS, OVER 2300 PARTICIPANTS IN OUR THREE RACES. THE WALKING CLASSIC BEING OUR SIGNATURE RACE. BUT WE ALSO, HAVE DONE THE WINTER WONDER AND THE CHILLY CHILI MILE, OH, WELL, I HAVE SOMETHING ON THE THIS YEAR'S WALK AT THE END, BUT, IT CONTINUES TO BE A POPULAR WAY FOR PEOPLE TO RECOGNIZE AND PARTICIPATE. WITH THE MOVEMENT IDEA HERE IN NEW ALBANY AND THEN IN TERMS OF CLASSES AND COMMUNITY, THIS IS THE KNOWLEDGE PIECE, ALSO SOME MOVEMENTS. SO WE HAVE DONE TEN COMMUNITY HEALTH TALKS. THOSE ARE OFTEN LUNCH AND LEARNS. SEVEN OF THOSE ARE NOT. THOSE ARE INDIVIDUAL NUMBERS PLUS SEVEN LUNCH AND LEARNS, OVERALL 85 PROGRAMS. LOTS OF COOKING PROGRAMS ARE QUITE POPULAR, WITH OVER ALMOST 900 REGISTRANTS IN THIS CALENDAR YEAR OF PEOPLE PARTICIPATING IN THOSE CLASSES. AND SO, YES, DOES THAT INCLUDE THE SENIOR CONNECTIONS PROGRAM THAT DOES NOT INCLUDE SENIOR CONNECTIONS.

SO, THE CITY RUNS THAT NOW. SO, THESE ARE REGISTRANTS IN COOKING CLASS OR GIRLS WHO LIFT OR, DIFFERENT. WE'VE DONE SELF-DEFENSE CLASSES. WE DO CANCER SURVIVORSHIP. LOTS OF

[00:10:04]

DIFFERENT HEALTH FOCUSED, WORK. WE ALSO HAVE ADDED THIS YEAR A PROGRAM CALLED WELLNESS WORKS, WHICH IS WORKING WITH BUSINESSES IN THE PARK IN THE THROUGHOUT REALLY THE GROWTH IT USED TO BE CALLED THE BUSINESS PARK. BUT NOW IT'S ALL OF NEW ALBANY. RIGHT. SO, SO WE'VE, WE REALLY HELPED WORKING WITH, WE HAVE 12 BUSINESSES WHO ARE REGULAR SUBSCRIBERS. SO WE DO A MONTHLY, USUALLY DAY OF BREAKS. AND HEY, LET'S TALK FOCUS ON MINDFULNESS AND MEDITATION OR HERE'S SOME WAYS TO EAT HEALTHILY. OR DID YOU KNOW THAT IF YOU GET THIS MANY STEPS, LOTS OF EDUCATION AND SUPPORT, PARTICULARLY, WE STARTED WITH ACXIOM AND THEY HAVE LIKE 17 LANGUAGES THAT THEY SERVICE IN THEIR WAREHOUSES. AND SO, HELPING THEIR FAMILIES CONNECT TO BOTH THE FOOD PANTRY AND UNDERSTANDING THE IMPLICATIONS OF THEIR HEALTH HELPS ACCESS THEM FROM A HR PERSPECTIVE. BUT THEN REALLY HELPS THINKING THROUGH THE BUSINESSES AND HOW THEY CAN GET SUPPORT OF WELLNESS PROGRAMING INSIDE THEIR COMPANIES, SO THAT'S A GROWING PROGRAM FOR US, AND THE OTHER THING THAT I THINK IS REALLY CONTRIBUTING TO THE COMMUNITY IS THE 936 TOTAL VOLUNTEERS, ALL OF THOSE ARE NEW ALBANY, NEW ALBANIANS, EITHER BECAUSE THEY WORK OR LIVE IN NEW ALBANY OR GO TO SCHOOL, BUT SAME THING, SO THAT'S OVER 9000 HOURS OF VOLUNTEERING. MANY HALF OF THOSE ARE IN THE FOOD PANTRY. SO THAT'S AN IMPORTANT THING THAT WE DO, WE HAVE BEEN ABLE TO DO THIS BECAUSE OF THE GENEROSITY THAT YOU, THE CITY COUNCIL, PROVIDED IN GIVING US OUR RENT HOLIDAY, WE ARE VERY EXCITED THAT THIS YEAR, ON SEPTEMBER 15TH IS THE 20TH ANNIVERSARY OF THE WALKING CLASSIC, I REMEMBER WE WERE ACTUALLY MY HUSBAND AND I ARE COMING ON OUR 20TH ANNIVERSARY OF BEING HOMEOWNERS IN NEW ALBANY. AND WE WERE LOOKING AT HOUSES AND ALL THE ROADS WERE CLOSED BECAUSE THERE WAS THIS THING CALLED THE WALKING CLASSIC. AND SO, IT'S REALLY GROWN SINCE THEN, BUT I WOULD BE REMISS IF I DIDN'T TELL YOU THERE ARE STILL SOME HEADWINDS. WE FEEL VERY SOLID ABOUT THE NEW STRATEGIC PLAN, WHERE WE'RE GOING, BUT, IT IS, WALK REGISTRATIONS ARE BELOW WHAT WE HAD HOPED. AND WE'RE STILL GOING TO GIVE A BIG PUSH UNTIL SEPTEMBER. BUT I THINK I SHARED IN DECEMBER THAT, PEOPLE ARE CHOOSING DIFFERENT ACTIVITIES INSTEAD OF PAYING FOR A WALK. SO AS A FUNDRAISER, WE'RE RETHINKING HOW THAT WILL WORK INTO THE FUTURE, WE WILL WE'LL GET THERE IN TERMS OF THIS YEAR'S ACTIVITIES, BUT IT'S JUST TAKEN A HEAVIER LIFT TO DO THAT, THE OTHER HAND, WIND THAT WE'RE FACING IS THAT THE PANTRY HAS TO MOVE SOONER THAN WE THOUGHT. AND SO WE'RE GREAT PARTNERS WITH THE SCHOOL. THEY'VE BEEN VERY, VERY SUPPORTIVE. BUT WE'LL PROBABLY HAVE AN INTERIM MOVE BEFORE WE CAN DO THE FUNDRAISING WE'D LIKE TO DO FOR A PERMANENT HOME, SO THAT IS SOMETHING THAT WE ARE FACING. AND THEN OF COURSE, WE, OUR EXECUTIVE DIRECTOR LEFT. WE HAVE BEEN WORKING WITH TWO EXPERTS IN NONPROFITS. THEY ARE SERVING AS CO-INTERIM DIRECTORS, AND WE HAVE JUST AGREED TO WORK WITH BROADVIEW, WHICH IS A SEARCH FIRM. MANY OF YOU KNOW CHRISTIE ANGEL, SHE'LL BE HELPING US ON OUR EXECUTIVE DIRECTOR SEARCH. SO WE HOPE TO HAVE SOMEONE NAMED BY THE END OF THE YEAR. SO, AND WE'RE EXCITED AGAIN. I MENTIONED OUR WORK TOGETHER WITH THE CITY ON TAYLOR FARM, SO THAT'S WHERE WE STAND.

I LOVE TO HEAR ANY QUESTIONS. WELL, PATTY, THANK YOU SO MUCH FOR THIS PRESENTATION. I'D LOVE TO SEE IT. AND ONE QUICK QUESTION FOR ANYONE THAT'S INTERESTED IN THAT WONDERFUL COMMUNITY GARDEN OUT AT TAYLOR FARM, WHICH LOOKS AMAZING. WHEN WILL THEY BE ABLE TO RENT SPACE OR A PLOT? WHEN WILL THAT BE AVAILABLE FOR NEXT YEAR? YOU KNOW, USUALLY I DON'T KNOW. OFF THE TOP OF MY HEAD, I KNOW THAT IT WON'T BE UNTIL AFTER THE NEW YEAR. SO, SO IT'S NEXT YEAR, LIKE FEBRUARY, WE OFFER FIRST TO PEOPLE WHO WILL HAVE CURRENT PLOTS SO THEY CAN RE SIGN UP AT THE END OF THE SEASON. AND THEN I THINK WE OPEN IT AFTER THAT. THAT'S HOW WE'VE DONE HISTORICALLY, BECAUSE WE HAD A SET NUMBER OF PLOTS. NOW THAT WE WILL HAVE MORE, I THINK WE WILL BE OPENING IT IN THE JANUARY TIME FRAME, BUT OKAY, I CAN GET THE INFORMATION TO JENNIFER AND THEY CAN POST IT ON ALL OF YOUR. OKAY GREAT. THANKS. I HAD A QUESTION MORE FOR YOU, JOE, IN REGARDS TO THE PLOTS THAT ARE HERE, ARE WE STILL GOING TO OPERATE THOSE UNTIL CHANGES OCCUR? ANY FUTURE CHANGES MAY OCCUR TO WHAT WE'RE DOING. WITH THE PARKING AREA BACK HERE, OR IS EVERYTHING MOVING OVER TO TAYLOR FARM? I THINK THE ASSUMPTION WAS EVERYTHING WAS GOING TO MOVE TO TAYLOR. OKAY. YEAH. IT'S, IT'S VERY NICE THAT NOW THE PATHS ARE ALL THE WAY OUT TO TAYLOR. SO, WE HAVE GARDENERS WHO ARE RIDING THEIR BIKES OUT TO THE PARK, SO THE PATHS ARE MUCH APPRECIATED. WELL, THANK YOU AGAIN FOR THE PRESENTATION. IS THERE ANYTHING WE COULD BE DOING TO HELP HEALTHY NEW ALBANY MORE THAN WE ARE TODAY, OR ANY SUGGESTIONS OR WALK FOR THE WALK? GOT IT, SO IT IS. IT'S A 20TH ANNIVERSARY, AND SO WE'RE EXCITED TO BE

[00:15:08]

CELEBRATING 20 YEARS OF, A MINDSET THAT IS ABOUT CREATING COMMUNITY AND CREATING CONNECTIONS THROUGH HEALTH IN THE COMMUNITY. AND I'LL HAVE MORE ON THAT TOPIC LATER. ALL RIGHT. WELL, GREAT TO SEE YOU AND THANKS FOR THE. WE SHOULD LOOK AT SIGNING UP AS A GROUP.

THAT MIGHT BE BETTER. SIGN UP FOR THE WALK. YEAH, YEAH I KNOW CHIP ALREADY SIGNED UP. HE'S LIKE EARLY BIRD. I SAW THE GUNS OUT. I WASN'T SURE IF I, BUT WE NEED TO DO SOMETHING WITH THE WALK. THANKS FOR EVERYTHING. IT'S A LOT OF GOOD INFORMATION. THANK YOU, ALL RIGHT, WE'RE STILL UNDER HEARING OF VISITORS. IS THERE ANYONE ELSE FROM THE PUBLIC THAT WOULD LIKE TO ADDRESS COUNCIL REGARDING A MATTER? NOT ON TONIGHT'S AGENDA? BEFORE WE MOVE INTO THE BOARD AND COMMISSION REPORTS, I JUST WANT TO RECOGNIZE, OUR GOOD FRIEND ABE JACOBS, AND HE HAS A YOUNG ASSOCIATE WITH HIM THIS EVENING WHO'S SHADOWING HIM THROUGH THE SUMMER, HOPEFULLY LEARNING A THING OR TWO ABOUT, GOVERNMENT RELATIONS. APPRECIATE, BLAKE JOINING US THIS EVENING. HOPE TO SEE YOU IN THE POOL SOON AT WATER POLO. MAYBE, BUT, AGAIN, HOPE YOU'RE HAVING A GOOD EXPERIENCE. AND IF YOU GOT ANY QUESTIONS ABOUT LOCAL GOVERNMENT, YOU KNOW, WE'D

[7. BOARD/COMMISSION REPORTS]

REPRESENT YOU. SO GIVE US A CALL. WE CAN HAPPILY ANSWER ANY OF THOSE QUESTIONS YOU MAY HAVE.

ALL RIGHT. BOARD AND COMMISSION REPORTS, PLANNING COMMISSION. I KNOW MISS WILTROUT IS NOT HERE.

STAFF HAVE ANY UPDATE OR WAS THERE A MEETING? THERE WAS A MEETING. I CAN SHE ASKED ME IF I COULD SHARE THE UPDATE FOR PLANNING COMMISSION. SO THANK YOU. YOU GUYS CAN CERTAINLY PROVIDE AN ASSIST WHEN NEEDED. BUT, YES, PLANNING COMMISSION DID HOLD THEIR MEETING LAST NIGHT, ANDRE, BECAUSE OF HER ILLNESS, ASKED THAT I STEPPED IN. SO I KNOW I HAVE NOTES HERE.

JUST LET ME FIND THEM. ALL RIGHT, SO THERE WERE THREE ITEMS ON THE AGENDA FOR PLANNING COMMISSION. FIRST WAS, GARDEN PARKWAY, WEST DEDICATION, THAT WAS QUICKLY REVIEWED AND APPROVED UNANIMOUSLY BY THE PLANNING COMMISSION, THE SECOND THING WE REVIEWED, REVIEWED LAST NIGHT WAS THE CITY CODE AMENDMENT REGARDING PROHIBITING COMMERCIAL CULTIVATION, PROCESSING, AND DISPENSING OF RECREATIONAL MARIJUANA. THE PLANNING COMMISSION REVIEWED THAT, THERE WAS SOME DISCUSSION AND THEY DID APPROVE A REVIEWED AND PASSED BY A 4 TO 1 VOTE, AND THIRDLY, THE MOST IMPORTANTLY WAS THE HAMLET INFORMAL REVIEW. SO THIS WILL BE THE FIRST REVIEW OF THE HAMLET TO THE PLANNING COMMISSION LAST NIGHT, SO INFORMAL. THANK YOU. SO, STEINER COMPANY WAS THERE LAST NIGHT TO DO THE INFORMAL REVIEW, THERE WERE SEVERAL THINGS. DISCUSSED AND PRESENTED FIRST. THE WHICH I DID NOT KNOW. THEY HIRED KEITH MYERS FOR THE LANDSCAPE DESIGN OF THE PROJECT. SECONDLY, IN THE PLAN THEY PRESENTED 195 UNITS, WHICH WE HAD EXPECTED, INCLUDING SINGLE FAMILY HOMES, TOWNHOMES AND 40 LUXURY APARTMENTS THAT WILL BE PART OF THE DEVELOPMENT.

SINGLE FAMILY HOMES WILL RANGE FROM $800,000 TO $1 MILLION, THE TOWNHOMES, ACCORDING TO STEINER, LAST NIGHT WILL BE AROUND 700,000 STARTING POINT. AND THE 40 APARTMENTS, THEY'RE CALLING LUXURY APARTMENTS, IF THEY MAINTAIN THEM AS LUXURY APARTMENTS OR CONDOS. STILL YET TO BE DETERMINED, I BELIEVE, BUT RIGHT NOW, FOR LUXURY APARTMENTS, THE MONTHLY RATE, THE MONTHLY, LEASE WILL BE 4000 BUCKS A MONTH, THEREABOUTS. FOR THOSE APARTMENTS. OTHER THINGS, DISCUSSED AND PRESENTED BY STEINER LAST NIGHT WAS, ONE ALTERNATIVE STORMWATER STRATEGIES THAT THEY HAVE FOR THE SITE WOULD INCLUDE PERMEABLE PAVERS, UNDERGROUND WATER RETENTION, AND VEGETATION RETENTION. SO THIS WILL BE A UNIQUE WAY TO MANAGE WATER AND ALLOW FOR, TO MANAGE THE NATURAL ENVIRONMENT IN A MORE SUSTAINABLE WAY, THEY'VE ALSO MORE IMPORTANTLY, HAVE REQUESTED TO THE PLANNING COMMISSION FIVE WAIVERS TO THE ORIGINAL ZONING THAT WE'VE, THAT WE APPROVED. AND THOSE FIVE WAIVERS WOULD INCLUDE, SOME INTERNAL FOR SOME INTERNAL SIDEWALKS WITHIN THE SITE PLAN. THEY, YOU KNOW, OUR STANDARD IS FIVE FEET, THEY WOULD LIKE TO HAVE SOME SIDEWALKS THAT ARE ADJACENT TO SOME OF THE TOWNHOMES TO BE I THINK IT'S 3FT OR 4FT, FOUR FEET. AND THE REASON FOR THAT IS TO KEEP WITH THE, THE FEEL OF THE COMMUNITY. SO IT'S MORE INTIMATE IF YOU HAVE A SIDEWALK THAT IS NOT AS WIDE, THAT'S ADJACENT TO, SAY, A TOWNHOME OR A RESIDENCE. SO IT GIVES IT A MORE INTIMATE FEEL AS YOU'RE

[00:20:01]

WALKING ON THE SIDEWALK. HOWEVER SIDEWALKS WILL BE ON BOTH SIDES OF THE STREET. SO THOSE AREAS WHERE THERE IS NOT, RESIDENTS OR TOWNHOMES, THE SIDEWALKS ON THE OPPOSITE SIDE OF THE STREET WILL BE THE STANDARD FIVE FEET. AND THEN ALSO THE MAIN THOROUGHFARES ON 605 AND, CENTRAL COLLEGE WILL HAVE STANDARD LEISURE TRAILS ON BOTH SIDES, AS I RECALL. SO THAT'S THE FIRST WAY WE'RE TO REDUCE THE SIDEWALKS AND AREAS WHERE THERE ARE RESIDENTS FROM 5FT TO 4FT TO PROVIDE A MORE INTIMATE, MORE INTIMATE ENVIRONMENT, KIND OF LIKE A MORE OF A HAMLET FEEL, I THINK, AS THEY DESCRIBED IT, THE SECOND WAIVER, THAT, THEY WERE ASKING FOR LAST NIGHT WAS TO INCLUDE TWO SINGLE FAMILY HOMES FRONTING 605, AND I BELIEVE THE OUR, OUR ZONING HAD FOR EVERYTHING FACING 605 TO BE TOWNHOMES AND NO SINGLE FAMILY HOMES. BUT THEY'RE ASKING AS PART OF THE GATEWAY ENTRANCE, TO HAVE TWO SINGLE FAMILY HOMES. AT THE GATEWAY, KIND OF TO MAKE IT MORE OF A, MORE OF A GATEWAY INTO THE COMMUNITY INSTEAD OF HAVING TOWNHOMES. SO EVERYTHING ELSE FACING 605 WILL BE TOWNHOMES. BUT FOR THE ENTRANCE, THEY WOULD LIKE JUST TWO SINGLE FAMILY HOMES, IT'S HARD TO ENVISION, BUT IT ALLOWS THEM FOR A MORE GRAND ENTRANCE, BY THE WAY, THEY HAVE DESIGNED IT. SO COMING OFF 605, WHEN YOU ENTER, THERE WILL BE TWO SINGLE FAMILY HOMES, AND THEN BESIDE THEM WE'LL START THE ROWS OF THE TOWNHOMES. SO JUST BUTLER, THERE'S A HOUSE ON EACH SIDE OF THE ROAD, EACH SIDE. SO IF YOU HAVE THE IF YOU'RE COMING IN THE ENTRANCE, COMING SOUTH ON 605. YEAH. AND YOU'RE ENTERING IN THERE WILL BE ENTRANCE ON THE EAST SIDE OF 605. YEAH. OKAY.

I'LL BE AS YOU COME INTO THE ENTRANCE INSTEAD OF HAVING ROWS OF TOWNHOMES AS YOU ENTER, THERE'LL BE TWO SINGLE FAMILY HOMES. THERE'LL BE A AS I SAW IT, THERE WILL BE A, AN ISLAND IN THE MIDDLE THAT WILL HAVE A GAZEBO OR SOME KIND OF STRUCTURE TO PROVIDE A MORE, STATIC ENTRANCE. RIGHT MORE GRAND ENTRANCE INTO, INTO THE COMMUNITY. GOT IT. AND THEN THE REST OF THE HOME. IT'S HARD TO EXPLAIN. YOU HAVE TO SEE IT. AND THE REST OF THE HOMES FACING 605 WILL BE TOWNHOMES. AS PRESENTED, THROUGH THE ZONING APPLICATION. ANY QUESTIONS ON THAT, AND FOR THE MOST PART, IT APPEARED THAT THE PLANNING COMMISSION WAS OPEN TO IT. IF YOU SAW THE PLAN, IT MADE PERFECT SENSE AND IT WILL ADD TO THE COMMUNITY IN TERMS OF ESTHETICS, AS FOR THE MAIN ENTRANCE POINT IN THE THIRD WAIVER THAT YOU'RE ASKING FOR, AGAIN, ANOTHER ONE. HARD TO EXPLAIN, BUT THEY WANT TO CHANGE THE MAXIMUM BUILDING HEIGHT IN SUBAREA TWO, WHICH IS WHERE MOST OF THE TOWNHOMES WILL BE LOCATED. THEY WANT TO CHANGE THAT TO 44FT INSTEAD OF 38FT.

WELL 40FT TO 44, 40 AND 50 ARE WHAT THEY COULD DO, WHAT THEY COULD DO. BUT THEY WANT TO CHANGE THE FRONTAGE, WHICH I THINK THEY SAID WAS 38FT. IF YOU'RE VIEWING IT FROM THE STREET, RIGHT, IT WILL BE 38FT. BUT THE WAY TO LOOK AT THIS IS, RICHMOND SQUARE. SO IF YOU LOOK AT RICHMOND SQUARE FROM THE FRONT, RIGHT, SO YOU HAVE THE FRONT ELEVATION, WHATEVER FOOTAGE THAT IS MAYBE 38FT, BUT IF YOU PULL AROUND TO THE BACK, THERE'S A GARAGE THAT'S BELOW GRADE. SO FROM THE GARAGE LEVEL UP, THAT'S 44FT. SO WHAT YOU SEE FROM THE STREET IS GOING TO BE 38FT, ALL ALONG THE STREET. BUT BEHIND IT, BECAUSE OF THE GRADE CHANGE, BECAUSE YOU'RE GOING TO BE ENTERING THE GARAGE BELOW GRADE. THAT WILL BE A 44FT HEIGHT. SO THAT HOPEFULLY EXPLAIN THAT SO YOU UNDERSTAND IT. BUT THAT ALSO SEEMED TO BE ACCEPTABLE TO PLANNING COMMISSION AS WELL. THEY'RE NOT MAKING ANY FORMAL, YOU KNOW, FORMAL DECISIONS. BUT, FROM THE QUESTIONS, THEY SEEM TO THINK THAT WOULD BE ACCEPTABLE TO BE DETERMINED. AND THE FOURTH, WAIVER THAT THEY'RE ASKING FOR IS A REQUIREMENT FOR ENTRIES INTO THE HOME. SO THE STEPS GOING INTO THE HOMES, THE ZONING FOR NEW ALBANY IS THAT IT HAS TO BE AT LEAST TWO FEET, THEY'RE REQUESTING AT LEAST TWO RISERS OR TWO STEPS INTO THE HOME, WHICH MOST CASES WILL BE LOW, WILL BE BELOW TWO FEET, AND AGAIN, THIS IS MORE FOR ESTHETICS. YOU KNOW, THEY WERE SHOWING PICTURES OF OTHER LIKE, HAMLETS AND DIFFERENT AREAS OF, IN ENGLAND OR WHERE ELSE, WHERE THERE'S MORE OF A TRADITIONAL HAMLET FEEL THAT THERE'S ONLY YOU DON'T HAVE THESE LARGE, RISERS GOING INTO A HOME. YOU HAVE MORE OF A TWO STEP RISER, GIVES IT A MORE INTIMATE HAMLET

[00:25:04]

FEEL. AND AGAIN, THAT THAT DID NOT SEEM TO BE AN ISSUE SO FAR WITH THE PLANNING COMMISSION AS IT WAS PRESENTED. I THINK THEY ALSO WAS THAT ALSO THE SITUATION WHERE BY KEEPING IT A LITTLE BIT LOWER, THEY CAN HAVE THE NINE FOOT CEILING. WAS IT FOR THAT ONE AS WELL THAT ALLOWS THEM TO HAVE A NINE FOOT CEILING, WHICH IS ALSO A BETTER FEATURE FOR THE UNITS. AND THE POINT POINT WAS ALSO MADE THAT FOR MANY OF THE FOR OUR 55 AND OLDER COMMUNITIE, WE'VE ALREADY APPROVED SUCH VARIANCES TO HOW TO HAVE LESS THAN TWO FEET AS AN ENTRANCE POINT. AND I WANT TO MENTION BEFORE I FORGET, THE CHRISTOPHER VERY GOOD JOB IN PRESENTING THIS TO THE PLANNING COMMISSION. HE ALSO PLANTED IT PLANT, PRESENTED IT TO PARKS AND TRAILS ADVISORY BOARD, WHICH WAS BEFORE PLANNING COMMISSION. I'LL BE SPEAKING TO NEXT AND DID AN EXCELLENT JOB THERE AS WELL. SO SHOUT OUT TO CHRISTOPHER FOR DOING SUCH A REALLY GOOD JOB, PRESENTING THIS TO BOTH BOARDS. SO THE FIFTH, THE FIFTH WAIVER, THEY WANT TO HAVE, THIS IS ANOTHER ONE THAT CAUSED SOME, DISCUSSION. THEY WANT TO HAVE A WAIVER SO THAT THE COMMERCIAL OFFICE TENANTS CAN GO OVER 10,000FTā– !S. SO THE WAY THAT STEINER WAS PRESENTING THAT THERE MAY BE SOME CASES WHERE YOU HAVE A COMMERCIAL OFFICE TENANT THAT MAY NEED 12,000FTā– !S, SO YOU CAN IMAGINE THERE'S 10,000FT ON THE TOP FLOOR OF THE BUILDING. AND MAYBE PART OF THE, BOTTOM FLOOR WHERE THERE'S RETAIL SPACE. THEY MAY WANT TO USE THAT ALSO AS COMMERCIAL SPACE. SO THEY'RE ASKING FOR A WAIVER TO GO OVER THAT 10,000 SQUARE FOOT LIMIT FOR COMMERCIAL OFFICE SPACE. DID I DESCRIBE THAT CORRECTLY. YEAH. THAT'S ACCURATE. YEAH. SO DID THEY WAS THERE A MAXIMUM IN THAT WAIVER OR WAS IT JUST A MAXIMUM 10,000 AS I UNDERSTAND IT, 10,000FTā– !S PER BUILDING FOR. SI THINK IT'S JUST A BLANKET REQUIREMENT. YEAH. YEAH. SO THAT THAT WAS 10,000FTā– !S. SO THEY'RE ASKING IF THEY COULD GO BEYOND THAT IN THE CASE THAT THEY MAY HAVE A TENANT THAT NEEDS JUST MORE THAN 10,000FTā– !S. RIGHT. I GUESS I WAS ASKING MUCH BEYOND IN GENERAL. OR IS IT BEYOND, BUT ONLY UP TO. SO IT SOUNDS LIKE IT WAS JUST BEYOND IN GENERAL. IN GENERAL. YEAH. YEAH YEAH. SO I THINK STAFF'S POSITION IS THAT, MORE OFFICE SPACE, IF THEY HAVE A USER IS GOING TO TAKE UP SPACE IS A DIFFERENT INCOME GENERATOR, WHICH IS POSITIVE FOR THE COMMUNITY. RIGHT. I JUST DON'T WANT TO LOSE THE RETAIL, WHICH IS A BIG DRAW OF THIS WHOLE THING. I, YOU KNOW, IF IT ALL BECOMES OFFICE, I THINK IT'S NOT WHAT WE ENVISIONED IT BEING. SO THAT'S THE SAME THING THAT WAS BEING DISCUSSED LAST NIGHT. JUST AS YOU HAD DESCRIBED IT. SO THERE'S GOING TO BE FURTHER DISCUSSION ON THAT. THAT TOPIC WAS PROBABLY THE ONE THAT WAS MOST DISCUSSED OF ALL THESE WAIVERS THAT WERE BEING REQUESTED. AND I THINK TO YOUR POINT, JUSTIN, WHO WAS DOING THE PRESENTATION FOR STEINER THAT ACTUALLY CAME UP INDIRECTLY AND ONE OF THE QUESTIONS WAS, WELL, IT SEEMS LIKE IN THIS ENVIRONMENT, OFFICE SPACE, YOU KNOW, THERE'S PLENTY OUT THERE.

WHY WOULD YOU NEED MORE FOR HERE? AND, YOU KNOW, HIS POINT WAS, WELL, IT'S THIS TYPE OF A DEVELOPMENT THAT PEOPLE WANT TO BE IN OFFICE SPACE, I.E. RETAIL PARK SPACE, GREEN SPACE WHERE THEY CAN GO OUT INTO THE ENVIRONMENT, THEY CAN DO THINGS AND SO TO YOUR POINT, YOU KIND OF HATE TO TAKE AWAY, RIGHT? MAYBE WHAT'S A SELLING FEATURE FOR A TENANT THAT'S ACTUALLY CONSIDERING IT? SO I DON'T I THINK THEY'RE VERY AWARE OF THAT. YEAH. BECAUSE I THINK WE WERE VERY CLEAR THAT WE WANTED THIS COUNTER BALANCE OF MIXED USE, AND WE DON'T WANT IT TO GO TOO HEAVY ON ANY ONE DIRECTION. SO I THEY WERE VERY SENSITIVE TO THAT. OKAY. SO ALL RIGHT. SO AGAIN THIS WAS THE FORMAL PRESENTATION. SO EVERYBODY WAS JUST GETTING, THEIR FIRST LOOK AND WHAT THE STEINER WAS PROPOSING AND REQUESTING. SO THAT ONE, I THINK WE'LL HAVE A LOT MORE DISCUSSION AROUND ALSO, THEY DID A SCHOOL IMPACT STUDY, FOR THE DEVELOPMENT. AND ACCORDING TO STEINER, I THINK HE SAID THE SCHOOL WAS EXPECTING 65 STUDENTS TO COME FROM THIS PROJECT AND THEIR OWN ANALYSIS. STEINER IS PROJECTING THAT THERE WILL BE 50 SOME 55 STUDENTS. SO THEY'RE PROJECTING LESS THAN WHAT THE SCHOOL IS ACTUALLY PLANNING FOR. OKAY. SO IF THAT'S TRUE, THEN IT WILL BE A NET BENEFIT TO THE SCHOOL. THEY'LL BE GETTING LESS STUDENTS THAN THEY'RE EXPECTING TO GET FROM THE PROPOSED PROJECT. CORRECT. ALL RIGHT. SO THERE THERE IS I'M SORRY. WAS THERE ANY DISCUSSION OF THE SQUARE FOOTAGE ESTIMATES FOR THOSE LUXURY APARTMENTS, OR BEDROOMS OR ANY OF THAT? I DON'T THINK WE HAVE THAT BREAKDOWN YET. OKAY. THAT QUESTION WAS ASKED AND THEY DIDN'T HAVE IT YET. THEY'RE GETTING CLOSE, RIGHT. AND I'M TRYING TO

[00:30:04]

REMEMBER IT'S BEEN A COUPLE OF YEARS, HOW MANY STUDENTS WERE IN THE HOMES THEY WERE EXISTING. SO 24. SO THIS IS LIKE A NET 25 STUDENTS. OKAY I THOUGHT I THOUGHT IT WAS MORE THAN THAT, BUT I DON'T KNOW. I'M JUST A ROUGH, ROUGH GUESS IN THERE. I THINK THIS COULD HAVE BEEN MORE SO. THERE IS MORE. THAT WAS DISCUSSED LAST NIGHT TO THE PLANNING COMMISSION, BUT ALL THAT'S GOING TO BE INCLUDED IN MY NEXT PRESENTATION REGARDING THE PARKS AND TRAILS MEETING, BECAUSE THE REST OF THE REST OF WHAT I'LL SHARE IS IN REGARDS TO THE PARKS AND TRAILS MEETING OPEN SPACE, GREEN SPACE, ETC. SO THAT'S IT FOR THE PLANNING COMMISSION. GOOD JOB. ALL RIGHT.

ANY QUESTIONS ON THE REPORT. ALL RIGHT MR. FELLOWS. PARKS AND TRAILS. PARKS AND TRAILS. YES I DID ATTEND THAT MEETING LAST NIGHT. AND I WILL ADD THAT CHRISTOPHER DID AN EXCELLENT JO.

YES HE DID. HE WAS VERY IMPRESSIVE GUY, BUT FIRST I DID ALREADY MENTION THAT THEY HIRED KEITH MYERS FOR THE LANDSCAPE DESIGN. I WAS VERY IMPRESSED WITH EVERYTHING THAT HAS COME OUT OF THIS PLAN. I MIGHT ADD. YOU KNOW, I WAS A I WAS A BIG SKEPTIC WHEN THIS WAS ORIGINALLY BROUGHT TO US. AND I THINK THE FINAL PLAN, THEY'VE DONE A VERY NICE JOB. STAFF'S DONE A VERY GOOD JOB IN WORKING, WITH THE DEVELOPER, TO GET WHERE WE ARE TODAY. WITH THAT SAID, AND REASONS I THINK THAT IS ONE IS THEY REFINE THEY REFINE PLAN TO HAVE HOUSING CLUSTERS BE ANCHORED BY OPEN SPACES. AND THIS IS WHAT WAS PRESENTED TO SPECIFICALLY PARKS AND TRAILS REGARDING THE GREEN SPACES AND PARKS. THEIR REFINED PLAN TO HAVE HOUSING CLUSTERS BE ANCHORED BY OPEN SPACES AND POCKET PARKS. AND THAT'S IMPORTANT BECAUSE AS YOU LOOK THROUGH THE DEVELOPMENT, THERE'S A LOT OF DIFFERENT GREEN SPACES, POCKET PARKS, PLAYGROUNDS, THROUGHOUT THE WHOLE DEVELOPMENT, THEY EXPANDED THE NATURAL STREAM CORRIDOR FROM 5.8 ACRES TO EIGHT ACRES. SO THEY'RE GIVING MORE PARKLAND ALONG, ALONG, SUGAR RUN. THEY EXPANDED OPEN SPACE OVERALL THROUGHOUT THE DEVELOPMENT. SO YOU CAN CORRECT ME IF I'M WRONG FROM 25%, WHICH WAS REQUIRED IN THE ZONING TEXT TO 33%. RIGHT, SO WE'RE GETTING THERE'S MORE OPEN SPACE THAN WHAT WAS REQUIRED FROM OUR ZONING TEXT, THEY MODIFIED BUILDING LAYOUTS.

THROUGHOUT THE PROJECT. SO, SO AS TO PRESERVE AS MANY TREES AS POSSIBLE. AND THEY DID EMPLOY OR WAS IT OUR ARBORIST OR DID THEY EMPLOY THEIR OWN ARBORIST TO GO IN? SO THEY EMPLOYED AN ARBORIST TO GO IN AND HELP THEM IDENTIFY THE TREES THAT THEY THOUGHT THEY COULD SAVE? THEY CAN'T SAVE EVERY TREE. AND I WILL GUARANTEE YOU, WHEN WE SEE THOSE TREES COMING DOWN, BECAUSE THERE'S A LOT OF TREES THERE, THERE'LL BE TREES COMING DOWN. YOU KNOW, WE'LL HAVE INITIAL IMPACT ON THE COMMUNITY BECAUSE EVERYBODY LOVES TREES, BUT THEY'VE DONE THEIR BEST JOB POSSIBLE TO PRESERVE AS MANY OF THE NICE, TALL STANDING TREES THAT THEY CAN AND WORK THAT INTO THE DEVELOPMENT PLAN, WHICH WAS REALLY GOOD NEWS. THEY WILL HAVE PLAY AREAS, POCKET PARKS, AS I'VE ALREADY SPOKE OF, AND ACCESS TO THE STREAM SIMILAR TO ROSE RUN. SO THEY WANT TO DEVELOP THE STREAM SO THAT, THE VISITORS KIDS WILL HAVE ACCESS. JUST WHAT THEY'RE DOING AT THE ROSE RUN PARK. GET INTO THE STREAM, TURN ROCKS, YOU KNOW, AND ENJOY THE NATURAL ENVIRONMENT, AS, AS PART OF THIS PLAN, THEY WILL HAVE TWO THIRDS MILE OF LEISURE TRAILS THROUGH THE PARK, SO ADD TO OUR LEISURE TRAILS. WE'LL HAVE ALSO VERY INTERESTING. THEY WILL HAVE PUBLIC ART DISPLAYS THROUGHOUT THE SITE. SO 4 TO 5 PIECES OF LARGE SCALE PUBLIC ART, BY, LOCAL ARTISTS. AND AS I UNDERSTAND IT, AND HALEY WAS THERE LAST NIGHT DURING THE PLANNING COMMISSION. HALEY WILL BE HALEY WILL BE OVERSEEING, THAT PROJECT, EMPLOY OR INTERVIEWING AND TAKING APPLICATIONS FOR THIS PUBLIC ART THAT WILL BE DONE BY LOCAL ARTISTS THAT WILL BE THROUGHOUT THAT PROJECT. SO WILL THAT BE LIKE ROTATING ART OR WILL THAT BE PERMANENT? SAY, THAT WAS A ROTATING, THEY JUST SAID THERE WILL BE FIVE PIECES. IT SEEMED TO ME THAT THAT WOULD BE PERMANENT, PERMANENT FIXTURES. YEAH ALSO KEEPING WITH THE ART THEME, THEY WILL HAVE, ARTISTS CREATING BIRDHOUSES. THROUGHOUT THE NATURAL ENVIRONMENT THERE.

SO THEY'LL HAVE A THEME, JUST ADD MORE COLOR, TO THE NATURAL ENVIRONMENT. SO THERE'LL BE LOCAL ARTISTS THAT THEY WILL, INTERVIEW TO CREATE BIRDHOUSES THROUGHOUT THE NATURAL AREA.

[00:35:02]

AND, THOSE ARE THE BIG, BIG POINTS AGAIN, VERY IMPRESSED WITH THE PLAN. ESPECIALLY THE GREEN AREA AND WHAT THEY'RE DOING WITH, SUGAR RUN PARK. LOOKS LIKE IT'S GOING TO BE A WONDERFUL AMENITY TO THE COMMUNITY, NICE PARK SPACE FOR US, FOR THE COMMUNITY TO ENJOY, AND, AFTER THAT, THE PLANNING OR THE PARKS AND TRAILS ADVISORY BOARD HAD A COUPLE QUESTIONS AROUND MAKING SURE THAT THERE ARE BENCHES AND WASTE RECEPTACLES RECYCLABLE, THAT ALL THAT WAS GOING TO BE INCLUDED IN THE PARK PART OF THE PROJECT. SO THEY DID MAKE THAT ONE ONE, ONE THING THAT WOULD BE CONTINGENT, OF COURSE, STEINER'S TEAM OF, AGREED TO THAT. SO THE BOARD APPROVED WHAT WAS PRESENTED TO THEM UNANIMOUSLY. UNANIMOUSLY LAST NIGHT. THAT'S IT. ALL RIGHT. WELL, THANK YOU, MR. FELLOWS. SORRY FOR THE LENGTHY. NO, IT'S GOOD. IT'S VERY HELPFUL. ANY UPDATE FROM THE AR, GOOD NEWS IS NO MEETING. LET'S SKIP THAT ONE. ALL RIGHT, BOARD OF ZONING APPEALS, NO MEETING, ANY REPORT FROM THE SUSTAINABILITY ADVISORY BOARD, I HAVE A QUICK ONE. OKAY, WE SWORE IN OUR NEWEST MEMBER, MOLLY SCOTT, SO THAT WAS EXCITING. AND THEN, THE MAIN, DISCUSSION AT THE MEETING WAS AROUND NATIVE LANDSCAPING. THAT'S ONE OF THE BOARD'S PRIORITIES. AND SO WE HAD A TWO PART SESSION WITH THEM. THE FIRST ONE BEING A PRESENTATION FROM MXQ COVERING, LIKE CASE STUDIES OF WHERE CITIES HAVE USED NATIVE LANDSCAPING AND THEN, ASKING THE QUESTION, HOW CAN CITIES GET THE MOST BANG FOR THEIR BUCK WHEN LOOKING AT NATIVE OR SUSTAINABLE LANDSCAPE, SO THAT DISCUSSION WILL CONTINUE ON TO NEXT MONTH'S MEETING. ALL RIGHT. WELL, THANK YOU FOR THAT UPDATE. ANY UPDATE FROM THE IDEA IMPLEMENTATION PANEL? NO MEETING. MAYOR SPALDING IS HERE. OH, I APOLOGIZE, OKAY. TO SKIP SOMEBODY? NOPE. START OVER, CEMETERY RESTORATION ADVISORY BOARD. NO MEETING AND NO MEETING OF THE PUBLIC RECORDS COMMISSIO. HAS THERE BEEN ANY CORRESPONDENCE OR COMMUNICATION THAT ANY MEMBER OF COUNCIL WOULD LIKE TO PROVIDE AN UPDATE ON? SINCE OUR LAST MEETING? SECOND READING AND PUBLIC HEARING. WE HAVE NONE ON TONIGHT'S AGENDA. MAYOR, AND BUT CAN I CLARIFY WITH CITY MANAGER, MISS MCCLELLAN IS HERE TO TALK ABOUT THE NATIONWIDE CHILDREN. IS THAT ON THE AGENDA ELSEWHERE, OR ARE WE WAITING TILL OTHER BUSINESS? WELL, I'M ASSUMING IT'S UNDER ORDINANCE 28. OH, I DIDN'T THINK THAT WAS RELATED. MY MISTAKE. IS THAT I ANTICIPATE. OKAY, WELL, SHE CAN SHE CAN COME UP WHENEVER SHE WANTS. I DIDN'T WANT HER TO, LIKE, SIT THROUGH THE WHOLE

[10. INTRODUCTION AND FIRST READING OF ORDINANCES]

THING UNTIL THE OTHER BUSINESS AT THE VERY END. THAT WOULD BE BEST, INTRODUCTION OF FIRST READING OF ORDINANCE. ORDINANCE OH 24 2024 AN ORDINANCE AMENDING SECTIONS 1105102M AND SECTION 1127. 02J OF THE CODIFIED ORDINANCES OF THE CITY OF NEW ALBANY TO DEFINE AND PROHIBIT THE CULTIVATION, PROCESSING, AND RETAIL DISPENSING OF RECREATIONAL MARIJUANA IN ANY ZONING DISTRICT WITHIN THE CITY, AND DECLARING AN EMERGENCY. WHO'S GOING TO PROVIDE THE UPDATE ON THIS ONE? SURE, I'D BE HAPPY TO. THANK YOU. SO THIS CODE UPDATE IS REALLY JUST FOR TWO SECTIONS. SO IT UPDATES THE DEFINITION SECTION OF THE CITY'S ZONING CODE TO INCLUDE RECREATIONAL AND MEDICAL MARIJUANA. UNDER THE DEFINITION OF MARIJUANA. AND IT ALSO UPDATES THE GENERAL REGULATIONS SECTION OF THE ZONING TEXT AND PROHIBITS MARIJUANA, WHETHER IT BE RECREATIONAL OR MEDICAL, FROM ANY ZONING DISTRICT THROUGHOUT THE ENTIRE CITY. SO THE CITY HAS ALREADY ADOPTED LANGUAGE THAT PROHIBITS THE CULTIVATION, PROCESSING AND DISPENSING OF MEDICAL MARIJUANA AND THIS UPDATE REALLY JUST ADDS, RECREATIONAL MARIJUANA TO THAT CODE. UPDATE AND LAST NIGHT, THE PLANNING COMMISSION REVIEWED AND RECOMMENDED APPROVAL AS COUNCIL MEMBER FELLOWS MENTIONED. ALL RIGHT. AND WE DISCUSSED AT OUR LAST COUNCIL MEETING, HAVING STAFF PREPARE AN ORDINANCE FOR COUNCIL'S CONSIDERATION. AND THEN DUE TO THE TIMELINE WITH THE STATE TODAY DECLARING RECREATIONAL MARIJUANA TO BE LEGAL FOR SALE, THAT WE WOULD HERE THIS ORDINANCE TONIGHT AND DECLARE AN EMERGENCY SO THAT WE COULD CONSIDER AND PERHAPS VOTE ON THIS THIS EVENING, ARE THERE ANY QUESTIONS FROM COUNCIL ON THE PRESENTATION OF THE ORDINANCE? ALL RIGHT. DO WE VOTE FOR THE EMERGENCY BEFORE WE OPEN THE PUBLIC HEARING ON THE ORDINANCE? I WOULD GO AHEAD AND VOTE FOR IT. DECLARE AN EMERGENCY. ALL RIGHT. I WOULD MOVE THAT. WE APPROVE. I WOULD MOVE TO CONSIDER ORDINANCE OH 24 2024 AS AN EMERGENCY SECOND WAVE. SECOND READING. SORRY, SECOND. MAYOR SPALDING. YES. COUNCILMEMBER. RISK. YES.

[00:40:06]

COUNCIL MEMBER. DEREK YES. COUNCIL MEMBER. FELLOWS. YES. COUNCIL MEMBER. SHELL. YES FIVE.

YES. VOTES TO TREAT ORDINANCE OH 2024 AS AN EMERGENCY. NOW WE'LL NOW OPEN THE PUBLIC HEARING. IS THERE ANYONE FROM THE PUBLIC THAT WOULD LIKE TO SPEAK REGARDING ORDINANCE OH 24 2024? HEARING NO PUBLIC COMMENT, I WILL CLOSE THE PUBLIC HEARING. I WILL MOVE FOR THE ADOPTION OF ORDINANCE. OH 24 2024 SECOND. MAYOR SPALDING. YES. COUNCILMEMBER SCHOLL. YES.

COUNCIL MEMBER. FALLOWS. YES. COUNCIL MEMBER. DARBY YES. COUNCIL MEMBER. BRUCE. YES.

FIVE. YES. VOTES TO ADOPT ORDINANCE OH 24 2024. ORDINANCE OH 25 2024. AN ORDINANCE TO AMEND CHAPTER 137 SUSTAINABLE ADVISORY BOARD, SECTIONS 137 .021, 37.04 AND 137 .06 OF THE CITY OF NEW ALBANY, OHIO'S CODIFIED ORDINANCES AS REQUESTED BY THE CITY OF NEW ALBANY. THIS ALSO COMES OUT OF A COUNCIL REQUEST TO STAFF AND CITY MANAGER STEPANOV HANDED THIS ONE TO ME. THIS UPDATES CHAPTER 137 OF THE CITY'S CODIFIED ORDINANCES, WHICH SETS OUT THE SUSTAINABILITY ADVISORY BOARD, WHICH WAS ESTABLISHED IN 2021 THROUGH ORDINANCE OH 19 2021, IT WAS MODIFIED TO INCLUDE THE OPTION OF A NONRESIDENT SCHOOL REPRESENTATIVE THROUGH ORDINANCE OH FIVE 2024. THE PROPOSED CODE CHANGES ARE THE RESULT OF THE DISCUSSION AT THE LAST MEETING.

THE INTENT OF THE CHANGES IS TO CLARIFY THE SUSTAINABILITY ADVISORY BOARD'S PURPOSE, POWERS AND DUTIES, AND TO UPDATE THE ABSENCES LANGUAGE TO REFER TO THE GENERAL POLICY AS REFLECTED IN CODE SECTION 159 .02, AND THE CHANGES ARE SET FORTH ON THE MARKUP TEXT. THEY INCLUDE TAKING OUT THE WORD POLICIES IN THE 137 .02, WHICH HAD BEEN PREVIOUSLY DISCUSSED, AGAIN, UPDATING TO POINT TO, JUST GENERAL ATTENDANCE, WHICH WE'RE GOING TO ADDRESS IN THE NEXT ORDINANCE.

AND ALSO ON POWERS AND DUTIES. THERE'S A LINE NOW THAT SAYS, AS DIRECTED BY CITY COUNCIL, THE BOARD PROMOTES AND COMMUNICATES THE PRINCIPLES OF SUSTAINABILITY BROADLY AMONG THE COMMUNITY AND STAKEHOLDERS, I'LL HAND IT OFF TO CITY MANAGER. IF YOU'VE GOT ANYTHING TO ADD, YOU MAY NOT.

ALL RIGHT. ANY QUESTIONS ON THE ORDINANCE? NO, WE'LL SET THAT FOR SECOND READING AND PUBLIC HEARING AT OUR MEETING ON AUGUST 20TH. ORDINANCE OH 26 2024 AN ORDINANCE TO AMEND CHAPTER 159, RULES OF PROCEDURE FOR BOARDS AND COMMISSIONS, SECTIONS ONE, FIVE, 9.02 D OF THE CITY OF NEW ALBANY, OHIO, CODIFIED ORDINANCES AS REQUESTED BY THE CITY OF NORTH. ALL RIGHT. THIS IS ALSO. YEAH. THIS IS, AMENDING CHAPTER 159 OF THE CODIFIED ORDINANCE, WHICH CONTAINS THE RULES OF PROCEDURE FOR BOARDS AND COMMISSIONS, THE STANDARD RULES, AS YOU KNOW, RECEIVED A SUBSTANTIAL REVIEW AND REVISIONS IN JANUARY OF 2023 VIA ORDINANCE 007 2023, IN RESPONSE TO THE LATEST COUNCIL DISCUSSION AT THE LAST MEETING, STAFF TO PREPARE THE PROPOSED CHANGES TO ALLOW COUNCIL TO CONSIDER AND EXCUSE ABSENCES IN CERTAIN CIRCUMSTANCES. THE PROPOSED LANGUAGE IS REDLINED ON THE ORDINANCE ITSELF AND SPECIFICALLY IT TALKS ABOUT THE FOUR ABSENCES IN A 12 MONTH PERIOD OR THREE CONSECUTIVE ABSENCES AS GROUNDS FOR FORFEITURE, BUT THEN GOES ON TO SAY THAT COUNCIL HAS THE AUTHORITY TO EXCUSE AN ABSENCE DUE TO ILLNESS, INJURY OR OTHER EMERGENCY CIRCUMSTANCE. IF A MEMBER OR AN IMMEDIATE FAMILY MEMBER AND THEN, THE CITY MANAGER AND I KIND OF CLEANED UP THE LANGUAGE DOWN BELOW TO JUST SAY, WITH THE GROUNDS HAPPENING, THE COUNCIL MEMBER OR A CLERK NOTIFIES ME WHO WILL THEN NOTIFY COUNCIL, AND THEN IT'S UP TO YOU TO DECIDE HOW TO PROCEED. AND THAT'S THE CLEAN UP. ALL RIGHT.

ANY QUESTIONS ON THE ORDINANCE THEN WE'LL ALSO SET THAT FOR SECOND READING AND PUBLIC HEARING IN OUR MEETING ON AUGUST 20TH. ORDINANCE OH 27 2024 AN ORDINANCE TO AMEND THE ZONING ORDINANCE OF THE CITY OF NEW ALBANY BY AMENDING THE ZONING MAP TO REZONE 11.44 PLUS OR MINUS ACRES OF LAND LOCATED AT 7800 WALTON PARKWAY FOR AN AREA KNOWN AS THE 7800 WALTON PARKWAY ZONING DISTRICT, FORMERLY KNOWN AS THE COMMERCIAL VEHICLE GROUP ZONING DISTRICT FROM ITS CURRENT ZONING OF LIMITED OFFICE CAMPUS DISTRICT L OCD TO LIMITED GENERAL EMPLOYMENT LGA, AS REQUESTED BY THE CITY OF NEW ALBANY. MR. MAYOR, THANK YOU. SO AS YOU MENTIONED, THIS REZONING IS JUST FOR THE CVG SITE. SO IT'S LOCATED NORTH OF WALTON PARKWAY AND WEST OF NEW ALBANY.

CONDIT ROAD OUTLINED IN RED HERE. SO THE CURRENT ZONING IS OCD. THIS IS ACTUALLY THE MOST RESTRICTIVE COMMERCIAL ZONING DISTRICT THAT THE CITY HAS. THIS LIST SHOWS THE PERMITTED USES, SO IT REALLY JUST ALLOWS GENERAL OFFICE RESEARCH AND PRODUCTION USES. WAS ACTUALLY A CONDITIONAL USE APPROVED BY THE PLANNING COMMISSION. AND SO THERE'S NOT MANY VARIETY OF USES ALLOWED AT THE SITE. AND SO THEY REALLY EXHAUSTED EVERYTHING THEY CAN DO FROM AN OFFICE CAMPUS DISTRICT STANDPOINT. THE CITY HAS SPONSORED THIS REZONING IN ORDER TO ADD ONLY CLEAN AND NON-HAZARDOUS MANUFACTURING AND PRODUCTION USES TO THE SITE AS A PERMITTED USE IN ORDER TO MAKE IT MORE COMPETITIVE. THIS IS THE SAME USE THAT'S ALSO UTILIZED IN THE SOUDER ROAD AREA. THE

[00:45:03]

RESEARCH AND DEVELOPMENT AND I'M SORRY, RESEARCH AND INFORMATION DISTRICT. THINK OF LIKE AMERICAN REGIONS WITHIN THAT AREA. SO IT IS CONSISTENT WITH THE SURROUNDING AREA TO THE NORTH AND THE PLANNING COMMISSION DID REVIEW AND RECOMMENDED APPROVAL AT THEIR MEETING LAST MONTH. AND IT MATCHES THE LAND USE RECOMMENDATIONS OF THE STRATEGIC PLAN. I'LL JUST MAKE ONE LAST NOTE. THIS IS ONLY A CHANGE TO THE USE. THIS DOES NOT CHANGE ANY OF THE DEVELOPMENT STANDARDS THAT EXIST ON THE PROPERTY TODA. THAT'S GOOD. HAD ME WORRIED WHEN I SAW THE ZONING SIGN OUT ALONG THE STREET. WHAT WAS HAPPENING WITH THAT PROPERTY? SO IT'S. ALL RIGHT. ANY QUESTIONS ON THE UPDATE. AND WE WILL SET THAT FOR SECOND READING AND PUBLIC HEARING AT OUR MEETING ON AUGUST 20TH. ORDINANCE OH 28 2024 AN ORDINANCE TO AMEND THE ZONING ORDINANCE OF THE CITY OF NEW ALBANY BY AMENDING THE ZONING MAP TO REZONE APPROXIMATELY 108.1 PLUS OR MINUS ACRES OF LAND GENERALLY LOCATED SOUTH OF STATE ROUTE ONE, 61 EAST OF US 62, NORTH OF EAST DUBLIN GRANVILLE ROAD AND WEST OF KITZMILLER ROAD FROM COMPREHENSIVE PLAN UNIT DEVELOPMENT PUD TO COMP COMPREHENSIVE PLAN UNIT DEVELOPMENT KPD FOR AN AREA TO BE KNOWN AS THE GATTON KPD ZONING DISTRICT, AS REQUESTED BY THE NEW ALBANY COMPANY, LLC.

KERRY AARON UNDERHILL, ESQUIRE. MR. MAYOR, THANK YOU. SO THE ZONING TODAY, AS YOU MENTIONED, IS PART OF THE 1998 NACO PUD. SO IT'S OVER 25 YEARS OLD. AND PART OF THIS REZONING IS REALLY BRINGING IT UP TO DATE AND MODERNIZING IT WITH CURRENT OTHER CODES. SO TODAY IT'S JUST ONE LARGE SUB AREA. EVERYTHING IN BLUE HERE IS ONE SUB AREA AND IS WHAT IS BEING REZONED. IT CURRENTLY ALLOWS FOR 294 SINGLE FAMILY UNITS. VERY LIMITED COMMERCIAL USES REALLY JUST ON THE EDGES AND THEN COMMUNITY FACILITIES, WHICH INCLUDES HOSPITALS JUST AND THAT'S ALL IT STATES. AND SO RIGHT NOW, SINCE IT'S ONE BIG SUB AREA, IT'S REALLY LIKE A MELTING POT OF USES. AND WHAT THIS REZONING DOES IS CREATES THREE NEW SUB AREAS. SO IT ESSENTIALLY IS RESIDENTIAL ON THE BOTTOM SUB AREA IN BLUE AND THEN COMMERCIAL SUB AREAS ON THE TOP. AND IT'S DIVIDED BY THE FUTURE GANNON PARKWAY EXTENSION SHOWN HERE. AND THIS REZONING DOES PROVIDE ADDITIONAL RIGHT OF WAY EASEMENTS FOR THAT GANN PARKWAY EXTENSION. SO JUST A LITTLE BIT MORE BREAKDOWN HERE. SO SUB AREA ONE ALLOWS FOR HOSPITALS SURGERY CENTERS AND OFFICE USES SUB AREA TWO OFFICES AND THEN SUB AREA THREE ALLOWS FOR THE SAME AMOUNT OF RESIDENTIAL UNITS WHICH IS 294. AND THEN SOME OTHER GOVERNMENTAL USES AS WELL. AND WHAT THIS TEXT DOES UPDATE AND COMMIT TO IS PROVIDES 100 FOOT OF PARKLAND ALONG THE EAST SIDE OF ROSE RUN WITHIN SUB AREA THREE, AND ALSO COMMITS TO PROVIDING THE SAME OVERALL AMOUNT OF LANDSCAPE AND PARKLAND AREA, WHICH I BELIEVE IS 38 ACRES THROUGHOUT ALL THREE OF THESE, SUB AREAS IN THE CANTON PARKWAY AREA. SO THIS IS THE CITY'S, NEW ALBANY STRATEGIC PLAN. SO YOU CAN SEE THAT IT MATCHES THE LAND USE RECOMMENDATIONS, WHICH THOSE COMMERCIAL ALONG THE NORTHERN PART OF THE FUTURE GANNON PARKWAY EXTENSION AND VILLAGE CENTER, WHICH INCLUDES RESIDENTIAL ALONG THE SOUTHERN PORTION. THIS REZONING WAS REVIEWED AND RECOMMENDED FOR APPROVAL BY THE CITY'S ARCHITECTURE REVIEW BOARD, SINCE IT'S IN THE VILLAGE CENTER AND THE CITY'S PLANNING COMMISSION. AT LAST MONTH'S MEETING AND STAFF IS HAPPY TO TAKE ANY QUESTIONS. I JUST ONE FROM ME, DO YOU BACK A SLIDE WITH THE SUB AREA THREE? YES. IN GENERAL, HOW MANY ACRES IS THAT AND WHAT WOULD THE DENSITY BE WITH 294 RESIDENTIAL UNITS IN WHAT IS LESS THAN 100 ACRES? SO THIS IS ESSENTIALLY A TRANSFER OF DEVELOPMENT RIGHTS. SO THE OVERALL DENSITY FOR THE ENTIRE GAME AREA IS THE SAME. BUT YOU ARE RIGHT. THERE IS MORE UNITS WITH WITH JUST WITHIN SUB AREA THREE, I DON'T KNOW, MR. UNDERHILL, IF YOU KNOW THE NUMBER OF ACRES OFFHAND, FOUR POINTS, 4.52 UNITS PER ACRE. IF YOU LOOK AT THE 65 ACRES IN SUB AREA THREE. SO THE SUB AREA THREE ALLOWS FOR SINGLE FAMILY DETACHED UNITS, DUPLEXES, TOWNHOMES. AND THEN WHAT I WOULD ESSENTIALLY CALL LIKE A FOUR PLEX. SO UNITS, A SINGLE BUILDING THAT HAS FOUR UNITS. AND SO THAT'S THE SCALE OF THE BUILDINGS THAT ARE ALLOWED WITHIN SUB AREA THREE. THE OWNER OCCUPIED OR RENTAL OR DOES IT DISTINGUISH. YEAH. SO WE DON'T SPECIFY THAT IN THE CODE. MR. UNDERHILL. THE ANSWER, IF HE HAS ANYTHING TO ADD. YEAH. THERE'S NOT A, HEARING OF OR A PUBLIC HEARING TONIGHT, BUT WE CERTAINLY WANT TO HAVE A LITTLE BIT BROADER CONVERSATION ON THIS ORDINANCE BECAUSE OF ITS SIGNIFICANT IMPACT ON THE CITY AND THE FACT THAT YOU KNOW, THIS IS A FAIRLY LARGE ANNOUNCEMENT, WHILE WE'RE JUST TALKING ABOUT A

[00:50:05]

ZONING ORDINANCE, YOU KNOW, THIS IS A SIGNIFICANT DEVELOPMENT IN OUR COMMUNITY. WE'D LIKE TO PUT A LITTLE MORE COLOR ON IT. IF YOU WILL. SO, MR. UNDERHILL, OTHER MEMBERS OF THE TEAM THAT WOULD LIKE TO PROVIDE A LITTLE BIT OF DETAIL TO THE CITY COUNCIL AND THOSE WATCHING AT HOME. THANK YOU. MAYOR, MY NAME IS AARON UNDERHILL. I'M AN ATTORNEY WITH UNDERHILL AND HODGE AT 8000 WALTON PARKWAY HERE IN NEW ALBANY, REPRESENTING THE NEW ALBANY COMPANY. EXCITED TO BE HERE TONIGHT. MR. DEREK, I APPRECIATE YOUR QUESTION. I'M GOING TO ADDRESS THAT MOMENTARILY, BUT, REALLY, AS STEVEN MENTIONED, WE ARE HERE TO MODERNIZE STANDARDS THAT WERE PUT IN PLACE, SOME 26 YEARS AGO. I WILL SAY THAT IF YOU LOOK AT THE 1998 PUD, IT WAS REALLY A LOT OF FORESIGHT THERE. AND THERE WERE A LOT OF THINGS THAT WE ARE CARRYING OVER HERE. AND, YOU KNOW, WE CONTINUE TO, THE CURRENT ZONING WOULD LARGELY MATCH THE STRATEGIC PLAN AS IT EXISTS TODAY. BUT THIS ZONING, I THINK, BRINGS IT INTO EVEN MORE COMPLIANCE. BUT WE DID WANT TO MODERNIZE STANDARDS RELATING TO THE CF OR COMMUNITY FACILITIES USES, WHICH ALSO INCLUDES ELIMINATING, WHAT IS A LAUNDRY LIST OF USES THERE TO REALLY NARROW THEM DOWN TO MORE OF THE MEDICAL TYPE USES, SO THAT'S WHAT YOU'RE SEEING THERE IN SUBAREA ONE, SUBAREA TWO IS INTENDED TO ALLOW SUPPORTING OFFICE USES. SO MEDICAL OFFICE AND ADMINISTRATIVE OFFICE, PROFESSIONAL OFFICE WILL BE ALLOWED THERE UNDER THE CURRENT ZONING THAT IS NOT ALLOWED. SO, THAT'S A PRETTY SIGNIFICANT ADDITION. AND THEN IN SUBAREA THREE, OF COURSE, WE ARE KEEPING, THE RIGHT TO THE 294 RESIDENTIAL UNITS. THE INTERESTING THING THAT HAS HAPPENED, I DON'T REMEMBER WHAT YEAR IT WAS, MAYBE 2012, WHEN THE URBAN CENTER CODE WAS ADOPTED, ESSENTIALLY ON THIS PIECE OF PROPERTY, YOU'RE LEFT WITH A CHOICE TO CONTINUE UNDER THE CP ZONING THAT'S IN PLACE TODAY, OR TO GO UNDER THE URBAN CENTER CODE OVERLAY. AND SO THAT URBAN CENTER CODE OVERLAY DOES ALLOW A VARIETY OF RESIDENTIAL USES. IT, IN FACT, ALLOWS A LOT SMALLER TYPE OF, LOT SIZES THAT ARE PROBABLY BETTER FOR THE SCHOOL DISTRICT IN THE LONG RUN.

THE IMPORTANT DISTINCTION, I THINK, BETWEEN WHAT WE'RE GOING TO BE DOING IN, COMMITTING TO THOSE URBAN CENTER CODE STANDARDS FOR RESIDENTIAL IS WE'RE GOING TO AVOID THE MINIMUM LOT SIZE REQUIREMENT ITHEN CURRENT ZONING OF 80FT IN WIDTH. SO, YOU KNOW, THAT'S MORE OF THE TRADITIONAL SINGLE FAMILY SUBDIVISION SORT OF DEVELOPMENT THAT WE SAW THROUGHOUT THE FIRST COUPLE OF DECADES HERE IN NEW ALBANY. SO THIS OPENS UP THE POSSIBILITY OF BRINGING MORE VILLAGE CENTER TYPE RESIDENTIAL USES, HERE AND TO SUPPORT, ALL OF THOSE COMMERCIAL USES WE WANT TO SEE HAPPEN AND CONTINUE HERE IN THE VILLAGE CENTER. SO THAT'S THE INTENT THERE, ALSO IMPORTANTLY, STEPHEN, YOU HAD ON THAT PREVIOUS SLIDE, CANTON PARKWAY, WANT TO POINT OUT THAT, OBVIOUSLY CANTON PARKWAY IS GOING TO GO THROUGH A PLANNING PROCESS THROUGH THE PLANNING COMMISSION AND THROUGH YOU ALL FOR THE FINAL SAY, OUR TEXT DOES ALLOW US SOME FLEXIBILITY FOR THE SOUTHERN BOUNDARY OF THE SUBAREA ONE. AND TWO, WHICH IS SHARED WITH THE NORTHERN BOUNDARY OF SUBAREA THREE, TO SHIFT JUST A LITTLE BIT BASED ON THAT FINAL PLAT CONFIGURATION, AND, OBVIOUSLY THERE'S GOING TO BE A LOT OF DISCUSSION ABOUT HOW THE CONNECTION IS MADE OVER THERE AT DUBLIN-GRANVILLE ROAD. THIS OBVIOUSLY DOESN'T REPRESENT WHAT THAT CONDITION WILL BE, BUT IT'S JUST INTENDED TO DEMONSTRATE HOW, HOW WE ONE WAY THIS COULD, KIND OF, ROLL THROUGH THE DISTRICT HERE. SO AS FAR AS, THE CPWD IS CONCERNED, ANOTHER BENEFIT OF GOING A CPWD ROUTE AND RATHER THAN GOING THROUGH JUST THE VILLAGE, THE URBAN CENTER CODE AND THE VILLAGE CENTER IS THAT THAT WOULD ONLY HAVE A REVIEW WITH THE ARB IF WE WERE TO CHOOSE THAT ROUTE. THE CPWD OBVIOUSLY IS GOING THROUGH THIS ZONING PROCESS WITH THE COMPREHENSIVE PLAN STAGE, WHICH IS A BUBBLE, AND THAT'S WHY YOU'RE NOT SEEING MUCH DETAIL NOW. BUT WE WILL HAVE TO THEN GO THROUGH A PRELIMINARY DEVELOPMENT PLAN REVIEW WITH THE ARB AND PLANNING COMMISSION, AS WELL AS ANY FINAL DEVELOPMENT PLAN REVIEW ON EACH PHASE OF THE DEVELOPMENT, WITH THOSE BODIES, IN ADDITION TO GOING THROUGH THE TYPICAL PLANNING PROCESS AND PROCESSES THAT ARE LIKELY TO HAPPEN HERE. SO, WE BELIEVE THAT'S A BENEFIT TO HAVE YOU ALL INVOLVED HERE AND THE PLANNING COMMISSION IN ADDITION TO THE ARB. SO THAT'S SORT OF THE REASONING BEHIND THE REQUEST, AND I'D LIKE TO ASK TOM RUBY TO COME UP HERE AND PROVIDE SOME MORE COLOR. I THINK AARON, BETWEEN AARON'S PRESENTATION AND STEPHEN, THEY'VE HIT REALLY MOST OF THE HIGH MARKS. AGAIN, THRILLED TO BE HERE, SINCE THIS WAS ORIGINALLY ZONED BACK IN 1994, AARON HIT ON SOME OF THE HIGHLIGHTS ABOUT CANTON PARKWAY EXTENSION. WE CONTINUE TO WORK WITH MIKE BARKER AND THE CITY

[00:55:02]

STAFF. CARPENTER MARK, I THINK IS ALSO INVOLVED AT THIS POINT IN IN DETERMINING THAT ALIGNMENT. THERE'S 100FT OF RIGHT OF WAY THAT WILL BE DEDICATED. WITH THAT ROADWAY EXTENSION, A COUPLE OF IMPORTANT THINGS IN SUBAREA THREE TO HIGHLIGHT JUST REAL QUICKLY, WE TALKED ABOUT THE, 30 ACRES. STEPHEN MENTIONED THAT WOULD BE PART OF A PARKLAND DEDICATION IF IT'S DEVELOPED UNDER THE URBAN CENTER CODE. ALL OF THAT STARTED WITH OUR DEAR FRIEND BILL RESCH, THERE IS ACTUALLY A RESTRICTIVE COVENANT ALONG A SECTION OF THE HEADWATERS OF THE ROSE RUN STREAM THAT EXTEND ALONG THE EASTERN OR THE WESTERN BOUNDARY OF THIS SUBAREA. SO MORE TO COME ON THAT, MORE EXCITING NEWS. BUT THE REAL GREAT THING THAT WE'RE HERE TO ANNOUNCE TONIGHT IS SUBAREA ONE, ROUGHLY 25 ACRES. WHEN YOU TAKE OUT THE RIGHT OF WAY OVER THE PAST YEAR OR SO, WE'VE BEEN WORKING CLOSELY WITH NATIONWIDE CHILDREN'S HOSPITAL AND THROUGH COOPERATIVE EFFORTS OF BOTH THE WEXNER FAMILY AND THE NEW ALBANY COMPANY, THAT ENTIRETY OF SUBAREA ONE WILL BE DONATED TO NATIONWIDE CHILDREN'S HOSPITAL, PATTY MCCLIMON REPRESENTING NATIONWIDE CHILDREN'S WITH HER OTHER HAT ON IS HERE WITH ME TONIGHT, TO SAY A FEW WORDS ON THAT AS WELL.

GREAT. THANKS, TOM. HI, KAREN. SORRY WEARING MY NATIONWIDE CHILDREN'S HAT, I MENTIONED THAT WE ARE COMMITTED TO HEALTH IN THE COMMUNITY, AND NATIONWIDE CHILDREN'S HAS A VERY SMALL PRESENCE OVER AT THE HEIGHTS CENTER, THIS WOULD BE OUR LARGEST SUBURBAN PRESENCE WITH A 100,000 SQUARE FOOT BUILDING. WITH URGENT CARE SUBSPECIALTY CLINICS, PHYSICAL THERAPY, OCCUPATIONAL THERAPY, AND SPEECH THERAPY, AS WELL AS BEHAVIORAL HEALTH SERVICES FOR CHILDREN IN NEW ALBANY AND THE WHOLE NORTHEAST AREA. WE'RE VERY EXCITED ABOUT THIS BECAUSE OF THE GENEROSITY OF THE NEW ALBANY COMPANY AND THE WEXNER FAMILY, WE ARE ABLE TO INVEST MORE IN A BUILDING BECAUSE OF THE REALLY GREAT, LAND DONATION. SO, WE'RE EXCITED THAT IF WE CAN GET THE ZONING, THEN WE WILL BE ABLE TO MOVE FORWARD WITH THIS CLOSE TO HOME NEW ALBANY. WILL THERE BE ANY ACUTE INPATIENT ROOMS OR IS IT ALL OUTPATIENT? IT'S ALL OUTPATIENT. OTHER QUESTIONS, NOT REGARDING THIS PORTION. THIS IS EXCELLENT NEWS, BY THE WAY. THANK YOU. THANK YOU PATTY.

APPRECIATE IT. AGAIN, A VERY EXCITING ANNOUNCEMENT, I FEEL LIKE WE'VE ALL BEEN WORKING TOWARDS THIS GOAL FOR, A WHILE, AND I'M GLAD THAT, THE NEW ALBANY COMPANY, THE WEXNERS, COULD MAKE A SIZABLE DONATION TO GET THIS PROJECT TO WHERE IT IS TODAY. SO THANK YOU. WE'RE THRILLED TO BE ABLE TO MAKE THAT ANNOUNCEMENT, WE'LL BE BACK HERE IN TWO WEEKS, WHEN THIS IS FORMALLY HEARD AND WITH A LITTLE BIT OF LUCK ADOPTED, IF THERE ARE ANY OTHER QUESTIONS YOU GUYS HAVE NOW, I'M HAPPY TO ANSWER THOSE. CONTINUE WORKING WITH STAFF ON SOME OF THE DETAILS.

YEAH, I HAVE A COUPLE QUESTIONS, STAFF HAD MENTIONED THAT THERE IS A 100 FOOT EASEMENT FROM IS THAT SUGAR RUN THAT'S COMING THROUGH THERE? SUGAR RUN. SO THE HEADWATERS OF THE ROSE RUN. ROSE RUN. YEAH. RIGHT HERE. ONE OF THE REQUESTS FROM STAFF EARLY ON WAS THAT THAT WOULD BE PART OF THE PARKLAND DEDICATION. THAT WOULD BE REQUIRED FOR RESIDENTIAL DEVELOPMENT. WE'VE AGREED TO THAT. I SUSPECT, AS THIS CONTINUES TO DEVELOP, YOU'LL SEE MUCH MORE THAN 100 FOOT SWATH OF. YEAH, MY CONCERN WAS ONLY 100 FOOT. THAT WILL BARELY FIT A LEISURE TRAIL THROUGH THE 100FT. IS CONSISTENT WITH THE PRESERVATION EASEMENT THAT BILL RASH HAD US PUT ON THIS LAND 15, 20 YEARS AGO. SO THAT'S WHERE THAT CAME FROM. NOW THE ACREAGE DEDICATED TO THE PARKLAND IS THAT UP ALONG THAT EASEMENT, THE, THE ROSE RUN EASEMENT. SO WE'LL HAVE A WE'LL HAVE TO COME IN WITH A PLAN. RIGHT. OKAY. GO BEFORE THE ARCHITECTURAL REVIEW BOARD, THE PLANNING COMMISSION, COUNCIL WOULD SEE THAT THE PLANNING STAGE, BUT THE IDEA IS ALL OF SUBAREA THREE WILL BE DEVELOPED RESIDENTIALLY. ENTITLEMENTS OF 294 UNITS CARRIED OVER, AS WELL AS A SIGNIFICANT PARKLAND DEDICATION REQUIREMENT, NOT ONLY BASED ON WHATEVER THAT ULTIMATE RESIDENTIAL COUNT IS, BUT OTHER FACTORS AS WELL, INCLUDING PRESERVATION OF THE HEADWATERS OF THE ROSELAND CREEK. OKAY SO I'M ASSUMING THAT SOME AREA IS GOING TO, ADHERE TO OUR WAS OUR RATIO OF 3 TO 1, 3 TO 1. THAT'S OUR RATIO FOR HOUSING PER ACRE WITH THE GREEN SPACE THAT YOU'RE DEDICATING. WELL, IT'S I THINK 55 AND OLDER IS THERE'S A, THERE'S A, THERE'S A ONE HOUSE, ONE ONE PER ONE ACRE, ONE HOUSE PER ONE. WELL, THAT GREEN SPACE THAT YOU ARE, THAT'S GOING TO BE A PART OF THAT, FIT INTO THE 1 TO 1 HOUSING RATIO IS THE QUESTION. THE GREEN SPACE AND

[01:00:07]

THE PARKLAND DEDICATION IN SUBAREA THREE WILL MEET ALL OF THE SUBDIVISION REGULATION REQUIREMENTS. AS WELL AS ZONING REQUIREMENTS THAT HAVE BEEN IN PLACE SINCE 98. SO AS I UNDERSTAND IT, THAT IS A MINIMUM OF 2400FTā– !S OF PARKLAND. DEDICATION PER RESIDENTIAL UNIT AND 20% MINIMUM OPEN SPACE REQUIREMENT. GOOD THE ONLY OTHER QUESTION I HAVE IS THE HAVE THE SCHOOLS REVIEWED THIS PLAN OR ARE WE GET TO THAT POINT YET IN TERMS OF THE IMPACT TO THE SCHOOL FOR THE RESIDENTIAL PIECE? YEAH, FOR THE RESIDENTIAL. SO THERE WERE QUESTIONS EARLIER IN, IN THE MEETING ABOUT THE NUMBER OF RESIDENTIAL UNITS, THE ZONING THAT'S ON THE PROPERTY RIGHT NOW. RIGHT NOW IT'S 294 UNITS WITH A MINIMUM LOT FRONTAGE OF 80FT FOR COMPARISON. THAT'S VERY SIMILAR TO WHAT YOU HAVE IN THE WINDSOR NEIGHBORHOOD DIRECTLY TO THE WEST OF THIS, THERE WAS CLEAR RECOMMENDATION FROM THE SCHOOL DISTRICT THAT THEY DID NOT WANT TO SEE THAT DUPLICATED FOR NO OTHER REASON THAN THE IMPACT THAT THAT HAS ON THE SCHOOL DISTRICT. WE ALL LOVE WINDSOR. IT'S A BEAUTIFUL NEIGHBORHOOD. WISH WE COULD BUILD MORE OF THEM, SOME OF YOUR BEST FRIENDS LIVE IN WINDSOR. I KNOW A COUPLE OF PEOPLE THAT LIVE THERE. I WISH I WERE LUCKY ENOUGH TO BE ONE OF THEM, THE TRUTH OF THE MATTER IS THAT THAT FROM THE SCHOOL DISTRICTS PERSPECTIVE, YIELDS A HIGHER STUDENT RATIO PER HOUSE THAN SOMETHING LESS SOMETHING DIFFERENT THAN THAT AS A RESULT, WE HAVE MODIFIED THE ZONING, AS AARON DESCRIBED, TO BE PART OF THE URBAN CENTER CODE, WHICH ALLOWS FOR A DIFFERENT UNIT TYPE THAT WE WILL COORDINATE WITH THE SCHOOL DISTRICT BEFORE WE COME BACK HERE, BEFORE YOU AND THE OTHER BOARDS AND COMMISSIONS FOR REVIEW OF THAT, BUT THAT WAS THE THAT'S WHAT DROVE THE DECISION TO MODIFY THAT ZONING AND ZONING REQUEST FOR THE UNIT TYPE. GOOD NEWS. THANK YOU. TOM AND THEN JUST AS A REMINDER, PRIOR TO THE REQUEST FOR THE ZONING CHANGE, NEW ALBANY COMPANY HAD AN ENTITLEMENT TO BASICALLY THESE 300 RESIDENTIAL UNITS WITHIN THAT PROPERTY. SO YOU TECHNICALLY COULD HAVE STARTED CONSTRUCTION AT ANY TIME ON THOSE 300 UNITS. THANK YOU. YES OKAY. ALL RIGHT. ANY OTHER QUESTIONS, AT THIS MOMENT ON THE ORDINANCE, THEN WE WILL SET THAT FOR SECOND READING AND PUBLIC HEARING AT OUR MEETING ON AUGUST 20TH. AND AS I ALWAYS SAY, IF YOU WERE JUST HERE FOR ONE ISSUE AND WANT TO GO ENJOY THE REST OF YOUR EVENING, NO OFFENSE. IF YOU SHOULD DECIDE TO LEAVE AND DO S. CAN I THANK YOU? ORDINANCE OH 29 2027 ORDINANCE TO APPROVE THE FINAL PLAT AND ACCEPT RIGHT OF WAY DEDICATION FOR GANTON PARKWAY WEST PHASE THREE AS REQUESTED BY THE CITY OF NORFOL. MISTER MAYOR, THANK YOU. SO THIS IS AN EXTENSION OF CANTON PARKWAY FROM LICKING COUNTY INTO FRANKLIN COUNTY. SO THIS IS APPROXIMATELY 1500FT IN LENGTH AND ENCOMPASSES APPROXIMATELY JUST UNDER FOUR ACRES IN SIZE. SO AS MENTIONED EARLIER, THE CITY HAS HIRED CARPENTER MARTI, THE ENGINEERING FIRM, TO DESIGN THE OVERALL GAINED PARKWAY EXTENSION, THE CONSTRUCTION PLANS HAVE REACHED A POINT FOR THIS PHASE THAT WE FEEL COMFORTABLE PLATTING IT. SO THE PLAT ITSELF IS 100FT IN WIDTH, PLUS 50FT OF EASEMENTS ON BOTH THE NORTH AND SOUTH SIDE OF THE ROADWAY. SO WITH THAT, DEDICATION, IT MATCHES THE RECOMMENDATIONS AND THE STRATEGIC PLAN FOR BOTH, CHARACTER AND THE FUNCTIONAL CLASSIFICATIONS AND THE CITY PLANNING COMMISSION REVIEWED AND RECOMMENDED APPROVAL LAST NIGHT AT THE PLANNING COMMISSION MEETING. WHAT'S THE PLANS FOR I? WE'RE EXTENDING IT AND THEN IT STOPS AT THAT POINT. WHAT'S IT GOING TO BE USED FOR? SO THIS WILL BE USED, FOR FUTURE BUSINESSES TO THE SOUTH. AND, AND SO WHAT'LL BE. SO IT'S A PART OF THE DEVELOPMENT AGREEMENT THAT WAS ALREADY APPROVED WITH BTS. AND THEIR DEVELOPMENT. WE WERE TRYING TO THEY NEED THIS ROAD FOR ACCESS. THEY WERE DEVELOPING SEVERAL SITES WITHIN THE COMMUNITY, AND THEY WEREN'T STARTING WITH THIS SITE. SO WHEN WE APPROVED THEIR PACKAGE, A COUPLE MONTHS AGO, PART OF IT WAS AT A CERTAIN POINT THAT THEY GAVE US NOTICE WE WOULD BE READY TO CONSTRUCT THIS ROAD. AND SO THE DEDICATION AND THE PLAT IS TO GET US READY FOR CONSTRUCTION, SO THAT WHEN THEY GIVE US THE NOTICE THAT THEY NEED IT FOR ACCESS TO THE SITE TO THE SOUTH, THAT WE COULD GO AHEAD AND START CONSTRUCTION, OUR GOAL WOULD BE TO PACKAGE THE CONSTRUCTION OF THIS WITH THE CONSTRUCTION OF POTENTIALLY, THE FIRST LEG OF CANTON PARKWAY BEHIND THE FIRE STATION. AND

[01:05:05]

THIS WAY WE'LL GET BETTER PRICING. SO WE'RE NOT JUST GOING OUT TO BID FOR 1500FTā– !S. THE REASON WE HAVEN'T, WE'RE NOT PLANNING MORE OF IT AT THIS TIME IS BECAUSE WE'RE WE'RE CURRENTLY WORKING WITH CARPENTER, MARDI, TO FINALIZE THE DESIGN FROM THE TERMINUS OF CANTON PARKWAY HERE IN THIS LOCATION ON THIS WESTERN SIDE, THROUGH TO KITZMILLER AND REALLY TRYING TO UNDERSTAND WHAT THE BEST ALIGNMENT FOR THAT IS. BUT WE KNOW WE NEED PIECES OF THIS DONE, EARLIER BECAUSE OF THESE DEVELOPMENT OPPORTUNITIES AND BECAUSE OF COMMITMENTS, WE MADE IN THE DEVELOPMENT AGREEMENT. OKAY ALL RIGHT. ANY OTHER QUESTIONS ON THE ORDINANC? AND WE WILL SET THAT FOR SECOND READING AND PUBLIC HEARING AT OUR MEETING ON AUGUST 20TH. ORDINANCE. OH 30 2024. AN ORDINANCE PROVIDING FOR THE ISSUANCE AND SALE OF NOTES IN THE MAXIMUM PRINCIPAL AMOUNT OF $22,500,000 IN ANTICIPATION OF THE ISSUANCE OF BONDS FOR THE PURPOSE OF PAYING THE COST OF IMPROVING THE CITY'S VEHICULAR TRANSPORTATION SYSTEM AND DECLARING AN EMERGENCY. THANK YOU. THE, ORDINANCE THAT'S PRESENTED GRANTS AUTHORIZATION TO PROCEED WITH SECURING THE NECESSARY FINANCING TO FUND THE PREVIOUSLY APPROVED MARKET STREET EXTENSION PROJECT AND THE CONSTRUCTION OF THE NEXT PORTION OF THE BRISCOE PARKWAY, LOCATED IN THE NEW ALBANY BUSINESS PARK.

IT PROVIDES FOR THE ISSUANCE AND SALE OF NOTES OF UP TO A MAXIMUM OF $22.5 MILLION IN ANTICIPATION OF THE FUTURE ISSUANCE OF THE SAME. IN GENERAL OBLIGATION BONDS, WHICH IS THE MAXIMUM AMOUNT OF PRINCIPAL NEEDED FOR THE STATED PROJECTS. THIS DOES NOT NECESSARILY MEAN THAT, WE WILL ROLL THE NOTES INTO THAT. FUTURE ISSUANCE, BUT IT PROVIDES FOR THE, ANTICIPATION OF THAT.

EACH OF THE PROJECTS HAVE ADDITIONAL LEGISLATION TO BE CONSIDERED LATER THIS EVENING.

ADDITIONALLY, THE ORDINANCE PROVIDES FOR THE FOLLOWING THE DESCRIPTION OF THE ESTIMATED FUTURE BOND TERMS. NOT TO BE CONFUSED WITH THE NOTE TERMS THAT WERE GOING TO BE ISSUING IS INCLUDED IN SECTION TWO, AND THIS IS FOR THE SOLE PURPOSE OF PROVIDING INFORMATION TO FRANKLIN AND LINCOLN COUNTIES TO ASSIST WITH THE ESTIMATED FUTURE DEBT LIMITATION CALCULATIONS, MYSELF AND, JOE, THE CITY MANAGER, WILL DETERMINE THE ACTUAL PRINCIPAL AMOUNT OF BOND ANTICIPATION NOTES TO BE SOLD, ONCE WE GET TO, ONCE WE GET TO PRICING AND WHEN WE GO FOR THE ISSUANCE UP TO $22.5 MILLION, THE NOTES ARE TO BE DATED THE DATE OF ISSUANCE AND SHALL NOT MATURE MORE THAN ONE YEAR FOLLOWING THE DATE OF ISSUANCE. THE NOTES WILL BEAR INTEREST RATE AT A RATE OR RATES NOT TO EXCEED 6.5% PER YEAR. WE DO NOT ANTICIPATE THOSE RATES TO BE THAT HIGH BASED ON WHAT WE'RE SEEING. SO FAR IN THE MARKET AND THE NOTES MAY UTILIZE THE OHIO MARKET ACCESS PROGRAM, PROVIDED THAT IN IN CONSULTATION WITH OUR MUNICIPAL ADVISOR AND UNDERWRITER, THEY FIND IT ADVANTAGEOUS. AT THIS POINT. WE ARE CURRENTLY NOT PLANNING TO UTILIZE THAT. AFTER ADDITIONAL REVIEW, DUE TO THE NECESSARY, FUNDING NEEDED. IN A QUICK TURNAROUND, THE PROCEEDS WILL BE PAID INTO THE PROPER FUND OR FUNDS, AND WITH THIS ORDINANCE, THEY WOULD BE CONSIDERED APPROPRIATED AND WILL BE USED FOR THE PURPOSE FOR WHICH THE NOTES ARE ISSUED. THE SOURCE OF REPAYMENT FOR BRISCOE PARKWAY PORTION, WHICH IS THE $7.5 MILLION OF THE ISSUANCE, MAY CONSIST OF RELATED TIF PAYMENTS AND INCOME TAX SET ASIDE FOR INFRASTRUCTURE FOR ECONOMIC DEVELOPMENT PURPOSES. AND I WILL SAY, PRELIMINARY EVALUATION AND ANALYSIS THAT WE'RE DOING WITH OUR FULL CAPITAL BUDGET AND PROJECTIONS. I DON'T ANTICIPATE, NEEDING TO ROLL THAT INTO A LONGER TERM BOND, BUT THIS IS ALLOWING US TO TAKE ADVANTAGE OF OUR, THE MARKET AND THE ECONOMY, TO KEEP OUR CASH AVAILABLE. THE SOURCE OF REPAYMENT FOR MARKET STREET EXTENSION PORTION, WHICH IS $15 MILLION, COULD BE, THE ISSUANCE MAY CONSIST OF RELATED TO PAYMENTS IN THE WINDSOR TIF FUND AND BUSINESS DEVELOPMENT CHARGE COLLECTED BY THE EAST AUTHORITY FOR CERTAIN BUSINESSES WITHIN THE BUSINESS PARK. AND THIS IS SOMETHING THAT WAS CONSIDERED, WOULD BE CONSIDERED IN ANY OVERALL DEBT ISSUANCE IF IT WOULD NEED TO BE ADDITIONAL ANALYSIS AND REVIEW OF THESE FUNDING SOURCES ARE CONTINUALLY EVALUATED AS OTHER PROJECTS AND SIGNIFICANT EXPENSES ARE PLANNED, AND FINALIZED, WITH BOND COUNCIL AND MUNICIPAL ADVISOR CONSULTATION, THEY RECOMMENDED THAT WE PURSUE THE ISSUANCE OF BOND ANTICIPATION NOTES FOR THESE PROJECTS, ISSUING THESE NOTES INSTEAD OF GOING DIRECTLY TO THE ISSUANCE OF GENERAL OBLIGATION BONDS, WILL ALLOW FOR A STREAMLINED AND ABBREVIATED PROCESS TO OBTAIN FUNDING FOR THE IMMEDIATE PROJECT NEEDS, WHILE ALLOWING FOR ADDITIONAL TIME TO EVALUATE

[01:10:03]

VARIOUS OTHER PROJECTS AND PLANNING STAGES AND THEIR FUNDING SOURCES. NO OFFICIAL STATEMENT OR EXTENDED CREDIT RATING PROCESS, WOULD BE NECESSARY. HOWEVER, WE WILL BE PURSUING A STANDALONE RATING WITH S&P, WHICH IS TYPICALLY OBTAINED BY COMPLETING A QUESTIONNAIRE FOR THEIR REVIEW. SO THIS PROCESS ALLOWS FOR US TO STILL, SEEK THAT TRIPLE-A RATING FOR THESE NOTES AND TAKE ADVANTAGE OF THE MARKET WITH THAT, THIS ALLOWS FOR, NEW ALBANY TO TAKE ADVANTAGE OF CERTAIN ECONOMIC CONDITIONS WHERE CASH CAN BE INVESTED AT A HIGHER INTEREST RATE THAN ANTICIPATED. INTEREST RATE CHARGE FOR THE NOTES ISSUED. AND WE'RE CONTINUING, TO EVALUATE THE MARKET AND POTENTIALLY LOCK IN A LOWER INTEREST RATE IF THERE IS A DECISION MADE TO PROCEED WITH THE FULL GENERAL OBLIGATION BOND ISSUANCE, IT ALLOWS TIME FOR THAT. THE TARGET TIMELINE WAS INCLUDED IN THE LEGISLATIVE REPORT. WE HAVE ADJUSTED IT SLIGHTLY TO MOVE THE PROCESS UP, EVEN FASTER BY A WEEK. SO, AS OF NOW, WE ANTICIPATE THE PRICING TO BE AUGUST 28TH AND THE CLOSE TO BE SEPTEMBER 11TH, AS I MENTIONED BEFORE, THERE ARE TWO RELATED AGENDA ITEMS, CONCERNING THE MARKET STREET EXTENSION, THE BRISCOE PARKWAY PROJECT, WHICH SHOULD BE CONSIDERED ONCE THIS ORDINANCE, TO ISSUE NOTES, IS ADOPTED, THE ORDINANCE ESTABLISHES THE APPROPRIATION FOR THE PROJECT, WHICH SHOULD BE IN PLACE PRIOR TO APPROVAL, THIS ORDINANCE INCLUDES LANGUAGE DECLARING AN EMERGENCY AND WAIVING THE SECOND READING TO FACILITATE ADOPTION THIS EVENING. AND DUE TO THE IMMEDIATE NEED TO SECURE FUNDING RELATED TO THE MENTIONED PROJEC, STREAMLINED TIMELINES AND CURRENT MARKET CONDITIONS, IT'S NECESSARY TO ADOPT THIS LEGISLATION AT THE EARLIEST DATE POSSIBLE. WAIVING THE SECOND READING WILL ALLOW FOR THE CITY TO ADHERE TO THE TARGETED TIMELINE AS PRESENTED AND, FOR ME TO ISSUE TIMELY CERTIFICATION OF FUNDS FOR EACH OF THE PROJECTS AT HAND. QUESTIONS ON THE ORDINANCE? YEAH, A COUPLE. SO I UNDERSTAND THE WHY BEHIND THE NOTES, JUST TO MEET SOME OBLIGATIONS THAT WE CURRENTLY HAVE. AND I DO LIKE THE FACT THAT WE'LL HAVE SOME FLEXIBILITY IN A YEAR TO MAYBE GO TO BONDS IF NEEDED, BUT I GUESS MY GENERAL QUESTION WOULD BE PROBABLY TO BOTH YOU AND JOE THEN GIVEN FUTURE, PROJECTS, DOES THIS ALLOW US THE FLEXIBILITY TO POSSIBLY PULL BACK THAT 22, FIVE IN A YEAR IF WE NEED TO MOVE IT INTO ANOTHER DIRECTION, YOU KNOW, SAY WE'RE PUTTING THIS VETERANS MEMORIAL PARK OR SOMETHING OF THAT NATURE. DOES THIS ALLOW A FLEXIBILITY BY NOT BY DOING THE NOTES VERSUS ISSUANCE OF BONDS? YES. AND SO THE OVERALL VALUATION THAT'S BEEN DONE IN THE PAST, STILL REMAINS THE SAME AS THE AVAILABILITY OF FUNDS, FOR, YOU KNOW, NEWER PROJECTS, VETS MEMORIAL, POTENTIAL UPDATES TO THAT PROJECT AND THIS PARTICULAR AMOUNT, AS I SAID, THE 7.5 MILLION FOR BRISCOE PARKWAY, I DON'T ANTICIPATE ROLLING ANY PORTION OF THAT INTO ANY SORT OF FUTURE ISSUANCE. SO THAT AVAILABILITY WOULD BE THERE. IN ADDITION, THERE IS CASH AVAILABLE FOR MARKET STREET EXTENSION, YOU KNOW, AS OF RIGHT NOW, WE HAVE WE ALREADY APPROPRIATED $5 MILLION OUT OF THE WINDSOR TIF FUND SO THAT CASH IS AVAILABLE AT THIS POINT.

AND SO THIS DOES ALLOW FOR US ADDITIONAL TIME TO DECIDE IF A PORTION OF THAT WOULD BE ROLLED INTO, WHAT WOULD BE CONSIDERED, THE SAME SOURCE OF REPAYMENT AS WHAT WE CONSIDERED FOR ROUND TWO. BUT THERE'S, ADDITIONAL FLEXIBILITY THAT WE HAVE WITH OTHER FUNDS THAT WE WANT TO EVALUATE. OKAY AND I KNOW WE TALKED ABOUT A CAP OR SO OF WHAT WE'RE LOOKING TO SPEND. I THINK WE WOULD STILL STAY WITHIN THAT CAP AND GOING THIS ROUND. OKAY YES. OKAY ANY OTHER QUESTIONS ON THE ORDINANCE? ALL RIGHT. THERE'S BEEN A REQUEST FROM STAFF TO DECLARE AN EMERGENCY AND WAIVE SECOND READING FOR THIS ORDINANCE. I WILL MOVE TO DECLARE AN EMERGENCY AND WAIVE SECOND READING FOR ORDINANCE OH 30 2024. SECOND. MR. JOHNSON, THANK YOU. THIS RESOLUTION AUTHORIZES A SECOND AMENDMENT TO THE DEVELOPMENT AGREEMENT WITH COY. NEW ALBANY TECH PARK, LLC, REPRESENTED BY VANTRUST REAL ESTATE. THE FIRST AMENDMENT WAS APPROVED LAST YEAR, AUTHORIZING VANTRUST TO BUILD A PORTION OF BRISCOE PARKWAY, WHICH THE CITY WOULD REIMBURSE VANTRUST FOR. THIS AMENDMENT AUTHORIZES VANTRUST TO BUILD THE REMAINING PORTION OF BRISCOE PARKWAY, WHICH ALLOWS THE CITY TO CAPTURE AN ECONOMY OF SCALE WITH THE ADJACENT SEGMENT. HAPPY TO TAKE ANY QUESTIONS. OTHERWISE, THIS, RESOLUTION CAN BE ADOPTED THIS EVENING. ALL RIGHT. ANY QUESTIONS ON, RESOLUTION R 32? BY THE WAY, IF YOU HAVEN'T BEEN UP THERE IN A WHILE, THERE'S A LOT OF NEW ROADS. RESOLUTION R 34 2024 A RESOLUTION TO AUTHORIZE CITY MANAGER TO ADVERTISE, BID, AWARD AND EXECUTE CONTRACTS RELATED TO THE CONSTRUCTION OF THE MARKET STREET EXTENSION PROJECT. MR. BARKER FOR REAL THIS TIME. SO THIS ONE IS, THIS ONE'S COME A LONG WAY. IT'S LIKE GROUNDHOG DAY ALL OVER AGAIN. LIKE I'VE DONE THIS BEFORE, BUT, SO, ONCE AGAIN, AS A RESULT OF THE PUBLIC OUTREACH AND ENGAGEMENT THAT WA, REALLY THE CORE OF THE STRATEGIC PLAN UPDATE IN 2020, THERE WAS A LOT OF CONCERN, REGARDING THE TRAFFIC CONGESTION WITHIN THE VILLAGE CENTER. AND A LOT OF THAT WAS DUE IN PART TO THE SCHOOL JUST AM. AND PM, PEAK TRAFFIC, BUT JUST OVERALL AM AND PM PEAK, JUST BYPASSING AND KIND OF GOING THROUGH THE CITY WITH WAS REALLY CAUSING SOME DELAY AND JUST SOME CONCERN THAT WE WANTED TO BE PROACTIVE AND GET AHEAD OF, SO THE MARKET STREET EXTENSION PROJECT WAS REALLY DEVELOPED AND STUDIED AND EVALUATED DURING THAT TIME AND REALLY IMPLEMENTS AND PUTS IN PLACE A MORE OF A DIRECT CONNECTION TO AND FROM, US 62, PRIMARILY IN THE NORTH SOUTH DIRECTION, IT ALSO, IT DOES ALLOW, TRAVELERS TO BASICALLY BYPASS THE CENTER OF TOWN, WHICH ARE THE AREAS THAT ARE MOST PRONE TO, CONGESTION. SO THIS IS A GREAT PROJECT, AND WE'RE REALLY EXCITED TO SEE IT, JUST TO SEE IT IN ACTION HELP. IT JUST BETTER DISTRIBUTE, TRAFFIC THROUGHOUT THE CITY. NEXT SLIDE, PLEASE LET ME KNOW. OH, VERY GOOD. OKAY. SO, HERE IS, FINALLY A TOTAL, PROJECT, SO HERE WE AR.

THIS IS, REYNOLDSBURG, NEW ALBANY ROAD. OF COURSE. THIS IS MARKET STREET EXTENSION, MARKET STREET HERE, WHERE IT CURRENTLY, DEAD ENDS AT AT, REYNOLDSBURG, NEW ALBANY ROAD, WE ARE

[01:20:04]

PROPOSING TO INSTALL A ROUNDABOUT AT THIS LOCATION. THIS WILL BE MUCH LIKE, WHAT WE HAVE AT MARKET IN MAIN, NOT QUITE AS FANCY, BUT BUT IT WILL DEFINITELY, TAKE CUES FROM WHAT WE ALREADY HAVE IN PLACE THERE, MARKET STREET WOULD THEN EXTEND TO THE EAST OF REYNOLDSBURG. NEW ALBANY ROAD AND THEN CONTINUE NORTH TO WHERE IT WOULD MORE OR LESS JOIN UP WITH THIRD STREET.

AT DUBLIN-GRANVILLE ROAD. SO BASICALLY THE ROAD SECTION THAT WE'RE PLANNING THROUGH HERE IS JUST BASICALLY IT'S A SINGLE LANE IN EACH DIRECTION, AND THERE WILL BE A LANDSCAPED MEDIAN ALONG THE CENTER, AND THEN AT SUCH TIME AS, YOU KNOW, IF THERE'S DEVELOPMENT, IN ANY OF THESE AREAS, IT WOULD LIKELY HAVE A CURB CUTS AND OTHER THINGS, ADDED, WITHIN THAT, WITHIN THAT CENTER MEDIAN TO ACCOUNT FOR THAT, THIRD STREET, IS, UNFORTUNATELY, IT WILL BE RECONSTRUCTED AS A PART OF THIS PROJECT, THE EXISTING BRICK STREET IN ITS CURRENT FORM JUST DOESN'T HAVE THE LOADING CAPACITY TO DEAL WITH THE AVERAGE DAILY TRAFFIC AND SOME OF THE WEIGHTS THAT WE'RE ANTICIPATING WITH, WITH THIS BEING A SUCCESSFUL PROJECT THAT WE EXPECT IT TO BE, SO IT WILL BE RECONSTRUCTED. GENERALLY, THIS WILL BE A THREE LANE SECTION HERE ALONG THIRD STREET, THERE WILL BE A, A TURN LANE, A LEFT TURN LANE THAT WILL ALLOW PEOPLE TO TURN LEFT ONTO, WHAT? I GUESS THIS IS WHAT THE US 62. AND THEN ALSO THERE WILL BE A TURN LANE FOR PEOPLE THAT ARE SOUTHBOUND ON 62 TO ALLOW THEM TO TURN, TURN RIGHT INTO THERE, THE INTERSECTION HERE WILL BE A SIGNALIZED INTERSECTION. AND WE'RE DOING THAT VERY INTENTIONALLY BECAUSE WE WANT TO MAKE SURE THAT WE'RE ABLE TO KIND OF DIRECT TRAFFIC TO FOLLOW WHAT SHOULD FEEL LIKE THE NEW THROUGH MOVEMENT, WHICH IS REALLY MAKING THIS US 62 KIND OF CONTINUING DOWN THIRD STREET. AND THEN INTO, YOU KNOW, THE VILLAGE CENTER AREA AT MARKET STREET, TO MAKE THAT THE MORE INTUITIVE ROUTE TO REALLY KIND OF KEEP PEOPLE FROM JUST CUTTING THROUGH NEW ALBANY IN THAT MOST CENTER OF TOWN THAT WE HAVE, ADDITIONALLY, THE PROJECT WILL CONTINUE FURTHER NORTH. ORIGINALLY WE WERE ANTICIPATING, STOPPING STOPPING THE PROJECT AND PAVEMENT IMPROVEMENTS AT GENERALLY IN THE AREA OF GINKGO ALLEY. THIS AREA IS THE NEW ALBANY EXCHANGE, WE ORIGINALLY CONSIDERED STOPPING IT HERE, BUT WE RECOGNIZE THAT THERE'S SOME PENDING DEVELOPMENT AND THERE'S JUST THIS SMALL SECTION OF THE ROAD HERE THAT IS INCOMPLETE AS IT RELATES TO THE STREET SECTION OF WHAT YOU WOULD SEE OUT THERE. SO IT'S STILL UNIMPROVED.

THERE'S NO CURB, THERE'S NO PARALLEL PARKING, THERE'S NO SIDEWALKS. SO IT MAKES SENSE NOW TO JUST TO JUST DO THE WHOLE THING, GET IT DONE, REPAVE, HAVE THIS THING BE CONTINUOUS, NOT TO COME BACK IN 2 OR 3 YEARS TO, TO DO AN ADDITIONAL, PAVEMENT PROJECT AND RE DISTURB, RESIDENTS AND POPULATION AND TRAFFIC THAT WE SEE. SO, TO THAT END, THE PROJECT WILL BE CONSTRUCTED IN TWO PHASES AND GENERALLY SPEAKING, PHASE ONE IS GOING TO INCLUDE THE CONSTRUCTION OF THE ROUNDABOUT AND THE ROADWAY IMPROVEMENTS HERE ALONG REYNOLDSBURG NEW ALBANY ROAD. IT WILL ALSO INCLUDE THE CONSTRUCTION OF THE ROADWAY ACROSS, BASICALLY ACROSS ROSE RUN STREAM HERE AND THEN LINING UP TO DUBLIN-GRANVILLE ROAD, AND THEN AT THE SAME TIME, PHASE ONE IMPROVEMENTS ARE ALSO GOING TO INCLUDE THE PRIVATE SITE IMPROVEMENTS THAT WE HAVE, AS WITH REGARD TO THE NEW ALBANY UNITED METHODIST CHURCH AND ALSO THE NORTHWEST EYE SURGEONS PROPERTY THERE. SO WE AS A AS A WAY OF SOFTENING THIS CURVE, WE DID ENCROACH PRETTY SIGNIFICANTLY ONTO THE CHURCH PROPERTY IN PARTICULAR, THEY'VE BEEN A GREAT SUPPORT, AND VERY PATIENT WITH US THROUGHOUT THIS PROJECT. AND WE'RE JUST BASICALLY RETURNING THEIR, THEIR PARKING LOT TO, TO A BETTER CONDITION THAN WHAT IT WAS. IT HELPS US TO JUST, I THINK I THINK OVERALL, I THINK THAT WE'RE WE'RE MUTUALLY BENEFITING FROM THIS. WE'RE DOING SOME IMPROVEMENTS ON THEIR PROPERTY. THEY'RE GIVING US SOME RIGHT OF WAY SO THAT WE CAN IMPROVE TRAFFIC CIRCULATION THROUGH THE CITY. SO WE COMMITTED EARLY ON THAT WE WOULD NOT, HAVE THEM IN A CONDITION WHERE THEIR, PARKING AREA AND ACCESS WAS OUT OF COMMISSION AT THE SAME TIME AS THEIR THE ADJACENT ROADWAY WAS OUT OF COMMISSION. SO WE'RE MAKING SURE THAT WE FOLLOW THROUGH WITH THOSE COMMITMENTS THROUGHOUT CONSTRUCTION, SO AGAIN, PHASE ONE IS GENERALLY THE ROUNDABOUT AT MARKET STREET AND REYNOLDSBURG NEW ALBANY ROAD, THE SECTION THAT LEADS UP TO, DUBLIN-GRANVILLE ROAD AND THEN ALSO THE PRIVATE PROPERTY IMPROVEMENTS, THAT ARE, THAT ARE A PART OF THAT. ARE SUBSTANTIAL COMPLETION DATE FOR PHASE ONE IMPROVEMENTS IS JULY 1ST, 2025.

[01:25:02]

SO SUBSTANTIAL COMPLETION, MEANING THAT GENERALLY THE ROADWAY IS COMPLETE AND CAN BE OPEN TO PUBLIC TRAFFIC. THERE'S LIKELY GOING TO BE PUNCH LIST ITEMS AND OTHER KIND OF CLEANUP KIND OF BEYOND THAT. FURTHERMORE, IN MAY OF 24, COUNCIL APPROVED RESOLUTION R 2024, WHICH AUTHORIZED CITY MANAGER TO ENTER INTO A MEMORANDUM OF UNDERSTANDING WITH THE NEW ALBANY COMPANY AS IT RELATES TO THE CONSTRUCTION OF THIS SECTION OF PHASE ONE, SO BASICALLY, THE NEW ALBANY COMPANY, BY A SEPARATE CONTRACT FROM THE CITY, WILL BE CONSTRUCTING THIS SECTION OF MARKET STREET, WHICH IS GENERALLY FROM THIS LINE HERE TO THIS LINE HERE, SO THEY WILL BE BUILDING THAT WITH THEIR PROJECT AND REGIONAL BASINS AND ALL OF THAT AS WELL. SO OUR PHASE ONE, MILESTONES ARE THE SAME, THE SAME DATES. SO, OUR, OUR PROJECTS, HAVE TO BE DELIVERED AT THE SAME TIME. SO IT'S INTENTIONALLY SCHEDULED THAT WAY. AND, AND PART OF THE AGREEMENT AS SUCH, THE BALANCE OF THE WORK, IS ANTICIPATING A SUBSTANTIAL COMPLETION DATE OF NOVEMBER 15TH, 2026. PART OF THE REASON FOR THAT IS THAT WE WERE VERY MINDFUL ABOUT HAVING, THE INTERSECTION REALIGNMENT WORK. WE WANTED TO BE STRATEGIC ABOUT ENSURING THAT WE HAD A SUMMER SEASON, TO ALLOW THAT CONSTRUCTION TO HAPPEN. WE WANTED TO CAPITALIZE ON THOSE TIMES WHERE TRAFFIC IS TRAFFIC VOLUMES ARE DOWN, AND IT JUST HELPS US TO HAVE OVERALL A LITTLE BIT LESS DISTURBANCE. IT'S GOING TO BE INCONVENIENT FOR A PERIOD OF TIME, BUT IF SOME OF THE WORK ON 605 THIS YEAR IS PROOF THAT I THINK WE'VE BEEN ABLE TO GET IN AND GET OUT, PRETTY QUICKLY ON SOME OF THESE PROJECTS. SO WE HOPE TO CONTINUE THAT TREND. WITH THIS ONE AS WELL, SO IT'S VERY LIKELY THAT THE CONTRACTOR WOULD START ON A LOT OF THE IMPROVEMENTS ON THIRD STREET AND MAYBE SOME THINGS ALONG THE ROAD, BUT REALLY WHAT WE'RE BOILING DOWN TO IS WE CAN'T HAVE THE MAJOR, THE MOST IMPACTFUL TRAFFIC. YOU KNOW, THE MOST THE LARGEST TRAFFIC IMPACT, CAN'T HAPPEN UNTIL SUCH TIME AS SCHOOL IS OUT FOR THE SUMMER.

AND THAT'S THE REASON FOR THE SCHEDULE. THERE MIKE, CAN I ASK A QUESTION? YES. SO IN THAT INTERIM PERIOD, DO YOU END UP WITH A WHOLE BUNCH OF NEW TRAFFIC REDIRECTING ALONG THOSE PAVER ROADS? IS THAT A CONCERN FOR THAT LONG PERIOD OF TIME NOW THAT WE'VE GOT. SO WE FINISHED THE TRAFFIC CIRCLE. WE'RE DIRECTING EVERYBODY THROUGH, AND WE'VE GOT THIS ROAD THAT REALLY CAN'T HANDLE THE CAPACITY. HOW IS THAT GOING TO WORK IN THAT INTERIM? YEAH. SO BECAUSE WE'RE BUILDING IT GENERALLY FROM LIKE SOUTH TO NORTH, WE'RE NOT REALLY GOING TO SEE AN INCREASE IN TRAFFIC VOLUME UNTIL SUCH TIME AS THIS REALIGNMENT HAPPENS. OKAY. SO THE REALIGNMENT IS ESSENTIALLY THE LAST THING TO HAPPEN TO REALLY FORCE THE REDIRECTION OF TRAVEL PATHS, IF THAT MAKES SENSE. SO WHAT WILL HAPPEN, ON AN INTERMITTENT BASIS IS THAT, YOU KNOW, PHASE ONE IS DONE BASICALLY TO REYNOLDSBURG, NEW ALBANY ROAD. AND TRAFFIC WOULD THEN JUST CONTINUE ON ON SOMETHING THAT IS VERY SIMILAR TO WHAT IS EXISTING THIRD STREET TODAY, AND THEN JUST IN CONJUNCTION WITH THAT, YOU KNOW, AGAIN, THE LARGER REALIGNMENT, THE EXPANSION OF THIRD STREET WOULD HAPPEN, SO THAT'S KIND OF THE FINAL PIECE TO REALLY FORCE THE REDIRECTION OF TRAFFIC AT THAT TIME. SO I DON'T WE'RE NOT ANTICIPATING, A PROBLEM IN THAT IN THAT END, OF COURSE, WE'LL BE ACTIVELY MONITORING THE PROJECT THROUGHOUT CONSTRUCTION AND WE'LL HAVE TO ADJUST AS NEEDED.

BUT, OKAY. WILL THAT BE SIGNALIZED AT THE DUBLIN-GRANVILLE ROAD AT THIRD STREET, NO. SO THIS IS GOING TO BECOME SO MARKET STREET WILL WILL BE. WELL, THIRD STREET, MARKET STREET HERE WILL BECOME A THROUGH MOVEMENT. AND THEN THERE WILL BE A STOP CONDITION ON THE EAST AND WEST ON DUBLIN-GRANVILLE ROAD. THE INTENT IS TO ALLOW PRIORITY FOR THE HIGHEST VOLUME OF TRAFFIC CONTINUING THROUGH THERE. MIKE, IT MAY BE HELPFUL IF YOU, DESCRIBE THE COMPLETION DATE THAT THE BEGINNING OF PHASE TWO RELATIVE TO THE COMPLETION OF PHASE ONE, HOW MUCH OF A GAP IS THERE GOING TO BE? SO WE DON'T WE HAVEN'T IDENTIFIED SPECIFIC MILESTONE DATES WITHIN PHASE TWO TO THAT LEVEL OF DETAIL YET, BUT I DON'T THERE'S NOTHING THAT WOULD, AT LEAST AT THIS TIME, PRECLUDE THE CONTRACTOR FROM STARTING ON PHASE TWO IMPROVEMENTS EVEN AT THE SAME TIME AS PHASE ONE IMPROVEMENTS. I THINK THAT'S GOING TO BE A VERY LIKELY THE WAY THAT THEY ACTUALLY BUILD IT. I'M TRYING TO GIVE THEM AS MUCH FLEXIBILITY AS THEY CAN JUST TO HELP US WITH WITH SCHEDULING AND TIMING AND PRICING. AT THE END OF THE DAY, BUT IT'S VERY LIKELY THAT TO THE GENERAL PUBLIC, IT'S GOING TO LOOK LIKE THERE THAT THIS IS JUST ONE CONTINUING CONSTRUCTION PROJECT. I DON'T I DON'T ANTICIPATE THAT THERE'S GOING TO BE A HARD START AND A HARD STOP, AND THEN FOLLOWED BY ANOTHER HARD START AND ANOTHER HARD

[01:30:01]

STOP. JUSTIN SO THE INTENTION THAT WE HAVE WITH THE CONSTRUCTION OF THE ROUNDABOUT IN THE PORTION THAT HAS NUMBER ONE AND THEY GO THERE, WE'RE GOING TO UTILIZE THE NEW ROADWAY ACTUALLY TO MAINTAIN TRAFFIC WHEN THIRD STREET IS CLOSED. SO THERE'LL BE A DETOUR. I DON'T KNOW EXACTLY THE ROUTING OFF THE TOP OF MY HEAD, BUT IT WILL TAKE US UP MARKET STREET AND THEN DETOUR SOMEWHERE ALONG DUBLIN-GRANVILLE ROAD, WHILE THIRD STREET IS CLOSED. SO, ESSENTIALLY WHAT WE'RE ANTICIPATING IS ONCE PHASE ONE ON THE CITY'S END AND NACO'S END IS COMPLETE, THEN THAT WILL OPEN UP THE NORTHERN PORTION OF THIRD STREET FOR THE CONTRACTOR. SO ULTIMATELY WE'RE LOOKING AT, YOU KNOW, PHASES ONE. SOUTH OF DUBLIN-GRANVILLE. AND THEN AS SOON AS THAT'S COMPLETE, TRAFFIC WILL BE PUT ON THE NEW ROADWAY, AND THEN THE CONTRACTOR WOULD START NORTH OF DUBLIN-GRANVILLE AND ON THIRD PHASE, PHASE ONE WILL END JULY 24TH IS WHAT I HEARD. 25, 25, 25. YEAH. EXCUSE ME. 25. AND THEN PHASE TWO WILL GO THROUGH NOVEMBER OF 26. SO THAT'S A YEAR, 15 MONTHS CORRECT. AFTER PHASE ONE HAS BEEN COMPLETED. AND AGAIN, I DIDN'T SAY THIS EARLIER, BUT I DID NOT WANT TO HAVE A SCENARIO WHERE WE HAVE TRAFFIC IMPACTED FOR THE CONSTRUCTION OF THE ROUNDABOUT ON REYNOLDSBURG AND ALBANY ROAD. AND THIS TRAFFIC BEING IMPACTED AT THE SAME TIME. I JUST DON'T THINK THAT THERE WOULD BE A HIGH LEVEL OF TOLERANCE FOR THAT. SO WE'RE WE'RE DEFINITELY MAKING THAT DECISION TO PUSH THIS. SO AND I UNDERSTAND THAT. JUST A QUESTION. SO YOU FINISHED THE ROUNDABOUT SECTION ONE. YOU GET UP TO DUBLIN-GRANVILLE ROAD. IF TRAFFIC GOES UP TO THAT INTERSECTION AND YOU'RE BUILDING ON THIRD, WHERE DOES THE TRAFFIC GO? WE WOULD HAVE ACCESS. AT DUBLIN-GRANVILLE ROAD ONLY. SO THEY WOULD THEY WOULD BE, FOR A TEMPORARY PERIOD OF TIME. THEY WOULD HAVE TO TURN LEFT OR RIGHT ON DUBLIN-GRANVILLE ROAD FOR 13 MONTHS. IS THAT RIGHT? SO TEMPORARY IS A YEAR AND A HALF YEAR 13 MONTHS? YEAH THAT'S THAT'S TRUE. BUT BEFORE THERE'S A TRUE. NOW IN THE MEANTIME, TRAFFIC WILL BE MAINTAINED. YOU COULD STILL GO UP TO THE INTERSECTION OF THIRD STREET AND 62 AS IT IS TODAY. SO YOU WOULD STILL BE ABLE TO KIND OF MAKE THAT RIGHT HAND TURN OR LEFT HAND TURN. SO, YOU KNOW, I UNDERSTAND. SO ONCE YOU OPEN THAT UP, WHAT ARE YOU DOING A SEMI COMES THROUGH THERE. GETS TO THAT INTERSECTION. IT HAS TO GO UP THIRD STREET IN THE MIDDLE OF CONSTRUCTION. HAS TO TAKE A RIGHT TURN ON AN INTERSECTION THAT ISN'T COMPLETED. AND PRETTY TIGHT. JUST TRYING TO UNDERSTAND THE LOGISTICS OF THAT. YEAH. SO WE. YEAH. SO WE, WE NOW HAVE, PHDS IN TRUCK TRAFFIC, BECAUSE IT IS A MESS EVERY DAY, SO CLEARLY. YEAH, YEAH, I THINK THAT, WE'VE DONE A GREAT JOB. SO THIS ROUTE, PARTICULARLY THIS, THIS INTERSECTION HERE OF 62 AND 605, IT IS BASICALLY OFF OF THE ROUTES FOR LARGE TRUCKS. SO WE'VE BEEN WORKING CLOSELY WITH ODOT. WE'VE BEEN ACTIVELY ENFORCING THINGS ON OUR OWN. RIGHT. JUST MAKE SURE THAT WE'RE ISSUING PERMITS THAT DON'T INCLUDE THESE ROUTES. WE ALWAYS HAVE ISSUES WHERE PEOPLE ARE GETTING STUCK IN THE INTERSECTION TO THAT END. SO I DON'T BELIEVE, YOU KNOW, AS FAR AS OVERSIZE LOADS, THINGS OF THAT NATURE, I DON'T BELIEVE THAT THEY WOULD FIND THEMSELVES, HERE. WE CERTAINLY WOULDN'T PERMIT IT THAT WAY. BUT WE WILL WE'LL DEFINITELY LOOK INTO THAT IN MORE DETAIL, I THINK THAT WE'VE ESTABLISHED ENOUGH ALTERNATIVE PATHS FOR THE FOR THE LARGER VEHICLES, IN CONJUNCTION WITH ALL THE OTHER CONSTRUCTION ACTIVITY THAT I DON'T ANTICIPATE THAT, THAT THIS IS GOING TO CONFLICT WITH ANY OF THOSE OTHER ALTERNATIVE PATHS THAT WE'VE BEEN USING. SO, MIKE, WOULDN'T WE ALSO HAVE TO WORK WITH ODOT AND HAVE A DESIGNATED TRUCK ROUTE DETOUR AS PART OF THIS CLOSURE OR RESTRICTION? SO, YEAH, CORRECT. PERHAPS POTENTIALLY ROUTE TRUCK TRAFFIC ON TO 161 AND AROUND THE VILLAGE CENTER. OKAY. YEAH. THAT'S ULTIMATELY, AS IT PERTAINS TO THE OVERSIZE LOAD PERMITS, ESPECIALLY DURING THE TIMES OF CONSTRUCTION, I WOULD NOT PERMIT AN OVERSIZE LOAD TO GO THROUGH THE VILLAGE CENTER, PARTICULARLY, YOU KNOW, IN ANY GIVEN DAY. BUT GENERALLY THOSE OVERSIZE LOADS ARE DELIVERING THINGS TO DEVELOPERS, RIGHT? SO, WE DON'T SEE ANY REAL THROUGH OVERSIZE LOADS THROUGH THE VILLAGE CENTER, IF WE WERE TO GET ONE, IT WOULD BE FOR A DEVELOPMENT THAT'S IN PROGRESS.

SO THE, THE BULK OF THE OVERSIZE LOAD PERMITS THAT WE'RE SEEING ARE OUT EAST IN KIND OF THE INTEL BUSINESS PARK QUADRANT, I DON'T THINK I'VE SEEN A SINGLE PERMIT REQUEST THROUGH THE VILLAGE CENTER SINCE I'VE BEEN HERE SINCE FEBRUARY. I UNDERSTAND OVERSIZE LOAD. I'M JUST TRYING TO UNDERSTAND A SEMI COMING THROUGH THERE THAT'S NOT AN OVERSIZE LOAD. RIGHT. TRUCK TRAFFIC. YEAH, YEAH, YEAH, YEAH. AND JOE'S POINT, IF THAT CAN BE REROUTED, I THINK THAT'S GOING

[01:35:05]

TO BE MUCH BETTER FOR RESIDENTS AND THE TRAFFIC. TRAFFIC WE'RE TALKING ABOUT IS GOING TO BE COMING NORTH ON 605. THEY'RE GOING TO HIT THAT ROUNDABOUT AND HAVE A CHOICE TO MAKE. THEY TURN RIGHT, WHICH WOULD BE DISCOURAGED DURING THE CONSTRUCTION PHASE OR CONTINUE NORTH, MAYBE ALL THE WAY UP TO WALTON PARKWAY BEFORE MAKING A TURN. RIGHT, THAT WOULD PROBABLY BE THE PREFERRED ROUTE TO GET THROUGH THERE, HYPOTHETICALLY, IF AND I'VE SEEN SEMIS TRY TO MAKE THIS TURN, WHICH IS ALWAYS INVIGORATING WHEN YOU'RE PARKED THERE, TO TURN RIGHT, YOU KNOW, BASICALLY AT EAGLES PIZZA OFF OF 62. YEAH. IT'S FUN TO WATCH, YEAH, IT'S NOT PRETTY, I THINK MOST OF THE TRUCKERS HAVE REALIZED, YOU KNOW, THEY ONLY MAKE THAT TRIP ONCE, YEAH. YEAH BUT IS THERE SOME OTHER SIGNAGE OR, AND, YOU KNOW, WORK WITH OUR FRIENDS AT GOOGLE OR APPLE MAPS TO, TO, YOU KNOW, LET TRUCKERS KNOW THAT THAT THAT IS A DISCOURAGED ROUTE. YEAH. NO DOUBT WE DEFINITELY CAN WORK WITH DEVELOPMENT AND MAKE SURE THAT, YOU KNOW, WE GET THE WORD OUT AND WE HAVE, YOU KNOW, A LOT OF PROVISIONS WITHIN OUR, WITHIN THE PROJECT ITSELF JUST FOR ALL OF THAT TEMPORARY SIGNAGE DURING CONSTRUCTION. AND, YOU KNOW, IT'S ALWAYS ON THE FLY AS BEST AS YOU PLAN. THERE'S ALWAYS SOMETHING ELSE TO ADD. SO WE'RE DEFINITELY GOING TO BE, YOU KNO, NIMBLE AND KIND OF ADDRESSING THINGS LIKE THAT AS, AS THEY COME UP. BUT YEAH. AND THE OTHER COMPLICATION IS IT IS A DESIGNATED STATE ROUTE. SO, YOU KNOW, IT IS AGAIN, OPEN TO THE PUBLIC FOR TRANSIT. IT IT IS YOU'RE RIGHT. AND ACTUALLY WE'VE ALSO FOUND SOME WAY TO WITH UTILIZING GOOGLE AND SOME OTHER TOOLS WITH GOOGLE THAT WE CAN BASICALLY IDENTIFY CONSTRUCTION, ON, ON ROADWAYS. SO PEOPLE THAT ARE USING IT FOR MAPPING, IT KIND OF AVOIDS CERTAIN AREAS. IF YOU NOTICE, I THINK SOUTH HARLEM ROAD, IS NOW UPDATED. IT'S GOT, YOU KNOW, IF YOU USE WAZE OR ANYTHING, IT'S GOT A, THERE'S A BIG SCENE THAT SHOWS UP ON YOUR NAVIGATION. AND REALLY IT'S NOT TAKING YOU DOWN THERE. SO THERE'S OTHER THINGS LIKE THAT THAT WE CAN DO AS WELL, BECAUSE MOST PEOPLE DEPEND ON, NAVIGATION TO GET TO AND FROM A LOT OF THESE DESTINATIONS NOW.

SO BUT YEAH, I MEAN, IT'S A GREAT POINT AND WE'RE DEFINITELY GOING TO BE WORKING TO MAKE SURE THIS IS COMMUNICATED. AND, YOU KNOW, TO AVOID AS MANY OF THESE DISRUPTIONS AS WE CAN, CAN WE DO LIKE A PERMANENT CONSTRUCTION DESIGNATION THROUGH ALL OF THE CITY? IT IS WE WE'RE ALWAYS UNDER CONSTRUCTION RIGHT IN THE CENTER. YEAH. JUST PUTTING UP ORANGE BARRELS OUT. YEAH. WE, WE'RE FORTUNATE BECAUSE WE DO HAVE A REALLY PRODUCTIVE RELATIONSHIP WITH ODOT, BUT, YOU KNOW, I'VE HAD CONVERSATIONS WITH ODOT AND SAID, HEY, WE NEED TO NOT ALLOW TRUCKS HERE. AND THEY'RE LIKE, APPRECIATE THE SUGGESTION THERE. YEAH BUT THERE WILL BE TRUCKS THERE. AND, YOU KNOW, THERE'S CERTAIN LIMITATIONS THAT WE HAVE, BUT THEY'VE BEEN VERY HELPFUL, WORKING WITH US. AND I THINK WE'VE BEEN ABLE TO ALLEVIATE A LOT OF THE MORE FREQUENT ISSUES THAT WE'VE HAD, IN THIS AREA IN PARTICULAR. SO WELL, I'M JUST HOPING JUSTIN SAVES SOME OF HIS MAGIC FROM THE 605 TURN LANE FOR THIS PROJECT. YEAH, BECAUSE THAT WAS THAT WAS LITERALLY MAGIC. I WAS GOING TO SAY THE SAME THING. I HAVE A LOT OF FAITH AFTER WHAT I'VE SEEN YOU GUYS DOING RECENTLY, I, I KNOW THIS IS GOING TO BE CHALLENGING. AND SO OF COURSE WE'RE ALL NERVOUS BECAUSE, YOU KNOW, WE GET BLOWBACK, OBVIOUSLY. BUT I'VE GOT A LOT OF FAITH. AND YOU'LL DO THE BEST YOU CAN WITH A COMPLICATED PROJECT. SO I APPRECIATE THAT. HEY MIKE, JUST REAL QUICK, I KNOW WHEN YOU LOOK AT THIS, YOU GOT THIS LINE THAT'S ON THE. I GUESS I'LL JUST CALL IT THE WEST SIDE OF THAT. BUT THAT PHASE ONE WILL INCLUDE A CONNECTION TO DUBLIN-GRANVILLE ROAD, RIGHT? YEAH. SO LINE IS RIGHT HERE. YOU WILL BE CONNECTED DURING PHASE ONE. IT WILL. AND THAT IS JUST A. YEAH. I MEAN, WE ARE ACTUALLY GOING TO BECAUSE THE CITY'S PROJECT IS GOING TO BE CONSTRUCTING THIS. THE INTERSECTION ITSELF, INCLUDING A SHORT DISTANCE SOUTH OF DUBLIN-GRANVILLE ROAD, THAT JUST HAPPENS TO BE ABOUT WHERE THE WHERE A PHASE LINE IS DRAWN WITHIN OUR CONSTRUCTION PLANS. OKAY. BUT BUT CORRECT. THERE WILL BE THAT WOULD NOT BE OBVIOUSLY REOPENED UNTIL IT IS. THERE IS A CONNECTION INTO DUBLIN-GRANVILLE. OKAY. YEAH.

THANKS OKAY. A QUESTION ON PHASE TWO. YOU'RE GOING TO CREATE THREE LANES, RIGHT? FOR TURNING LANES ON PHASE TWO, YOU'RE REFERRING TO THIRD STREET, THIRD STREET OR UP. 62. IS THAT GOING TO BE THREE LANES? I THOUGHT I HEARD YOU SAY THAT, SO, FOR A TURNING LANE. YEAH SO, AT AT THE INTERSECTION LOCATION AT THE SIGNALIZED INTERSECTION, THERE WILL BE TURN LANES, BASICALLY AT AT EACH OF THE THREE LEGS WHERE WE HAVE BASICALLY A RIGHT TURN LANE, GOING SOUTHBOUND ON 62 TO TURN RIGHT TO ESSENTIALLY CONTINUE ON TO 62, THERE WILL BE A NORTHBOUND LEFT TURN LANE FROM THIRD STREET THERE, AND THEN THERE WILL ALSO BE A, I GUESS AN EASTBOUND NORTHBOUND ON THE

[01:40:01]

EXISTING 62 HERE IN ORDER TO TURN LEFT TO CONTINUE ON TO 62 FROM THAT DIRECTION. SO THERE'S GOING TO BE TURNING LANE ADDED TO 62. IT'S HEADED TOWARDS THE YEAH DEPARTMENT. WELL NO. SO IT JUST THE TURN LANE WOULD JUST BE GENERALLY KIND OF IN THIS AREA ONLY TO ACCOMMODATE. BECAUSE WHAT WE WANT TO DO IS I DON'T WANT PEOPLE COMING HERE AND WANTING TO TURN RIGHT ONTO 62.

SO WE HAVE A THERE'S SOME STACKING THERE FOR SOME CARS THAT WANT TO TURN RIGHT, BUT BECAUSE IT WILL BE A SIGNALIZED INTERSECTION, WE ARE GOING TO GIVE A PRIORITY GREEN LIGHT TO THAT CONTINUATION OF THAT MOVEMENT THROUGH THIRD STREET. SO WE'RE GOING TO SORT OF DE-INCENTIVIZE, THE TRAFFIC FROM CONTINUING ON ON THE PATH THAT THEY TEND TO FOLLOW TODAY AND TEACH THEM THAT, HEY, THERE'S A MUCH FASTER WAY AROUND, WITH THIS PROJECT. AND THEN ONCE PEOPLE ACCLIMATE TO IT AND WE SEE THAT THERE'S A NEW AND DIFFERENT, YOU KNOW, TRAFFIC DISTRIBUTION, WE'LL KIND OF FINE TUNE THE TIMING AT THAT POINT. I THINK IN THE BEGINNING WE'RE GOING TO HAVE TO MAKE IT, YOU KNOW, KNOWN THAT, HEY, YOU YOU REALLY WANT TO KIND OF CONTINUE, OR YOU'LL HAVE TO JUST WAIT, GIVE THEM A REALLY LONG WAIT. TURNING RIGHT. YEAH NOW, WE RECOGNIZE THERE'S BUSINESSES AND OTHER THINGS HERE WE'RE NOT LOOKING TO HURT THAT, BUT WITHIN REASON, I THINK THAT PEOPLE NEED TO UNDERSTAND THAT. HEY, I'M SITTING HERE AND ALL THESE CARS ARE PASSING BY ME, AND, YOU KNOW, TO THAT END, THEY MAY EVEN FIND IT FASTER TO JUST CONTINUE TO GO AROUND AND KIND OF WORK THEIR WAY BACKWARDS TO GET TO GET THERE. SO I GUESS THE BEAUTY OF THE GRID NETWORK WE HAVE AND THE NICO SECTION, THAT'S GOING TO BE TWO LANES, CORRECT AND CORRECT. IT'LL BE, IT'S BASICALLY THE WIDTH OF A THREE LANE SECTION, BUT THAT CENTER LANE WILL BE A GRASSED MEDIAN. THERE WILL BE STREET TREES IN IT, IT WILL BE CURVED. AND THEN IF THERE'S A NEED FOR A TURN LANE IN THE FUTURE TO SUPPORT SOME TYPE OF DEVELOPMENT THAT MIGHT BE ADJACENT TO THE ROAD, THEY WOULD BASICALLY JUST CUT OUT A SECTION OF THAT OF THAT MEDIAN TO INTRODUCE THE NECESSARY TURN LANE. YOU ANSWERED MY QUESTION. THANK YOU.

YEAH AND MIKE, JUST A REMINDER. FOR THIS ROAD PROJECT, WAS THERE ANY LAND ACQUISITION COSTS FOR THE CITY? THERE HAS BEEN NO NO LAND ACQUISITION COSTS FOR THE CITY. HOW IS THAT POSSIBLE? YEAH, WE'VE BEEN, YOU KNOW, NEW ALBANY COMPANY WAS, VERY GENEROUS WITH THEIR DONATION OF LAND, AGAIN, I THINK THE PARTNERSHIP AND KIND OF THE MUTUAL BENEFIT THAT WE'VE BEEN ABLE TO PUT IN PLACE WITH THE CHURCH AND THE EYE DOCTOR AND THE CITY IS LIKE, EVERYBODY IS WINNING FROM THIS. IT'S GOING TO BE INCONVENIENT FOR A PERIOD OF TIME. BUT I'M I'M CONVINCED THAT WHEN THIS IS DONE, EVERYBODY HERE IS GOING TO LOOK AT THIS AND JUST BE BE TOTALLY IMPRESSED WITH IT. SO IT REALLY IS A WIN WIN PROJECT. IT'S JUST KIND OF STUMBLING TO GET THIS THING MOVING, BUT WE'VE GOT ALL THE MOMENTUM RIGHT NOW AND APPRECIATING THAT, YOU KNOW, WE'RE KIND OF JOKING ABOUT IT, BUT, WE'VE BEEN TALKING ABOUT THIS PROJECT FOR, YOU KNOW, A WHILE, AND THERE WAS SOME DELAY. IN PART TO TAKE A CLOSER LOOK AT WHAT THE ENVIRONMENT WILL LOOK LIKE AT COMPLETION. NOT ONLY HAS THE ALBANY COMPANY DONATED ALL OF THE LAND FOR THE RIGHT OF WAY AND THE ROAD THAT THAT PART OF THE ROAD THAT OR THE PART OF THE LAND THAT WOULD BE USED TO CONSTRUCT THE ROAD. BUT THEY'RE ALSO MAKING SIGNIFICANT IMPROVEMENTS, SORT OF ON THEIR SIDE OF THE FENCE AS I WOULD SAY, WHERE THAT RETENTION POND IS. AND THAT AREA THAT'S SOUTH OF THE MARKET STREET EXTENSION, SO I JUST WANT TO MAKE SURE THAT THE, THE PUBLIC UNDERSTANDS THAT, AGAIN, A PRETTY SIGNIFICANT, INVESTMENT BEING MADE BY OUR PARTNERS IN THAT AREA. YEAH. MR. THANK YOU, MAYOR, FOR MENTIONING THAT. AND JUST MAYBE JUST READ A LITTLE BIT, SHED A LITTLE BIT MORE LIGHT ON THAT THERE THERE IS A DESIGN TO THAT SECTION OF THE ROAD NEXT TO THE, BLUE RETENTION BASIN, WHERE WE'LL, WE WILL BE DEVELOPING AN OVERLOOK THAT IS, THAT DESIGNED WITH THE SAME MATERIALS AND ATTENTION TO DETAIL THAT THE CITY DID WITH ROSE RYAN. SO THERE'S SOME WOOD DECKING AND SOME THAT METAL FENCING THAT PROVIDES A PUBLIC OVERLOOK FOR A I'M CALLING IT A RETENTION BASIN, BUT IT WILL BE A BEAUTIFUL POND WITH WETLAND PLANTINGS AND ALL THE BELLS AND WHISTLES THAT I THINK FOLKS WILL BE THRILLED TO HAVE AND BE ABLE TO SEE. AND AGAIN, THIS FITS INTO THE DISCUSSION THAT WE'VE BEEN HAVING ABOUT SORT OF EXTENDING THE ROSE RUN CORRIDOR AND SORT OF THAT GREEN FEATURE THROUGH THE COMMUNITY FROM STARTING AT TAYLOR FARM, AND NOW IT'S GOING TO WORK ITS WAY ALL THE WAY UP TO THE NEW GANTON PARKWAY. AND, OUR NEWEST NEIGHBORS AT NATIONWIDE CHILDREN'S. SO THAT'S AN EXCITING OPPORTUNITY TO MAKE THAT EXTENSION. AND REALLY BRING SOME ADDITIONAL GREEN FEATURES.

AND SUSTAINABLE GREEN FEATURES INTO THE HEART OF OUR COMMUNITY. ALL RIGHT. ANY OTHER OVERHEAD? ANY OTHER QUESTIONS? I'M SORRY, I WAS GOING TO SAY ABOUT THE FUNDING FOR THIS. THE FUNDING IS

[01:45:04]

HAS BEEN PARTIALLY PROVIDED FOR IN OUR MID-YEAR APPROPRIATION THIS YEAR. THE BALANCE OF THAT FUNDING IS ALSO INCLUDED IN, THE ORDINANCE THAT BETHANY PRESENTED EARLIER REGARDING THE BOND ISSUANCE, AT THE SAME TIME, STILL, WE HAVE THE FUNDING IN PLACE FROM THE OPWC THAT WE'VE HAD FOR A FEW YEARS NOW, SO WE'LL BE ABLE TO FULLY CAPTURE ALL THAT AS WELL. SO OKAY. ANY OTHER QUESTIONS ON THE RESOLUTION? THEN WE'LL OPEN THE PUBLIC HEARING. IS THERE ANYONE FROM THE PUBLIC THAT WOULD LIKE TO SPEAK REGARDING RESOLUTION? 34 2024 HEARING NO, PUBLIC COMMENT. I WILL CLOSE THE PUBLIC HEARING. IS THERE A MOTION ON THE RESOLUTION? MOVE TO ADOPT RESOLUTION, 34 2024 SECOND COUNCIL MEMBER BRESKE. YES. COUNCIL MEMBER DEREK. YES MAYOR.

SPALDING. YES. COUNCIL MEMBER. SHAW. YES. COUNCIL MEMBER. FELLOWS. YES. FIVE. YES. FOLKS WITHOUT RESOLUTION 34 2024. RESOLUTION R 35 2024 A RESOLUTION TO AUTHORIZE THE CITY MANAGER TO ENTER INTO ANY AND ALL CONTRACTS FOR THE PURCHASE AND UPFIT OF A SEWER, JET AND BACK TRUCK. LISTEN, I KNOW THIS IS WHAT YOU'VE ALL BEEN WAITING FOR, WHICH IS WHY WE SAVED IT FOR LAST. SO I BET WE'LL HAVE A LOT OF QUESTIONS. YES SO, JUST FOR YOUR REFERENCE, THAT IS, THAT IS WHAT WE ARE PROPOSING TO BUY, WE HAVE SOMETHING THAT IS CURRENTLY, VERY SIMILAR TO THAT, CERTAINLY NOT NOT NEARLY AS SOPHISTICATED AND AS CAPABLE AS THAT, SO THE CITY CURRENTLY OWNS A SEWER JET AND BACK TRUCK, THAT'S ACTIVELY USED FOR A VARIETY OF PURPOSES, ONE OF THOSE PURPOSES IS, ARE SOME PROGRAMS THAT WE'VE DEVELOPED, AND REALLY GROWN SIGNIFICANTLY OVER THE PAST FEW YEARS. AND THEY'RE SPECIFIC TO THE ANNUAL INSPECTION OF OUR SANITARY SEWER SYSTEMS, OUR STORM SEWER SYSTEMS, OUR UTILITIES TEAM HAS JUST REALLY JUST STEPPED UP IN A TREMENDOUS WAY. AND WE'RE GETTING MORE AND MORE USE OUT OF THAT TRUCK THAN THAN WE EVER HAVE, THAT TRUCK IS A 2009 INTERNATIONAL, 7500 HIGH BACK, HAS ABOUT 30,000 MILES ON IT. SO IT'S NOT SOMETHING THAT GETS DRIVEN AROUND QUITE A BIT, BUT IT HAS A LOT OF HOURS ON IT. SO ABOUT 4500 HOURS, WE HAVE BEEN TRACKING OUR MAINTENANCE COSTS ON THIS, AND WE SEE THAT WE HAVE REALIZED, ABOUT $100,000 OF, OF EXPENSES, JUST IN THE MAINTENANCE OF THIS PIECE OF EQUIPMENT OVER THE PAST THREE YEARS. SO WE DEFINITELY HAVE AN ACTIVE TRACK ON COST OF OWNERSHIP AND JUST EVALUATING THAT WITH WHAT WE PREDICTED, THE LIFE EXPECTANCY OF IT TO BE, SO BASICALLY, THE TIME IS NOW, FUTURE REPAIRS TO WHAT WE HAVE WOULD BE MUCH MORE SUBSTANTIAL, COST. AND, SO THE TIME IS NOW AND ALSO TO THIS IS A CRITICAL PIECE OF INFRASTRUCTURE MAINTENANCE, EQUIPMENT THAT WE NEED TO HAVE AVAILABLE AT ALL TIMES. SO WORST CASE SCENARIO IS THERE'S A SANITARY SEWER BLOCKAGE OR OBSTRUCTION. AND BASICALLY THIS IS THE PIECE OF EQUIPMENT THAT WE SEND IN THERE TO BASICALLY CLEAR THAT OBSTRUCTION. SO PEOPLE, YOU KNOW, AREAS WHERE WE HAVE, YOU KNOW, PUBLIC HEALTH CONCERNS, WHERE, YOU KNOW, SEWAGE COULD BE BACKING UP INTO SOMEONE'S HOME OR THERE COULD BE PRIVATE PROPERTY DAMAGE THAT MIGHT RESULT FROM SOME TYPE OF OBSTRUCTION. THIS IS THE PIECE OF EQUIPMENT THAT WE USE, ALMOST EXCLUSIVELY, TO ENSURE THAT THAT IS IMMEDIATELY ADDRESSED IN A TIMELY MANNER. SO WE ARE PROPOSING TO PURCHASE, THE TRUCK THAT YOU SEE ABOVE. THERE IT IS, A FREIGHTLINER CHASSIS, AT THIS POINT IN TIME, WE'RE PRETTY MUCH ENTIRELY A FREIGHTLINER. FLEET RIGHT NOW FOR OUR LARGER TRUCKS.

AND WE'RE ALSO PROPOSING TO PURCHASE. IT'S CALLED THE GAP AX COMBINATION JET AND BACK MACHINE. SO BASICALLY SITS ON A TRUCK CHASSIS. AND THEN EVERYTHING THAT YOU SEE KIND OF ON, ON THE BACK AREA, THAT'S PART OF WHAT IS THE UPFIT AND ALL THE CONTROLS AND EXTENSIONS AND HOSES AND ALL OF THAT, WE DO WE WILL BE UTILIZING THE ODOT, COMPETITIVE PRICING AND PURCHASING AGREEMENTS FOR BOTH THE PURCHASE OF THE CHASSIS AND THE, THE, THE JET BACK MACHINE AS WELL. SO TOTAL COST OF THE PURCHASE AND UPFIT OF THE SEWER JACK IS $691,087. AND FUNDING FOR THIS PURCHASE WAS APPROVED IN THE 2024 CAPITAL EQUIPMENT BUDGET AND PROVIDED FOR IN THE ANNUAL APPROPRIATION ORDINANCE. AND I'M HAPPY TO ANSWER ANY QUESTIONS THAT YOU HAVE. I HAD A QUESTION, FOR THESE LARGE, SPECIALIZED, EXPENSIVE PIECES OF EQUIPMENT, IS THERE A CONSORTIUM OF MUNICIPALITIES THAT WOULD PERHAPS BUY TOGETHER, EQUIPMENT LIKE THIS? AND THEN THROUGH, LIKE, A SHARED AGREEMENT INSTEAD OF ONE MUNICIPALITY HAVING TO CARRY THE FULL BURDEN THAT WE'RE

[01:50:02]

SPENDING $650,000 FOR A TRUCK. IS THERE A CONSORTIUM OUT THERE OF MUNICIPALITIES WHERE WE WOULD WE COULD JOIN AND SHARE IN THE EXPENSE OF THAT TRUCK? SO I DEFINITELY THINK THERE COULD BE A POSSIBILITY OF THAT. I THINK THAT GIVEN, THE, THE GROWTH OF OUR INFRASTRUCTURE ITSELF AND NOW THE FREQUENCY THAT WE ARE USING THIS PIECE OF EQUIPMENT, IT'S MY OPINION THAT OPERATIONALLY THERE IS A NEED THAT WOULD EXCEED, SOMETHING THAT MIGHT BE AVAILABLE, THROUGH SOME TYPE OF, SHARED USE AGREEMENT. AND, YOU KNOW, I ALSO TO, YOU KNOW, I THINK THERE'S TREMENDOUS VALUE FOR, FOR NEW ALBANY TO JUST HAVE CONTROL OF, YOU KNOW, YOU KNOW, WE HAVE A BACKUP TODAY AND, YOU KNOW, ANOTHER MUNICIPALITY HAS THE BACK TRUCK, AND I NEED TO GET THIS THING. SO THERE ARE CERTAIN THINGS THAT ARE OUT OF OUR CONTROL THAT I'M PERSONALLY IT'S UP TO COUNCIL AND JOE, BUT, I LIKE THE IDEA OF JUST HAVING COMPLETE AND TOTAL CONTROL OF SOMETHING THAT WE CAN CONTROL. IT'S PRIORITY, OVER OTHERS THAT WOULD SHARE IT, BUT YOU'RE RIGHT. I MEAN, THIS IS A THIS IS DEFINITELY AN EXPENSIVE, ENDEAVOR. I HAVE HAD SOME COMMUNITIES REACH OUT, WANTING TO KIND OF PARTNER ON ON THINGS. AND WHAT I'M FINDING IS THAT, YOU KNOW, THANKS. THANKS. LARGELY TO, ANGIE HOBART AND NICK KOCHANOWICZ, WHO'S OUR UTILITY SUPERVISOR. OUR PROGRAM IS SO, SO FAR AHEAD OF WHAT? WHAT ELSE IS OUT THERE TODAY? SO IN MY IN MY MIND, IT, I WANT TO KEEP MOVING FORWARD. I REALLY DON'T WANT TO GO BACKWARDS BECAUSE I THINK THAT YOU KNOW, ULTIMATELY THE PERPETUAL MAINTENANCE OF THIS INFRASTRUCTURE IS GOING TO BECOME MORE IMPORTANT EVERY YEA. SO JUST HOW MANY, DAYS, SAY ON AVERAGE OF THE WEEK IS THAT ALL BEING USED, UTILIZED, I MEAN, PROBABLY EVERY DAY OF THE WEEK.

I MEAN, IT'S I WOULD SAY IT'S 3 TO 4 DAYS A WEEK. OKAY WOW, AND IT JUST DEPENDS WHAT WE'RE WHAT WE'RE WORKING ON. YOU KNOW, THE CAPITAL PROJECTS CONTINUE TO GROW, WE DO A LOT OF WORK, THIS IS ALSO A HYDRO EXCAVATOR. SO THAT'S A TYPE OF MACHINE TO WHERE YOU CAN GO. AND JUST BY THE BY PRESSURIZED WATER, YOU CAN BASICALLY UNCOVER UTILITIES. SO WHEN WE'RE DESIGNING PROJECTS, WE HAVE TO GO OUT AND GET A QUICK LOCATE. HEY, I KNOW THERE'S FIBER HERE. I KNOW THERE'S ELECTRIC HERE. HOW DEEP IS IT. WHERE IS IT EXACTLY? WE'RE ABLE TO USE THIS MACHINE, IT'S A NONDESTRUCTIVE WAY TO BASICALLY EXCAVATE, AND THEN IT WON'T DAMAGE ANY UTILITIES THAT IT THAT IT MIGHT FIND, BECAUSE IT'S JUST BASICALLY WATER. SO, I THINK THERE'S A TON OF WAYS THAT WE THAT WE USE THIS, ANYTIME THERE'S ANY TYPE OF, ILLICIT DISCHARGE OR SOMETHING ALONG THE LINES OF, YOU KNOW, MAYBE THERE'S AN OIL SPILL OR THERE'S OTHER CONTAMINATION THAT WOULD HAPPEN. THIS IS THE THING THAT RESPONDS AND BASICALLY CAN BACK THAT UP AND WE CAN TAKE IT TO ANOTHER, YOU KNOW, PLACE FOR DISPOSAL. SO, IT'S DEFINITELY GROWING IN ITS USE. AND I THINK OUR TEAM IS GROWING IN ITS ABILITY TO, TO UTILIZE IT. SO I THINK WE'RE ON A GREAT TRACK WITH IT. THANKS TO PUT THIS IN PERSPECTIVE, WHEN WE BOUGHT THE FIRST BACK TRUCK, IT WAS ABOUT A QUARTER MILLION DOLLARS, AND AT THAT TIME IT WAS THE MOST EXPENSIVE VEHICLE IN THE FLEET.

YEAH, AND IT'S BEEN A TREMENDOUS BENEFIT TO US. WE USED TO HAVE TO CONTRACT OUT WITH A PRIVATE, COMPANY TO BRING THEIR VAC TRUCK IN, AND IT WAS VERY EXPENSIVE, AND WE COULDN'T GET THE RESPONSIVENESS THAT WE NEEDED. SO YEAH, IT SEEMS LIKE WE JUST BOUGHT THAT TRUCK, TIME GOES FAST. THAT WAS 2009 THAT WE BOUGHT THAT LAST TRUCK. YEP FIRST PERSPECTIVE BASED ON WHAT JOE WAS SAYING, CONTRACT BACK TRUCK IS LIKE 350 OR $400 AN HOUR. AND TYPICALLY THEY HAVE, LIKE, A MINIMUM SHOW UP TIME OF ANYWHERE FROM 4 TO 6 HOURS, SO ULTIMATELY, IF IT'S SOMETHING THAT WE USE OFTEN, IT'S GENERALLY A PRETTY GOOD INVESTMENT FROM THAT STANDPOINT.

IT SOUNDS LIKE YOU SHOULD BUY A TRUCK AND START RUNNING IT OUT. THAT'S WHAT I'M THINKING. THAT'S WHAT I'M THINKING. I DON'T MISS THIS OPPORTUNITY HERE. I DON'T WANT I DON'T WANT TO SHARE. MY LET'S GET TWO FIRST. YEAH TWO IS ONE AND ONE IS NONE. ALL RIGHT, ANY ADDITIONAL QUESTIONS ON THE RESOLUTION? NO. OPEN THE PUBLIC HEARING. WOULD ANYONE FROM THE PUBLIC LIKE TO SPEAK REGARDING RESOLUTION? 35 2024? HEARING NO PUBLIC COMMENT. I'LL CLOSE THE PUBLIC HEARING. IS THERE A MOTION ON THE RESOLUTION? I MOVE ADOPTION OF RESOLUTION, 35 2024 SECOND. COUNCIL MEMBER. FELLOWS.

YES COUNCIL MEMBER. SHAW. YES. MAYOR. SPALDING. YES. COUNCIL MEMBER. BRISK. YES. COUNCIL MEMBER. DEREK. YES. FIVE. YES POSTED. UP. RESOLUTION. 35 2024. COUNCIL. SUBCOMMITTEE REPORTS.

[13. REPORTS OF REPRESENTATIVES]

IS THERE ANY SUBCOMMITTEE REPORTS? REPORTS OF REPRESENTATIVES? JOE. ANY UPDATE

[01:55:04]

FROM MORSI, THE MORSI COMMISSION WILL BE RETURNING FROM SUMMER RECESS, THE FIRST MEETING WILL BE NEXT THURSDAY. SORRY. THIS THURSDAY. THANK YOU. ALL RIGHT, ANY UPDATE FROM THE JOINT PARKS? YEAH, I GOT A COUPLE UPDATES. THEY MET LAST NIGHT. JUST A QUICK ONE HERE. THEY, WENT AHEAD AND RESEALED, THEIR PARKING LOT AND PATH SEALING IS NOW COMPLETED AT BETHEL HEIMER. THEY GOT A ROTATION PROCESS, MUCH LIKE WE DO. SO THEY'LL BE ROTATING AROUND, RESEALING EACH YEAR, SOMETHING OF INTEREST. THEY HAD A FIELD RESTORATION PROGRAM. I DON'T KNOW IF ANYONE IS HAS GONE OUT THERE OVER THE LAST THREE MONTHS OR SO, BUT BY THE OFFICE, THEY HAD A FIELD AREA WHERE SOCCER AND FOOTBALL WAS PLAYED THAT THEY HAD OFF LIMITS. THEY TRIED SOME AERATION AND SOME OTHER ACTIVITIES OUT THERE TO HELP THE FIELD. EVIDENTLY IT WAS A GREAT SUCCESS, WE HAD A LOT OF RAIN THAT HIT OUT THERE. THEY DIDN'T HAVE ANY MUD, SO THEY'RE LOOKING TO EXPAND THAT NOW TO OTHER AREAS. TO RESTORE THE GROWTH OF THE GRASS AND HAVE NICE FIELDS FOR EVERYBODY TO PLAY IN. THEY ALSO HAD A, A BOOK LIBRARY IS GOING TO BE LOCATED OUT THERE NOW, I CAN'T BELIEVE WE'VE NEVER DONE IT BEFORE, BUT WHAT A GREAT IDEA. THERE'S I CAN'T THINK OF A BETTER PLACE OTHER THAN MAYBE THE SCHOOLS WHERE WE HAVE MORE KIDS GOING OUT TO. SO THEY'RE GOING TO HAVE A BOOK LIBRARY WHERE YOU CAN KIND OF TAKE IT AND SHARE SOME, I BELIEVE THE DEDICATION WILL BE THIS SATURDAY, I KNOW I'M GIVING A TENT TO THE PEOPLE THAT ARE DOING IT SO THAT THEY CAN DO IT. SO IT'LL BE OUT THERE, BUT IT'LL BE NICE TO HAVE THAT, AN EXISTING BUILDING OR HOW ARE THEY GOING TO. IT'S GOING TO BE I BELIEVE IT'S OUT, AND I KNOW, MARK, YOU'RE HERE, WAS IN THE MEETING, TOO. I BELIEVE IT'S GOING TO BE OUT BY THAT PAVILION AREA, I THINK THAT'S WHERE IT IS. DON'T QUOTE ME ON THAT. BUT I'M PRETTY SURE THAT'S WHERE THEY SAID RIGHT WHEN YOU'RE KIND OF COMING IN TO WHERE THEIR OFFICES ARE. YEAH. RIGHT. IN THAT SECTION, AND ONE OTHER THING. OH, THERE ARE NEW WEBSITE, SO THEY WORKED WITH, BUCKEYE INNOVATION, THEIR NEW WEBSITE. THEY RAN THROUGH IT LAST NIGHT. WHAT IT'S GOING TO LOOK LIKE. IT'S AMAZING. THEIR NEW LOGO, EVERYTHING THEY'VE GOT GOING, IT'S REALLY SHARP.

THEY'VE. IT WAS TIME, IT'S GOING TO BE SO USER FRIENDLY. I'LL TELL YOU. THEY'VE GOT A GOOD TEAM OUT THERE, THEO ON THE EXECUTION IS DOING AN AMAZING JOB, BUT THAT'LL GO LIVE IN SEPTEMBER. AND THE MOST IMPORTANT PART THAT I WANTED TO SAY OUT OF ALL THAT IS EVERY RESIDENT THAT PLANS ON USING THE PARKS AND RECREATION DEPARTMENT, BE IT FOR THEIR KIDS OR FOR ADULT PROGRAMING, PICKLEBALL, ANY OF THOSE THINGS WILL NEED TO REGISTER ON THAT SITE. THERE WILL BE NO TRANSPORTING OF DATA FROM THE OLD SITE TO THE NEW. SO IN ESSENCE, EVERYONE HAS TO REGISTER FOR IT. SO ONCE THAT GOES LIVE IN SEPTEMBER, THEY ACTUALLY HAVE A NEW, SITE NAME AND A PARKS OHIO.ORG. IT USED TO BE ANY PARKS .ORG AND THEY WANT TO MAKE SURE OHIO'S IN THERE NOW. SO ANY PARKS OHIO.ORG WILL BE THE DOMAIN. YOU CAN STILL GET THERE IF YOU DO ANY PARKS.ORG.

BUT THAT'LL ALL BE READY TO GO. THEY'RE NOT PUTTING ANY INFORMATION. THE IT WAS TOO COMPLICATED, TO TRY TO PORT ANY OF THAT INFORMATION OVER, SO THEY'RE JUST GOING TO ASK EVERYBODY TO HAVE TO REREGISTER. SO I'LL LET YOU KNOW HERE NEXT MONTH WHEN IT GOES LIVE. WELL, THAT'S IT. ALL RIGHT. THANK YOU. OH, ONE OTHER THING. PICKLEBALL TOURNAMENT WENT VERY, VERY WELL A COUPLE OF WEEKS AGO, IN OTHER NEWS, YOU CAN'T EVEN BELIEVE THAT I FORGOT ABOUT THAT, THERE WE GO, VERY WELL ATTENDED. THE WEATHER WAS AMAZING, WE REALLY LUCKED OUT, THE FACILITY LOOKED OUTSTANDING. MIKE, YOUR TEAM DID A PHENOMENAL JOB GETTING IT READY, KEEPING IT CLEANED.

EVERYTHING, MUCH, YOU KNOW, SUCCESS DUE TO THE PARKS, YOU KNOW, DAVE, THEO, THEY ALL DID A WONDERFUL JOB OUT THERE, ERIC MILLER WAS THE TOURNAMENT DIRECTOR, HE DID AN OUTSTANDING JOB AS WELL. MORGAN DID ALL THE MARKETING. I KNOW, YOU KNOW. THANK YOU, JOSH, TO YOUR TEAM. I KNOW SAM AND GREG WERE BOTH OUT THERE DOING SOME FILM AND SOME THINGS. THE SURVEY RESULTS WERE EXTREMELY POSITIVE. THERE'S SOME THINGS THAT WE CAN IMPROVE FROM A TOURNAMENT PERSPECTIVE, WHICH WE WILL NEXT YEAR, WHICH IS GOOD. BUT I WILL SAY FROM A CITY PERSPECTIVE, ALMOST TO A PERSON, ONE OF THE THINGS WHERE WE ASKED, YOU KNOW, WHAT WOULD YOU RECOMMEND THAT WE COULD DO BETTER ON THE FACILITY, WAS RESTROOMS AND WATER AND SHADE STRUCTURES. SO NOTHING, NOTHING.

NOT A ROOF? NO. THERE'S NO SPECIFIC MENTION OF A ROOF, NO. YOU KNOW, I THINK THAT WE KNOW THAT. AND WE'RE PROBABLY GOING TO LOOK AT THAT HERE IN OUR UPCOMING CAPITAL DAY.

DISCUSSION. BUT OVERALL, IT'S A HUGE SUCCESS. AND, YOU KNOW, WE HAVEN'T BEEN OUT THERE LATELY

[02:00:04]

GOING OUT, YOU'LL SEE A LOT OF PEOPLE LOOKS LIKE YOU GOT THEY GOT SOME GOOD SPONSORS, TOO.

YEAH THEY HAD, YEAH, THEY HAD SIX SPONSORS, THAT, THAT THEY WENT OUT AND GOT HIM AND THIS IS ONE OF THOSE EVENTS THAT THEY DID THAT THEY WERE IN THE GREEN, AT THE END OF IT. SO AWESOME.

EVERYTHING WORKED OUT REALLY WORKED OUT WELL. DO YOU HAVE ANY LIVE AUCTIONS, LIVE ACTION SHOTS OF YOURSELF THAT YOU CAN SHARE, I DON'T KNOW IF THERE'S ANY OF MYSELF, WE DO HAVE MAYBE SOMEONE UP THERE IN THE TOP RIGHT CORNER. IT'S MY PARTNER. I PLAY A LOT OF MEN'S DOUBLES WITH.

BUT, OTHER THAN THAT, NO, THERE WAS NONE. DID YOU GUYS DO ANYTHING, WE METAL. WE'LL JUST LEAVE IT AT THAT. BUT IT WAS FUN. GOOD. GOOD TIME. CONGRATULATIONS, MATT. THANKS.

I'VE HEARD A LOT OF REALLY GREAT THINGS. I KNOW IT WAS A BIG SUCCESS. I KNOW YOU PUT IN A LOT OF WORK AND, YOU KNOW, THE CITY REALLY STOOD UP AND SUPPORTED HIM. AND I MEAN EVERY WHICH WAY WE COULD. WE SUPPORTED THIS TOURNAMENT AND HELPING IT OUT. SO IT REALLY WAS A GOOD, YOU KNOW, COLLABORATION BETWEEN THE CITY AND THE PARK AND RECREATIO. PARK AND REC WENT OUT AND GOT THE SPONSORS ON THEIR OWN. YEAH, YEAH. YEP AND NOW I AM DONE. ALL RIGHT. THAT WAS GOOD, ANYBODY FROM THE SCHOOLS? I DON'T THINK CASEY OR ANDREW ARE HERE. OBVIOUSLY THEY VOTED TO PUT A LEVY ON THE BALLOT AND A LOT OF INFORMATION IS OUT THERE REGARDING THAT, REQUEST OF THE PUBLIC. WE'LL WAIT FOR AN UPDATE AT OUR NEXT COUNCIL MEETING TO SEE HOW THINGS ARE PROGRESSING.

AND THE UPDATE, MR. DIRT FROM THE TOWNSHIP, HE HAD A MEETING. OBVIOUSLY, THEY APPROVED A LEVY 3.0 LEVY, WHICH IS A NEW LEVY. THEY'LL RETAIN THE OTHER ONE. THAT LEVY SHOULD GENERATE ABOUT $105 PER HUNDRED THOUSAND, IN TERMS OF INCREASED TAX TO AN INDIVIDUAL, INDIVIDUAL HOMEOWNE.

AND THAT WAS PRETTY MUCH IT FOR THEIR PARTICULAR MEETING. OKAY. WELL, WE'LL CONTINUE TO FOLLOW BOTH OF THOSE LEVY ISSUES AND, WISH OUR PARTNERS WELL, THAT'S GOING TO BE ON THE BALLOT IN

[14. REPORTS OF CITY OFFICIALS]

NOVEMBER. YES ALL RIGHT. REPORTS CITY OFFICIALS, AGAIN, THE HIGH COMPLIMENTS TO OUR POLICE DEPARTMENT AND EVERYONE WHO HELPED PARTICIPATE IN THE COPS AND BOBBERS EVENT. I HAD A CHANCE TO STOP BY, AND, A LITTLE BIT SWEATY COMING HOME FROM A BIKE RIDE, BUT, AGAIN, IT WAS A VERY WELL ATTENDED EVENT, I DID NOT EAT A HOT DOG BECAUSE I STILL HAD ABOUT FIVE MILES TO GO, BUT, AGAIN, GREAT. GREAT DAY, THEY MUST HAVE SEEDED THE POND WITH SOME FRESH FISH BECAUSE THEY WERE BITING LIKE CRAZY OUT THERE. YEAH. BUT AGAIN, GREAT EVENT. AND THANKS.

CHIEF, FOR ALL THE TEAM'S EFFORT. YEAH THIS IS IN THE POND. YEAH. THE, PARKS DISTRICT AND, THE SERVICE PARK DID A GREAT JOB. THEY WORKED TOGETHER AND STOCKED THE POND. THE DAY BEFORE WITH A LOT OF FISH, AND THEY WERE ACTUALLY PRETTY BIG. I WAS SURPRISED THAT SOME OF THE SIZE, SO, BUT NO, REALLY, THE, THE PARKS DEPARTMENT ALSO STEPPED UP BIG TIME AND MAKING SURE THAT THE, POND WAS, WAS LOOKING REALLY GOOD AND THE BANKS WERE LOOKING REALLY GOOD AND REALLY APPRECIATE ALL THEIR HELP. AND, WE WERE SURPRISED THERE WAS A LOT OF FISH GETTING CAUGHT. AND FORTUNATELY, THE MAYOR DIDN'T GET CAUGHT BY ANY HOOKS THAT WERE BEING CAST AS HE STOPPED BY. BUT, AND THEN WE WERE KIND OF COMMENTING THAT THE, FISH, THEY TOOK GREAT CARE IN MAKING SURE THE FISH MADE IT TO THE POND ALIVE, THE DAY BEFORE. AND THEN THE FISH WERE YANKED OUT OF THE WATER THE NEXT DAY. SO THEY HAD QUITE A BIT OF, THEY HAD AN EVENTFUL WEEK, SO.

BUT AGAIN, IT WAS A VERY SUCCESSFUL EVENT. PEOPLE ARE DOING BETTER. HOOK AND WORMS. SO WE WERE GLAD TO SEE THAT. AND, BUT WE WILL, THIS WAS OUR SECOND YEAR, SO WE HOPE FOR ANOTHER SUCCESSFUL YEAR NEXT YEAR. WAS IT FOLLOWED BY A FISH FRY? NO AND ACTUALLY SOMEBODY ASKED, IS THIS CATCH AND RELEASE? AND TECHNICALLY IT IS. HOWEVER, MANY OF THE KIDS WALKED AROUND WITH THEIR FISH FOR QUITE A WHILE LOOKING FOR OFFICERS TO LOG THEIR FISH TO SEE IF THEY GET THE BIGGEST FISH, COMPETITION. SO MANY OF THE FISH, I SUSPECT, ARE DIDN'T MAKE IT THROUGH THE WHOLE FEW FLOATERS. YEAH, A LOT OF FLOATERS. WELL THERE WAS ONE BIG FLOATER, WHICH A LOT OF PEOPLE NOTICED, BUT THAT WAS NOT OURS. THAT WAS IT DIDN'T MAKE IT THROUGH THE TRANSFER FROM THE TRUCK TO THE POND. SO THE BLUE HERONS HAD A GREAT WEEKEND. OH YEAH. IT WAS. AND I WOULD SAY I STOPPED OUT. IT WAS INCREDIBLY WELL ATTENDED AND REALLY EVERYBODY WAS HAVING A GREAT TIME, I'M JUST GOING TO ASK, IS THAT OFFICER SUAREZ IN THE RIGHT HAND CORNER? AND WHY DID WE NOT HAVE HIM? AND THE, SUN'S OUT, GUNS OUT VIDEO. YEAH, I AM ALL FOR HIM BEING IN MORE VIDEOS AND ME BEING IN LESS VIDEOS. SO I'VE BEEN TALKING TO JOSH ABOUT THAT. SO. BUT THERE'S A COUPLE GUYS THAT COULD THAT COULD FILL THAT ROLE. BUT SUAREZ DID. THIS WAS HIS FIRST YEAR HELPING OUT. HE'S A THIRD SHIFT OFFICER, HE DID A GREAT JOB, HELPING THE KIDS AND WAS REALLY ACTIVE, HE DID LOSE

[02:05:06]

HIS UNIFORM PANTS AND REACHING DOWN IN THE POND, ALL THAT STUFF. HE DID TEAR HIS PANTS, SO. WHOOPS YEAH. ONE CASUALTY, BUT THAT WAS THE ONLY INJURY THAT WE HAD WHEN YOU HAVE CATS THAT BIG, THAT'S GOING TO HAPPEN. YEAH, YEAH YEAH. ALL RIGHT, ONE OTHER POINT.

OBVIOUSLY WE HAD A, YOU KNOW, ANOTHER SUCCESSFUL PELOTONIA WEEKEND, AGAIN, THANKS TO THE POLICE DEPARTMENT AND THE SERVICE DEPARTMENT FOR ALL YOUR ASSISTANCE, A GOOD SHOWING AGAIN BY NEW ALBANY. A LOT OF RIDERS COMING THROUGH TOWN, RESIDENTS LIVE HERE THAT ALSO RIDE AND JUST WANT TO ALSO THANK THE PUBLIC FOR THEIR SUPPORT AND UNDERSTANDING OF THAT EVENT, IT'S ALWAYS GOOD TO PLAY HOST TO THAT, BUT IT DOES, YOU KNOW, WE HAVE TO BE GOOD MOTORISTS AND GOOD MEMBERS OF THE PUBLIC TO, TO SUPPORT THAT EVENT. AND AGAIN, IT WAS A VERY SUCCESSFUL WEEKEND, I UNFORTUNATELY DID NOT RIDE THIS WEEKEND. I SIGNED UP FOR THE GRAVEL RIDE LATER IN THE YEAR, HAD TO MOVE MY SON BACK TO UTAH. SO I THINK I WAS IN LIKE MOUNT RUSHMORE. I THINK WHEN THAT RIDE WAS GOING. BUT, AGAIN, THANKS TO EVERYONE'S HELP ON MAKING THAT ANOTHER SUCCESSFUL EVENT, ANYTHING FROM THE CLERK JUST KIND OF FOLLOWING UP ON MY EMAIL PARTLY TO SENIOR STAFF AND ALSO TO COUNCIL ABOUT THE CAPITAL PROJECTS WORKSHOP NEXT MONTH, COUNCIL MEMBER DEREK IS GOING ON AN EXTENDED TRIP IF STAFF IS OKAY WITH BRINGING UP, COUNCIL MEMBER DEREK UP TO SPEED. SEPARATELY, YOU CAN WATCH THE RECORDING. I'M SURE IT'LL BE PAINFUL BECAUSE IT'LL BE OUT OF PUBLIC SERVICE, BUT THAT'LL BE AVAILABLE. WOULD IT BE IN EUROPE FOR TWO WEEKS? RIGHT THAT'S IT, AND IF VISITING YOUR SON IN LONDON, WE'RE ALL GOING TO ITALY. OH, EVEN BETTER. YEAH.

NICE. AND IF STAFF IS OKAY AND COUNCIL IS OKAY, WE WILL DO IT ON THE SEPTEMBER 17TH COUNCIL MEETING. NORMALLY EVENING. BUT WE'LL DO IT DURING THE DAY, IT'D BE THE TYPICAL SETUP. NINE ISH.

AND WE'LL GET MORE SPECIFIC. WE USUALLY START AROUND NINE, FINISH AROUND 330. I UNDERSTAND MAYOR SPALDING HAS TO LEAVE PRETTY CLOSE AT THE END THERE. YEP, BUT WE WILL PROVIDE LUNCH.

DID ANYONE HERE? NO. IT'LL BE OUT AT PUBLIC SERVICE, TRAINING ROOM. UNLESS COUNCIL REQUESTS OTHERWISE, THE MORE COLLABORATIVE SPACE, IF THERE WAS ANYTHING YOU LIKED AT NEW ALBANY THAT YOU WOULD LIKE ME TO PURSUE FOR LUNCH, CATERING, GET IN TOUCH. AND THAT WE'LL FIND SOMEONE LOCAL. A LOT OF GREAT CHOICES. YEAH, RIGHT. I MEAN, IT WAS A GREAT EVENT. LET ME KNOW IF THERE WERE ANY WINNERS THAT, YOU WANT TO FOLLOW UP WITH, AND WE'LL GO FROM THERE WITH MORE SPECIFICS, OKAY, WE MAY NEED A SPECIAL COUNCIL MEETING AT SOME POINT, BUT I'LL WAIT FOR DEVELOPMENT TO PING ME ON THAT, AND THEN I'LL REACH OUT. OKAY. ANY UPDATE FROM THE FINANCE DIRECTOR, YES, I DID HAND OUT EARLIER THE JUNE MONTHLY REPORT, FOR FINANCIALS AND, QUICK REVIEW. HALF OF THE YEAR IS COMPLETE, OUR REVENUES ARE GREATER THAN WE ANTICIPATED SO FAR. WE STILL HAVE TO ADJUST THE BUDGET, DUE TO UPDATED PROJECTIONS, FOR MAINLY FOR INCOME TAX. AND THEN EXPENSES ARE WELL BELOW THE 50% MARK, OF THE YEAR AT 36% OF BUDGET, THE BREAKDOWN OF OUR INCOME TAXES AT THE IS AT THE BOTTOM OF THE FIRST PAGE FOR GENERAL FUND WITHHOLDING HAS INCREASED. BUT, THAT IS PARTLY ATTRIBUTED TO, CONSTRUCTION WITHHOLDING ABATEMENTS, ROLLING OFF SUCCESSFUL YEARS, INCREASED EMPLOYMENT. I'M PRETTY SURE EVERYTHING IS WORKING, FOR THE GOOD AT THIS POINT, STILL TO BE REVIEWED, THOUGH, THE SECOND PAGE IS A BREAKDOWN OF REVENUE COLLECTIONS OVER THE LAST TEN YEARS, AND THEN WHAT'S BEEN COLLECTED. SO FAR EACH MONTH, UPDATED WITH PROJECTIONS OR NOT? THE BUDGET IS NOT UPDATED.

HOWEVER, IF YOU LOOK AT THE BOTTOM OF THE PAGE THAT ALLOWS FOR YOU TO COMPARE PROJECTIONS, AS A PERCENTAGE OF, HISTORICAL COLLECTIONS YEAR TO DATE AND AS A PERCENT OF BUDGET FOR GENERAL FUND. THE THIRD PAGE IS THE STATUS OF OUR, ALL OF OUR FUND BALANCES AND THE ACTIVITY THAT WE'VE HAD SINCE THE BEGINNING OF THE YEAR, THE ENCUMBRANCE COLUMN, GIVES YOU AN IDEA OF HOW MUCH IN CONTRACTS WE HAVE OUTSTANDING TO STILL PAY AGAINST THE FUND BALANCES THAT WE HAVE.

THE FOURTH PAGE IS SIMILAR TO THE GENERAL FUND, ANALYSIS FOR THE LAST TEN YEARS, BUT IT INCLUDES ALL FUNDS, INCOME TAX COLLECTION. AND THEN THE LAST TWO PAGES, DETAIL OUR

[02:10:02]

INVESTMENTS. BEING, BROKEN DOWN WITHIN THE VARIOUS CUSTODY ACCOUNTS THAT WE HAVE FOR THE DIFFERENT TYPES OF FUNDING. AND THEN ALSO THE FINAL PAGE, GIVES US A TOTAL PICTURE OF WHAT OUR INVESTMENTS AND CASH BALANCES ARE. WOULD YOU LIKE TO ADD ANYTHING ABOUT OUR MEETING WITH OUR INVESTMENT ADVISOR, YES. SO WE DID MEET WITH OUR INVESTMENT ADVISORS TODAY, AND ALSO WE MET WITH, OUR CASH VEST, I GUESS REPRESENTATIVES, CONSULTANTS, WENT OVER OUR CASH REPORT, BUT OUR INVESTMENTS ARE DOING WELL. THEY'RE, WORKING HARD TO ENSURE THAT WE'RE GETTING THE BEST THAT WE CAN. AS FAR AS, MAXIMIZING THE POTENTIAL THAT WE HAVE WITH OUR FUNDS AND THE INTEREST RATE ENVIRONMENT THAT WE HAVE, AND, WE ARE WORKING WITH, YOU KNOW, ADJUSTING LIQUIDITY TO ALIGN WITH THE PROJECTS AND THE CASH FLOWS THAT WE HAVE COMING, COMING DUE. AND SO IT WAS OVERALL A GOOD MEETING. THEY, YOU KNOW, THEY PRESENTED SLIDES THAT WERE PREPARED, LAST FRIDAY BEFORE WHAT MAINLY HAPPENED YESTERDAY IN THE MARKET. AND THEY, YOU KNOW, SO A COUPLE OF THE THINGS THAT THEY HAD PRESENTED WERE CHANGED A LITTLE BIT. BUT, SO FAR, YOU KNOW, THEY'RE, GIVING US GOOD, GOOD ADVICE TO MAINTAIN WHERE WE ARE. AND, AND WAIT. SO. ALL RIGHT.

ANY QUESTIONS ON THE FINANCE DIRECTOR'S REPORT? I WOULD ADD ONE THING.
